The state of Florida, for instance, takes a strict stance on <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/drug-dealing-and-drug-sales-charges.html\">drug offenses<\/a>. It implemented comprehensive drug trafficking laws that cover a wide range of activities.<\/p>\r\n<p>This article examines Florida\u2019s approach to drug trafficking, including drug schedules and the penalties imposed for drug trafficking charges in the state.<\/p>\r\n<h2><b>Understanding Drug Trafficking<\/b><\/h2>\r\n<p>Drug distribution encompasses a wide range of activities related to the illegal transfer of controlled substances. These activities include:<\/p>\r\n<ul>\r\n<li>Delivering a controlled substance<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/state\/florida-law\/florida-drug-cultivation-and-manufacturing-laws.html\">Manufacturing<\/a> a controlled substance<\/li>\r\n<li>Selling or possessing a controlled substance with the intent to sell<\/li>\r\n<\/ul>\r\n<p>Note that drug trafficking applies to all types of controlled substances mentioned under Florida drug laws. The penalties vary depending on the type of drug and the amount involved.<\/p>\r\n<h2><b>Drug Possession, Drug Distribution, and Drug Trafficking Charges<\/b><\/h2>\r\n<p>In Florida, drug possession, drug distribution, and drug trafficking charges are distinct criminal charges. Although they all involve <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/drug-possession-overview.html\">possession of controlled substances<\/a>, they differ based on the intent of the offender and the amount of drugs involved.<\/p>\r\n<p><a href=\"https:\/\/www.findlaw.com\/state\/florida-law\/florida-drug-possession-laws.html\">Drug possession<\/a> often means the criminal act where police find a person in possession of a controlled substance. This drug offense often results in lesser penalties and is less severe compared with drug distribution and trafficking charges.<\/p>\r\n<p>Drug possession could escalate into <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/drug-trafficking-distribution.html#:~:text=Drug%20distribution%20or%20trafficking%20is%20criminalized\">drug trafficking or drug distribution charges<\/a> if the controlled substance possessed by the offender exceeds the threshold amount and if evidence suggests that the offender intended for the delivery, sale, or distribution of the controlled substance. Law enforcement can infer intent to sell or distribute based on the presence of other paraphernalia, such as scales, packaging materials, or large amounts of cash.<\/p>\r\n<p>The key difference between drug distribution and drug trafficking charges lies in the amount of controlled substances. <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xlvi-crimes\/fl-st-sect-893-135\/\" target=\"_blank\" rel=\"noopener\">Florida statute \u00a7 893.135<\/a> addresses drug trafficking charges. This drug offense involves controlled substances that exceed specified thresholds, such as:<\/p>\r\n<ul>\r\n<li>More than 25 pounds of cannabis<\/li>\r\n<li>More than 28 grams of cocaine<\/li>\r\n<li>More than 4 grams of heroin, opium, and similar drugs<\/li>\r\n<li>More than 14 grams of hydrocodone<\/li>\r\n<\/ul>\r\n<p>A conviction for drug trafficking carries severe penalties, with a maximum charge of life imprisonment.<\/p>\r\n<h2><b>Florida Drug Schedules<\/b><\/h2>\r\n<p>Controlled substances are categorized into <a href=\"http:\/\/www.leg.state.fl.us\/STATUTES\/index.cfm?App_mode=Display_Statute&amp;Search_String=&amp;URL=0800-0899\/0893\/Sections\/0893.03.html\" target=\"_blank\" rel=\"noopener\">five drug schedules<\/a>. Schedule I are those that have the highest risk for drug abuse yet have no accepted medical use. On the other end, Schedule V drugs are those that have the lowest risk for drug abuse but have accepted medical use.<\/p>\r\n<ul>\r\n<li><b>Schedule I: <\/b>Drugs viewed as having a high potential for abuse and no accepted medical use. Examples include heroin, LSD, <a href=\"https:\/\/www.findlaw.com\/cannabis-law.html\">cannabis<\/a>, peyote, and psilocybin.<\/li>\r\n<li><b>Schedule II: <\/b>Drugs with a high potential for abuse but have accepted medical use, although with severe restrictions. Some of the drugs under Schedule II are methamphetamine, <a href=\"https:\/\/www.findlaw.com\/state\/criminal-laws\/drug-possession.html\">morphine<\/a>, amphetamine, oxycodone, fentanyl, and Ritalin.<\/li>\r\n<li><b>Schedule III:&nbsp;<\/b>These types of drugs have a lower potential for abuse and are subject to less stringent regulations compared with Schedule II drugs. They also have accepted medical uses. Some examples of Schedule III drugs are <a href=\"https:\/\/medlineplus.gov\/anabolicsteroids.html\" target=\"_blank\" rel=\"noopener\">anabolic steroids<\/a>, testosterone, ketamine, or codeine.<\/li>\r\n<li><b>Schedule IV: <\/b>These types of drugs have a lower potential for abuse compared with Schedule III controlled substances. Some examples of Schedule III drugs are Xanax, Valium, Ativan, Ambien, and <a href=\"https:\/\/www.drugs.com\/tramadol.html\" target=\"_blank\" rel=\"noopener\">tramadol<\/a>.<\/li>\r\n<li><b>Schedule V: <\/b>These types of drugs have the lowest potential for drug abuse compared to Schedule IV controlled substances. Some examples of common medications under Schedule V are cough medicines with 200 milligrams of codeine or less, <a href=\"https:\/\/www.webmd.com\/drugs\/2\/drug-93965\/lyrica-oral\/details\" target=\"_blank\" rel=\"noopener\">Lyrica<\/a>, or Lomotil.<\/li>\r\n<\/ul>\r\n<p>This drug scheduling system determines the penalties associated with drug trafficking.<\/p>\r\n<h2><b>Penalties and Sentences<\/b><\/h2>\r\n<p>The penalties for drug trafficking depend on the type of drug and the quantity involved. Florida law sets a maximum term of thirty years for a first-degree felony. But, state laws also establish specific terms of imprisonment that depend on the type of drug and the amount of drug involved.<\/p>\r\n<p>Some trafficking offenses include mandatory minimum sentences. The punishment escalates when enhancing circumstances are present. <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xlvi-crimes\/fl-st-sect-893-135\/\" target=\"_blank\" rel=\"noopener\">Florida
