You must include the officer\u2019s name and badge number, the location of the incident, and the nature of the misconduct. You should also provide contact information for any witnesses to the event.<\/li>\n<li><strong>Provide a detailed description of the incident<\/strong>: This is your chance to explain what happened. Include a chronological description of the events related to your complaint.<\/li>\n<li><strong>Submit your complaint within 90 days of the incident<\/strong>: You can fill out a complaint form online, or you can mail your completed form to the OPC. You can call for an update at (202) 727-3838 or (866) 588-0568.<\/p>\n<h3>Filing a Civil Lawsuit for Damages<\/h3>\n<p>If you suffer an injury as a result of <span data-term-id=\"52843720\">police misconduct<\/span>, you may have a claim for damages. To recover compensation for your injuries, you must <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit.html\">file a civil lawsuit<\/a> against the officer and the <span data-term-id=\"52843742\">law enforcement<\/span><span data-term-id=\"52843742\"> agency<\/span> that employs them. In some cases, the government may claim that the officer named in the lawsuit is immune from <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/civil-cases-the-basics.html\">civil liability<\/a>.<\/p>\n<p>Government actors, such as <span data-term-id=\"52843721\">police officers<\/span>, firefighters, and other personnel, are often <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/can-i-sue-a-911-dispatcher.html\">immune from civil liability<\/a>. If the officer can prove that they were carrying out their official duties at the time of the incident and did not violate clearly established law, the courts may dismiss your claim.<\/p>\n<p>Whether a government agent can claim this <a href=\"https:\/\/supreme.findlaw.com\/supreme-court-insights\/pros-vs-cons-of-qualified-immunity-both-sides-of-debate.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52843749\">qualified immunity<\/span><\/a> depends on the facts of the case. <span data-term-id=\"52843749\">Qualified immunity<\/span> is not intended to provide\u00a0<span data-term-id=\"52843721\">police officers<\/span> with absolute protection against citizens filing civil lawsuits. The purpose of offering <span data-term-id=\"52843733\">law enforcement<\/span><span data-term-id=\"52843733\"> officers<\/span>\u00a0immunity is to ensure that they can perform their duties without fear of being sued.<\/p>\n<p>To qualify for immunity, a <span data-term-id=\"52843721\">police officer<\/span> must demonstrate the following:<\/p>\n<ul>\n<li>The officer was performing their job at the time of the incident<\/li>\n<li>The <span data-term-id=\"52843721\">police officer<\/span> did not intentionally violate a \u201cclearly established\u201d <span data-term-id=\"52843732\">constitutional right<\/span><\/li>\n<li>The officer acted reasonably, given the circumstances<\/li>\n<li>The <span data-term-id=\"52843721\">police officer<\/span> <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/468\/897.html\" target=\"_blank\" rel=\"noopener\">acted in good faith<\/a> and with due care<\/li>\n<\/ul>\n<p>A right is considered clearly established when prior court decisions have confirmed that the officer&#8217;s conduct would be unlawful. This requires prior cases with very similar facts.<\/p>\n<p>For example, although the use of <span data-term-id=\"52843722\">excessive force<\/span> is illegal, an officer might receive immunity if they used a specific tactic or type of force that wasn&#8217;t addressed in earlier court cases involving similar circumstances. This specificity requirement presents\u00a0a significant hurdle to <span data-term-id=\"52843749\">qualified immunity<\/span>\u00a0in many <span data-term-id=\"52843720\">police misconduct<\/span> cases. If the defendant is successful in claiming immunity, the court may <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/what-is-a-motion-to-dismiss.html\">dismiss your claim<\/a>.<\/p>\n<h3>Seeking Criminal Prosecution<\/h3>\n<p>In addition to pursuing a civil action against a <span data-term-id=\"52843721\">police officer<\/span> who violates your <span data-term-id=\"52843732\">constitutional rights<\/span>, you can also seek criminal prosecution for their actions. The process is similar to any other criminal case. As the victim, you cannot charge a <span data-term-id=\"52843733\">law enforcement<\/span><span data-term-id=\"52843733\"> officer<\/span> with a crime. Only prosecutors can bring criminal charges. However, you can report their behavior and ask the government to <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/how-are-criminal-charges-brought-against-someone.html\">pursue criminal charges<\/a>.<\/p>\n<p>A <span data-term-id=\"52843721\">police officer<\/span> is subject to <a href=\"https:\/\/www.findlaw.com\/state\/dc-law\/dc-criminal-laws.html\">D.C.\u2019s criminal laws<\/a> just like other citizens and, if they break the law, will face the same criminal penalties. If a <span data-term-id=\"52843733\">law enforcement<\/span><span data-term-id=\"52843733\"> officer<\/span> engages in <span data-term-id=\"52843720\">police misconduct<\/span>, they may face criminal charges, such as assault. The specific charges, of course, depend on the nature of their actions.<\/p>\n<p>The U.S. Attorney for D.C. handles local prosecutions. As the victim, the prosecutor will likely call on you to testify about what the officer did. If the judge or jury finds the officer guilty, they will face possible jail time, fines, and probation.<\/p>\n<h3>Pursuing Criminal Charges in <span data-term-id=\"52843747\">Federal Court<\/span><\/h3>\n<p>In addition to prosecution under D.C. criminal laws, serious <span data-term-id=\"52843723\">civil rights<\/span> violations may also be prosecuted under <span data-term-id=\"52843736\">federal law<\/span>. <a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-242.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52843736\">Federal law<\/span> states<\/a> that government agents cannot willfully deprive a person of the rights and privileges provided by the <a href=\"https:\/\/constitution.findlaw.com\/\" target=\"_blank\" rel=\"noopener\">Constitution<\/a> or other <span data-term-id=\"52843748\">laws of the United States<\/span>. Anyone acting under \u201c<span data-term-id=\"52843739\">color of law<\/span>\u201d (acting under legal authority) must not knowingly or intentionally violate a person\u2019s <span data-term-id=\"52843723\">civil rights<\/span>.<\/p>\n<p>Such <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/3-potential-ways-to-sue-if-your-constitutional-rights-are-violated\/\">deprivation of rights<\/a> may include, but isn&#8217;t limited to:<\/p>\n<ul>\n<li>Physical assault<\/li>\n<li>Sexual misconduct<\/li>\n<li>Deliberate indifference to a serious medical condition or substantial risk of harm<\/li>\n<li>A failure to intervene<\/li>\n<\/ul>\n<p>The federal<a href=\"https:\/\/www.justice.gov\/crt\/addressing-police-misconduct-laws-enforced-department-justice\" target=\"_blank\" rel=\"noopener\"> <span data-term-id=\"52843738\">Department of Justice<\/span> (DOJ)<\/a> investigates <span data-term-id=\"52843753\">police abuse<\/span> and misconduct claims.
