Under this <span data-term-id=\"40881912\">state law<\/span>, employers cannot deny you work because of your <span data-term-id=\"40881905\">union membership<\/span> status or lack thereof.<\/p>\n<p>This means employers cannot require you to join a union or pay <span data-term-id=\"40881922\">union dues<\/span> as a condition of getting or keeping a job. Whether you choose to join a union is entirely up to you. Employers cannot use your <span data-term-id=\"40881945\">non-membership<\/span> as grounds to deny you employment. They also cannot use it to change your <span data-term-id=\"40881913\">employment contract<\/span> or discriminate against you.<\/p>\n<p>The same constitutional section also protects <span data-term-id=\"40881904\">collective bargaining<\/span> rights. Employees have the right to organize and bargain collectively through a <span data-term-id=\"40881908\">labor organization<\/span>. As government workers, <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0400-0499\/0447\/Sections\/0447.505.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40881910\">public employees<\/span><\/a> in <span data-term-id=\"40881899\">Florida<\/span> do not have the right to strike.<\/p>\n<h2><strong>Right-To-Work vs. At-Will Employment: Know the Difference<\/strong><\/h2>\n<p>It\u2019s common to conflate right-to-work with at-will employment. These are separate legal concepts governing different aspects of the <span data-term-id=\"40881929\">employment relationship<\/span>.<\/p>\n<p><strong><span data-term-id=\"40881902\">Right-to-work laws<\/span><\/strong> are about your right to choose whether to join a union. Employers cannot require you to join a union, pay <span data-term-id=\"40881922\">union dues<\/span>, or support a <span data-term-id=\"40881908\">labor organization<\/span> as a condition of getting or keeping a job. An employer cannot use your <span data-term-id=\"40881905\">union membership<\/span> status against you, whether you choose to join or not.<\/p>\n<p><strong>At-will employment<\/strong> governs how and when your employment can end. In <a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/at-will-employee-faq-s.html\"><span data-term-id=\"40881937\">at-will employment states<\/span><\/a>, either you or your employer can end the working relationship at any time. It can be for any reason or no reason at all. However, this doctrine has important exceptions. Employers cannot terminate you based on protected characteristics. These include race, sex, religion, disability, <span data-term-id=\"40881933\">marital status<\/span>, or <span data-term-id=\"40881920\">national origin<\/span>.<\/p>\n<p>At-will employment also protects employees against retaliation for exercising their rights. This includes filing a <span data-term-id=\"40881928\">workers&#8217; compensation<\/span> claim or pursuing a <span data-term-id=\"40881919\">wrongful termination<\/span> lawsuit. It also includes protections for\u00a0<span data-term-id=\"40881918\">whistleblowers<\/span>\u00a0who report unlawful conduct.<\/p>\n<h2><strong>Employer Obligations Under <span data-term-id=\"40881899\">Florida<\/span>&#8216;s <span data-term-id=\"40881902\">Right-To-Work Law<\/span><\/strong><\/h2>\n<p><span data-term-id=\"40881917\">The state of <\/span><span data-term-id=\"40881899\">Florida<\/span>&#8216;s <span data-term-id=\"40881902\">right-to-work law<\/span> places specific requirements on employers as well. Employers cannot enter into agreements that make <span data-term-id=\"40881905\">union membership<\/span> a condition for hiring. This means that <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/union-shops-closed-shops-and-the-law.html\">&#8220;closed shop&#8221;<\/a> arrangements, in which employers hire only <span data-term-id=\"40881947\">union members<\/span>, are unconstitutional in <span data-term-id=\"40881899\">Florida<\/span>. Even if an employee initially joins a union, employers cannot make continued <span data-term-id=\"40881905\">union membership<\/span> a requirement for keeping that job.