This law protects people from <span data-term-id=\"52845081\">prohibited discrimination<\/span> based on:<\/p>\n<ul>\n<li>Race<\/li>\n<li>Color<\/li>\n<li>Religion<\/li>\n<li>Sex<\/li>\n<li>Pregnancy<\/li>\n<li><span data-term-id=\"52845053\">National origin<\/span><\/li>\n<li>Age<\/li>\n<li>Handicap (disability)<\/li>\n<li><span data-term-id=\"52845059\">Marital status<\/span><\/li>\n<\/ul>\n<p>These protections reflect major <span data-term-id=\"52845064\">federal laws<\/span>, including\u00a0<a href=\"https:\/\/corporate.findlaw.com\/human-resources\/title-vii-and-sexual-harassment-claims.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52845063\">Title VII<\/span> of the <span data-term-id=\"52845080\">Civil Rights Act of 1964<\/span><\/a>, the\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/age-discrimination-in-employment.html\">Age Discrimination in Employment Act (ADEA)<\/a>, and the\u00a0<a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/the-americans-with-disabilities-act-overview.html\">Americans with Disabilities Act (ADA)<\/a>.<\/p>\n<p><span data-term-id=\"52845052\">Florida<\/span>&#8216;s <span data-term-id=\"52845075\">state laws<\/span> do not cover sexual orientation and gender identity. Federal courts have interpreted <span data-term-id=\"52845063\">Title VII<\/span>&#8216;s sex discrimination ban to include both workplace and non-workplace contexts, following the U.S. Supreme Court&#8217;s 2020 ruling in\u00a0<a href=\"https:\/\/supreme.findlaw.com\/supreme-court-insights\/bostock-v-clayton-county-case-summary-.html\" target=\"_blank\" rel=\"noopener\"><em>Bostock v. Clayton County<\/em><\/a>. In 2021, the <span data-term-id=\"52845055\">Florida<\/span><span data-term-id=\"52845055\"> Commission on Human Relations<\/span> announced it would interpret the statutory prohibition against \u201csex\u201d discrimination to include sexual orientation and gender identity. This includes being fired, demoted, passed over for a promotion, paid less, or subjected to harassment that creates a hostile work environment. It applies everywhere, from big cities like <span data-term-id=\"52845057\">Tallahassee<\/span> to tiny villages like Marineland.<\/p>\n<p>For <span data-term-id=\"52845052\">Florida<\/span>&#8216;s <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0700-0799\/0760\/0760.html#:~:text=(7)%E2%80%83%E2%80%9CEmployer%E2%80%9D%20means%20any%20person%20employing%2015%20or%20more%20employees%20for%20each%20working%20day%20in%20each%20of%2020%20or%20more%20calendar%20weeks%20in%20the%20current%20or%20preceding%20calendar%20year%2C%20and%20any%20agent%20of%20such%20a%20person.\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52845065\">employment discrimination<\/span> laws<\/a> to apply, an employer must employ at least 15 people for 20 or more weeks per year. This matches the threshold under <span data-term-id=\"52845064\">federal law<\/span>. If you work for a smaller employer, your city or county may have a local ordinance that offers additional protections.<\/p>\n<p><span data-term-id=\"52845052\">Florida<\/span> law also protects you from <a href=\"https:\/\/www.findlaw.com\/employment\/losing-a-job\/retaliation-and-wrongful-termination.html\">retaliation<\/a>. These unlawful retaliatory practices can also be reflected in the <span data-term-id=\"52845074\">conditions of employment<\/span> and your day-to-day activities, as well as in how your employer responded to the complaint.<\/p>\n<p>If you want to file an <span data-term-id=\"52845058\">unlawful employment practice<\/span> complaint, you generally have to first file a complaint with the\u00a0<a href=\"https:\/\/fchr.myflorida.com\/employment\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52845055\">Florida<\/span><span data-term-id=\"52845055\"> Commission on Human Relations<\/span> (<span data-term-id=\"52845078\">FCHR<\/span>)<\/a>\u00a0or the\u00a0<a href=\"https:\/\/www.eeoc.gov\/filing-charge-discrimination\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52845085\">Equal Employment Opportunity Commission<\/span> (EEOC)<\/a>. <span data-term-id=\"52845052\">Florida<\/span> gives you up to 365 days from the date of the discriminatory act to file, which is a wider window than the 180- or 300-day deadlines under <span data-term-id=\"52845064\">federal law<\/span>.<\/p>\n<h2>Housing Discrimination<\/h2>\n<p>It is also illegal under the <span data-term-id=\"52845070\">Florida<\/span><span data-term-id=\"52845070\"> Fair Housing Act<\/span> to discriminate in the sale, rental, or financing of housing based on:<\/p>\n<ul>\n<li>Race<\/li>\n<li>Color<\/li>\n<li><span data-term-id=\"52845053\">National origin<\/span><\/li>\n<li>Sex<\/li>\n<li>Disability<\/li>\n<li>Religion<\/li>\n<li><span data-term-id=\"52845084\">Familial status<\/span> (including pregnancy)<\/li>\n<\/ul>\n<p>Under both <span data-term-id=\"52845052\">Florida<\/span> and <span data-term-id=\"52845064\">federal law<\/span>, a landlord or seller cannot refuse to rent or sell housing, impose different terms, or place discriminatory ads. If you have a disability, you also have the right to request reasonable accommodations from your landlord and to make reasonable modifications to your home.<\/p>\n<p>Those who believe they\u2019ve been discriminated against can file a\u00a0<a href=\"https:\/\/fchr.myflorida.com\/fair-housing\" target=\"_blank\" rel=\"noopener\">housing complaint with the\u00a0<span data-term-id=\"52845078\">FCHR<\/span><\/a>\u00a0or\u00a0the\u00a0<a href=\"https:\/\/www.hud.gov\/contactus\" target=\"_blank\" rel=\"noopener\">U.S. Department of Housing and Urban Development (HUD)<\/a>. The window for filing is one year from when the discriminatory act occurred.