They can review your situation and help you understand your options.<\/p>\n<h2>Is <span data-term-id=\"52763537\">Holiday Pay<\/span> Required in <span data-term-id=\"52763531\">Florida<\/span>?<\/h2>\n<p>The short answer is no, at least not for most workers. Your right to <span data-term-id=\"52763537\">holiday pay<\/span> is determined by your employer and the specific terms of your employment agreement.<\/p>\n<p>Under the federal\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/fair-labor-standards-act.html\" target=\"_blank\" rel=\"noopener\">Fair Labor Standards Act (FLSA)<\/a>, employers are not required to pay employees for time not worked, including holidays. <span data-term-id=\"52763531\">Florida<\/span> has no <span data-term-id=\"52763547\">state law<\/span> that adds to this baseline. <span data-term-id=\"52763537\">Holiday pay<\/span> in the private sector is entirely a matter of employer policy, employment contracts, or collective bargaining agreements.<\/p>\n<p>The rules are different for state government workers. If you work for a <span data-term-id=\"52763531\">Florida<\/span> state agency, you are entitled to <span data-term-id=\"52763554\">paid time off<\/span> on the nine holidays designated under <span data-term-id=\"52763546\">Florida<\/span><span data-term-id=\"52763546\"> law<\/span>. In the private sector, your employer decides whether to offer <span data-term-id=\"52763537\">holiday pay<\/span>, which holidays it covers, and how much it pays. Many private employers in retail and food service treat holidays as regular <span data-term-id=\"52763573\">workdays<\/span> and are fully within their legal rights to do so.<\/p>\n<p><span data-term-id=\"52763546\">Florida<\/span><span data-term-id=\"52763546\"> law<\/span> entitles state agency employees to <span data-term-id=\"52763539\">paid holidays<\/span> on nine designated days each year, which are listed below. If a <span data-term-id=\"52763539\">paid <\/span><span data-term-id=\"52763564\">holiday<\/span><span data-term-id=\"52763564\"> falls<\/span> on a Saturday, the preceding Friday is observed. If a <span data-term-id=\"52763564\">holiday falls<\/span> on a Sunday, the following Monday is observed as a holiday. In addition, full-time state employees are granted one extra personal holiday each year.<\/p>\n<p>Employers must not discriminate when granting or denying holiday time off. <span data-term-id=\"52763543\">Federal law<\/span> prohibits decisions based on religion, race, or other protected characteristics when determining who receives a holiday off.<\/p>\n<h2>What Non-Exempt Employees Should Know About Overtime and Holidays<\/h2>\n<p>A common misconception is that working on a holiday automatically triggers <span data-term-id=\"52763569\">overtime pay<\/span>. Under the\u00a0<a href=\"https:\/\/www.dol.gov\/agencies\/whd\/overtime\" target=\"_blank\" rel=\"noopener\">FLSA<\/a>, overtime is calculated based on hours actually worked in a <span data-term-id=\"52763545\">workweek<\/span>, not hours paid. That distinction matters when a <span data-term-id=\"52763564\">holiday falls<\/span> within a regular <span data-term-id=\"52763545\">workweek<\/span>.<\/p>\n<p>If your employer gives you <span data-term-id=\"52763554\">paid time off<\/span> for a holiday, those hours count as paid hours but not as hours worked for overtime purposes. For instance, let\u2019s say that you received eight hours of <span data-term-id=\"52763537\">holiday pay<\/span> and worked 40 hours during the rest of the week. Your total compensation covers 48 hours, but because only 40 were actually worked, no overtime is owed.<\/p>\n<p>If your employer requires you to work on the holiday and your total hours worked that week exceed 40, you are entitled to <span data-term-id=\"52763569\">overtime pay<\/span> for those excess hours. The rate must be at least one-and-a-half times your regular pay. That obligation exists because of the hours worked, not simply because the day is a holiday. The\u00a0<a href=\"https:\/\/www.dol.gov\/agencies\/whd\/fact-sheets\/23-flsa-overtime-pay\" target=\"_blank\" rel=\"noopener\">Department of Labor<\/a>\u00a0confirms that working on a holiday does not automatically trigger overtime. The FLSA only requires overtime when your total hours worked that week cross the 40-hour mark, regardless of which days those hours fall on.<\/p>\n<h2>What Exempt (Salaried) Employees Should Know<\/h2>\n<p>If you are classified as an exempt, salaried employee, a holiday often cannot reduce your weekly paycheck. The FLSA protects exempt employees from having a holiday reduce their paycheck. As long as you do any work during that <span data-term-id=\"52763545\">workweek<\/span>, your employer owes you your full weekly salary, regardless of whether a <span data-term-id=\"52763564\">holiday falls<\/span> in that week.