Florida mandates certain professionals to report suspected abuse and imposes severe penalties for failure to report or false reporting. <\/p>\n\n    <\/div>\n\n<p>Child abuse is generally defined as emotional, physical, or sexual abuse, neglect, or abandonment of a child by a parent or caregiver. It includes acts of intentional act or threatened acts that impact the child\u2019s welfare. The state law also recognizes that there are two different categories of abusive conduct:<\/p>\r\n<p>Child abuse:<\/p>\r\n<ul>\r\n<li>Intentional infliction of physical or mental injury to a child<\/li>\r\n<li>Any intentional act which could result in physical or mental injury to a child<\/li>\r\n<li>Encouraging others to commit acts that result in injury to the child<\/li>\r\n<\/ul>\r\n<p>Aggravated child abuse:<\/p>\r\n<ul>\r\n<li>Commission of aggravated battery on the child<\/li>\r\n<li>Malicious corporal punishment<\/li>\r\n<li>Willful torture of the child<\/li>\r\n<li>Intentionally causing great bodily harm to the child, permanent disfigurement or disability<\/li>\r\n<\/ul>\r\n<p>Mental injury:<\/p>\r\n<ul>\r\n<li>Causing injury to the psychological or mental capacity of the child<\/li>\r\n<li>Creating substantial impairment to the child\u2019s ability to function normally<\/li>\r\n<\/ul>\r\n<p>Neglect of a child:<\/p>\r\n<ul>\r\n<li>Failure to give the child essential care, supervision, and services<\/li>\r\n<li>Withholding necessary medical care<\/li>\r\n<li>Providing inadequate nutrition, food, clothing, or shelter<\/li>\r\n<li>Failure to protect the child from abuse, exploitation, or neglect by another person<\/li>\r\n<\/ul>\r\n<p>Sexual abuse:<\/p>\r\n<ul>\r\n<li>Direct sexual exploitation or abuse<\/li>\r\n<li>Exposing the child to sexual predators<\/li>\r\n<li>Creating a condition that allows sexual abuse against the child<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td><p><b>Mandatory reporters<\/b><\/p>\r\n<\/td>\r\n<td><p>Anyone who knows or has reasonable suspicion that a child is experiencing abuse, neglect, or abandonment by a parent, legal guardian, or caregiver should file a report.<\/p>\r\n<p>However, <a href=\"https:\/\/codes.findlaw.com\/fl\/title-v-judicial-branch\/fl-st-sect-39-201\/\" target=\"_blank\" rel=\"noopener\">Florida statute <\/a>enforces strict reporting requirements for certain professionals with direct contact or interaction with the child.<\/p>\r\n<p>The following people are <a href=\"https:\/\/www.findlaw.com\/family\/child-abuse\/checklist-are-you-a-mandatory-reporter-of-child-abuse.html\" title=\"mandatory reporters\">mandatory reporters<\/a> in Florida:<\/p>\r\n<ul>\r\n<li>Physicians<\/li>\r\n<li>Osteopathic physicians<\/li>\r\n<li>Medical examiners<\/li>\r\n<li>Chiropractors<\/li>\r\n<li>Nurses<\/li>\r\n<li>Hospital personnel engaged in admission, examination, care, or treatment<\/li>\r\n<li>Health or mental health professionals not listed in the medical category<\/li>\r\n<li>Practitioners who rely solely on spiritual means for healing<\/li>\r\n<li>School teachers<\/li>\r\n<li>Other school officials<\/li>\r\n<li>School personnel<\/li>\r\n<li>Social workers<\/li>\r\n<li>Daycare center workers<\/li>\r\n<li>Professional childcare workers<\/li>\r\n<li>Foster care workers<\/li>\r\n<li>Residential workers<\/li>\r\n<li>Institutional workers<\/li>\r\n<li>Law enforcement officers<\/li>\r\n<li>Judges<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td><p><b>Reporting procedures<\/b><\/p>\r\n<\/td>\r\n<td><p>Florida state law provides multiple avenues to report cases of child abuse. You can contact the Florida Abuse Hotline at 1-800-962-2873. You can also report abuse online through the<a href=\"https:\/\/www.myflfamilies.com\/services\/abuse\/abuse-hotline\/how-report-abuse\" target=\"_blank\" rel=\"noopener\"> Florida Department of Children and Families (DCF) website.