The <span data-term-id=\"52763862\">FLSA<\/span> <span data-term-id=\"52763898\">mandates<\/span> that employers pay at least one-and-a-half times your regular rate for these hours, often called &#8220;<span data-term-id=\"52763891\">time and a half<\/span>.&#8221;<\/p>\n<p>Employers must calculate overtime on a week-by-week basis. If an <span data-term-id=\"52763887\">employee works<\/span> 38 hours one week and 42 the next, their employer cannot average the two weeks to avoid paying overtime. Only hours over 40 in a single <span data-term-id=\"52763865\">workweek<\/span> count toward overtime.<\/p>\n<h2>Why <span data-term-id=\"52763870\">Federal Law<\/span> Controls Overtime in Florida<\/h2>\n<p>Florida does not have its own <span data-term-id=\"52763864\">overtime law<\/span>. The Florida Constitution sets the minimum wage but does not mention overtime, leaving <a href=\"https:\/\/www.dol.gov\/agencies\/whd\/flsa\" target=\"_blank\" rel=\"noopener\">the <span data-term-id=\"52763862\">FLSA<\/span><\/a>\u00a0as the only law that covers <span data-term-id=\"52763861\">overtime pay<\/span> in Florida.<\/p>\n<p>This affects Florida workers in several ways.<\/p>\n<ul>\n<li><strong>No additional state protections<\/strong>: Florida workers receive only the protections set by <span data-term-id=\"52763870\">federal law<\/span>. They do not get daily overtime, double-time pay, or other hours-based rules that exist in some states.<\/li>\n<li><strong>Federal enforcement<\/strong>:\u00a0The\u00a0<a href=\"https:\/\/www.dol.gov\/agencies\/whd\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52763892\">U.S. Department of Labor<\/span>&#8216;s <span data-term-id=\"52763910\">Wage and Hour Division<\/span><\/a>\u00a0(WHD) enforces <span data-term-id=\"52763873\">overtime rules<\/span> in Florida. Workers may also file private lawsuits.<\/li>\n<li><strong>Federal <span data-term-id=\"52763866\">exemptions<\/span> apply<\/strong>:\u00a0the\u00a0<span data-term-id=\"52763866\">exemptions<\/span>\u00a0that excuse employers from paying overtime are set forth in the <span data-term-id=\"52763862\">FLSA<\/span>. There are no overtime provisions under Florida law.<\/li>\n<\/ul>\n<p><span data-term-id=\"52763893\">Florida\u2019s minimum wage<\/span> is set by the state constitution and is higher than the federal minimum. This does not change how <span data-term-id=\"52763861\">overtime pay<\/span> is computed.<\/p>\n<h2>Who Qualifies for <span data-term-id=\"52763861\">Overtime Pay<\/span> in Florida?<\/h2>\n<p>Under the <span data-term-id=\"52763862\">FLSA<\/span>, most <span data-term-id=\"52763909\">hourly workers<\/span> and salaried workers are entitled to overtime. The law divides employees into two categories. &#8220;Non-exempt&#8221; employees are eligible for <span data-term-id=\"52763861\">overtime pay<\/span>, while &#8220;exempt&#8221; employees are not.<\/p>\n<p>Non-exempt status is the default. To classify you as exempt, the employer must show that it meets all federal requirements. This usually means paying a minimum salary\u00a0and assigning <span data-term-id=\"52763876\">job duties<\/span> that fit a recognized <span data-term-id=\"52763866\">exemption<\/span>.<\/p>\n<p>A <span data-term-id=\"52763908\">job title<\/span> alone does not determine exempt status. What matters is what you actually do day-to-day and how you are paid.<\/p>\n<h2>Common Overtime Myths<\/h2>\n<p>There are many misconceptions about <span data-term-id=\"52763873\">overtime rules<\/span>, which lead to confusion. Some mistaken beliefs include:<\/p>\n<ul>\n<li><strong><span data-term-id=\"52763875\">Salaried employees<\/span> never get overtime<\/strong>:\u00a0This is false. Many salaried workers are non-exempt and entitled to overtime. The <span data-term-id=\"52763902\">salary basis<\/span> alone does not exempt anyone.<\/li>\n<li><strong>Your boss said you are exempt, so you are<\/strong>:\u00a0Employer classification is not binding. If your duties and pay do not meet federal tests, you are non-exempt regardless of what your offer letter or <span data-term-id=\"52763886\">employment contract<\/span> says.<\/li>\n<li><strong>You agreed to waive overtime<\/strong>:\u00a0Employees cannot waive overtime rights, even in writing. Any such agreement is unenforceable.