It also covers certain <span data-term-id=\"52777748\">independent contractors<\/span> who do business with the government. It involves any other negative change in employment conditions because of whistleblowing. The two statutes have different procedures, deadlines, and definitions. Which law applies depends on whether you work in the public or <span data-term-id=\"52777757\">private sector<\/span>.<\/p>\n<h2><strong>Protections for Private Employees<\/strong><\/h2>\n<p>The\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/whistleblowers\/whistleblower-protections.html\"><span data-term-id=\"52777757\">Private Sector<\/span> <span data-term-id=\"52777740\">Whistleblower&#8217;s Act<\/span><\/a>\u00a0covers most for-profit and nonprofit employers in <span data-term-id=\"52777739\">Florida<\/span> with 10 or more employees. <span data-term-id=\"52777748\">Independent contractors<\/span> are not considered employees under this law.<\/p>\n<h3><strong>Three Types of Protected Activity<\/strong><\/h3>\n<p><span data-term-id=\"52777777\">Private <\/span><a href=\"https:\/\/www.flsenate.gov\/Laws\/Statutes\/2024\/448.102\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52777777\">employers<\/span> cannot retaliate<\/a> against employees who do any of the following:<\/p>\n<ul>\n<li>Reported, or signaled an intent to report, an employer activity, policy, or practice that violates a law, rule, or regulation to an appropriate governmental agency<\/li>\n<li>Provided information or testified before any governmental agency or person conducting an investigation, hearing, or inquiry into the employer&#8217;s conduct<\/li>\n<li>Objected to or refused to participate in any employer activity, policy, or practice that violates a law, rule, or regulation<\/li>\n<\/ul>\n<p><span data-term-id=\"52777739\">Florida<\/span>&#8216;s <span data-term-id=\"52777757\">private-sector<\/span> statute defines &#8220;law, rule, or regulation&#8221; broadly. It covers any <span data-term-id=\"52777759\">state laws<\/span> or ordinances. It also includes other regulations or rules adopted by\u00a0federal or\u00a0<span data-term-id=\"52777759\">state law<\/span>, or by local ordinance, that apply to employers and relate to the business.<\/p>\n<h3><strong>Written Notice Requirement<\/strong><\/h3>\n<p>If you plan to disclose or threaten to disclose information to a government agency, you usually need to give your employer written notice of the <span data-term-id=\"52777769\">suspected violation<\/span> first. You must also give your employer a chance to fix it. This written notice is not required if you are providing information or testifying in a government investigation. It is also not required if you object to or refuse to participate in the activity.<\/p>\n<h3><strong>The &#8220;Actual Violation&#8221; Standard<\/strong><\/h3>\n<p><span data-term-id=\"52777739\">Florida<\/span> appellate courts disagree on what an employee must prove to bring a claim. Some courts require proof of an actual legal violation. Others hold that a good-faith, objectively reasonable belief is enough. The First and Second District Courts of Appeal require proof of an actual violation. The Fourth District accepts a reasonable-belief standard. Until the <span data-term-id=\"52777739\">Florida<\/span> Supreme Court decides, the outcome depends on where your case is filed.<\/p>\n<h2><strong>Protections for <span data-term-id=\"52777764\">Public Employees<\/span><\/strong><\/h2>\n<p><span data-term-id=\"52777764\">Public employees<\/span> in <span data-term-id=\"52777739\">Florida<\/span> are governed by the <a href=\"https:\/\/www.flsenate.gov\/Laws\/Statutes\/2024\/112.3187\" target=\"_blank\" rel=\"noopener\">Public-Sector <span data-term-id=\"52777740\">Whistleblower&#8217;s Act<\/span><\/a>. This law covers a broader range of misconduct than the <span data-term-id=\"52777757\">private-sector<\/span> statute.<\/p>\n<h3><strong>Who Is Covered?<\/strong><\/h3>\n<p>The public-sector statute covers employees and applicants of any <span data-term-id=\"52777756\">state agency<\/span>. It also covers local <span data-term-id=\"52777764\">public employees<\/span>, including those from cities, counties, school districts, and special districts. Employees of <span data-term-id=\"52777748\">independent contractors<\/span> who provide goods or services to a <span data-term-id=\"52777776\">public employer<\/span> are also covered.