The following are considered void or voidable.<\/p>\n<ul>\n<li><strong>Marriage Between Close Blood Relatives<\/strong>: <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliii-domestic-relations\/fl-st-sect-741-21\/\" target=\"_blank\" rel=\"noopener\">Under <span data-term-id=\"49450179\">Florida<\/span><span data-term-id=\"49450179\"> law<\/span><\/a>, marriage between siblings, parents, children, and close blood relatives is prohibited<\/li>\n<li><strong>Bigamous Marriages<\/strong>: Marrying while still legally married to someone else constitutes\u00a0<a href=\"https:\/\/codes.findlaw.com\/fl\/title-xlvi-crimes\/fl-st-sect-826-01.html\/\" target=\"_blank\" rel=\"noopener\">bigamy, a third-degree felony<\/a>, and carries penalties that include up to five years in prison and fines up to $5,000<\/li>\n<li><strong>Party Lacks Mental Capacity<\/strong>: A person who lacks the mental capacity to understand marriage and its obligations cannot enter into a valid marriage in <span data-term-id=\"49450176\">Florida<\/span>, including cases of severe intoxication or incapacity during the ceremony<\/li>\n<\/ul>\n<p>Other instances may also qualify as a voidable marriage.<\/p>\n<h2><strong>The <span data-term-id=\"49450187\">Marriage Ceremony<\/span><\/strong><\/h2>\n<p><span data-term-id=\"49450179\">Florida<\/span><span data-term-id=\"49450179\"> law<\/span> also sets rules for conducting the <span data-term-id=\"49450187\">marriage ceremony<\/span>. This includes who can legally perform it and who must be present.<\/p>\n<h3><strong>Who Can Perform Marriages<\/strong><\/h3>\n<p>Under\u00a0<span data-term-id=\"49450179\">Florida<\/span><span data-term-id=\"49450179\"> law<\/span>, the following individuals may <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliii-domestic-relations\/fl-st-sect-741-07\/\" target=\"_blank\" rel=\"noopener\">perform a legal <span data-term-id=\"49450187\">marriage ceremony<\/span><\/a> in <span data-term-id=\"49450176\">Florida<\/span>:<\/p>\n<ul>\n<li><span data-term-id=\"49450221\">Regularly ordained ministers of the gospel<\/span>, elders in communion with a church, or other ordained clergy<\/li>\n<li><span data-term-id=\"49450216\">Judicial officers<\/span>, including retired <span data-term-id=\"49450216\">judicial officers<\/span><\/li>\n<li><span data-term-id=\"49450183\">Clerks of the circuit courts<\/span><\/li>\n<li><span data-term-id=\"49450201\">Notaries public<\/span> authorized by the state<\/li>\n<\/ul>\n<p>Members of the Society of Friends, known as Quakers, may marry according to their own rites and ceremonies. <span data-term-id=\"49450176\">Florida<\/span> recognizes those marriages as valid. <span data-term-id=\"49450179\">Florida<\/span><span data-term-id=\"49450179\"> law<\/span> also allows <span data-term-id=\"49450201\">notaries public<\/span> to perform marriages, a unique feature not recognized in most other states.<\/p>\n<h3><strong>Witness Requirements<\/strong><\/h3>\n<p><span data-term-id=\"49450176\">Florida<\/span> does not require witnesses to be present at the wedding ceremony. Only the couple and an officiant must be present and sign the <span data-term-id=\"49450192\">Florida<\/span> <span data-term-id=\"49450177\">marriage license<\/span>.<\/p>\n<h3><strong>Solemnization and Recording<\/strong><\/h3>\n<p>The ceremony must occur after the license&#8217;s <span data-term-id=\"49450196\">effective date<\/span> and during the 60-day expiration window. Within 10 days after the ceremony, the officiant must sign and return the license to the issuing clerk for official recording as a <span data-term-id=\"49450198\">marriage certificate<\/span>.<\/p>\n<h2><strong><span data-term-id=\"49450222\">Legal Rights<\/span> and Responsibilities<\/strong><\/h2>\n<p>Getting married in <span data-term-id=\"49450176\">Florida<\/span> creates <span data-term-id=\"49450222\">legal rights<\/span> and responsibilities that take effect immediately. These cover everything from how your property is handled to who can make medical decisions on your behalf.<\/p>\n<h3><strong>Property Rights<\/strong><\/h3>\n<p><span data-term-id=\"49450176\">Florida<\/span> is not a community property state. Instead, it follows <span data-term-id=\"49450220\">equitable distribution<\/span>. In a divorce, marital assets and liabilities are divided fairly, starting with a presumption of equal split. Property is not automatically shared 50\/50 upon marriage.<\/p>\n<p>Marital property includes assets and debts acquired during marriage. Property owned before marriage or received as a gift or inheritance is usually non-marital. Mixing non-marital assets with marital funds can complicate this distinction.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/fl\/florida-constitution1968-revision\/fl-const-art-10-sect-4\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"49450176\">Florida<\/span>&#8216;s Constitution<\/a>\u00a0also provides strong homestead protections for a <span data-term-id=\"49450202\">married couple<\/span>&#8216;s primary residence. A spouse generally cannot sell or mortgage the family homestead without the other spouse&#8217;s joinder.<\/p>\n<h3><strong>Financial Obligations<\/strong><\/h3>\n<p>Marriage creates mutual financial obligations between spouses. Under\u00a0<a href=\"https:\/\/codes.findlaw.com\/fl\/title-vi-civil-practice-and-procedure\/fl-st-sect-61-09\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"49450179\">Florida<\/span><span data-term-id=\"49450179\"> law<\/span><\/a>, a spouse who can contribute to the other&#8217;s support but fails to do so can be compelled by a court to pay, even outside divorce proceedings.