It also covers the protections and programs available, as well as key legal aspects you should be aware of.<\/p>\n<p>Everyone deserves an abuse-free life. Read on to learn about how to make that possible.<\/p>\n<h2><strong><span data-term-id=\"39043548\">Florida<\/span> <span data-term-id=\"39043548\">Domestic Violence<\/span><span data-term-id=\"39043548\"> Laws<\/span>: What Is <span data-term-id=\"39043484\">Domestic Violence<\/span>?<\/strong><\/h2>\n<p>Home is where the heart is, but it&#8217;s also where almost all <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-laws.html\"><span data-term-id=\"39043484\">domestic violence<\/span><\/a> is found as well. To classify a crime as <span data-term-id=\"39043484\">domestic violence<\/span>, specific relationship and abuse criteria must be met. The best way to learn them is to jump right in, so let&#8217;s get started.<\/p>\n<h3><strong><span data-term-id=\"39043484\">Domestic Violence<\/span> in <span data-term-id=\"39043489\">Florida<\/span>: Criminal Acts<\/strong><\/h3>\n<p>There are two elements required for a <span data-term-id=\"39043484\">domestic violence<\/span> offense. The first is the type of crime committed. <span data-term-id=\"39043560\">Domestic abuse<\/span> is a crime of <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/power-and-control\/\" target=\"_blank\" rel=\"noopener\">control and power<\/a>. The abuser employs <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/types-of-domestic-violence.html\">different types of abusive acts<\/a> intended to keep the victim feeling powerless and helpless. This includes, but is not limited to, <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/battered-women-s-syndrome.html\">physical abuse and intimidation<\/a>.<\/p>\n<p><span data-term-id=\"39043489\">Florida<\/span>, like many states, has categories for <span data-term-id=\"39043484\">domestic violence<\/span> crimes. However, it also specifies particular offenses. The following make up <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliii-domestic-relations\/fl-st-sect-741-28.html\" target=\"_blank\" rel=\"noopener\">one required element for a <span data-term-id=\"39043484\">domestic violence<\/span> classification<\/a>:<\/p>\n<ul>\n<li>Assault with or without a <span data-term-id=\"39043544\">deadly weapon<\/span><\/li>\n<li><span data-term-id=\"39043517\">Aggravated assault<\/span><\/li>\n<li>Battery<\/li>\n<li><span data-term-id=\"39043505\">Aggravated battery<\/span><\/li>\n<li><span data-term-id=\"39043522\">False imprisonment<\/span><\/li>\n<li>Kidnapping<\/li>\n<li><span data-term-id=\"39043501\">Sexual assault<\/span><\/li>\n<li><span data-term-id=\"39043589\">Sexual battery<\/span><\/li>\n<li>Stalking<\/li>\n<li><span data-term-id=\"39043534\">Aggravated stalking<\/span><\/li>\n<li>Any other <span data-term-id=\"39043521\">criminal offense<\/span> resulting in <span data-term-id=\"39043572\">physical injury<\/span> or death<\/li>\n<\/ul>\n<p>Crimes not mentioned in the statute can still count as <span data-term-id=\"39043560\">domestic abuse<\/span>. This is true if they result in <span data-term-id=\"39043572\">physical injury<\/span> or death among family or <span data-term-id=\"39043491\">household members<\/span>. Financial control or economic abuse can be part of <span data-term-id=\"39043560\">domestic abuse<\/span>. However, they do not form a separate <span data-term-id=\"39043484\">domestic violence<\/span> crime under <span data-term-id=\"39043499\">Florida<\/span><span data-term-id=\"39043499\"> law<\/span>.<\/p>\n<p>A crime that doesn&#8217;t qualify as <span data-term-id=\"39043484\">domestic violence<\/span> is still a crime and subject to prosecution. Being stalked by a stranger isn&#8217;t <span data-term-id=\"39043560\">domestic abuse<\/span>, but it is an offense that <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm\" target=\"_blank\" rel=\"noopener\">has its own protections available<\/a>.