A valid durable power of attorney must be signed by the principal in front of two witnesses and a notary public.<\/p>\n\n        <\/div>\n    <\/details>\n<\/section>\n\n\n\n<div><p>A power of attorney (<span data-term-id=\"41287322\">POA<\/span>) is a <span data-term-id=\"41287314\">legal document<\/span> that allows you (the \u201cprincipal\u201d) to grant certain authority to a trusted person (the \u201cagent\u201d or \u201c<span data-term-id=\"41287345\">co-agents<\/span>,\u201d also known as the \u201c<span data-term-id=\"41287304\">attorney-in-fact<\/span>\u201d) to act on your behalf to manage your financial affairs. If the <span data-term-id=\"41287311\">power of attorney document<\/span> includes statute-specific durability language, this authority remains in place even if you become <span data-term-id=\"41287298\">incapacitated<\/span>. In the <span data-term-id=\"41287299\">estate-planning<\/span> context, a <span data-term-id=\"41287297\">durable power of attorney<\/span> (DPOA) is an essential component of <span data-term-id=\"41287300\">incapacity<\/span> planning.<\/p>\n<h2><span data-term-id=\"41287300\">Incapacity<\/span> Planning in <span data-term-id=\"41287296\">Florida<\/span><\/h2>\n<p>A thorough <span data-term-id=\"41287299\">estate plan<\/span> includes your directions about how your estate should be handled at your death as well as during your lifetime if you become <span data-term-id=\"41287298\">incapacitated<\/span>. Including <span data-term-id=\"41287300\">incapacity<\/span> planning means you\u2019ve provided instructions to your <span data-term-id=\"41287347\">family members<\/span> and loved ones not only for after your death but also for your potential <span data-term-id=\"41287300\">incapacity<\/span>. You need two different <span data-term-id=\"41287314\">legal documents<\/span> to fully plan for your <span data-term-id=\"41287300\">incapacity<\/span>. One appoints an agent to manage your financial matters (the focus of this article), while the other appoints an agent to manage your <span data-term-id=\"41287331\">healthcare decisions<\/span>.<\/p>\n<h3><span data-term-id=\"41287297\">Durable Power of Attorney<\/span> for Financial Matters<\/h3>\n<p>If you become <span data-term-id=\"41287298\">incapacitated<\/span> and have a <span data-term-id=\"41287297\">durable power of attorney<\/span>, your agent can usually step in immediately with the authority you\u2019ve granted to control your financial matters. The process can be quick and seamless, allowing continuity in the management of your financial affairs and interactions with <span data-term-id=\"41287302\">financial institutions<\/span>.<\/p>\n<p>Without a <span data-term-id=\"41287297\">durable power of attorney<\/span>, your loved ones may have to initiate a guardianship proceeding so that the court can appoint a guardian to manage your finances during your <span data-term-id=\"41287300\">incapacity<\/span>. The court (<span data-term-id=\"41287306\">probate<\/span> division) will oversee the determination of your <span data-term-id=\"41287300\">incapacity<\/span>, appoint your guardian, and provide ongoing supervision of your guardian\u2019s actions. Not only does this take time and money, but it also means you\u2019ve given up control over who manages your financial matters.<\/p>\n<p>Unless an exception applies, a <span data-term-id=\"41287296\">Florida<\/span> DPOA is <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xl-real-and-personal-property\/fl-st-sect-709-2108\/\" target=\"_blank\" rel=\"noopener\">effective at execution<\/a>. Some states allow a <span data-term-id=\"41287352\">springing power of attorney<\/span> that only takes effect if you become <span data-term-id=\"41287298\">incapacitated<\/span>. <span data-term-id=\"41287296\">Florida<\/span> is not one of them. Possible exceptions to this are a <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xl-real-and-personal-property\/fl-st-sect-709-2106\/\" target=\"_blank\" rel=\"noopener\">military power of attorney<\/a> (which may be effective at deployment) or a DPOA created before October 1, 2011.