<\/p>\n<h3><strong>Protected Disclosures<\/strong><\/h3>\n<p>A <span data-term-id=\"52777764\">public employee<\/span> is <a href=\"https:\/\/www.flsenate.gov\/Laws\/Statutes\/2024\/112.3187\" target=\"_blank\" rel=\"noopener\">protected when<\/a> they report a violation or <span data-term-id=\"52777769\">suspected violation<\/span> of relevant laws that creates significant danger to safety, welfare, or <span data-term-id=\"52777773\">public health<\/span>. To qualify for protection, the employee must engage in one of several protected activities under the statute. These include filing a signed, <span data-term-id=\"52777775\">written complaint<\/span> on the employee&#8217;s own initiative, participating in a government investigation when requested, refusing to take part in a prohibited adverse action, or initiating a complaint through a <a href=\"https:\/\/www.floridaoig.com\/whistleblowerbrochure.htm\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52777762\">whistleblower hotline<\/span><\/a>.<\/p>\n<p>Reports to a supervisor or an agency <span data-term-id=\"52777765\">inspector general<\/span> are also protected. So are reports to the Chief <span data-term-id=\"52777765\">Inspector General<\/span> in the Executive Office of the Governor or the <span data-term-id=\"52777755\">Florida<\/span><span data-term-id=\"52777755\"> Commission on Human Relations<\/span>.<\/p>\n<h3><strong>Key Differences from <span data-term-id=\"52777757\">Private-Sector<\/span> Protections<\/strong><\/h3>\n<p><span data-term-id=\"52777764\">Public employees<\/span> are not required to give their employer written notice before making a disclosure. The law also covers a wider range of disclosures, such as <span data-term-id=\"52777750\">gross mismanagement<\/span> and <span data-term-id=\"52777781\">waste of public funds<\/span>, which are not covered under the <span data-term-id=\"52777757\">private-sector<\/span> statute. <span data-term-id=\"52777764\">Public employees<\/span> must follow a specific <a href=\"https:\/\/www.flsenate.gov\/Laws\/Statutes\/2024\/112.31895\" target=\"_blank\" rel=\"noopener\">administrative complaint process<\/a> before filing a civil lawsuit.<\/p>\n<h2><strong>What Counts as Retaliation?<\/strong><\/h2>\n<p>Both <span data-term-id=\"52777768\">Florida<\/span><span data-term-id=\"52777768\"> statutes<\/span> broadly define retaliation. An employer cannot dismiss, <span data-term-id=\"52777746\">demote<\/span>, suspend, discipline, harass, or take any other <a href=\"https:\/\/www.flsenate.gov\/Laws\/Statutes\/2024\/112.3187\" target=\"_blank\" rel=\"noopener\">adverse <span data-term-id=\"52777744\">personnel action<\/span><\/a> against an employee because of protected whistleblowing. Common examples include:<\/p>\n<ul>\n<li>Firing or laying off the employee<\/li>\n<li>Cutting pay or demoting the worker<\/li>\n<li>Reassigning them to less desirable shifts, locations, or duties<\/li>\n<li>Excluding them from meetings, training, or promotions<\/li>\n<li>Issuing unwarranted negative performance reviews<\/li>\n<li>Subjecting the worker to hostile treatment or harassment<\/li>\n<\/ul>\n<p>Courts examine the timing between protected activity and any negative employment action. A short gap between the two, along with a sudden change in how an employee is treated, can strongly suggest retaliation.<\/p>\n<h2><strong>How To File a Whistleblower Complaint<\/strong><\/h2>\n<p>Procedures and deadlines vary based on whether you work for a <span data-term-id=\"52777756\">state agency<\/span>, local government, or <span data-term-id=\"52777777\">private employer<\/span>. Let\u2019s take a closer look at each type.<\/p>\n<ul>\n<li><strong><span data-term-id=\"52777756\">State agency<\/span> employees<\/strong>:\u00a0State employees must file a complaint with the <span data-term-id=\"52777755\">Florida<\/span><span data-term-id=\"52777755\"> Commission on Human Relations<\/span> (FCHR). It\u00a0should be no later than 60 days after the prohibited <span data-term-id=\"52777744\">personnel action<\/span>. After the FCHR completes or terminates its investigation, the employee receives a notice. From that point, the employee has 180 days to act. They may pursue the administrative remedy through the <span data-term-id=\"52777764\">Public Employees<\/span> Relations Commission, bring a <span data-term-id=\"52777770\">civil action<\/span> in court, or both.<\/li>\n<li><strong>Local government employees:<\/strong> Complaints must be filed with the appropriate local governmental authority. The timeframe to file is within 60 days of the prohibited action. This applies only if the local government has established an administrative procedure. After a final decision, the employee has <a href=\"https:\/\/www.flsenate.gov\/Laws\/Statutes\/2024\/112.3187\" target=\"_blank\" rel=\"noopener\">180 days to file a <span data-term-id=\"52777770\">civil action<\/span><\/a>. If the local authority has not adopted an administrative procedure, the employee may file a <span data-term-id=\"52777770\">civil action<\/span> within 180 days of the violation itself.