This act outlines the basic requirements for a valid <span data-term-id=\"49437660\">prenuptial agreement<\/span>.<\/p>\n<p>As of 2025, 28 states plus the <span data-term-id=\"49437666\">District of Columbia<\/span> have adopted the UPAA. Some states have modified the act to better fit local laws and policies. For the most part, the jurisdictions that abide by the UPAA follow the same rules.<\/p>\n<p>In general, the UPAA maintains the following <a href=\"https:\/\/www.findlaw.com\/family\/marriage\/prenuptial-agreements.html\">requirements for a <span data-term-id=\"49437665\">prenup<\/span><\/a> to be enforceable:<\/p>\n<ul>\n<li>Both parties to the marriage must sign the agreement before the wedding<\/li>\n<li>The individuals must enter the agreement voluntarily and knowingly<\/li>\n<li>The agreement must include a fair and reasonable <a href=\"https:\/\/www.findlaw.com\/family\/marriage\/sample-financial-statement.html\"><span data-term-id=\"49437692\">financial disclosure<\/span><\/a><\/li>\n<li>The agreement cannot include terms that are <span data-term-id=\"49437671\">unconscionable<\/span><\/li>\n<li>The contract cannot include terms on either <a href=\"https:\/\/www.findlaw.com\/state\/dc-law\/district-of-columbia-child-custody-laws.html\"><span data-term-id=\"49437670\">child custody<\/span><\/a> or <span data-term-id=\"49437669\">child support<\/span><\/li>\n<\/ul>\n<p>As long as your <span data-term-id=\"49437662\">premarital agreement<\/span> meets the above criteria, there is a good chance the courts will deem it valid, legitimate, and enforceable.<\/p>\n<h2>What Makes an Agreement <span data-term-id=\"49437671\">Unconscionable<\/span>?<\/h2>\n<p>For any type of contract to be enforceable, it cannot be <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/unenforceable-contract-5-common-errors\/\"><span data-term-id=\"49437671\">unconscionable<\/span><\/a>. This term has a specific definition when used in the context of a <span data-term-id=\"49437660\">prenuptial agreement<\/span>.<\/p>\n<p>For a <span data-term-id=\"49437662\">premarital agreement<\/span> to be enforceable under D.C. law and the UPAA, it cannot be <span data-term-id=\"49437671\">unconscionable<\/span>. This means that it cannot include any of the following:<\/p>\n<ul>\n<li>Anything that \u201cshocks the conscience\u201d<\/li>\n<li>Terms that are evidence of <a href=\"https:\/\/lawreview.colorado.edu\/wp-content\/uploads\/2025\/08\/Barnhizer.pdf\" target=\"_blank\" rel=\"noopener\">unequal bargaining power<\/a><\/li>\n<li>Terms that one party does not understand or recognize<\/li>\n<li>Terms that have inherent unfairness or lack <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/equitable-distribution.html\"><span data-term-id=\"49437675\">equitable<\/span> distribution of property<\/a><\/li>\n<\/ul>\n<p>These are things a <span data-term-id=\"49437668\">family lawyer<\/span> will look for when they review your agreement. These are also the things the court will consider when determining whether the agreement is enforceable.<\/p>\n<h2>When Is the Best Time To Sign a <span data-term-id=\"49437660\">Prenuptial Agreement<\/span>?<\/h2>\n<p>The <span data-term-id=\"49437666\">District of Columbia<\/span>\u2019s adoption of the <a href=\"https:\/\/aaml.org\/wp-content\/uploads\/MAT206_3.pdf\" target=\"_blank\" rel=\"noopener\">Uniform <span data-term-id=\"49437662\">Premarital Agreement<\/span> Act<\/a> (UPAA) means that the UPAA\u2019s rules for creating and enforcing a <span data-term-id=\"49437665\">prenup<\/span> govern all <span data-term-id=\"49437662\">premarital agreements<\/span> in <span data-term-id=\"49437661\">Washington, D.C<\/span>. According to the UPAA and D.C. law, you can sign a <span data-term-id=\"49437660\">prenuptial agreement<\/span> at any time before the wedding. As long as both parties <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-contracts-forms\/what-are-the-rules-regarding-signatures-in-contracts.html\">sign the contract<\/a> before the wedding takes place, the court should enforce it. The agreement must meet all other requirements of the UPAA.