<\/p>\n<h3>Designation of <span data-term-id=\"41287313\">Health Care Surrogate<\/span><\/h3>\n<p>The agent under a DPOA cannot make <span data-term-id=\"41287331\">healthcare decisions<\/span> on <span data-term-id=\"41287307\">behalf of the principal<\/span>. To name a trusted person to manage your healthcare if you become <span data-term-id=\"41287298\">incapacitated<\/span>, you need a <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliv-civil-rights\/fl-st-sect-765-203\/\" target=\"_blank\" rel=\"noopener\">Designation of <span data-term-id=\"41287313\">Health Care Surrogate<\/span><\/a>. This <span data-term-id=\"41287314\">legal document<\/span> works well for <span data-term-id=\"41287300\">incapacity<\/span> planning in combination with a <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliv-civil-rights\/fl-st-sect-765-303\/\" target=\"_blank\" rel=\"noopener\">living will<\/a>, which is the <span data-term-id=\"41287314\">legal document<\/span> expressing your healthcare wishes. A <span data-term-id=\"41287296\">Florida<\/span> statutory form is available for both.<\/p>\n<p>Unlike a DPOA for financial matters, your agent\u2019s authority under a Designation of <span data-term-id=\"41287313\">Healthcare Surrogate<\/span> may be immediate or springing. The latter means it\u2019s effective only if and when you become <span data-term-id=\"41287298\">incapacitated<\/span>.<\/p>\n<h2>Requirements for a Valid DPOA in <span data-term-id=\"41287296\">Florida<\/span><\/h2>\n<p>Although <span data-term-id=\"41287309\">Florida<\/span><span data-term-id=\"41287309\"> law<\/span> doesn\u2019t provide a safe-harbor DPOA statutory form, it does set out several requirements that must be met for a valid <span data-term-id=\"41287303\">Florida<\/span><span data-term-id=\"41287303\"> power of attorney<\/span>.<\/p>\n<h3>The Framework of a Valid DPOA<\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/fl\/title-xl-real-and-personal-property\/fl-st-sect-709-2105\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41287305\">Florida<\/span><span data-term-id=\"41287305\"> Statutes<\/span><\/a> outline qualifications and document execution requirements for an agent:<\/p>\n<ul>\n<li>The agent must be 18 <span data-term-id=\"41287363\">years of age<\/span><\/li>\n<li>The DPOA must be signed by the principal<\/li>\n<li>The DPOA must be signed by two subscribing witnesses<\/li>\n<li>The DPOA must be acknowledged before a <span data-term-id=\"41287312\">notary<\/span><span data-term-id=\"41287312\"> public<\/span><\/li>\n<\/ul>\n<p>The <span data-term-id=\"41287312\">notary<\/span><span data-term-id=\"41287312\"> public<\/span> may sign on the principal\u2019s behalf if the principal is unable to sign the DPOA.<\/p>\n<h3>Durability Language<\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/fl\/title-xl-real-and-personal-property\/fl-st-sect-709-2104\/\" target=\"_blank\" rel=\"noopener\">Durability language<\/a> is essential for <span data-term-id=\"41287300\">incapacity<\/span> planning. Without it, the authority granted in a power of attorney terminates at the principal\u2019s <span data-term-id=\"41287300\">incapacity<\/span>, which would defeat the purpose. The statute provides safe-harbor durability language: \u201cThis <span data-term-id=\"41287297\">durable power of attorney<\/span> is not terminated by subsequent <span data-term-id=\"41287354\">incapacity<\/span><span data-term-id=\"41287354\"> of the principal<\/span> except as provided in <span data-term-id=\"41287321\">chapter 709<\/span>, <span data-term-id=\"41287305\">Florida<\/span><span data-term-id=\"41287305\"> Statutes<\/span>.\u201d This language, or something similar, must be included for a <span data-term-id=\"41287322\">POA<\/span> to be durable.