It&#8217;s also a lot simpler when there are no minor children involved. But, the parties rarely agree to everything. And many cases do include children. Before you file your petition for dissolution of marriage, you must understand how divorce law works in Florida.<\/p>\r\n<p>Here, we&#8217;ll offer an overview of the divorce process in Florida. This includes filing for divorce until the judge issues your final divorce decree.<\/p>\r\n<h2><b>Florida Divorce Process at a Glance<\/b><\/h2>\r\n<p>There&#8217;s a reason getting through law school and passing the bar exam is so tough. The law is confusing. To help the non-lawyer residents of the Sunshine State understand the divorce process, we&#8217;ve provided the following plain English explanations of the law and resources to help you navigate the system like a pro.<\/p>\r\n<h3><b>Statute&nbsp;<\/b><\/h3>\r\n<p>Florida Statutes: Civil Practice and Procedure&nbsp;<a href=\"https:\/\/codes.findlaw.com\/fl\/title-vi-civil-practice-and-procedure\/fl-st-sect-61-001.html\" target=\"_blank\" rel=\"noopener\">\u00a761.001<\/a>, et seq.<\/p>\r\n<h2><b>Requirements for a Simplified (Uncontested) Divorce<\/b><\/h2>\r\n<p>Florida has two types of divorce: a simplified dissolution of marriage and a regular dissolution of marriage.<\/p>\r\n<p>You may file for a simplified dissolution of marriage by meeting the following requirements:<\/p>\r\n<ol>\r\n<li>There are no children under 18<\/li>\r\n<li>Neither spouse is pregnant<\/li>\r\n<li>At least one spouse has lived in Florida for six months<\/li>\r\n<li>There are no disagreements over the division of property and liabilities<\/li>\r\n<li>Neither party is seeking spousal support (alimony)<\/li>\r\n<li>Both spouses agree the marriage is irretrievably broken<\/li>\r\n<\/ol>\r\n<h3><b>How To File for a Simplified Divorce in Florida<\/b><\/h3>\r\n<ol>\r\n<li><b>Prepare and file a Petition for Simplified Dissolution of Marriage<\/b>&nbsp;in the county clerk&#8217;s office where you or your spouse live. You must also pay filing fees unless you qualify for a&nbsp;<a href=\"https:\/\/www.floridalawhelp.org\/content\/waiving-court-fees-or-filing-fees-faq\" target=\"_blank\" rel=\"noopener\">fee waiver<\/a>.<\/li>\r\n<li><b>Even if you and your spouse agree on the division of property and debts<\/b>, you must put it in writing. The best way to do this is to file a&nbsp;<a href=\"https:\/\/www.flcourts.gov\/Resources-Services\/Office-of-Family-Courts\/Family-Court-in-Florida\/Family-Law-Forms\/Additional-Supporting-Documents-12.902-Forms-B-J\/Marital-Settlement-Agreement-for-Simplified-Dissolution-of-Marriage\" target=\"_self\" rel=\"noopener\">Marital Settlement Agreement for Simplified Dissolution of Marriage<\/a>.<\/li>\r\n<li><b>Attend a hearing before the court.<\/b>&nbsp;The courts typically schedule this shortly after you file your petition. Visit the<\/i>&nbsp;<a href=\"http:\/\/www.flcourts.org\/resources-and-services\/family-courts\/family-law-self-help-information\/family-law-forms.stml#901\" target=\"_blank\" rel=\"noopener\"><i>Florida State Court System&#8217;s Self-Help Center<\/i><\/a>&nbsp;<i>for a complete list.<\/i><\/p>\r\n<h2><b>How To File for Divorce in Florida With a Child<\/b><\/h2>\r\n<p>If your case involves a minor child, you can&#8217;t file for a simplified dissolution of marriage. You must file for a regular dissolution of marriage.<\/p>\r\n<h2><b>Filing for Regular Dissolution of Marriage in Florida<\/b><\/h2>\r\n<p>The steps below explain the process you will follow for a regular dissolution of marriage. You&#8217;ll also follow this process for a contested divorce.