It is punishable by up to <span data-term-id=\"40825080\">one year<\/span> in jail and a fine not exceeding $1,000.<\/p>\n<h3><span data-term-id=\"40825081\">Felony Battery<\/span><\/h3>\n<p>If the defendant has a <span data-term-id=\"40825106\">prior conviction<\/span> for battery, state law allows the prosecutor to charge the defendant with <span data-term-id=\"40825081\">felony battery<\/span>. This applies whether your <span data-term-id=\"40825106\">prior conviction<\/span> was for <span data-term-id=\"40825074\">simple battery<\/span>, <span data-term-id=\"40825062\">aggravated battery<\/span>, or <span data-term-id=\"40825081\">felony battery<\/span>. This can mean up to five years in prison and fines of up to $5,000. A conviction includes cases where the judgment was withheld or a nolo contendere plea was entered.<\/p>\n<h3><span data-term-id=\"40825062\">Aggravated Battery<\/span><\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/fl\/title-xlvi-crimes\/fl-st-sect-784-045\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40825062\">Aggravated battery<\/span><\/a> can apply if a person, in the commission of the battery, either intentionally or knowingly causes <span data-term-id=\"40825079\">great <\/span><span data-term-id=\"40825064\">bodily harm<\/span>, permanent disability, or permanent <span data-term-id=\"40825072\">disfigurement<\/span>. It\u2019s also triggered by the use of a <span data-term-id=\"40825065\">deadly weapon<\/span>. It is also an <span data-term-id=\"40825062\">aggravated battery<\/span> if the act was committed against a pregnant victim and the offender knew that the victim was pregnant or should have reasonably known.<\/p>\n<p><span data-term-id=\"40825062\">Aggravated battery<\/span> is a <span data-term-id=\"40825067\">second-degree felony<\/span>. Conviction carries a maximum sentence of 15 years in prison and fines of up to $10,000. If it occurred during a riot, the penalties are ranked one level higher than the normal sentencing for the crime.<\/p>\n<h3>Domestic Battery by Strangulation<\/h3>\n<p><span data-term-id=\"40825059\">Florida<\/span> takes strangulation cases seriously, particularly when they happen between family members, household members, or people in dating relationships.\u00a0It\u2019s a crime to <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xlvi-crimes\/fl-st-sect-784-041\/\" target=\"_blank\" rel=\"noopener\">intentionally restrict someone&#8217;s breathing or blood circulation<\/a> by putting pressure on their throat or neck, or by covering their nose or mouth.\u00a0<\/p>\n<p>The mere creation of a risk of serious harm is enough.<strong>\u00a0<\/strong>The critical elements are that you acted knowingly and intentionally, and that it was against the other person&#8217;s will. <span data-term-id=\"40825076\">Domestic violence<\/span> by strangulation is a <span data-term-id=\"40825060\">third-degree felony<\/span> that carries up to five years in prison and fines reaching $5,000.<\/p>\n<h2><span data-term-id=\"40825076\">Domestic Violence<\/span> Assault and Battery<\/h2>\n<p><a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliii-domestic-relations\/fl-st-sect-741-28\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40825073\">Florida<\/span><span data-term-id=\"40825073\"> law<\/span><\/a> treats certain offenses between family members differently from those involving strangers, and covers a wide range of crimes under <span data-term-id=\"40825076\">domestic violence<\/span>. These crimes include:<\/p>\n<ul>\n<li>Assault<\/li>\n<li><span data-term-id=\"40825061\">Aggravated assault<\/span><\/li>\n<li>Battery<\/li>\n<li><span data-term-id=\"40825062\">Aggravated battery<\/span><\/li>\n<li>Sexual assault<\/li>\n<li><span data-term-id=\"40825104\">Sexual battery<\/span><\/li>\n<li>Stalking<\/li>\n<li>Aggravated stalking<\/li>\n<li>Kidnapping<\/li>\n<li>False imprisonment<\/li>\n<\/ul>\n<p>It also includes any criminal offense that results in <span data-term-id=\"40825116\">physical harm<\/span> or the death of a family or household member. What makes these acts a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/domestic-violence.html\"><span data-term-id=\"40825076\">domestic violence<\/span> case<\/a> is the relationship between the people involved.<\/p>\n<h3>Who Counts as Family or Household Members?<\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliii-domestic-relations\/fl-st-sect-741-28\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40825070\">Florida<\/span><span data-term-id=\"40825070\"> statute<\/span><\/a> defines family or household members as current and former spouses, relatives by blood or marriage, and anyone who lives together or has lived together in a familial relationship. Co-parents who share a child also fall under this definition, even if they were never married or never lived together in the same home.<\/p>\n<p>For most other relationships, there&#8217;s a requirement for a living arrangement. You and the other person must currently live together or have lived together in the past. The co-parent exception is the only relationship that counts without ever sharing a home.<\/p>\n<h3>Mandatory Batterers&#8217; Intervention Program<\/h3>\n<p>Whether you&#8217;re found guilty, plead no contest, or have adjudication withheld, the court will order you into a\u00a0<a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliii-domestic-relations\/fl-st-sect-741-281\/\" target=\"_blank\" rel=\"noopener\">batterers&#8217; intervention program<\/a>. Judges can only skip this requirement if they explain on the record specific reasons why the program wouldn&#8217;t be appropriate in your case. This rarely happens.<\/p>\n<p>These programs take at least\u00a0<a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliii-domestic-relations\/fl-st-sect-741-325\" target=\"_blank\" rel=\"noopener\">29 weeks with 24 weekly sessions<\/a>, plus intake, assessment, and orientation. In addition, you&#8217;ll serve at least <span data-term-id=\"40825080\">one year<\/span> on probation.<\/p>\n<h2>Enhanced Penalties for Protected Classes<\/h2>\n<p><span data-term-id=\"40825059\">Florida<\/span> imposes much harsher penalties\u00a0when victims fall into certain protected categories.\u00a0The law treats violence against vulnerable populations and public safety personnel as particularly serious.<\/p>\n<h3>Assault Against First Responders and Law Enforcement<\/h3>\n<p>Charges are often increased when the victim is a <span data-term-id=\"40825086\">law enforcement officer<\/span>, firefighter, emergency medical provider, or similar personnel performing their lawful duties. <span data-term-id=\"40825077\">Simple assault<\/span> becomes a <span data-term-id=\"40825063\">first-degree misdemeanor<\/span> instead of a <span data-term-id=\"40825066\">second-degree misdemeanor<\/span>. You may face up to <span data-term-id=\"40825080\">one year<\/span> in jail rather than 60 days. <span data-term-id=\"40825074\">Simple battery<\/span> escalates from a misdemeanor to a <span data-term-id=\"40825060\">third-degree felony<\/span>. This can result in up to five years in prison instead of a <span data-term-id=\"40825080\">one-year<\/span> maximum.<\/p>\n<p><span data-term-id=\"40825061\">Aggravated assault<\/span> becomes a <span data-term-id=\"40825067\">second-degree felony<\/span> with a mandatory minimum sentence of three years and a maximum of fifteen years. <span data-term-id=\"40825062\">Aggravated battery<\/span> elevates to a first-degree felony with a five-year mandatory minimum and a thirty-year maximum.<\/p>\n<h3>Assault Against People Age 65 and Older<\/h3>\n<p>Enhanced penalties are imposed for elderly victims. Possessing a gun during the crime means a mandatory minimum of ten years. If you fire the weapon, that jumps to a minimum of 20 years.