<\/p>\n<p>Your employer may still require you to use accrued <span data-term-id=\"52763572\">vacation time<\/span> or <span data-term-id=\"52763554\">paid time off<\/span> (PTO) to cover a holiday closure. They cannot dock your salary for the holiday, but they can reduce your PTO balance.<\/p>\n<p>If your employer reduces your salary because of a holiday or holiday closure rather than applying PTO, that could raise questions about your exempt classification and may constitute a wage violation. However, most of them choose to do so.<\/p>\n<h2><span data-term-id=\"52763531\">Florida<\/span> <span data-term-id=\"52763544\">Legal Holidays<\/span> Under State Commercial Law<\/h2>\n<p><span data-term-id=\"52763531\">Florida<\/span> also recognizes a broader <a href=\"https:\/\/www.tallahassee.com\/story\/news\/local\/state\/2023\/07\/06\/florida-holidays-all-official-legal-public-days-weeks-and-months-observes\/70382629007\/\" target=\"_blank\" rel=\"noopener\">list of <span data-term-id=\"52763544\">legal holidays<\/span><\/a> and <span data-term-id=\"52763556\">public holidays<\/span> under a separate statute that falls under the state&#8217;s commercial relations laws, not <span data-term-id=\"52763561\">employment law<\/span>. This list is relevant for purposes such as contract deadlines and court filings. It does not require employers to give workers time off or extra pay.<\/p>\n<p>The list includes days unique to <span data-term-id=\"52763531\">Florida<\/span>&#8216;s history and culture, such as:<\/p>\n<ul>\n<li><span data-term-id=\"52763558\">Pascua <\/span><span data-term-id=\"52763558\">Florida<\/span><span data-term-id=\"52763558\"> Day<\/span> (April 2)<\/li>\n<li><span data-term-id=\"52763566\">Confederate <\/span><span data-term-id=\"52763538\">Memorial Day<\/span> (April 26)<\/li>\n<li>Birthday of Robert E. Lee (January 19)<\/li>\n<li>Tuskegee Airmen Commemoration Day (fourth Thursday in March)<\/li>\n<li>Birthday of Jefferson Davis (June 3)<\/li>\n<li><span data-term-id=\"52763550\">Good Friday<\/span><\/li>\n<li><span data-term-id=\"52763567\">General Election Day<\/span><\/li>\n<\/ul>\n<p>The full list includes federally recognized observances and other designated days, such as <span data-term-id=\"52763565\">Washington&#8217;s Birthday<\/span>, <span data-term-id=\"52763552\">Columbus Day<\/span>, Farmers&#8217; Day, Flag Day, and Shrove Tuesday, which is also known as Mardi Gras in counties with organized celebrations.<\/p>\n<h2><span data-term-id=\"52763559\">Federal Holidays<\/span><\/h2>\n<p>Federal employees and bank employees generally receive <span data-term-id=\"52763554\">paid time off<\/span> on <span data-term-id=\"52763559\">federal holidays<\/span>. Private-sector workers may also receive the <span data-term-id=\"52763557\">day off<\/span> or <span data-term-id=\"52763537\">holiday pay<\/span>, depending on their employer&#8217;s policies, but this is not legally required.<\/p>\n<p>The federally recognized holidays are:<\/p>\n<ul>\n<li><span data-term-id=\"52763534\">New Year&#8217;s Day<\/span>: January 1<\/li>\n<li><span data-term-id=\"52763536\">Martin Luther King<\/span>, Jr. Day: Third Monday of January<\/li>\n<li><span data-term-id=\"52763565\">Washington&#8217;s Birthday<\/span>: Third Monday of February<\/li>\n<li><span data-term-id=\"52763538\">Memorial Day<\/span>: <span data-term-id=\"52763575\">Last Monday<\/span> of May<\/li>\n<li>Juneteenth National <span data-term-id=\"52763532\">Independence Day<\/span>: June 19<\/li>\n<li><span data-term-id=\"52763532\">Independence Day<\/span>: July 4<\/li>\n<li><span data-term-id=\"52763535\">Labor Day<\/span>: First Monday of September<\/li>\n<li><span data-term-id=\"52763552\">Columbus Day<\/span>: Second Monday of October<\/li>\n<li><span data-term-id=\"52763533\">Veterans Day<\/span>: November 11<\/li>\n<li>Thanksgiving: Fourth Thursday of November<\/li>\n<li><span data-term-id=\"52763540\">Christmas Day<\/span>: December 25<\/li>\n<\/ul>\n<p>Federal employees in the Washington, D.C. area recognize Inauguration Day (January 20, every four years). However, it is not a nationwide <span data-term-id=\"52763559\">federal holiday<\/span>.<\/p>\n<h2>What if Your Employer Has a Policy Regarding <span data-term-id=\"52763537\">Holiday Pay<\/span>?<\/h2>\n<p>Even though <span data-term-id=\"52763546\">Florida<\/span><span data-term-id=\"52763546\"> law<\/span> does not require <span data-term-id=\"52763537\">holiday pay<\/span>, employers who voluntarily adopt a <span data-term-id=\"52763537\">holiday pay<\/span> policy are expected to apply it consistently. If your employer promised <span data-term-id=\"52763537\">holiday pay<\/span> in an offer letter, handbook, or contract, that promise may be enforceable under contract law.
