Prosecutors look for evidence that the person took deliberate steps to carry out the murder, such as:<\/p>\r\n<ul>\r\n<li>Actions taken by the person to prepare for the killing<\/li>\r\n<li>Statements indicating their intent<\/li>\r\n<li>Obtaining weapons to commit the murder<\/li>\r\n<li>Evidence of stalking or &quot;lying in wait&quot;<\/li>\r\n<\/ul>\r\n<p>However, premeditation does not require extensive planning over a long period. Under Florida law, premeditation can form in mere moments before the killing occurs. The defendant need not cause the death or intend for any person to die.<\/p>\r\n<p>This means that even <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-is-complicity-or-accomplice-liability.html\">accomplices<\/a> who never participated or anticipated in violence could face murder charges if a death occurs in the commission of a crime like burglary, robbery, or kidnapping.<\/p>\r\n<h3>Drug Distribution Resulting in Death<\/h3>\r\n<p>The state of Florida treats certain drug-related deaths as first-degree murder. They can also include evidence of <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/factors-considered-in-determining-sentences.html\" title=\"aggravating factors and mitigating circumstances\">aggravating factors and mitigating circumstances<\/a> (discussed in more detail below).<\/p>\r\n<h3>Jury Deliberation Process<\/h3>\r\n<p>After the court hears all the evidence, the jury deliberates and decides if the state has proven at least one aggravating circumstance beyond a reasonable doubt.<\/p>\r\n<p>The jury&#8217;s decision on guilt or innocence must be unanimous. However, <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2023\/450\/\" title=\"under a law passed in 2023\" target=\"_blank\" rel=\"noopener\">under a law passed in 2023<\/a>, a defendant can be sentenced to death if eight out of the 12 jurors agree.<\/p>\r\n<h3>Final Sentencing<\/h3>\r\n<p>Judges have some discretion in the final sentencing phase, depending on the jury&#8217;s decision. If the jury recommends life imprisonment, the court must follow this recommendation and impose that sentence.<\/p>\r\n<p>However, if the jury recommends the death penalty, the judge can choose whether to follow the jury or impose a life sentence instead.<\/p>\r\n<h3>Automatic Appeal<\/h3>\r\n<p>The Florida Supreme Court <a href=\"https:\/\/supremecourt.flcourts.gov\/About-the-Court\/Educational-Resources\/Understanding-Jurisdiction\" target=\"_blank\" rel=\"noopener\">automatically reviews<\/a> all death sentences.<\/p>\r\n<h2>Statutory Aggravating Factors<\/h2>\r\n<p><a href=\"https:\/\/dictionary.findlaw.com\/definition\/aggravating-circumstance.html\" title=\"Aggravating factors\" target=\"_blank\" rel=\"noopener\">Aggravating factors<\/a> are facts of a case that the prosecution uses to argue that a defendant should receive a more severe penalty. Aggravating factors in a first-degree murder case might include:<\/p>\r\n<ul>\r\n<li>The murder was particularly heinous, atrocious, or cruel<\/li>\r\n<li>The defendant has a prior conviction for another capital felony or a felony involving the use or threat of violence<\/li>\r\n<li>The defendant committed the murder while committing other specified felonies such as robbery, sexual battery, child abuse, kidnapping, and arson<\/li>\r\n<li>The murder was carried out for financial (pecuniary) gain<\/li>\r\n<li>The victim was under 12 years old<\/li>\r\n<li>The victim was a public official or an on-duty law enforcement officer&nbsp;<\/li>\r\n<\/ul>\r\n<p>Florida law identifies 16 specific aggravating factors for first-degree murder and other capital felonies under <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xlvii-criminal-procedure-and-corrections\/fl-st-sect-921-141.html\" title=\"\u00a7 921.141(6)\" target=\"_blank\" rel=\"noopener\">\u00a7 921.141(6)<\/a>.<\/p>\r\n<h2>Statutory Mitigating Circumstances<\/h2>\r\n<p><a href=\"https:\/\/dictionary.findlaw.com\/definition\/mitigating-circumstance.html\" title=\"Mitigating circumstances\" target=\"_blank\" rel=\"noopener\">Mitigating circumstances<\/a> that the defense may use to argue against imposition of the death penalty include the following, as stated in \u00a7 921.141(7):<\/p>\r\n<ul>\r\n<li>The defendant has no prior criminal history<\/li>\r\n<li>The defendant committed the felony while under extreme emotional or mental disturbance<\/li>\r\n<li>The defendant acted under duress or domination of another person<\/li>\r\n<li>The defendant&#8217;s age at the time of the commission of the crime<\/li>\r\n<\/ul>\r\n<h2>Florida Self-Defense and Stand Your Ground Laws<\/h2>\r\n<p><a href=\"https:\/\/www.findlaw.com\/state\/florida-law\/florida-self-defense-laws.html\" title=\"Florida&#039;s self-defense laws\">Florida&#8217;s self-defense laws<\/a> provide essential protections for those facing murder charges in certain circumstances. Under what&#8217;s commonly known as the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/states-that-have-stand-your-ground-laws.html\" title=\"&quot;Stand Your Ground&quot; law\">&quot;Stand Your Ground&quot; law<\/a>, you have the right to protect yourself without first attempting to retreat from danger.<\/p>\r\n<ul>\r\n<li><b>For non-deadly force:<\/b> You may use or threaten force (except deadly force) when you reasonably believe it is necessary to defend against someone&#8217;s imminent use of unlawful force.<\/li>\r\n<li><b>For deadly force:<\/b> You may only use or threaten deadly force if you reasonably believe it is necessary to prevent imminent death or great bodily harm to yourself or another person, or to prevent the imminent commission of a forcible felony.<\/li>\r\n<\/ul>\r\n<p><b>The no-retreat provision applies in both scenarios.<\/b> However, the law provides an important condition for deadly force. You must not be engaged in criminal activity yourself. You must be in a place where you have a legal right to be.<\/p>\r\n<h3>Home Protection<\/h3>\r\n<p>Florida law provides stronger protection when you are <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xlvi-crimes\/fl-st-sect-776-013.html\" title=\"defending your home\" target=\"_blank\" rel=\"noopener\">defending your home<\/a>. When you are in your dwelling, you do not have the duty to retreat before using force to protect yourself. The law creates a legal presumption in your favor.<\/p>\r\n<p>If someone is unlawfully and forcibly entering or has entered your home, vehicle, or residence, the law considers it enough to cause a reasonable fear. This reasonable fear justifies the use of deadly force.<\/p>\r\n<p>In addition, Florida&#8217;s home protection statute also presumes that anyone who forcibly enters your dwelling has violent intentions. This further boosts your right to defend yourself in your home.<\/p>\r\n<p>However, note that this presumption does not apply in certain scenarios. For example, if the person you are defending against is a lawful resident of the home or a law enforcement officer performing their official duties.<\/p>\r\n<h2>Heat of Passion Defense<\/h2>\r\n<p>The <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/voluntary-manslaughter-overview.html\">&quot;heat of passion&quot; defense<\/a> can reduce murder charges to manslaughter in some cases. This applies when a killing occurs due to intense emotion triggered by serious provocation.