<\/p>\n<p>While you can sign your <span data-term-id=\"49437660\">prenuptial agreement<\/span> at any time before the wedding, experts agree that you should review and sign the agreement at least a couple of months before your nuptials take place. This gives both parties a chance to have an independent attorney review the agreement to ensure it is <a href=\"https:\/\/thecgp.org\/2023\/11\/03\/thoughts-on-what-is-fair-and-reasonable\/\" target=\"_blank\" rel=\"noopener\">fair and reasonable<\/a>. It also allows both sides to consider the agreement and decide whether it\u2019s fair and practicable.<\/p>\n<h2>When Does Your <span data-term-id=\"49437665\">Prenup<\/span> Go Into Effect?<\/h2>\n<p>Under <span data-term-id=\"49437661\">Washington, D.C<\/span>. law, your <span data-term-id=\"49437660\">prenuptial agreement<\/span> takes effect when you get married. From that point forward, it is <a href=\"https:\/\/reference.findlaw.com\/amjur\/contracts-sect-180.html\" target=\"_blank\" rel=\"noopener\">enforceable against both parties<\/a>.<\/p>\n<p>It\u2019s possible to <a href=\"https:\/\/reference.findlaw.com\/amjur\/contracts-sect-496.html\" target=\"_blank\" rel=\"noopener\">modify or invalidate the agreement<\/a> at any point after the marriage. As long as both parties agree to either the changes or to invalidating them and sign it anew, this is permissible.<\/p>\n<h2>What Can Be Included in a <span data-term-id=\"49437685\">D.C. <\/span><span data-term-id=\"49437665\">Prenup<\/span>?<\/h2>\n<p>Since the <span data-term-id=\"49437666\">District of Columbia<\/span> follows the UPAA, the UPAA rules about what you can include in a <span data-term-id=\"49437660\">prenuptial agreement<\/span> apply to residents of <span data-term-id=\"49437661\">Washington, D.C<\/span>. You must also abide by the local <a href=\"https:\/\/codes.findlaw.com\/dc\/division-viii-general-laws\/dc-code-sect-46-501.html\" target=\"_blank\" rel=\"noopener\">statutes of the <span data-term-id=\"49437666\">District of Columbia<\/span> Code<\/a>.<\/p>\n<p>Under D.C. law, you can include the following provisions in a <a href=\"https:\/\/www.findlaw.com\/family\/marriage\/what-can-and-cannot-be-included-in-prenuptial-agreements.html\"><span data-term-id=\"49437701\">Washington, DC<\/span> <span data-term-id=\"49437660\">prenuptial agreement<\/span><\/a>:<\/p>\n<ul>\n<li>The party&#8217;s rights and obligations with respect to property (joint and separate)<\/li>\n<li><span data-term-id=\"49437690\">Property distribution<\/span> in the <span data-term-id=\"49437695\">event of a divorce<\/span> or <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/annulments-overview.html\"><span data-term-id=\"49437688\">annulment<\/span><\/a><\/li>\n<li>The <span data-term-id=\"49437683\">prospective spouses<\/span>\u2019 rights, obligations, and <span data-term-id=\"49437676\">liabilities<\/span><\/li>\n<li>Ownership of <span data-term-id=\"49437698\">death benefits<\/span> from a <span data-term-id=\"49437678\">life insurance policy<\/span><\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/family\/divorce\/spousal-support-alimony-basics.html\"><span data-term-id=\"49437664\">Alimony<\/span>\/<span data-term-id=\"49437663\">spousal support<\/span><\/a> in the event of divorce or separation<\/li>\n<li>The <span data-term-id=\"49437677\">choice of law<\/span> governing the construction of the agreement<\/li>\n<\/ul>\n<p>You can include any terms you like as long as they aren\u2019t <span data-term-id=\"49437671\">unconscionable<\/span>, against <span data-term-id=\"49437667\">public policy<\/span>, and both spouses are willing to agree to them. You must abide by these rules whether you enter a traditional marriage or <a href=\"https:\/\/www.findlaw.com\/family\/domestic-partnerships.html\"><span data-term-id=\"49437673\">domestic partnership<\/span><\/a>. The above rules also apply to any <a href=\"https:\/\/www.findlaw.com\/family\/marriage\/what-is-a-postnuptial-agreement.html\"><span data-term-id=\"49437681\">postnuptial agreement<\/span><\/a> you sign.