It may be one of the hardest decisions you ever make. It is also challenging to navigate the divorce process in Florida. Many prefer hiring a divorce lawyer rather than trying to handle it themselves.<\/p>\n<p>In Florida, a divorce is a dissolution of marriage. In this article, we will use the terms interchangeably.<\/p>\n<p>The&nbsp;<a href=\"https:\/\/www.findlaw.com\/state\/florida-law\/florida-family-laws.html\" title=\"family law&nbsp;courts\">family law&nbsp;courts<\/a> in Florida see countless divorce cases every day. The divorce legal process can be confusing and frustrating. The judge will not give you preferential treatment simply because you don\u2019t have a lawyer.<\/p>\n<p>Here, we\u2019ll explain the Florida divorce process, breaking it down step by step. We will also discuss some common <a href=\"https:\/\/www.findlaw.com\/family.html\" title=\"family law\">family law<\/a> issues you\u2019ll encounter during the divorce process. Finally, we\u2019ll explain why it may be in your best interests to <a href=\"https:\/\/lawyers.findlaw.com\/divorce\/florida?fli=dcta\" title=\"seek legal advice\" target=\"_blank\" rel=\"noopener\">seek legal advice<\/a> for a dissolution of marriage in Florida.<\/p>\n<h2><b>Residency Requirements for Divorce in Florida<\/b><\/h2>\n<p>To successfully file for divorce in Florida, you must prove that you or your spouse have lived in Florida for at least six months. You should have evidence that you meet the <a href=\"https:\/\/codes.findlaw.com\/fl\/title-vi-civil-practice-and-procedure\/fl-st-sect-61-021\/\" title=\"residency requirement\" target=\"_blank\" rel=\"noopener\">residency rule<\/a> before you file your petition.<\/p>\n<p>There are several ways to establish that someone meets the residency requirement, including:<\/p>\n<ul>\n<li>Florida driver\u2019s license<\/li>\n<li>Florida ID issued by the DMV<\/li>\n<li>Florida voter registration card<\/li>\n<li>Affidavit or testimony from an acceptable party<\/li>\n<\/ul>\n<p>In most states, <a href=\"https://www.findlaw.com/static/f/files\/pdf\/family\/family.findlaw.com_divorce_divorce-residency-faq-s.pdf\" title=\"residency\" target=\"_blank\" rel=\"noopener\">residency<\/a> implies that a person intends to stay in the state indefinitely. Use caution if you have not consistently lived in the state. A spouse may own homes in two states but still have only one home.<\/p>\n<p>If you file a divorce petition without meeting the <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/where-should-you-file-for-divorce\/\" title=\"residency rule\">residency rule<\/a>, the court may dismiss your action. When a party contests residency in a divorce case, the court can require more proof than in the original filing. To avoid wasting time and money, ensure you understand how courts in Florida view claims of residency.<\/p>\n<h2><b>Grounds for Divorce in the State of Florida<\/b><\/h2>\n<p>Under common law, there were nearly a dozen separate grounds for divorce. Often, a spouse had to <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/an-overview-of-no-fault-and-fault-divorce-law.html\" title=\"prove fault\">prove fault<\/a>, some conduct that gave rise to the need for divorce.<\/p>\n<p>Like many other states, Florida has moved toward <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/an-overview-of-no-fault-and-fault-divorce-law.html\" title=\"no-fault divorce\">no-fault divorce<\/a>. Florida law&nbsp;allows only <a href=\"http:\/\/www.leg.state.fl.us\/STATUTES\/index.cfm?App_mode=Display_Statute&amp;URL=0000-0099\/0061\/Sections\/0061.052.html\" title=\"two grounds for divorce\" target=\"_blank\" rel=\"noopener\">two grounds for divorce<\/a>:<\/p>\n<ul>\n<li>Your marriage is irretrievably broken<\/li>\n<li>A judge has deemed one party to the marriage mentally incapacitated at least three years before filing for divorce<\/li>\n<\/ul>\n<h2><b>Separation Before Filing for Divorce<\/b><\/h2>\n<p>Florida has no such rule that you <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/legal-separation-vs-divorce.html\" title=\"separate from your spouse\">separate from your spouse<\/a> for a specific period before filing for divorce. You can file for divorce even if you live with your spouse.