<\/p>\n<h3><strong><span data-term-id=\"39043484\">Domestic Violence<\/span> in <span data-term-id=\"39043489\">Florida<\/span>: The People Involved<\/strong><\/h3>\n<p>The second key element for classifying <span data-term-id=\"39043484\">domestic violence<\/span> is the participants involved. These are referred to as <span data-term-id=\"39043523\">family members<\/span> and <span data-term-id=\"39043491\">household members<\/span>. Under <span data-term-id=\"39043499\">Florida<\/span><span data-term-id=\"39043499\"> law<\/span>, the individuals involved must share one of a set of qualifying relationships. The <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliii-domestic-relations\/fl-st-sect-741-28.html\" target=\"_blank\" rel=\"noopener\">associations are as follows<\/a>:<\/p>\n<ul>\n<li>Spouses<\/li>\n<li><span data-term-id=\"39043526\">Former spouses<\/span><\/li>\n<li>Family by marriage (in-laws and stepfamily)<\/li>\n<li>Family by consanguinity (blood relatives)<\/li>\n<li>People who reside together as if a family<\/li>\n<li>People who have resided together in the past as if a family<\/li>\n<li>Parents of a child in common<\/li>\n<\/ul>\n<p>Aside from the parents of a child in common, individuals in qualifying relationships are required to have lived together in the same dwelling at some point. If two people in one of these relationships have an abusive crime committed between them, it&#8217;s <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/understand-relationship-abuse\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39043484\">domestic violence<\/span><\/a>.<\/p>\n<h2><strong><span data-term-id=\"39043548\">Florida<\/span> <span data-term-id=\"39043548\">Domestic Violence<\/span><span data-term-id=\"39043548\"> Laws<\/span>: Help for Victims<\/strong><\/h2>\n<p>Having a crime classified as <span data-term-id=\"39043484\">domestic violence<\/span> opens access to <a href=\"https:\/\/www.myflfamilies.com\/services\/abuse\/domestic-violence\/programs\" target=\"_blank\" rel=\"noopener\">different types of help<\/a> in <span data-term-id=\"39043489\">Florida<\/span>. Being aware of what&#8217;s available and how it can help you can make a huge difference.<\/p>\n<h3><strong><span data-term-id=\"39043489\">Florida<\/span> Injunction for Protection Against <span data-term-id=\"39043484\">Domestic Violence<\/span><\/strong><\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-orders-of-protection-and-restraining-orders.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39043558\">Protective orders<\/span><\/a> aren&#8217;t perfect, but they offer a combination of protections for victims backed by penalties for abusers. <span data-term-id=\"39043489\">Florida<\/span> calls its <span data-term-id=\"39043484\">domestic violence<\/span> <span data-term-id=\"39043515\">restraining order<\/span> an <a href=\"https:\/\/www.flcourts.gov\/Services\/Family-Courts\/domestic-relations-court-resources\/family-law-forms\/Domestic-Violence-12.980-Forms-A-E\/Petition-for-Injunction-for-Protection-Against-Domestic-Violence\" target=\"_blank\" rel=\"noopener\">Injunction for Protection Against <span data-term-id=\"39043484\">Domestic Violence<\/span><\/a>.<\/p>\n<p>When it comes to provisions, injunctions against <span data-term-id=\"39043484\">domestic violence<\/span> are conditional. This means the injunction is a one-of-a-kind <span data-term-id=\"39043530\">court order<\/span> tailored to the specific needs of the victim in each case. While each injunction can have unique aspects, <span data-term-id=\"39043499\">Florida<\/span><span data-term-id=\"39043499\"> law<\/span> <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0700-0799\/0741\/Sections\/0741.30.html\" target=\"_blank\" rel=\"noopener\">lists the following conditions as available<\/a> for all orders as of October 1st, 2024:<\/p>\n<ul>\n<li>The abuser (<span data-term-id=\"39043574\">respondent<\/span>) is forbidden from committing any <span data-term-id=\"39043511\">acts of <\/span><span data-term-id=\"39043484\">domestic violence<\/span> against the victim (petitioner) or their family<\/li>\n<li>Awarding the petitioner temporary exclusive use and possession of a shared dwelling and\/or forbidding the abuser from entering the premises<\/li>\n<li>Awarding the petitioner temporary custody of any household animals<\/li>\n<li>Drafting a temporary parenting plan that may restrict or exclude the <span data-term-id=\"39043574\">respondent<\/span>&#8216;s <span data-term-id=\"39043581\">child custody<\/span> rights<\/li>\n<li>Designating a safe, neutral location for any exchange of children<\/li>\n<li>Ordering the <span data-term-id=\"39043574\">respondent<\/span> to <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xlvi-crimes\/fl-st-sect-790-233\/\" target=\"_blank\" rel=\"noopener\">surrender all firearms<\/a> while the injunction is in effect<\/li>\n<li>Establishing temporary child support and\/or spousal support<\/li>\n<li>Ordering the <span data-term-id=\"39043574\">respondent<\/span> to participate in a mandatory <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliii-domestic-relations\/fl-st-sect-741-325\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39043509\">batterers&#8217; intervention program<\/span><\/a><\/li>\n<\/ul>\n<p>The court can add any other provision it considers necessary for the victim&#8217;s safety. These terms are often part of a <a href=\"https:\/\/www.flcourts.gov\/content\/download\/685947\/file_pdf\/12.980%28a%29.pdf\" target=\"_blank\" rel=\"noopener\">temporary ex parte injunction for protection from <span data-term-id=\"39043484\">domestic violence<\/span><\/a>. If you&#8217;ve suffered abuse or are in fear that you will be abused, this is the order you&#8217;ll file for. Answer all the questions and provide as much detail as possible when describing the abuse you&#8217;ve suffered.<\/p>\n<p>Once finished, you can either email the form or take it in person to <a href=\"https:\/\/www.flcourts.gov\/Florida-Courts\/Court-Locations\" target=\"_blank\" rel=\"noopener\">a court near you<\/a>. While you can do it yourself, help is available through <a href=\"https:\/\/www.myflfamilies.com\/services\/abuse\/domestic-violence\/find-your-local-domestic-violence-center\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39043484\">domestic violence<\/span> centers<\/a> or a <a href=\"https:\/\/lawyers.findlaw.com\/family-law\/florida?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39043489\">Florida<\/span> family law attorney<\/a>. The court clerk to whom you submit the request will forward it to a judge immediately, who may ask you questions. If the court determines that a threat of abuse exists, the injunction is issued and takes effect.<\/p>\n<p>In <span data-term-id=\"39043497\">domestic violence<\/span><span data-term-id=\"39043497\"> cases<\/span>, a <a href=\"https:\/\/www.flsenate.gov\/laws\/statutes\/2023\/741.30#:~:text=Within%2024%20hours%20after%20the,service%20to%20the%20sheriff%20with\" target=\"_blank\" rel=\"noopener\">sheriff will serve the <span data-term-id=\"39043574\">respondent<\/span><\/a> with the injunction. The temporary ex parte injunction normally lasts up to 15 days or until the court holds a full hearing, and the court can extend it for good cause. The court must set a hearing before the temporary order expires, regardless of whether the <span data-term-id=\"39043574\">respondent<\/span> formally objects.<\/p>\n<p>If the <span data-term-id=\"39043574\">respondent<\/span> opposes the injunction, you&#8217;ll both plead your cases in a court hearing. Both sides can present evidence and call witnesses. A <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0700-0799\/0741\/Sections\/0741.30.html\" target=\"false\" rel=\"noopener noreferrer nofollow\">final injunction for protection from <span data-term-id=\"39043484\">domestic violence<\/span><\/a> goes into effect if the court rules that the threat of abuse is ongoing.<\/p>\n<p>The final injunction may amend the provisions of the temporary order or add new ones. This can include <span data-term-id=\"39043577\">no-contact orders<\/span>, <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xlvi-crimes\/fl-st-sect-790-233\/\" target=\"_blank\" rel=\"noopener\">permanent firearm restrictions<\/a>, and more.<\/p>\n<p>The duration of the final injunction is up to the court. They&#8217;ll consider factors including the abuser&#8217;s criminal record, any previous <span data-term-id=\"39043503\">domestic violence<\/span><span data-term-id=\"39043503\"> charges<\/span>, and the severity of the abuse. Depending on the charges and circumstances, a first\u2011time offender may be eligible for probation, which often includes <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliii-domestic-relations\/fl-st-sect-741-325\/\" target=\"_blank\" rel=\"noopener\">completion of a mandatory <span data-term-id=\"39043509\">batterer&#8217;s intervention program<\/span><\/a>.