<\/p>\n<h2>Public Accommodations<\/h2>\n<p><span data-term-id=\"52845052\">Florida<\/span> law also protects you from discrimination in <span data-term-id=\"52845077\">places of public accommodation<\/span>. This includes hotels, restaurants, retail stores, gas stations, entertainment venues, and other businesses open to the public.<\/p>\n<p>Under the <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliv-civil-rights\/fl-st-sect-760-08\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52845054\">Florida<\/span><span data-term-id=\"52845054\"> Statutes<\/span><\/a>, businesses cannot discriminate based on race, color, <span data-term-id=\"52845053\">national origin<\/span>, sex, pregnancy, handicap, <span data-term-id=\"52845084\">familial status<\/span>, or religion. As with employment, <span data-term-id=\"52845052\">Florida<\/span>&#8216;s public accommodations law does not explicitly cover sexual orientation or gender identity. However, if you live in a city like\u00a0<a href=\"https:\/\/www.miamidade.gov\/global\/humanresources\/fair-employment\/human-rights-commission.page\" target=\"_blank\" rel=\"noopener\">Miami<\/a>\u00a0or\u00a0<a href=\"https:\/\/www.eqfl.org\/gender-identity-and-expression-added-orlandos-anti-discrimination-ordinance\" target=\"_blank\" rel=\"noopener\">Orlando<\/a>, local ordinances may offer broader protections that prohibit discrimination on the basis of sexual orientation and gender identity in public accommodations. You can check whether your area has <span data-term-id=\"52845072\">local laws<\/span> that address public accommodations.<\/p>\n<h2>Education Discrimination<\/h2>\n<p>The <a href=\"https:\/\/www.flsenate.gov\/laws\/statutes\/2021\/1000.05\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52845052\">Florida<\/span> Educational Equity Act<\/a>\u00a0protects students and employees in <span data-term-id=\"52845052\">Florida<\/span>&#8216;s public K-20 education system from discrimination based on race, ethnicity, <span data-term-id=\"52845053\">national origin<\/span>, gender, disability, religion, or <span data-term-id=\"52845059\">marital status<\/span>. This law requires that all students have equal access to educational programs, school activities, and <span data-term-id=\"52845069\">training programs<\/span>. It also requires public schools and colleges to provide equal athletic opportunities for students of all genders, in line with\u00a0<a href=\"https:\/\/www.ed.gov\/laws-and-policy\/civil-rights-laws\/title-ix-and-sex-discrimination\" target=\"_blank\" rel=\"noopener\">Title IX of the Education Amendments of 1972<\/a>.<\/p>\n<p>If you believe a school has violated your rights, you can file a\u00a0<a href=\"https:\/\/www.fldoe.org\/about-us\/office-of-the-inspector-general\/file-a-complaint.stml\" target=\"_blank\" rel=\"noopener\">complaint under the <span data-term-id=\"52845052\">Florida<\/span> Educational Equity Act<\/a>,\u00a0<a href=\"https:\/\/www.ed.gov\/laws-and-policy\/civil-rights-laws\/file-complaint\" target=\"_blank\" rel=\"noopener\">Title IX,<\/a>\u00a0or both.<\/p>\n<h2>Protections Unique to <span data-term-id=\"52845052\">Florida<\/span><\/h2>\n<p><span data-term-id=\"52845052\">Florida<\/span> offers a few anti-discrimination protections that go beyond what <span data-term-id=\"52845064\">federal law<\/span> requires, thanks to the <span data-term-id=\"52845062\">Florida<\/span><span data-term-id=\"52845062\"> Legislature<\/span>. This includes making <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliv-civil-rights\/fl-st-sect-760-50\/\" target=\"_blank\" rel=\"noopener\">it illegal to discriminate based on a person&#8217;s HIV or AIDS status<\/a>. <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliv-civil-rights\/fl-st-sect-760-40\/\" target=\"_blank\" rel=\"noopener\">Genetic privacy protections<\/a> mean that nobody can run a DNA analysis on you without your written consent, and results must stay confidential.<\/p>\n<h2>How To File a Civil Rights Complaint in <span data-term-id=\"52845052\">Florida<\/span><\/h2>\n<p>If you think your rights have been violated, it is important to act quickly. Missing a filing deadline could cost you your right to pursue a claim.<\/p>\n<p>For most employment and public accommodations claims, you must\u00a0<a href=\"https:\/\/fchr.myflorida.com\/employment\" target=\"_blank\" rel=\"noopener\">file a complaint with the <span data-term-id=\"52845078\">FCHR<\/span><\/a>\u00a0or the EEOC before you can file a lawsuit. Once you file, the <span data-term-id=\"52845078\">FCHR<\/span> will investigate whether there is enough reason to believe discrimination occurred.<\/p>\n<p>If the <span data-term-id=\"52845078\">FCHR<\/span> finds reasonable cause, they may try to help both sides reach a resolution. If that fails, you can request a hearing or file a lawsuit in civil court. If the <span data-term-id=\"52845078\">FCHR<\/span> finds no reasonable cause, you have 35 days to request a hearing. Missing that window may forfeit your right to proceed.<\/p>\n<p>For housing complaints, you can\u00a0<a href=\"https:\/\/fchr.myflorida.com\/fair-housing\" target=\"_blank\" rel=\"noopener\">file with the <span data-term-id=\"52845078\">FCHR<\/span><\/a>, with HUD, or go directly to state or federal court.