<\/li>\n<li><strong>Your employer can give you comp time instead of <span data-term-id=\"52763861\">overtime pay<\/span><\/strong>: This is rarely true in the private sector. Only government employers may offer paid time off in lieu of <span data-term-id=\"52763877\">overtime wages<\/span>.<\/li>\n<\/ul>\n<p>If the <span data-term-id=\"52763862\">FLSA<\/span> indicates that you\u2019re eligible for overtime, your employer\u2019s opinion doesn\u2019t matter.<\/p>\n<h2>Who Is Exempt From Overtime?<\/h2>\n<p>The <span data-term-id=\"52763862\">FLSA<\/span> recognizes several categories of exempt workers. The most commonly invoked are the\u00a0<a href=\"https:\/\/www.dol.gov\/agencies\/whd\/fact-sheets\/17a-overtime\" target=\"_blank\" rel=\"noopener\">white-collar <span data-term-id=\"52763866\">exemptions<\/span><\/a>, which cover:<\/p>\n<ul>\n<li><strong>Executive employees<\/strong>\u00a0whose <span data-term-id=\"52763901\">primary duty<\/span> is managing the business or a department. They must direct the work of at least two full-time employees and have authority to hire or fire, or whose recommendations on these matters carry particular weight.<\/li>\n<li><strong>Administrative employees<\/strong>\u00a0whose main duty is office work or non-manual work that is directly related to the general business or management operations. They must use their discretion and independent judgment on important matters.<\/li>\n<li><strong><span data-term-id=\"52763878\">Professional employees<\/span><\/strong>, sometimes referred to as the &#8220;learned professional&#8221; <span data-term-id=\"52763866\">exemption<\/span>. To qualify, the role must involve work that depends on specialized expertise in a scientific or academic discipline. It is generally obtained through extended formal education. This category also extends to creative professionals whose duties call for originality, invention, or artistic talent.<\/li>\n<li><strong>Computer employees<\/strong>\u00a0engaged in systems analysis, programming, software engineering, or similar work. Others in this field may also be considered exempt.<\/li>\n<li><strong><span data-term-id=\"52763913\">Outside sales employees<\/span>\u00a0<\/strong>who primarily work in the field, generating sales or obtaining contracts and orders. In most cases, the employer&#8217;s office is a secondary location.<\/li>\n<\/ul>\n<p>To qualify for the executive, administrative, or professional <span data-term-id=\"52763866\">exemptions<\/span>, your <span data-term-id=\"52763902\">salary basis<\/span> must be at least\u00a0<a href=\"https:\/\/www.ecfr.gov\/current\/title-29\/subtitle-B\/chapter-V\/subchapter-A\/part-541\/subpart-G\" target=\"_blank\" rel=\"noopener\">$684 per week<\/a>. This equals $35,568 per year.<\/p>\n<p>The <span data-term-id=\"52763892\">U.S. Department of Labor<\/span> (<span data-term-id=\"52763900\">DOL<\/span>) raised the threshold in 2024, but a federal court\u00a0<a href=\"https:\/\/www.dol.gov\/newsroom\/releases\/whd\/whd20260514\" target=\"_blank\" rel=\"noopener\">struck it down<\/a>. On May 15, 2026, the <span data-term-id=\"52763900\">DOL<\/span> published a technical amendment that formally rejected the 2024 rule and restored the 2019 salary levels. It confirmed $684 per week as the current federal threshold.<\/p>\n<p>Another <span data-term-id=\"52763866\">exemption<\/span> applies to a\u00a0<a href=\"https:\/\/www.dol.gov\/agencies\/whd\/fact-sheets\/17h-overtime-highly-compensated\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52763890\">Highly Compensated Employee<\/span> (HCE)<\/a> who earns at least $107,432 in total annual salary. Of that amount, $684 per week should come from a salary or fee basis. The worker must also perform at least one duty<a href=\"https:\/\/www.ecfr.gov\/current\/title-29\/subtitle-B\/chapter-V\/subchapter-A\/part-541\/subpart-G\/section-541.601\" target=\"_blank\" rel=\"noopener\"> of an exempt executive, administrative, or <span data-term-id=\"52763878\">professional employee<\/span><\/a> on a regular basis. The HCE <span data-term-id=\"52763866\">exemption<\/span> uses a less rigorous duties test than the standard white-collar <span data-term-id=\"52763866\">exemptions<\/span>. A high level of compensation is itself a strong indicator of exempt status.