<\/p>\n<p>It is also important to remember that right-to-work does not eliminate <span data-term-id=\"40881904\">collective bargaining<\/span>. Employers can still negotiate and maintain <span data-term-id=\"40881915\">collective bargaining<\/span><span data-term-id=\"40881915\"> agreements<\/span> with unions. These agreements can cover wages, hours, <span data-term-id=\"40881932\">working conditions<\/span>, and other employment terms. The limitation is that these agreements cannot include mandatory <span data-term-id=\"40881905\">union membership<\/span> or dues provisions.<\/p>\n<h2><strong>Special Rules for <span data-term-id=\"40881910\">Public Employees<\/span><\/strong><\/h2>\n<p>Government workers in <span data-term-id=\"40881899\">Florida<\/span> face additional restrictions other than the standard right-to-work provisions. The most significant restriction is the prohibition on strikes.\u00a0<a href=\"https:\/\/codes.findlaw.com\/fl\/florida-constitution1968-revision\/fl-const-art-1-sect-6\/\" target=\"_blank\" rel=\"noopener\">The <span data-term-id=\"40881921\">Florida<\/span><span data-term-id=\"40881921\"> Constitution<\/span><\/a>\u00a0states that \u201c<span data-term-id=\"40881910\">public employees<\/span> shall not have the right to strike.&#8221; This applies to all government workers at the state, county, and local levels.<\/p>\n<p>Despite the no-strike rule, <span data-term-id=\"40881910\">public employees<\/span> can still organize and bargain collectively through the <span data-term-id=\"40881910\">Public Employees<\/span> Relations Commission. <span data-term-id=\"40881899\">Florida<\/span> law also requires <span data-term-id=\"40881946\">public employers<\/span> to negotiate with certified bargaining agents.<\/p>\n<h2><strong>Exceptions to <span data-term-id=\"40881899\">Florida<\/span>&#8216;s <span data-term-id=\"40881902\">Right-To-Work Law<\/span><\/strong><\/h2>\n<p>Some workers are not covered by\u00a0<span data-term-id=\"40881899\">Florida<\/span>\u2019s\u00a0<span data-term-id=\"40881902\">right-to-work law<\/span>. Railroad and airline employees are governed by the federal Railway Labor Act, not <span data-term-id=\"40881912\">state law<\/span>. Since <span data-term-id=\"40881914\">federal law<\/span> provides stronger protection, it allows union-security agreements even in <span data-term-id=\"40881899\">Florida<\/span>.<\/p>\n<p>The U.S. Supreme Court upheld this exception in <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/351\/225.html\" target=\"_blank\" rel=\"noopener\"><em>Railway Employees&#8217; Dept. v. Hanson (1956)<\/em><\/a>. In this case, non-union railroad employees in Nebraska challenged a union shop agreement. They argued that it violated the right-to-work provision of the Nebraska Constitution. The Court ruled that the Railway Labor Act&#8217;s authorization of union shop agreements takes precedence over conflicting <span data-term-id=\"40881912\">state laws<\/span>.<\/p>\n<p>Federal government workers are also governed by separate <span data-term-id=\"40881914\">federal law<\/span>. The <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/florida\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">Federal Service Labor-Management Relations<\/a> laws determine the labor-management relationship for non-postal federal employees. This includes their right to organize and bargain collectively.<\/p>\n<h2><strong>Enforcement and Legal Remedies<\/strong><\/h2>\n<p><span data-term-id=\"40881899\">Florida<\/span>&#8216;s <span data-term-id=\"40881902\">right-to-work law<\/span> exists within a broader framework of federal labor legislation. Section 14(b) of the <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/taft-hartley-act-overview.html\">Taft-Hartley Act of 1947<\/a> grants states the authority to pass <span data-term-id=\"40881902\">right-to-work laws<\/span>. <span data-term-id=\"40881899\">Florida<\/span> exercised this option through its constitutional prohibition on compulsory <span data-term-id=\"40881905\">union membership<\/span>.