<\/p>\n<p>It\u2019s important to remember that it may be harder to prove your marriage is irretrievably broken if you and your spouse live together. It may be best to consider <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/legal-separation.html\" title=\"separating\">separating<\/a> before filing your divorce petition. But the courts typically don\u2019t investigate before accepting your divorce complaint.<\/p>\n<h2><b>Information to Gather<\/b><\/h2>\n<p>Before you <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/filing-and-serving-the-divorce-dissolution-petition.html\" title=\"file for divorce\">file for divorce<\/a>, you will need to supply some information when you file your initial divorce petition. You\u2019ll also need to give your spouse\u2019s attorney this information early in the divorce process.<\/p>\n<p>When you file your initial Petition for Dissolution of Marriage, you must submit a signed <a href=\"https:\/\/www.flcourts.gov\/content\/download\/685812\/file_pdf\/902b10-21.pdf\" target=\"_blank\" rel=\"noopener\">Family Law Financial Affidavit<\/a>. This document includes the following financial information:<\/p>\n<ul>\n<li>Proof of income<\/li>\n<li>Tax returns<\/li>\n<li>Proof of assets<\/li>\n<li>Proof of debts<\/li>\n<li>Bank statements<\/li>\n<li>Other relevant financial information, such as 401K statements, pensions, etc.<\/li>\n<\/ul>\n<p>The Florida family courts offer a <a href=\"https:\/\/www.flcourts.gov\/content\/download\/685813\/file_pdf\/902c10-21.pdf?inLanguage=eng-US&amp;version=8\" title=\"long\" target=\"_blank\" rel=\"noopener\">long<\/a> and short form of this affidavit. You must complete the long form if you or your spouse earn $50,000 or more annually. You can file the short form affidavit if you and your spouse barn less than $50,000 annually<\/p>\n<p>If you file the wrong form, <a href=\"https:\/\/www.findlaw.com\/family\/divorce.html\" title=\"you can always refile\">you can always refile<\/a>. But this will make the process more expensive. It will also delay your final judgment. Another problem that may arise is your spouse will file a divorce petition in the interim, and you\u2019ll end up as the respondent rather than the petitioner.<\/p>\n<p>Besides your petition and affidavit, if you have minor children with your spouse, you must submit a <a href=\"https:\/\/www.flcourts.gov\/Resources-Services\/Office-of-Family-Courts\/Family-Court-in-Florida\/Family-Law-Forms\/Additional-Supporting-Documents-12.902-Forms-B-J\/Child-Support-Guidelines-Worksheet\" title=\"Child Support Guidelines Worksheet\" target=\"_blank\" rel=\"noopener\">Child Support Guidelines Worksheet<\/a>. The courts rely on the Florida Child Support Guidelines to determine how much support the non-custodial parent will pay. If you have dependent children with disabilities, the judge may also require you to submit this worksheet.<\/p>\n<h2>Types of Petitions for Dissolution of Marriage<\/h2>\n<p>Two basic&nbsp;<a href=\"https:\/\/www.flcourts.gov\/Resources-Services\/Office-of-Family-Courts\/Family-Court-in-Florida\/Family-Law-Forms\/Petition-for-Dissolution-of-Marriage-12.901-Forms-A-B3\" target=\"_blank\" rel=\"noopener\">types of divorce petitions<\/a>&nbsp;may be filed in Florida courts. The first is a <a href=\"https:\/\/www.flcourts.gov\/content\/download\/685807\/file_pdf\/901a.pdf\" title=\"Simplified Dissolution of Marriage\" target=\"_blank\" rel=\"noopener\">Simplified Dissolution of Marriage<\/a>. This type of petition may be filed only if the following circumstances are true:<\/p>\n<ul>\n<li>You have no minor children together<\/li>\n<li>You both waive the right to request alimony<\/li>\n<li>You already signed a Marital Settlement Agreement or have otherwise divided your assets and liabilities to both parties&#8217; satisfaction<\/li>\n<li>You both waive your right to trial and appeal<\/li>\n<li>You both sign the petition and appear at a court hearing at the same time<\/li>\n<\/ul>\n<p>If you don&#8217;t meet the requirements for a Simplified Dissolution of Marriage petition, you will file a regular Dissolution of Marriage petition. There are three basic types of regular Dissolution