<\/li>\n<li><strong>Private employees<\/strong>:\u00a0<span data-term-id=\"52777757\">Private-sector<\/span> employees don\u2019t need to file with the FCHR. A worker can file a civil lawsuit directly in state circuit court. The lawsuit must be <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xxxi-labor\/fl-st-sect-448-103\/\" target=\"_blank\" rel=\"noopener\">filed within two years of the employee discovering<\/a> the <span data-term-id=\"52777758\">retaliatory action<\/span> or within four years after the action was taken, whichever is earlier.<\/li>\n<\/ul>\n<p>If you choose to bring a <span data-term-id=\"52777770\">civil action<\/span> to court, consider speaking with an <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/florida\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">employment attorney<\/a> for legal guidance.<\/p>\n<h2><strong>Documents To Gather<\/strong><\/h2>\n<p>Supporting documentation is important for both public and private claims. Helpful records include written reports of the violation, copies of notices to the employer, performance reviews, and disciplinary records. Also useful are communications showing the employer&#8217;s response and contact information for witnesses.<\/p>\n<h2><strong>What Remedies are Available?<\/strong><\/h2>\n<p>A successful whistleblower may be entitled to <a href=\"https:\/\/www.flsenate.gov\/Laws\/Statutes\/2024\/112.3187\" target=\"_blank\" rel=\"noopener\">several forms of relief<\/a> under <span data-term-id=\"52777768\">Florida<\/span><span data-term-id=\"52777768\"> statutes<\/span>, including:<\/p>\n<ul>\n<li><span data-term-id=\"52777747\">Reinstatement<\/span> to the same or an equivalent position<\/li>\n<li><span data-term-id=\"52777751\">Back pay<\/span>, with interest in many cases<\/li>\n<li>Restoration of lost benefits, including seniority<\/li>\n<li>Compensation for <span data-term-id=\"52777761\">lost wages<\/span><\/li>\n<li>Reasonable <span data-term-id=\"52777745\">attorney&#8217;s fees<\/span> and litigation costs<\/li>\n<li>Injunctive relief to stop ongoing retaliation<\/li>\n<li>Temporary <span data-term-id=\"52777747\">reinstatement<\/span> during proceedings (available in the public sector, but not for municipal employees)<\/li>\n<\/ul>\n<p>In <span data-term-id=\"52777757\">private-sector<\/span> cases, a <a href=\"https:\/\/www.flsenate.gov\/Laws\/Statutes\/2024\/448.104\" target=\"_blank\" rel=\"noopener\">court can order<\/a> the losing party to pay the other side&#8217;s <span data-term-id=\"52777745\">attorney&#8217;s fees<\/span>. An employee who loses a whistleblower case could be responsible for the employer&#8217;s reasonable fees. The public-sector law is more favorable to employees. Employers can only recover fees if the employee filed a frivolous case in bad faith.<\/p>\n<h2><strong><span data-term-id=\"52777772\">Federal <\/span><span data-term-id=\"52777741\">Whistleblower<\/span><span data-term-id=\"52777741\"> Protections<\/span><\/strong><\/h2>\n<p><span data-term-id=\"52777752\">Federal laws<\/span> may also protect <span data-term-id=\"52777739\">Florida<\/span> workers who report misconduct in certain industries or situations. If both state and federal protections apply, employees usually receive the more favorable standard.<\/p>\n<ul>\n<li><strong>The <\/strong><a href=\"https:\/\/www.findlaw.com\/employment\/workplace-safety\/workplace-safety-osha-and-osh-act-overview.html\"><strong>Occupational Safety and Health Act (OSHA)<\/strong><\/a>: Protects workers who report workplace safety hazards<\/li>\n<li><strong>The <\/strong><a href=\"https:\/\/www.findlaw.com\/consumer\/securities-law\/what-is-the-sarbanes-oxley-act.html\"><strong>Sarbanes-Oxley Act (SOX)<\/strong><\/a>: Provides protection to employees of publicly traded companies who report securities, mail, wire, or shareholder fraud<\/li>\n<li><strong>The <\/strong><a href=\"https:\/\/www.findlaw.com\/employment\/whistleblowers\/what-is-the-false-claims-act.html\"><strong>False Claims Act<\/strong><\/a>: Allows employees to bring <a href=\"https:\/\/www.findlaw.com\/employment\/whistleblowers\/qui-tam-actions.html\" target=\"_blank\" rel=\"noopener\">qui tam actions<\/a> on behalf of the federal government when an employer defrauds federal programs and protects them from retaliation<\/li>\n<li><strong>The <\/strong><a href=\"https:\/\/www.findlaw.com\/consumer\/securities-law\/what-is-the-dodd-frank-act.html\"><strong>Dodd-Frank Wall Street Reform Act<\/strong><\/a>: Protects employees who report securities violations to the SEC and may offer financial awards<\/li>\n<\/ul>\n<p><span data-term-id=\"52777772\">Federal whistleblower<\/span> deadlines are often shorter than those under <span data-term-id=\"52777739\">Florida<\/span> law. Missing a filing deadline usually bars the claim. These deadlines include 60 days, 180 days, or the\u00a0two-year and four-year deadlines for private employees.<\/p>\n<p><span data-term-id=\"52777748\">Independent contractors<\/span> are not covered by the <span data-term-id=\"52777757\">private-sector<\/span> statute, although other laws may offer protection.