<\/p>\n<h2>What Can\u2019t Be Included in a <span data-term-id=\"49437662\">Premarital Agreement<\/span>?<\/h2>\n<p>For the most part, you can include almost anything in your <span data-term-id=\"49437662\">premarital agreement<\/span>. As long as both parties provide <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/separation-divorce-financial-information-questionnaire.html\"><span data-term-id=\"49437697\">full disclosure<\/span><\/a> of their financial situation, there is a good chance the agreement will hold up in court.<\/p>\n<p>There are certain issues that you cannot address in your <span data-term-id=\"49437665\">prenup<\/span>. Your agreement cannot include terms related to any of the following:<\/p>\n<ul>\n<li><span data-term-id=\"49437670\">Child custody<\/span><\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/family\/child-support.html\"><span data-term-id=\"49437669\">Child support<\/span><\/a><\/li>\n<li>Lifestyle choices<\/li>\n<li>Illegal or unfair terms<\/li>\n<\/ul>\n<p>If you include any of the above, the court can refuse to enforce the specific clauses that violate the rules of the UPAA, or the judge may invalidate the entire agreement. Rather than risk this happening, it\u2019s a good idea to <a href=\"https:\/\/lawyers.findlaw.com\/family-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">meet with <span data-term-id=\"49437680\">legal counsel<\/span><\/a> before signing the agreement.<\/p>\n<h2>When Is a <span data-term-id=\"49437662\">Premarital Agreement<\/span> Not Enforceable?<\/h2>\n<p>As with any other contract, there are certain conditions that can invalidate your <span data-term-id=\"49437660\">prenuptial agreement<\/span>. For example, if either party claims that they didn\u2019t sign the agreement voluntarily, the court may <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-is-a-voidable-contract\/\">deem it invalid<\/a>.<\/p>\n<p>The courts will deem a <span data-term-id=\"49437665\">prenup<\/span> invalid if it was <a href=\"https:\/\/dictionary.findlaw.com\/definition\/unconscionable.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"49437671\">unconscionable<\/span><\/a> at the time the parties executed it. This can stem from any of the following conditions:<\/p>\n<ul>\n<li>One of the <span data-term-id=\"49437683\">prospective spouses<\/span> did not receive a fair and <span data-term-id=\"49437679\">reasonable disclosure<\/span> of the other party\u2019s property or <span data-term-id=\"49437700\">financial obligations<\/span><\/li>\n<li>They didn\u2019t voluntarily and expressly waive the right to this disclosure<\/li>\n<li>They didn&#8217;t\/couldn&#8217;t have had <span data-term-id=\"49437699\">adequate knowledge<\/span> of this information<\/li>\n<\/ul>\n<p>There are certain special situations. For example, if a provision of a <span data-term-id=\"49437660\">prenuptial agreement<\/span> modifies or eliminates spousal or <span data-term-id=\"49437682\">domestic partner support<\/span> and makes one party <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/state-public-assistance-welfare-information.html\">eligible for <span data-term-id=\"49437674\">public assistance<\/span><\/a>, the court can order support despite the provision.