of Marriage petitions. The <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/the-divorce-process-do-s-and-don-ts.html\" title=\"petition you will file\">petition you will file<\/a> depends on your circumstances. They include:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.flcourts.gov\/content\/download\/685808\/file_pdf\/901b1.pdf?inLanguage=eng-US&amp;version=3\" title=\"Petition for Dissolution of Marriage with Dependent or Minor Children\" target=\"_blank\" rel=\"noopener\">Petition for Dissolution of Marriage with Dependent or Minor Child(ren)<\/a><\/li>\n<li><a href=\"https:\/\/www.flcourts.gov\/content\/download\/685809\/file_pdf\/901b2.pdf\" title=\"Petition for Dissolution of Marriage with Property but No Dependent or Minor Children\" target=\"_blank\" rel=\"noopener\">Petition for Dissolution of Marriage with Property but No Dependent or Minor Child(ren)<\/a><\/li>\n<li><a href=\"https:\/\/www.flcourts.gov\/content\/download\/685810\/file_pdf\/901b3.pdf?inLanguage=eng-US&amp;version=3\" title=\"Petition for Dissolution of Marriage with No Dependent or Minor Children and No Property\" target=\"_blank\" rel=\"noopener\">Petition for Dissolution of Marriage with No Dependent or Minor Child(ren) or Property<\/a><\/li>\n<\/ul>\n<p>The clerk\u2019s office will reject your petition if you don\u2019t include the correct paperwork. <a href=\"https:\/\/lawyers.findlaw.com\/divorce\/florida?fli=dcta\" title=\"Hiring a divorce lawyer\" target=\"_blank\" rel=\"noopener\">Hiring a divorce lawyer<\/a> to handle your case is a good idea. Legal matters on divorce are complex. This is especially true if the marriage lasts more than a few years or you have substantial assets.<\/p>\n<h2><b>Contested vs. Uncontested Divorce<\/b><\/h2>\n<p>Most states give you the option of filing a <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/uncontested-divorce.html\" title=\"contested or uncontested divorce\">contested or uncontested divorce<\/a>. An uncontested divorce is typically filed by people who have only been married for a few years. It\u2019s often used by couples with no children and little property who have agreed on all matters.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/family\/divorce\/do-i-have-to-go-to-court-for-an-uncontested-divorce.html\" title=\"Contested divorces\">Contested divorces<\/a> are for petitioners who can&#8217;t agree on the terms of their divorce. They often share children and assets with their spouses and disagree about the terms of custody, support, or property division.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/family\/divorce.html\" title=\"Divorce cases in Florida\">Divorce cases in Florida<\/a> work a bit differently. Instead of offering a contested and uncontested divorce, you must file a regular dissolution of marriage petition or a simplified dissolution of marriage petition.<\/p>\n<p>A <a href=\"https:\/\/www.miamidadeclerk.gov\/clerk\/simplified-divorces.page\" title=\"simple dissolution of marriage\" target=\"_blank\" rel=\"noopener\">simple dissolution of marriage<\/a> petition is for people with few legal issues to discuss. They typically have no children, and the assets they share are minor. This type of petition is also available for couples with a final, signed marital settlement agreement.<\/p>\n<p>A <a href=\"https:\/\/www.floridabar.org\/public\/consumer\/pamphlet010\/\" title=\"regular dissolution of marriage petition\" target=\"_blank\" rel=\"noopener\">regular dissolution of marriage petition<\/a> is like a contested divorce in other states. This petition is for couples who can&#8217;t agree on property division or who have complicated economic circumstances. This might include a lot of credit card debt or personal loans. This petition is also for couples who can&#8217;t agree on child custody or alimony payments.<\/p>\n<p>Many people may tell you it\u2019s easy to <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/self-representation.html\" title=\"represent yourself\">represent yourself<\/a> in a simple divorce case. While it is true that these cases are less complex than a regular divorce, it&#8217;s not easy. An attorney can help you decide which type of divorce to file. They can help you get your fair share of your spouse\u2019s retirement accounts, marital property, and other assets.