<\/p>\n<h3>Industry-Specific <span data-term-id=\"52763866\">Exemptions<\/span><\/h3>\n<p>The <span data-term-id=\"52763862\">FLSA<\/span> exempts certain industries from overtime. These include:<\/p>\n<ul>\n<li>Most truck drivers and other transportation workers regulated by the\u00a0<a href=\"https:\/\/www.dol.gov\/agencies\/whd\/fact-sheets\/19-flsa-motor-carrier\" target=\"_blank\" rel=\"noopener\">U.S. Department of Transportation<\/a><\/li>\n<li>Railroad employees covered by the Railway Labor Act<\/li>\n<li>Many farmworkers and agricultural employees<\/li>\n<li>Certain seasonal amusement or recreational establishment workers<\/li>\n<li>Fishing industry workers<\/li>\n<li>Certain commissioned employees of retail or service establishments<\/li>\n<\/ul>\n<p>If you\u2019re not sure what your classification should be, consider speaking with a <a href=\"https:\/\/lawyers.findlaw.com\/employment\/florida\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52763918\">Florida <\/span><span data-term-id=\"52763880\">employment<\/span><span data-term-id=\"52763880\"> law<\/span> attorney<\/a>.<\/p>\n<h3>Determining <span data-term-id=\"52763866\">Exemption<\/span> Status<\/h3>\n<p>You are not automatically exempt just because you receive a salary instead of an <span data-term-id=\"52763897\">hourly wage<\/span>, hold a title with &#8220;manager,&#8221; &#8220;supervisor,&#8221; or &#8220;director&#8221;, earn a high income, or work remotely from home. The <span data-term-id=\"52763890\">Highly Compensated Employee<\/span> <span data-term-id=\"52763866\">exemption<\/span> is a narrow exception, not a general rule, that prevents high earners from receiving <span data-term-id=\"52763861\">overtime pay<\/span>.<\/p>\n<h2>How Overtime Is Calculated in Florida<\/h2>\n<p>Calculating <span data-term-id=\"52763861\">overtime pay<\/span> requires knowing a few basic facts. Under the <span data-term-id=\"52763862\">FLSA<\/span> regulations, a <span data-term-id=\"52763865\">workweek<\/span> is a fixed or recurring period of 168 hours. It can also be seven consecutive 24-hour days.<\/p>\n<p>The <span data-term-id=\"52763865\">workweek<\/span> does not need to run from Sunday to Saturday. Your employer can set it to begin on any day. Once established, your employer cannot simply change it to avoid paying overtime. Your hours from two different <span data-term-id=\"52763865\">workweeks<\/span> can\u2019t be averaged to keep you from receiving deserved <span data-term-id=\"52763861\">overtime pay<\/span>.<\/p>\n<h3>Calculating the Regular Rate<\/h3>\n<p><span data-term-id=\"52763861\">Overtime pay<\/span> is one-and-a-half times your <span data-term-id=\"52763872\">regular rate of pay<\/span>. Your regular rate might differ from the <span data-term-id=\"52763874\">hourly rate<\/span> listed in your offer letter.<\/p>\n<p>For <span data-term-id=\"52763895\">hourly employees<\/span>, the regular rate is the <span data-term-id=\"52763874\">hourly rate<\/span>. For salaried <span data-term-id=\"52763867\">non-exempt employees<\/span>, the salary is divided by the <span data-term-id=\"52763881\">number of hours<\/span> it is intended to cover to find the regular rate. Employees who earn bonuses or commissions must have non-discretionary bonuses and commissions added to the regular rate. Only certain payments, such as discretionary bonuses, gifts, and expense reimbursements, are excluded.<\/p>\n<h3>The Overtime Formula<\/h3>\n<p>The formula is regular rate times 1.5, times the number of <span data-term-id=\"52763868\">overtime hours<\/span>. Each week, you get your <span data-term-id=\"52763905\">regular pay<\/span> for the first 40 hours and <span data-term-id=\"52763861\">overtime pay<\/span> for any hours over a <span data-term-id=\"52763903\">40-hour <\/span><span data-term-id=\"52763865\">workweek<\/span>. For example, if you earn $20 per hour and work 45 hours, you would get $800 for the first 40 hours and $150 for 5 <span data-term-id=\"52763868\">overtime hours<\/span>, for a total of $950.