The same is true for the District of Columbia. If you\u2019re contemplating divorce in the nation&#8217;s capital, you should be familiar with the <a href=\"https:\/\/www.findlaw.com\/state\/dc-law\/your-washington-dc-divorce-the-basics.html\">divorce laws in Washington, D.C.<\/a> The laws can be complex, and it isn\u2019t easy to navigate the family courts.<\/p>\r\n<p>Here, we will highlight the divorce laws in Washington, D.C. We will also briefly explain the <a href=\"https:\/\/www.findlaw.com\/state\/dc-law\/d-c-divorce-process.html\">divorce process in D.C.<\/a> While most couples hire divorce lawyers to handle their divorce case, you can handle it yourself. But remember that the judge won\u2019t treat you differently because you don\u2019t have a family law attorney. You may be at a significant disadvantage.<\/p>\r\n<p>Read on and click the links below if you need additional information.<\/p>\r\n<h2><b>Legal Requirements for Divorce in Washington D.C.<\/b><\/h2>\r\n<p>Most states have a&nbsp;<a href=\"https:\/\/www.dccourts.gov\/services\/divorce-matters\" target=\"_blank\" rel=\"noopener\">residency requirement<\/a>&nbsp;to file for divorce. These laws require that a party live in-state for a specific period of time. In Washington, D.C., one party must have been a bona fide resident of the district for at least six months.<\/p>\r\n<p>In the past, Washington, D.C. law required a voluntary separation period of six months or one year before filing for divorce. This provision could be especially difficult in cases involving domestic violence.<\/p>\r\n<p>In 2023, the <a href=\"https:\/\/wtop.com\/dc\/2024\/02\/dc-law-removes-waiting-period-before-divorce\/\" target=\"_blank\" rel=\"noopener\">D.C. Council<\/a> passed the Grounds for Divorce, Legal Separation, and Annulment Amendment Act. The Act repealed the separation requirement. You can now file for a divorce in D.C. whether you have separated from your spouse or not.<\/p>\r\n<p>You can file your divorce complaint with the Superior Court <a href=\"https:\/\/www.dccourts.gov\/superior-court\/family-court-operations\" target=\"_blank\" rel=\"noopener\">Family Court Operations Division<\/a> of the District of Columbia.<\/p>\r\n<h2><b>Types of Divorce in the District of Columbia<\/b><\/h2>\r\n<p>There are two types of divorce in D.C.\u2014contested and uncontested. An uncontested divorce occurs when both spouses agree to the divorce terms. They both agree that divorce is best.<\/p>\r\n<p>According to the D.C. courts, to qualify for an uncontested divorce, the couple must agree on all matters, including:<\/p>\r\n<ul>\r\n<li>Property division<\/li>\r\n<li>Child custody (physical custody and legal custody)<\/li>\r\n<li>Childcare for minor children<\/li>\r\n<li>Parenting plan with visitation<\/li>\r\n<li>Child support<\/li>\r\n<li>Alimony<\/li>\r\n<li>Health insurance<\/li>\r\n<\/ul>\r\n<p>With a <a href=\"https:\/\/corporate.findlaw.com\/law-library\/contested-divorces.html\" target=\"_blank\" rel=\"noopener\">contested divorce<\/a>, the parties don\u2019t agree on divorce terms. Even with the help of their divorce attorneys, they can\u2019t negotiate a <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/settlement-agreements-and-court-approval.html\">marital settlement agreement<\/a>.<\/p>\r\n<p>The judge will order a trial in divorce cases where the spouses can\u2019t agree on basic divorce terms. Trials can be expensive and time-consuming. Plus, it\u2019s not always good to turn the decision-making over to a judge.<\/p>\r\n<p>If you work to resolve divorce issues out of court, you\u2019ll often have a better chance of negotiating a fair distribution of property, alimony, and child custody. Courts will also encourage parties to use <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/divorce-mediation-overview.html\">mediation services<\/a> to settle the case before the trial date.<\/p>\r\n<h2><b>No-Fault Divorce and Fault-Based Divorce<\/b><\/h2>\r\n<p>Every state recognizes a no-fault divorce. Washington, D.C., is no different. With a <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/an-overview-of-no-fault-and-fault-divorce-law.html\">no-fault divorce<\/a>, the parties don\u2019t blame each other for the breakdown of the marriage. They need only cite irreconcilable differences or make a no-fault claim consistent with the language of the divorce statute.<\/p>\r\n<p>With a fault-based divorce, one party cites specific reasons for wanting to end the marriage. Some common reasons petitioners cite include adultery, imprisonment, and cruel treatment. The D.C. code doesn\u2019t require you to do this.<\/p>\r\n<h2><b>Grounds for Divorce in D.C.<\/b><\/h2>\r\n<p>Unlike many other states, the District of Columbia does not require the parties to prove traditional grounds for divorce. A party need only state that they no longer wish to remain married.<\/p>\r\n<h2><b>Child Custody and Child Support<\/b><\/h2>\r\n<p>In most divorce cases, the parents work out <a href=\"https:\/\/www.findlaw.com\/state\/dc-law\/district-of-columbia-child-custody-laws.html\">child custody<\/a> through their D.C. divorce lawyers. Often, one party becomes the custodial parent. They have <a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/physical-custody.html\">physical custody<\/a> of the children. The other parent may share joint legal custody and have visitation with the kids.