<\/p>\n<h2><b>Filing Your Divorce Petition<\/b><\/h2>\n<p>The <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/the-divorce-process-do-s-and-don-ts.html\" title=\"divorce process in Florida\">divorce process in Florida<\/a> is like that in other states. You must prove that you or your spouse are legally married. One of you must meet the residency requirements.<\/p>\n<h3><b>Forms to Prepare and File With the Family Court<\/b><\/h3>\n<p>When you file your divorce petition, you must submit your <a href=\"https:\/\/www.flcourts.gov\/Resources-Services\/Office-of-Family-Courts\/Family-Court-in-Florida\/Family-Law-Forms\/Additional-Supporting-Documents-12.902-Forms-B-J\/Family-Law-Financial-Affidavit\" title=\"Family Law Financial Affidavit\" target=\"_blank\" rel=\"noopener\">Family Law Financial Affidavit<\/a>. You must also give the court the documents we mentioned above.<\/p>\n<p>The court requires that you sign a certification stating that the information you gave the court is complete and truthful. You must also meet the mandatory disclosure rules of the family court. You can&#8217;t withhold financial information or other materials.<\/p>\n<h3><b>Pay Your Filing Fees<\/b><\/h3>\n<p>When you file your petition, you must <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/how-much-does-a-divorce-cost-by-state.html\" title=\"pay the filing fees\">pay the filing fees<\/a>. The amount of these fees will depend on the type of petition you file. There are also extra fees that may arise during your divorce.<\/p>\n<p>In Florida, it&nbsp;<a href=\"https:\/\/www.flclerks.com\/general\/custom.asp?page=HDI_File_For_Divorce\" target=\"_blank\" rel=\"noopener\">costs $397.50<\/a>&nbsp;to file your petition for dissolution of marriage. You must also pay $10 for your final judgment. In most cases, you must pay a fee to serve a copy of the summons and petition on your spouse. You may need to pay for personal service if your spouse evades service.<\/p>\n<p>You may need to pay other fees for specific services along the way. For example, if your attorney <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/what-is-a-deposition.html\" title=\"deposes\">deposes<\/a> your spouse, they must pay a court reporter to transcribe the conversation. You may also have to pay a mediator if you and your spouse can&#8217;t agree on the terms of your divorce settlement and seek <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/divorce-mediation-overview.html\" title=\"mediation\">mediation<\/a>.<\/p>\n<h3><b>Serving Your Spouse a Copy of Your Complaint for Divorce<\/b><\/h3>\n<p>It\u2019s not enough that you file your divorce petition with the court clerk. You must <a href=\"https:\/\/dictionary.findlaw.com\/definition\/service-of-process.html\" title=\"serve your spouse\" target=\"_blank\" rel=\"noopener\">serve your spouse<\/a> with an official copy of your divorce petition.<\/p>\n<p>Often, your attorney will hire a&nbsp;<a href=\"https:\/\/www.findlaw.com\/legal\/practice\/practice-support\/services-for-lawyers-hiring-a-process-server.html\">process server<\/a> to deliver the summons to your spouse. Sometimes, a petitioner is on good terms with their spouse, and their spouse accepts service without issue. It depends on the circumstances in your case.<\/p>\n<p>The court will require that you provide proof of service. The clock \u2014 for filing a response \u2014 will begin running once the court sees that you have properly served your spouse.<\/p>\n<h3><b>Your Spouse\u2019s Response to Your Divorce Complaint<\/b><\/h3>\n<p>Once your spouse gets served with the divorce papers, they will have 20 days from the service date to&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/divorce\/answering-the-divorce-dissolution-petition.html\">file their answer<\/a>. An <a href=\"https:\/\/www.flcourts.gov\/content\/download\/685823\/file_pdf\/903b.pdf?inLanguage=eng-US&amp;version=2\" title=\"Answer To Petition for Dissolution of Marriage\" target=\"_blank\" rel=\"noopener\">Answer To Petition for Dissolution of Marriage<\/a> informs the court about whether they agree or disagree with the statements made in your petition. Your spouse must also file a Family Law Financial Affidavit. Your attorney can request a default judgment hearing if your spouse does not file their answer within 20 days.