<\/p>\n<p>It can be devastating to discover that your <span data-term-id=\"49437665\">prenup<\/span> isn\u2019t valid in the middle of a divorce. Therefore, make sure you consult a local <a href=\"https:\/\/lawyers.findlaw.com\/family-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"49437672\">family law attorney<\/span><\/a> or <span data-term-id=\"49437689\">divorce lawyer<\/span> before signing it. This allows you to identify potential issues and make necessary changes before the wedding.<\/p>\n<h2>Have Independent <span data-term-id=\"49437691\">Legal Representation<\/span> Review Your <span data-term-id=\"49437660\">Prenuptial Agreement<\/span><\/h2>\n<p>While the law doesn\u2019t require it, you should seek <a href=\"https:\/\/lawyers.findlaw.com\/family-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">independent <span data-term-id=\"49437680\">legal counsel<\/span><\/a> before signing a <span data-term-id=\"49437665\">prenup<\/span>. As much as you trust your soon-to-be spouse, you need to protect yourself. Your attorney will not only ensure that the agreement is fair, but they will also work hard to ensure that your partner has made a <span data-term-id=\"49437697\">full disclosure<\/span> of their debts and assets.<\/p>\n<p>Some people decide to go to an attorney with their prospective spouse, but it\u2019s a better idea for all involved if you each meet with a different lawyer. That\u2019s the only way to ensure that both parties\u2019 interests are protected by the agreement.<\/p>\n<h2>How To Enforce the Terms of Your <span data-term-id=\"49437665\">Prenup<\/span><\/h2>\n<p>Usually, the only time someone needs to enforce their <span data-term-id=\"49437665\">prenup<\/span> is if they get <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/legal-separation-vs-divorce.html\">separated or divorced<\/a>. Of course, there are exceptions to this rule. Regardless of the reason, there may come a time when you need to enforce some (or all) of the terms of your <span data-term-id=\"49437662\">premarital agreement<\/span>.<\/p>\n<p>Ideally, you and your spouse\/partner can come to an agreement on your own. If this doesn\u2019t work, you can <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/divorce-mediation-overview.html\">attend mediation<\/a> where an independent third party will recommend how the two of you should proceed.<\/p>\n<p>If there is no way to resolve the issues amicably, you can take the legal route. In D.C., there are specific steps you must take to <a href=\"https:\/\/www.findlaw.com\/family\/marriage\/top-10-reasons-a-premarital-agreement-may-be-invalid.html\">enforce your <span data-term-id=\"49437660\">prenuptial agreement<\/span><\/a>.<\/p>\n<p>These steps are as follows:<\/p>\n<ul>\n<li>Gather all evidence related to your <span data-term-id=\"49437665\">prenup<\/span>, such as financial records, <a href=\"https:\/\/www.findlaw.com\/tax.html\">tax returns<\/a>, emails, and text messages<\/li>\n<li>File a \u201cMotion to Enforce\u201d with the family court and <a href=\"https:\/\/www.dccourts.gov\/services\/family-matters\/family-filing-fees\" target=\"_blank\" rel=\"noopener\">pay the filing fee of $80<\/a> (make sure to attach all required paperwork to your motion)<\/li>\n<li>Attend a court hearing, although the family court judge will likely order you and your soon-to-be ex-spouse to make every effort to resolve the matter out of court through informal negotiations or attending <a href=\"https:\/\/www.findlaw.com\/adr\/mediation.html\">mediation<\/a><\/li>\n<li>Following the judge\u2019s ruling on whether to allow the <span data-term-id=\"49437665\">prenup<\/span> to be enforced<\/li>\n<li>If your spouse refuses to comply with the judge\u2019s order, you can ask the court to hold them in contempt<\/li>\n<\/ul>\n<p>While you can <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/what-is-a-motion.html\">file the motion<\/a> yourself, it\u2019s a good idea to at least meet with a <span data-term-id=\"49437687\">DC <\/span><span data-term-id=\"49437689\">divorce<\/span><span data-term-id=\"49437689\"> lawyer<\/span>.
