Courts impose <span data-term-id=\"59485737\">punitive damages<\/span> to penalize the wrongdoer and discourage others from engaging in similar conduct.<\/li>\n<\/ul>\n<p>If more than one party is at fault, the damages owed to the injured party can be <a href=\"https:\/\/codes.findlaw.com\/de\/title-10-courts-and-judicial-procedure\/de-code-sect-10-6302\/\" target=\"_blank\" rel=\"noopener\">divided between the defendants<\/a> who are found liable.<\/p>\n<p>However, in many states, a plaintiff\u2019s damages are reduced if they\u2019re found to be partially at fault for the accident. These rules typically fall into one of three categories:<\/p>\n<ul>\n<li><strong><span data-term-id=\"59485728\">Contributory negligence<\/span>:<\/strong> The most strict rule, where a plaintiff <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/what-is-contributory-negligence.html\">cannot <span data-term-id=\"59485716\">recover damages<\/span><\/a> if they are found at all at fault in the accident. Only a few states follow this rule.<\/li>\n<li><strong>Pure <span data-term-id=\"59485715\">comparative negligence<\/span>: <\/strong>The plaintiff can <span data-term-id=\"59485716\">recover damages<\/span> regardless of their <span data-term-id=\"59485722\">percentage of fault<\/span>. The amount is simply reduced by their contribution to the accident. We\u2019ll explain how this works below.<\/p>\n<h2><span data-term-id=\"59485718\">Modified <\/span><span data-term-id=\"59485715\">Comparative Negligence<\/span> in Delaware<\/h2>\n<p>If a jury finds that an injured person was partly responsible for an accident, the court reduces the damages awarded by that person&#8217;s <span data-term-id=\"59485722\">percentage of fault<\/span>. For example, if the total award is $100,000 and the court found the injured person 20 percent at fault. Then, their recovery would be $80,000.<\/p>\n<p>Under Delaware\u2019s <span data-term-id=\"59485736\">modified <\/span><span data-term-id=\"59485715\">comparative negligence<\/span><span data-term-id=\"59485736\"> rule<\/span>, someone can <span data-term-id=\"59485716\">recover damages<\/span> only if their share of fault is <strong>not greater than<\/strong> the <span data-term-id=\"59485742\">negligence of the defendant<\/span>.<\/p>\n<p>For example, imagine you are in a car accident and suffer injuries totaling $100,000 in damages. The court determines that the other driver was 70% at fault, but you were 30% at fault for speeding. Under Delaware&#8217;s rule, your recovery would be reduced by your <span data-term-id=\"59485722\">percentage of fault<\/span>. You could collect $70,000 ($100,000 minus your 30%).<\/p>\n<p>However, if the court found you were 60% at fault, your fault would be <strong>greater than<\/strong> the other driver&#8217;s (40%). In this case, Delaware&#8217;s <span data-term-id=\"59485736\">modified <\/span><span data-term-id=\"59485715\">comparative negligence<\/span><span data-term-id=\"59485736\"> rule<\/span> would bar you from recovering any damages at all.<\/p>\n<p>Insurance companies and defense attorneys often focus on assigning blame to the injured party, since each percentage point of fault reduces the potential recovery.<\/p>\n<h2>Common Types of Negligence Claims in Delaware<\/h2>\n<p>Negligence shows up in a wide range of everyday situations. Two of the most common are car accidents and injuries that occur on another person&#8217;s property.<\/p>\n<h3>Car Accidents<\/h3>\n<p>Delaware follows a <a href=\"https:\/\/www.findlaw.com\/state\/delaware-law\/delaware-car-accident-compensation-laws.html\">fault-based <span data-term-id=\"59485746\">auto accident<\/span> insurance system<\/a>. The driver who causes a crash and their insurer are usually responsible for damages, often determined by the details found in the official <span data-term-id=\"59485727\">police report<\/span>. If you cannot resolve your claim with the insurance company, you can file a negligence lawsuit against the at-fault driver. Missing this <span data-term-id=\"59485720\">statute of limitations<\/span> can mean losing your right to sue, no matter how strong your case.<\/p>\n<h3>Slip-and-Fall and Premises Liability Claims<\/h3>\n<p>Property owners in Delaware must keep their premises reasonably safe for visitors. The level of care owed depends on the reason for the visit.<\/p>\n<ul>\n<li>Customers, tenants, and other invited business visitors are owed the <a href=\"https:\/\/www.findlaw.com\/realestate\/owning-a-home\/property-owners-legal-duty-to-prevent-injury.html\" target=\"_blank\" rel=\"noopener\">highest <span data-term-id=\"59485719\">duty of care<\/span><\/a>. Property owners must address known hazards, such as a spill on a store floor, and take reasonable steps to find hazards they do not yet know about.<\/li>\n<li>People who enter for their own reasons, such as door-to-door solicitors, are subject to a lower <span data-term-id=\"59485719\">duty of care<\/span>.<\/li>\n<li>Trespassers receive the least protection under Delaware law. Property owners are generally not held to have a <span data-term-id=\"59485719\">duty of care<\/span> towards a trespasser.<\/li>\n<\/ul>\n<p>Other common negligence claims involve <a href=\"https:\/\/www.findlaw.com\/injury\/product-liability\/what-is-product-liability.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"59485729\">product liability<\/span><\/a> for defective or dangerous products, nursing home neglect or abuse, and dog bites. Each of these types of claims may have additional rules beyond Delaware&#8217;s general negligence and comparative fault laws.<\/p>\n<h2>How Are <span data-term-id=\"59485724\">Medical Malpractice<\/span> Cases Different From Typical Negligence Cases?<\/h2>\n<p><span data-term-id=\"59485724\">Medical malpractice<\/span>, also called medical negligence, is another type of negligence claim. These cases have unique legal requirements that make them more complex than typical slip-and-fall or\u00a0<span data-term-id=\"59485747\">motor vehicle accident<\/span> claims.<\/p>\n<h3>1. You Must File an Affidavit of Merit<\/h3>\n<p>An Affidavit of Merit is a legal document an expert completes stating that they believe medical negligence occurred. As\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/delaware\/wilmington\/michael-c-dalton-NTE5NDMzNF8x\/\" target=\"_blank\" rel=\"noopener\">Delaware <span data-term-id=\"59485724\">medical malpractice<\/span> lawyer Michael C. That&#8217;s not true with medical negligence cases.<\/p>\n<p>&#8220;Frequently, in order to argue for various claims in a medical negligence lawsuit, the plaintiff must employ more than one expert in different fields of medicine, or in other, non-medical fields (e.g., economics),&#8221; Dalton notes. &#8220;Defendants frequently retain more than one expert, and courts rarely restrict them from presenting several experts at trial.&#8221;<\/p>\n<h3>3. <span data-term-id=\"59485724\">Medical Malpractice<\/span> Cases Are Harder To Win<\/h3>\n<p>&#8220;The overwhelming majority of medical negligence claims nationally return defense verdicts,&#8221; according to Dalton. &#8220;Juries tend to believe and trust physicians and providers. Plaintiffs bringing a medical negligence lawsuit confront both the need to meet their burden of proof and overcome the innate sympathy and trust a jury may have for a medical provider accused of negligence.