<\/p>\n<p>Penalties for violating an injunction for protection from <span data-term-id=\"39043484\">domestic violence<\/span> are designed to make the abuser think twice about breaking them. All <span data-term-id=\"39043484\">domestic violence<\/span> crimes causing <span data-term-id=\"39043566\">bodily harm<\/span> <a href=\"https:\/\/www.flsenate.gov\/Laws\/Statutes\/2024\/741.283\" target=\"_blank\" rel=\"noopener\">carry minimum <span data-term-id=\"39043536\">jail time<\/span><\/a> if a sentence doesn&#8217;t include any:<\/p>\n<ul>\n<li><strong><span data-term-id=\"39043532\">First offense<\/span><\/strong>: 10 days<\/li>\n<li><strong>Second offense<\/strong>: 15 days<\/li>\n<li><strong>Third or subsequent offenses<\/strong>: 20 days<\/li>\n<\/ul>\n<p>If the crimes were committed in front of a minor under 16 years of age, the penalties increase:<\/p>\n<ul>\n<li><strong><span data-term-id=\"39043532\">First offense<\/span><\/strong>: 15 days<\/li>\n<li><strong>Second offense<\/strong>: 20 days<\/li>\n<li><strong>Third or subsequent offenses<\/strong>: 30 days<\/li>\n<\/ul>\n<p><a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliii-domestic-relations\/fl-st-sect-741-31\/\" target=\"_blank\" rel=\"noopener\">Violations carry their own penalties<\/a> in addition to any other punishments from convictions for the crimes committed during the violation:<\/p>\n<ul>\n<li><strong>First or second violation<\/strong> (<span data-term-id=\"39043495\">misdemeanor<\/span> in the first degree): Up to one year in jail and a fine of up to $1,000<\/li>\n<li><strong>Third or subsequent violations<\/strong> (felony of the third degree): Up to five years in prison and a fine of up to $5,000<\/li>\n<\/ul>\n<p>The violator also receives a mandatory <span data-term-id=\"39043509\">batterer&#8217;s intervention program<\/span> unless the court can find a reason why they shouldn&#8217;t. Crimes considered <span data-term-id=\"39043484\">domestic violence<\/span> can <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xlvi-crimes\/fl-st-sect-784-041\/\" target=\"_blank\" rel=\"noopener\">have their penalties enhanced<\/a> as well.<\/p>\n<h3><strong>Hope Cards<\/strong><\/h3>\n<p>In effect since October 1st, 2024, the <a href=\"https:\/\/www.flclerks.com\/page\/hopecardprogram\" target=\"_blank\" rel=\"noopener\">Hope Card Program<\/a> is intended to make it easier for <span data-term-id=\"39043484\">domestic violence<\/span> victims to get help from <span data-term-id=\"39043507\">law enforcement<\/span>. Information about their injunction is listed on a wallet-sized card for easy access and sharing. Victims can request a Hope Card from the circuit court that issued their injunction.<\/p>\n<h3><strong>Address Confidentiality Program (ACP)<\/strong><\/h3>\n<p>Victims who have fled their abusers and moved to a new home don&#8217;t want to be found. <span data-term-id=\"39043489\">Florida<\/span>&#8216;s <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliii-domestic-relations\/fl-st-sect-741-403\/\" target=\"_blank\" rel=\"noopener\">Address Confidentiality Program (ACP)<\/a> helps with that goal. A victim is given a second mailing address. This is used for all public record documents, such as driver&#8217;s licenses or voter registrations. First-class mail is forwarded to the victim&#8217;s home address.<\/p>\n<p>There is no charge for the ACP. To join, contact the Office of the Attorney General\u2019s Division of Victim Services and Criminal Justice Programs at 1-800-226-6667.<\/p>\n<h3><strong>Employee Protection<\/strong><\/h3>\n<p><span data-term-id=\"39043513\">Victims of <\/span><span data-term-id=\"39043484\">domestic violence<\/span> have special workplace protections. Under <span data-term-id=\"39043499\">Florida<\/span><span data-term-id=\"39043499\"> law<\/span>, they are permitted to <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliii-domestic-relations\/fl-st-sect-741-313\/\" target=\"_blank\" rel=\"noopener\">take up to three days a year off from work to deal with issues<\/a> stemming from <span data-term-id=\"39043484\">domestic violence<\/span> crimes. It&#8217;s up to the employer whether these days are paid or not. It only applies to companies with at least 50 employees, and if the victim has worked there for at least three months.<\/p>\n<p>The employee (or a family or <span data-term-id=\"39043491\">household member<\/span>) must be a victim of domestic or <span data-term-id=\"39043562\">sexual violence<\/span>, and the leave must be used for specific purposes such as seeking an injunction, obtaining medical or mental health care, securing housing, or obtaining legal assistance. Except in emergencies, employees must provide advance notice and may be required to exhaust available paid leave first, unless the employer waives this requirement.<\/p>\n<h2><strong><span data-term-id=\"39043548\">Florida<\/span> <span data-term-id=\"39043548\">Domestic Violence<\/span><span data-term-id=\"39043548\"> Laws<\/span>: Review<\/strong><\/h2>\n<p>As you can see, the <span data-term-id=\"39043484\">domestic violence<\/span> laws in <span data-term-id=\"39043489\">Florida<\/span> are complex.