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/fl\/title-xxxi-labor\/fl-st-sect-447-17\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40881943\">Florida<\/span><span data-term-id=\"40881943\"> Statutes<\/span><\/a> let you sue for damages, costs, and attorney\u2019s fees if you are denied a job or discriminated against because of your <span data-term-id=\"40881905\">union membership<\/span> status. The court may also award punitive damages if the discriminating party acted willfully and with malice.<\/p>\n<p>You can ask the court to stop the violation through injunctive relief. <span data-term-id=\"40881910\">Public employees<\/span> are not covered by this provision and instead fall under the <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xxxi-labor\/fl-st-sect-447-17\/https:\/\/www.flsenate.gov\/laws\/statutes\/2022\/447.301\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40881910\">Public Employees<\/span> Relations Act (PERA)<\/a>.<\/p>\n<h2><strong>Common Misconceptions About Right-To-Work<\/strong><\/h2>\n<p>There\u2019s a lot of information out there about right-to-work, and some of it is misleading. Let\u2019s get some answers to important questions:<\/p>\n<h3><strong>Does right-to-work mean I can be fired for any reason?<\/strong><\/h3>\n<p>No. Right-to-work only addresses\u00a0<span data-term-id=\"40881905\">union membership<\/span>\u00a0requirements. The ability of employers to terminate employees stems primarily from the doctrine of at-will employment. This is a separate legal doctrine. Even under <a href=\"https:\/\/www.findlaw.com\/employment\/losing-a-job\/at-will-employment-and-wrongful-termination.html\">at-will employment<\/a>, employers cannot fire you for illegal reasons. This includes discrimination based on race, gender, age, or disability, as well as retaliation for protected activity.<\/p>\n<h3><strong>Can I still join a union in <span data-term-id=\"40881899\">Florida<\/span>?<\/strong><\/h3>\n<p>Yes. Right-to-work protects your freedom to choose whether to join a union. You have every right to join, participate in, and support a <span data-term-id=\"40881908\">labor organization<\/span>. The law simply means you cannot be forced to do so.<\/p>\n<h3><strong>Will the union still represent me if I don&#8217;t pay dues?<\/strong><\/h3>\n<p>If a union represents your job, you\u2019ll be represented if need be.\u00a0<span data-term-id=\"40881914\">Federal law<\/span>\u00a0says unions must fairly represent everyone in the group, whether or not you are a member. Some extra benefits, such as legal help for non-contract issues, may be available only to dues-paying members.<\/p>\n<h3><strong>Does right-to-work affect my other employment rights?<\/strong><\/h3>\n<p>No. Right-to-work only covers\u00a0<span data-term-id=\"40881905\">union membership<\/span>\u00a0and dues. Your other rights, such as protection from discrimination, <span data-term-id=\"40881924\">civil rights<\/span>, <span data-term-id=\"40881911\">minimum wage<\/span>, and <span data-term-id=\"40881928\">workers\u2019 compensation<\/span>, are not affected.<\/p>\n<h2><strong>What To Do If Your Right-To-Work Rights Are Violated<\/strong><\/h2>\n<p>If you believe an employer or a <span data-term-id=\"40881900\">labor union<\/span> violated your right to work protections, there are several steps you can take to protect yourself. These include:<\/p>\n<ul>\n<li><strong>Document everything<\/strong>:\u00a0Keep records of any communications. This may include job offers, termination notices, or other documents from your employer or <span data-term-id=\"40881900\">labor union<\/span>. These records should suggest that you have been discriminated against because of your <span data-term-id=\"40881905\">union membership<\/span>.<\/li>\n<li><strong>File a complaint with the National Labor Relations Board (NLRB)<\/strong>:\u00a0The NLRB handles unfair labor practice complaints and can investigate violations of federal <span data-term-id=\"40881907\">labor law<\/span>. You can file a charge <a href=\"https:\/\/www.nlrb.gov\/guidance\/e-filing-service-desk\" target=\"_blank\" rel=\"noopener\">online through the NLRB&#8217;s website<\/a> or at your nearest regional office.<\/li>\n<li><strong>Consider seeking injunctive relief through the court system<\/strong>:\u00a0You are entitled to injunctive relief to stop an ongoing violation or prevent a threatened one.