<\/a><\/p>\r\n<p>The DCF is authorized to conduct the following actions:<\/p>\r\n<ul>\r\n<li>Interview the child subjected to abuse<\/li>\r\n<li>Conduct abuse investigations<\/li>\r\n<li>Develop safety plans for the child<\/li>\r\n<li>Access relevant records<\/li>\r\n<li>File a petition for protective orders<\/li>\r\n<li>Work with law enforcement agencies<\/li>\r\n<\/ul>\r\n<p>For emergencies, it is best to dial 911 or call your local law enforcement agency to seek immediate help.<\/p>\r\n<\/td>\r\n<\/tr><tr><td><p><b>Penalty for failure to report or false reporting<\/b><\/p>\r\n<\/td>\r\n<td><p><a href=\"https:\/\/m.flsenate.gov\/Statutes\/39.205\" title=\"Fla. Stat. \u00a7 39.205\" target=\"_blank\" rel=\"noopener\">Fla. Stat. \u00a7 39.205<\/a> enforces penalties on those who failed to report child abuse or who filed false allegations of abuse.<\/p>\r\n<p>Failure to report child abuse could result in the following penalties:<\/p>\r\n<ul>\r\n<li>Third-degree felony<\/li>\r\n<li>Up to 5 years of imprisonment<\/li>\r\n<li>Maximum fine of up to $5,000<\/li>\r\n<li>Possibility of extended sentences for repeat offenders<\/li>\r\n<\/ul>\r\n<p>These penalties apply to those who willfully and knowingly fail to report and to those who willfully and knowingly prevent others from filing a report.<\/p>\r\n<p>&nbsp;False reporting:<\/p>\r\n<ul>\r\n<li>Third-degree felony<\/li>\r\n<li>Up to 5 years imprisonment<\/li>\r\n<li>Maximum $5,000 fine<\/li>\r\n<\/ul>\r\n<p>These penalties apply to those who advise others to file a false report. However, the Florida statute gives good-faith reporters immunity.<\/p>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<h3><b>Unlawful Child Desertion of a Child<\/b><\/h3>\r\n<p><a href=\"https:\/\/www.flsenate.gov\/Laws\/Statutes\/2021\/827.10\" target=\"_blank\" rel=\"noopener\">Florida statute 827.10<\/a> specifically addresses unlawful desertion of a child. The state law makes it a third-degree felony to desert a child.<\/p>\r\n<p>Under this statute, unlawful desertion of a child happens when a parent, <a href=\"https:\/\/www.findlaw.com\/family\/guardianship.html\" title=\" legal guardian\">legal guardian<\/a>, caregiver, or a person responsible for the child\u2019s care leaves the child in any place. That person left the child with the intent to abandon the child without providing reasonable provisions for the child\u2019s support or supervision.<\/p>\r\n<p>The penalty for child desertion could be up to five years of imprisonment and a maximum fine of up to $5,000. Someone found guilty of this felony may also face potential termination of parental rights.<\/p>\r\n<h2><b>What Is the Child Protection Act in Florida?<\/b><\/h2>\r\n<p>The Florida Child Protection Act, as reflected in <a href=\"https:\/\/www.flsenate.gov\/Laws\/Statutes\/2022\/Chapter39\" title=\"Chapter 39 of the Florida Statutes\" target=\"_blank\" rel=\"noopener\">Chapter 39 of the Florida Statutes<\/a>, serves as the primary legislative framework that ensures the safety of children and promotes their health and well-being. This act provides a comprehensive legal system for reporting child abuse and neglect. It also specifies mandatory reporters who are required by law to report suspected cases of abuse or neglect.<\/p>\r\n<p>Moreover, the Act also defines the responsibilities of the Department of Children and Families (DCF), details investigation protocols in cases of child abuse, and provides guidelines for court proceedings, particularly when <a href=\"https:\/\/www.findlaw.com\/family\/parental-rights-and-liability\/termination-of-parental-rights.html\" title=\"termination of parental rights\">termination of parental rights<\/a> is involved.<\/p>\r\n<p>In addition, the Act also ensures that reporters and victims of child abuse maintain confidentiality.