<\/p>\r\n<p>If you can\u2019t agree on child custody, the judge will make that determination based on the <a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/focusing-on-the-best-interests-of-the-child.html\">best interests of the child<\/a>.<\/p>\r\n<p>You and your spouse can decide on child support as well. If you can\u2019t agree on this, the judge will calculate support using the <a href=\"https:\/\/www.findlaw.com\/state\/dc-law\/district-of-columbia-child-support-guidelines.html\">child support guidelines<\/a>. Typically, the judge\u2019s clerk will enter the parties\u2019 financial information into a software program. The program will use pre-set formulas to determine child support based on the parties&#8217; incomes, the number of children each spouse supports, and other factors.<\/p>\r\n<h2><b>Alimony and Spousal Support in D.C.<\/b><\/h2>\r\n<p>The District of Columbia refers to spousal support as alimony. In most divorce cases, the lower-earning spouse can demand <a href=\"https:\/\/www.findlaw.com\/state\/dc-law\/district-of-columbia-alimony-laws.html\">alimony<\/a> from their soon-to-be ex-spouse.<\/p>\r\n<p>D.C. recognizes three types of alimony:<\/p>\r\n<ul>\r\n<li><p><b>Temporary<\/b> (<a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/spousal-support-alimony-pendente-lite-faq\/#:~:text=Alimony%20Pendente%20Lite%2C%20or%20APL%2C%20is%20temporary%20spousal,will%20have%20to%20inform%20yourself%20of%20local%20law.\">pendente lite<\/a>): Sometimes, your divorce lawyer can convince the judge that you deserve alimony throughout the divorce proceedings. Temporary alimony ends when the divorce becomes final.<\/p>\r\n<\/li>\r\n<li><p><b>Short-term<\/b> (rehabilitative): Judges order this alimony to help the lower-earning spouse become self-supporting. The court will define an end date for this type of support.<\/p>\r\n<\/li>\r\n<li><p><b>Permanent<\/b>: It\u2019s rare for a judge to order permanent alimony. They reserve this type of support for cases where one spouse can\u2019t work due to age, disability, or employability.<\/p>\r\n<\/li>\r\n<\/ul>\r\n<h2><b>Equitable Distribution and Marital Property<\/b><\/h2>\r\n<p>Divorcing couples must divide their marital assets and debts. In community property states, courts divide these assets equally. This isn\u2019t what happens in D.C.<\/p>\r\n<p>The D.C. code calls for equitable distribution of marital property and debts. Usually, the divorcing couple\u2019s attorneys negotiate the property and debt division. If they can\u2019t achieve this, the family court judge will divide the assets and debts as they see fit.<\/p>\r\n<p>Property subject to <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/equitable-distribution.html\">equitable distribution<\/a> includes:<\/p>\r\n<ul>\r\n<li>Real estate<\/li>\r\n<li>Personal property (cars, jewelry, art, etc.)<\/li>\r\n<li>Retirement accounts<\/li>\r\n<li>Pensions<\/li>\r\n<li>Bank accounts<\/li>\r\n<li>Timeshares<\/li>\r\n<li>Pets<\/li>\r\n<\/ul>\r\n<p>The courts will rarely divide your marital assets in half. It\u2019s typically not feasible.<\/p>\r\n<p>You won\u2019t have to divide <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/divorce-property.html#:~:text=Separate%20property%20includes%20assets%20owned%20by%20either%20spouse,the%20date%20of%20separation%20is%20also%20separate%20property.\">separate property<\/a>. Separate property refers to assets you brought into the marriage. It also includes such things as gifts and inheritances as well.<\/p>\r\n<h2><b>Final Divorce Decree and Your Absolute Divorce Case<\/b><\/h2>\r\n<p>Once your divorce is complete, the judge will issue your absolute divorce decree. Once you have your final divorce judgment, your marital settlement agreement will become a court order, enforceable by both parties.<\/p>\r\n<table>\r\n<tbody><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Relevant D.C. Laws<\/b><\/p>\r\n<\/th>\r\n<td><p><b>District of Columbia Code<\/b><\/p>\r\n<p>Division II, Judiciary and Judicial Procedure, Title 16, Chapter 9,<a href=\"https:\/\/codes.findlaw.com\/dc\/division-ii-judiciary-and-judicial-procedure\/dc-code-sect-16-901.html\" target=\"_blank\" rel=\"noopener\">&nbsp;Section 16-901<\/a><span style=\"background-color: transparent;\">, et seq.<\/span><\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Residency Requirements<\/b><\/p>\r\n<\/th>\r\n<td><p>One party must be a bona fide resident of D.C. for six months before filing the divorce action.<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Waiting Period<\/b><\/p>\r\n<\/th>\r\n<td><p>A divorce decree becomes final 30 days after docketing with the Clerk unless an appeal is filed. Where parties reach an agreed settlement, they can also agree to waive the right to appeal so that the divorce takes effect upon the filing of the decree. See <a href=\"https:\/\/codes.findlaw.com\/dc\/division-ii-judiciary-and-judicial-procedure\/dc-code-sect-16-920.html\" target=\"_blank\" rel=\"noopener\">Section 16-920<\/a>.<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>&quot;No Fault&quot; Grounds for Divorce<\/b><\/p>\r\n<\/th>\r\n<td><p>One or both parties no longer want to be married.<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Defenses to a Divorce Filing<\/b><\/p>\r\n<\/th>\r\n<td><p>As D.C. divorces are no-fault, there are no substantive defenses.
