Unlike in many other states, most <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/domestic-workers-bill-of-rights.html\">domestic workers<\/a> in D.C. must be covered by workers&#8217; compensation. Note, however, that <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/public-employees-and-workers-compensation.html\">federal employees<\/a> are covered by a different set of regulations and <a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/being-an-independent-contractor-vs-employee.html\">independent contractors<\/a> are not covered at all. Most <a href=\"https:\/\/www.findlaw.com\/injury\/product-liability\/mesothelioma-and-asbestos.html\">occupational diseases<\/a>, including pneumoconiosis and radiation diseases, as well as most physical and <a href=\"https:\/\/codes.findlaw.com\/dc\/division-v-local-business-affairs\/dc-code-sect-31-3103.html\" target=\"_blank\" rel=\"noopener\">psychiatric<\/a> conditions, are covered under workers&#8217; compensation in D.C.<\/p>\r\n<h2>Types of Benefits<\/h2>\r\n<p>You may be entitled to compensation for your medical costs in addition to <a href=\"https:\/\/codes.findlaw.com\/dc\/division-v-local-business-affairs\/dc-code-sect-32-1508.html\" target=\"_blank\" rel=\"noopener\">wage replacement<\/a> compensation for your time away from work due to disability. Wage replacement comes in multiple forms, including permanent total disability, temporary total disability, and permanent partial disability. If your physician determines that you are <a href=\"https:\/\/codes.findlaw.com\/dc\/division-v-local-business-affairs\/dc-code-sect-32-1508.html\" target=\"_blank\" rel=\"noopener\">totally disabled<\/a>, you will be entitled to 66 2\/3% of our average weekly wages, subject to the statutory maximum. Once you have recovered to the extent your physician believes you will recover, your physician may diagnose you with a <a href=\"https:\/\/codes.findlaw.com\/dc\/division-v-local-business-affairs\/dc-code-sect-32-1508.html\" target=\"_blank\" rel=\"noopener\">permanent partial<\/a> disability. In that case, you will be entitled to additional compensation of 66 2\/3% of your average weekly wages for a set number of weeks based on your type of disability.<\/p>\r\n<h2>Dispute Resolution<\/h2>\r\n<p>If your claim is denied, you will need to <a href=\"http:\/\/does.dc.gov\/sites\/default\/files\/dc\/sites\/does\/publication\/attachments\/Application%20for%20Formal%20Hearing%20Rev_0%20%281%29_0.pdf\" target=\"_blank\" rel=\"noopener\">request a formal hearing<\/a> with the Administrative Hearings Division. This is a full legal proceeding, with a scheduling order which must be followed. Your employer will likely have an attorney and you may wish to get an attorney of your own to protect your rights during the process.<\/p>\r\n<h2>Get a Claim Review from a Workers&#8217; Compensation Attorney<\/h2>\r\n<p>Washington, D.C. has some progressive workers&#8217; compensation laws. Even still, if your claim is based on anxiety, stress, or panic attacks, you may need an attorney to help you make your case.