<\/p>\n<p>Getting married also changes your federal tax filing status. If you become incapacitated and have not created an advance directive or formally designated a healthcare surrogate, your <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliv-civil-rights\/fl-st-sect-765-401\/\" target=\"_blank\" rel=\"noopener\">spouse is first in the statutory priority order<\/a> to serve as your healthcare proxy and make medical decisions on your behalf. Spouses also have hospital visitation rights. This protection does not automatically extend to unmarried partners.<\/p>\n<h3><strong>Parental Rights<\/strong><\/h3>\n<p><span data-term-id=\"49450179\">Florida<\/span><span data-term-id=\"49450179\"> law<\/span> presumes that a child born during a valid marriage is the legal child of both spouses. The <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xxix-public-health\/fl-st-sect-382-013\/\" target=\"_blank\" rel=\"noopener\">husband&#8217;s name is entered on the <span data-term-id=\"49450225\">birth certificate<\/span><\/a> as the father. It establishes both spouses as legal parents, forming the basis for each parent&#8217;s rights and obligations toward the child, including the duty of support.<\/p>\n<h3><strong>Name Change<\/strong><\/h3>\n<p>Marriage gives you the option to change your surname, but it is not required. If you decide to do so, you will need to update your Social Security card, <span data-term-id=\"49450176\">Florida<\/span> <span data-term-id=\"49450191\">driver&#8217;s license<\/span>, passport, and other <span data-term-id=\"49450218\">official records<\/span>. No matter how long two people have lived together, cohabitation alone does not create a legal marriage in <span data-term-id=\"49450176\">Florida<\/span>. A narrow exception holds that a marriage that would otherwise be defective\u00a0<a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliii-domestic-relations\/fl-st-sect-741-211\/#:~:text=No%20common%2Dlaw%20marriage%20entered,substantial%20compliance%20with%20this%20chapter.\" target=\"_blank\" rel=\"noopener\">may still be valid if the parties entered into it in good faith<\/a>\u00a0and in substantial compliance with\u00a0<span data-term-id=\"49450179\">Florida<\/span><span data-term-id=\"49450179\">\u00a0law<\/span>.<\/p>\n<h2><strong>Same-Sex Marriage<\/strong><\/h2>\n<p><span data-term-id=\"49450176\">Florida<\/span> has recognized same-sex marriage since January 6, 2015. That followed a U.S. District Court ruling in\u00a0<a href=\"https:\/\/www.findlaw.com\/family\/marriage\/states-that-allow-same-sex-marriage.html#:~:text=Florida,January%206%2C%202015.\"><em>Brenner v. Scott<\/em><\/a>, which held that <span data-term-id=\"49450176\">Florida<\/span>&#8216;s ban on same-sex marriage violated the U.S. Constitution. The U.S. Supreme Court later extended that right nationwide in\u00a0<a href=\"https:\/\/supreme.findlaw.com\/supreme-court-insights\/obergefell-v-hodges-case-summary-and-significance.html\" target=\"_blank\" rel=\"noopener\"><em>Obergefell v. Hodges<\/em><\/a>, decided June 26, 2015. Under both <span data-term-id=\"49450176\">Florida<\/span> and federal law, same-sex couples face the same marriage requirements and hold the same <span data-term-id=\"49450222\">legal rights<\/span> and responsibilities as opposite-sex couples.<\/p>\n<h2><strong>Estate Planning Considerations<\/strong><\/h2>\n<p>After getting married, one of the first things to do is update your beneficiary designations for life insurance policies, retirement accounts, and investment accounts. If you do not update them, a former beneficiary or no named beneficiary at all could receive those assets regardless of your wishes.<\/p>\n<p>Having a will is important. If you pass away without a will, a probate court distributes your property according to\u00a0<a href=\"https:\/\/www.findlaw.com\/estate\/planning-an-estate\/intestate-succession-laws-by-state.html\"><span data-term-id=\"49450176\">Florida<\/span>&#8216;s intestate succession laws<\/a>, which may not reflect what you would have wanted.<\/p>\n<p>A will also lets you\u00a0<a href=\"https:\/\/codes.findlaw.com\/fl\/title-xliii-domestic-relations\/fl-st-sect-744-3046\/\" target=\"_blank\" rel=\"noopener\">nominate a guardian<\/a>\u00a0for your minor children. A court must still approve the appointment and is not bound by your nomination, but naming someone creates a rebuttable presumption in their favor. Without a nomination, the court makes that decision without the benefit of your stated wishes. A\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/estate-planning\/florida\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"49450176\">Florida<\/span> estate planning attorney<\/a>\u00a0can help you get both documents in order.<\/p>\n<h2><strong>Prenuptial and Postnuptial Agreements<\/strong><\/h2>\n<p>If you want to define property rights and financial expectations before or during your marriage, consider <a href=\"https:\/\/codes.findlaw.com\/fl\/title-vi-civil-practice-and-procedure\/fl-st-sect-61-079\/\" target=\"_blank\" rel=\"noopener\">having a premarital<\/a>\u00a0or postnuptial agreement. For the agreement to be valid in court, both parties must have entered the agreement voluntarily and free from fraud, duress, coercion, or overreaching.<\/p>\n<p>A court may refuse to enforce an agreement that was unconscionable at the time of signing. This applies in particular if one party was not given fair and reasonable disclosure of the other&#8217;s financial obligations and did not waive that right in writing.