<\/p>\n<h2>Duties, Powers, and Limitations<\/h2>\n<p>In <span data-term-id=\"41287296\">Florida<\/span>, a <span data-term-id=\"41287297\">durable power of attorney<\/span> grants an agent (or <span data-term-id=\"41287345\">co-agents<\/span>) broad authority to manage financial and legal affairs. That authority is carefully defined, subject to strict <span data-term-id=\"41287316\">fiduciary duties<\/span>, and limited by statute. Understanding the <span data-term-id=\"41287316\">fiduciary duties<\/span> an agent must meet, the scope of an agent\u2019s powers, and the limitations of a DPOA is essential to ensuring the document works within your <span data-term-id=\"41287299\">estate plan<\/span> strategy. Let\u2019s take a look at each one:<\/p>\n<h3>An Agent\u2019s Duties<\/h3>\n<p>An agent under a DPOA is a fiduciary. The agent must act in the principal\u2019s best interests and follow specific statutory duties. These duties are fully enumerated in the <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xl-real-and-personal-property\/fl-st-sect-709-2114\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41287305\">Florida<\/span><span data-term-id=\"41287305\"> Statutes<\/span><\/a>. Highlighted duties include:<\/p>\n<ul>\n<li>The agent must act in <span data-term-id=\"41287333\">good faith<\/span><\/li>\n<li>The agent must act within the scope of authority<\/li>\n<li>The agent must follow the principal\u2019s instructions or intent when known and otherwise act in the principal\u2019s best interest<\/li>\n<li>The agent must be loyal to the principal and avoid conflicts of interest<\/li>\n<li>The agent must keep records<\/li>\n<li>The agent must attempt to preserve the <span data-term-id=\"41287329\">principal\u2019s <\/span><span data-term-id=\"41287299\">estate<\/span><span data-term-id=\"41287299\"> plan<\/span>, if known<\/li>\n<\/ul>\n<p>In addition to covering all of the agent\u2019s duties, the statute also addresses the agent\u2019s potential liability. An agent who acts in <span data-term-id=\"41287333\">good faith<\/span> is not liable to a beneficiary of the <span data-term-id=\"41287329\">principal&#8217;s <\/span><span data-term-id=\"41287299\">estate<\/span><span data-term-id=\"41287299\"> plan<\/span> for failure to preserve it. Absent a breach of duty to the principal, an agent is not liable if the value of the principal&#8217;s property declines.<\/p>\n<h3>Granting Power to Your Agent<\/h3>\n<p>The <span data-term-id=\"41287353\">authority of the agent<\/span> is not unlimited. It depends on the powers you <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xl-real-and-personal-property\/fl-st-sect-709-2201\/\" target=\"_blank\" rel=\"noopener\">specify in the DPOA<\/a>, with heightened requirements for more powerful actions.<\/p>\n<p>Under the <span data-term-id=\"41287297\">durable power of attorney<\/span>, your agent can handle a wide range of financial and legal matters on your behalf to the extent you\u2019ve authorized. These powers may include managing <span data-term-id=\"41287323\">bank accounts<\/span> and <span data-term-id=\"41287318\">financial transactions<\/span>, paying bills, handling investments or your <span data-term-id=\"41287335\">retirement plan<\/span>, accessing your <span data-term-id=\"41287325\">safe-deposit box<\/span>, and conducting <span data-term-id=\"41287315\">real estate<\/span> transactions.<\/p>\n<p>Under <span data-term-id=\"41287309\">Florida<\/span><span data-term-id=\"41287309\"> law<\/span>, some powers must be <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xl-real-and-personal-property\/fl-st-sect-709-2202\/\" target=\"_blank\" rel=\"noopener\">specifically stated and separately signed or initialed by the principal<\/a>. These powers include making gifts, creating or changing trusts, modifying beneficiary designations, or waiving rights.