<\/p>\n<h3>What Counts as &#8220;Hours Worked&#8221;<\/h3>\n<p>Disputes often arise when discussing which activities count toward the 40-hour threshold. In general, the following count as compensable time:<\/p>\n<ul>\n<li>On-call time when your freedom is significantly restricted<\/li>\n<li>Mandatory training time<\/li>\n<li>Certain travel time between job sites during the workday<\/li>\n<li>Waiting time when you are &#8220;engaged to wait,&#8221; meaning required to remain available, rather than &#8220;waiting to be engaged&#8221;<\/li>\n<\/ul>\n<p>Meal breaks of 30 minutes or more are usually unpaid, provided you are completely relieved of work duties during the break.<\/p>\n<h2>Common Overtime Violations<\/h2>\n<p>Most wage-and-hour violations in Florida stem from a few common practices. These include the following:<\/p>\n<ul>\n<li>Misclassifying employees as exempt when their <span data-term-id=\"52763876\">job duties<\/span> do not meet the legal test<\/li>\n<li>Treating employees as <span data-term-id=\"52763888\">independent contractors<\/span><\/li>\n<li>Requiring off-the-clock work<\/li>\n<li>Averaging hours across <span data-term-id=\"52763865\">workweeks<\/span> to avoid overtime<\/li>\n<li>Offering comp time instead of <span data-term-id=\"52763861\">overtime pay<\/span> in the private sector<\/li>\n<li>Not including non-discretionary bonuses or commissions in the regular rate, and<\/li>\n<li>Automatically deducting meal breaks even when you worked through lunch<\/li>\n<\/ul>\n<p>If you experience any overtime violations at work, reach out to <a href=\"https:\/\/lawyers.findlaw.com\/employment\/florida\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">an employment attorney<\/a>. Only government employers may offer comp time at the rate of one-and-a-half hours off for each <span data-term-id=\"52763868\">overtime hour<\/span> worked.<\/p>\n<p>Your employer must also agree on an arrangement before you can perform <span data-term-id=\"52763884\">overtime work<\/span>. For most public employees, federal regulations cap <a href=\"https:\/\/www.ecfr.gov\/current\/title-29\/subtitle-B\/chapter-V\/subchapter-A\/part-553\/subpart-A\/subject-group-ECFRb5efe4232465438\/section-553.24\" target=\"_blank\" rel=\"noopener\">accruals at 240 hours<\/a> for some employees and 480 hours for police, firefighters, and emergency response personnel. Private employers must pay overtime in wages.<\/p>\n<h2>How To File an Overtime Complaint in Florida<\/h2>\n<p>If you believe your employer failed to pay your proper <span data-term-id=\"52763885\">overtime rates<\/span>, you have several options. These include:<\/p>\n<ul>\n<li><strong>Document your hours and wages<\/strong>:\u00a0Keep personal records of hours worked, pay stubs, and any communications about your schedule or classification<\/li>\n<li><strong>Raise the issue internally first, if you choose<\/strong>:\u00a0Some workers prefer to start with HR, while others go straight to a government agency<\/li>\n<li><strong>File a complaint with the <span data-term-id=\"52763892\">U.S. Department of Labor<\/span>&#8216;s <span data-term-id=\"52763910\">Wage and Hour Division<\/span><\/strong>:\u00a0You can submit complaints online or in person at a Florida\u00a0<a href=\"https:\/\/www.dol.gov\/agencies\/whd\/contact\/local-offices\" target=\"_blank\" rel=\"noopener\">WHD office<\/a><\/li>\n<li><strong>Consider a private lawsuit<\/strong>:\u00a0You can also file your own lawsuit to recover <span data-term-id=\"52763915\">unpaid wages<\/span><\/li>\n<\/ul>\n<p>Filing a lawsuit can be tricky and perhaps not worth it if the amount involved isn\u2019t enough. If your employer acted willfully, the deadline extends to three years. A willful violation means your employer knew or should have known its actions were against the law.<\/p>\n<h2>Remedies for Unpaid Overtime<\/h2>\n<p>A successful overtime claim under the <span data-term-id=\"52763862\">FLSA<\/span> can result in <span data-term-id=\"52763914\">back pay<\/span> for unpaid overtime, depending on whether the violation was willful. You may also retrieve liquidated damages equivalent to the amount of <span data-term-id=\"52763914\">back pay<\/span>, reasonable <span data-term-id=\"52763904\">attorney&#8217;s fees<\/span>, and court costs. There is no statutory cap on damages.<\/p>\n<p>The court can reduce or eliminate liquidated damages if your employer can show that they acted in good faith and had reasonable grounds to believe it was complying with the law.