<\/p>\n<p>When your spouse files their answer, they must provide the court with their Family Law Financial Affidavit. They face the same&nbsp;<a href=\"https:\/\/www.flcourts.gov\/Resources-Services\/Office-of-Family-Courts\/Family-Court-in-Florida\/Family-Law-Forms\/12.932-Form\/Certificate-of-Compliance-with-Mandatory-Disclosure\" target=\"_blank\" rel=\"noopener\">mandatory disclosure rules<\/a>. They must also give the court a certification confirming their accurate and complete information.<\/p>\n<h2><b>Equitable Distribution of the Marital Assets<\/b><\/h2>\n<p>One of the inevitable consequences of divorce is the&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/divorce\/equitable-distribution.html\">division of property<\/a>. Even in the most amicable divorce cases, the parties usually disagree about how to divide their property. Sadly, most couples don\u2019t fight over the high-value assets. Instead, they fight over minor assets, such as family albums or treasured items.<\/p>\n<p>Florida law says that both parties to a divorce <a href=\"https:\/\/corporate.findlaw.com\/law-library\/what-does-equitable-distribution-of-property-really-mean.html\" title=\"keep all non-marital assets\" target=\"_blank\" rel=\"noopener\">keep all non-marital assets<\/a>. Imagine that you owned your house when you got married. You and your spouse lived there throughout the marriage. When you divorce, you will keep ownership of the home. Of course, if you and your spouse contributed to the mortgage during the marriage, you\u2019ll have to split the equity you earned between the date of marriage and the date of divorce.<\/p>\n<p>The judge will presume that you and your spouse will divide&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/marriage\/managing-marital-property-do-s-and-don-ts.html\">marital debts<\/a>&nbsp;and assets equally (50\/50). But you can argue that you\u2019re entitled to more than half of specific assets or less than half of specific debts.<\/p>\n<h3><b>Factors the Judge Will Consider in the Division of Marital Property<\/b><\/h3>\n<p>If you can&#8217;t agree, the judge will consider several factors when dividing your marital assets and debts.<\/p>\n<p>The&nbsp;<a href=\"http:\/\/www.leg.state.fl.us\/Statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0000-0099\/0061\/Sections\/0061.075.html\" target=\"_blank\" rel=\"noopener\">factors the judge will consider<\/a>&nbsp;include the following:<\/p>\n<ul>\n<li>Length of the marriage<\/li>\n<li>Educational and career opportunities for each spouse<\/li>\n<li>Spousal contribution to marital assets (including savings, retirement, pension, etc.)<\/li>\n<li>Intentional destruction or depreciation of marital assets<\/li>\n<li>Marital home for dependent children<\/li>\n<li>The financial contribution of each spouse<\/li>\n<\/ul>\n<p>Of course, this list isn\u2019t exhaustive. There are other factors the judge may consider. It depends on the case.<\/p>\n<p>Certain assets are not subject to equitable distribution. For example, gifts and inheritances you get from third parties during the marriage are not marital property.<\/p>\n<p>Once you and your spouse agree on the division of marital property, your attorney will draft a&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/divorce\/settlement-agreements-and-court-approval.html\">marital settlement agreement<\/a> and a proposed order for the judge to review and approve. If the judge decides at the hearing how to divide the property and debts, they will issue an order.<\/p>\n<h2><b>Marital Settlement Agreements and Final Order for Divorce<\/b><\/h2>\n<p>Divorce cases <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/settlement-agreements-and-court-approval.html\" title=\"rarely go to trial\">rarely go to trial<\/a>. Eventually, your lawyer will work with your spouse\u2019s lawyer to devise a fair marital settlement agreement. This will include the division of your marital assets and debts.