<\/p>\n<p>Some powers cannot legally be delegated<strong>,<\/strong> while others are simply outside the scope of a DPOA. For example, an agent cannot act on the principal\u2019s behalf to:<\/p>\n<ul>\n<li>Make, change or revoke a will<\/li>\n<li>Vote in <span data-term-id=\"41287355\">public elections<\/span><\/li>\n<li>Make <span data-term-id=\"41287331\">healthcare decisions<\/span><\/li>\n<li>Perform purely personal acts or <span data-term-id=\"41287342\">personal services<\/span><\/li>\n<\/ul>\n<p>This is not an exhaustive list.<\/p>\n<h3>Limitations of a DPOA<\/h3>\n<p>A <span data-term-id=\"41287296\">Florida<\/span> DPOA is a powerful tool, but its power is limited to financial and legal matters. The agent\u2019s authority is limited to the powers the document specifically grants, subject to statutory requirements and restrictions. Some authority may not be delegated. The agent\u2019s authority terminates immediately when the principal dies.<\/p>\n<p>A well-drafted DPOA anticipates and addresses these potential gaps and limitations. It can work in conjunction with other <span data-term-id=\"41287299\">estate planning<\/span> strategies.<\/p>\n<h2>How To Make a <span data-term-id=\"41287297\">Durable Power of Attorney<\/span><\/h2>\n<p>Some states provide a fill-in-the-blank statutory form DPOA, but <span data-term-id=\"41287296\">Florida<\/span> is not one of them. You may find that the efficiency and convenience of an <a href=\"https:\/\/www.findlaw.com\/forms\/estate-planning.html\">online <span data-term-id=\"41287297\">Durable Power of Attorney<\/span> form<\/a> suits your needs. If you want to ensure that your DPOA for financial matters coordinates with your other <span data-term-id=\"41287299\">estate planning<\/span> strategies, you may want to consult with a <span data-term-id=\"41287296\">Florida<\/span> <a href=\"https:\/\/lawyers.findlaw.com\/estate-planning\/florida\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41287357\">estate planning<\/span><span data-term-id=\"41287357\"> attorney<\/span><\/a> or <a href=\"https:\/\/lawyers.findlaw.com\/elder-law\/florida\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41287341\">elder law<\/span> attorney<\/a>.<\/p>\n<h2>Terminating a <span data-term-id=\"41287297\">Durable Power of Attorney<\/span><\/h2>\n<p>A DPOA is designed to last for the principal\u2019s <span data-term-id=\"41287300\">incapacity<\/span>, but it doesn\u2019t last forever. A <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xl-real-and-personal-property\/fl-st-sect-709-2109\/\" target=\"_blank\" rel=\"noopener\">DPOA terminates<\/a> in several ways, including when:<\/p>\n<ul>\n<li>The principal dies<\/li>\n<li>The principal revokes the power of attorney through a formal <span data-term-id=\"41287308\">revocation<\/span><\/li>\n<li>The power of attorney terminates by its terms<\/li>\n<li>The purpose of the power of attorney is accomplished<\/li>\n<li>The agent&#8217;s authority terminates, and the power of attorney does not provide for a successor<\/li>\n<\/ul>\n<p>An agent&#8217;s authority terminates when:<\/p>\n<ul>\n<li>The agent dies, becomes <span data-term-id=\"41287298\">incapacitated<\/span>, resigns, or a court removes the agent<\/li>\n<li>The agent is the <span data-term-id=\"41287361\">principal\u2019s spouse<\/span> and an action is filed to end the marriage or legally separate (unless the power of attorney provides otherwise).<\/li>\n<li>The power of attorney terminates<\/li>\n<\/ul>\n<p>Make sure when a DPOA terminates is clearly defined on the document.<\/p>\n<h2>Work With an Experienced <span data-term-id=\"41287296\">Florida<\/span> <span data-term-id=\"41287357\">Estate Planning<\/span><span data-term-id=\"41287357\"> Attorney<\/span><\/h2>\n<p>Meeting with a lawyer can help you understand your options and how to best protect you and your loved ones with a comprehensive <span data-term-id=\"41287299\">estate plan<\/span> that includes <span data-term-id=\"41287300\">incapacity<\/span> planning.