<\/p>\r\n<h3><b>Prepare and File the Necessary Forms<\/b><\/h3>\r\n<p>You must file the appropriate dissolution of marriage forms in your county. You must ensure that you meet the residency requirements before doing this. Under Florida law, one spouse must have lived in Florida for at least six months.<\/p>\r\n<p>The initial document you will file is a &quot;<a href=\"https:\/\/www.flcourts.gov\/Resources-Services\/Office-of-Family-Courts\/Family-Court-in-Florida\/Family-Law-Forms?parentId=669505&amp;sort=form\/number%20asc,%20form\/date%20desc&amp;view=embed_custom&amp;searchtype=form&amp;limit=50&amp;query=&amp;offset=0\" target=\"_blank\" rel=\"noopener\">Petition for the Dissolution of Marriage<\/a>.&quot; The spouse who files the petition is the &quot;petitioner,&quot; and the other spouse is the &quot;respondent.&quot; The petition should address the following issues:<\/p>\r\n<ul>\r\n<li>Division of marital property and liabilities<\/li>\r\n<li>Alimony (spousal support)<\/li>\r\n<li>Custody of any minor or dependent children<\/li>\r\n<li>Child support<\/li>\r\n<\/ul>\r\n<p>Florida courts do not require parties to specify particular fault grounds for a divorce. But the judge may consider factors such as abandonment or abuse when deciding child custody and visitation if the behavior affects the child.<\/p>\r\n<p>On the distribution of assets, the court must consider&nbsp;<a href=\"http:\/\/www.leg.state.fl.us\/Statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0000-0099\/0061\/Sections\/0061.075.html\" target=\"_blank\" rel=\"noopener\">factors in the Florida Code<\/a>. While fault is not a factor in equitable distribution, if one of the spouses wasted or depleted marital assets \u2014 during or in the two years leading up to the divorce \u2014 it could affect how marital property gets distributed.<\/p>\r\n<p>Get your forms notarized before you file them with the court clerk. The clerk will give you a copy of your divorce papers after they stamp them with the filing date. Make an extra copy to serve on your spouse.<\/p>\r\n<h3><b>Serve the Forms on Your Spouse<\/b><\/h3>\r\n<p>To &quot;serve&quot; a court petition is to let the other party (your spouse) officially know about the proceedings. Your spouse or their attorney may accept service if they agree to the divorce. Acceptance and waiver of service prevent the need for the petitioner to have the documents served.<\/p>\r\n<p>You have several&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/divorce\/filing-and-serving-the-divorce-dissolution-petition.html\">options for serving the petition<\/a>&nbsp;on your spouse. You can do this via the county sheriff or a professional process server. You can&#8217;t mail or hand-deliver these forms to your spouse.<\/p>\r\n<h3><b>Provide Your Spouse With Financial Disclosures<\/b><\/h3>\r\n<p>Each party has a right to the other party&#8217;s financial information. Within 45 days of service of the petition, each party must provide their spouse with a signed affidavit detailing their financial assets and liabilities. This document is a&nbsp;<a href=\"https:\/\/www.flcourts.gov\/Resources-Services\/Office-of-Family-Courts\/Family-Court-in-Florida\/Family-Law-Forms\/Additional-Supporting-Documents-12.902-Forms-B-J\" target=\"_blank\" rel=\"noopener\">Family Law Financial Affidavit<\/a>&nbsp;that describes each party&#8217;s assets, debts, income, and expenses.<\/p>\r\n<p>The financial affidavit concerns (but is not limited to) the following:<\/p>\r\n<ul>\r\n<li>Income<\/li>\r\n<li>Other assets<\/li>\r\n<li>Tax returns<\/li>\r\n<li>Debts<\/li>\r\n<li>Bank and credit card statements<\/li>\r\n<li>Investments, retirement accounts, etc.<\/li>\r\n<\/ul>\r\n<p>If either spouse earns more than $50,000, they must file the&nbsp;<a href=\"https:\/\/www.flcourts.gov\/content\/download\/685813\/file_pdf\/902c10-21.pdf\" target=\"_blank\" rel=\"noopener\">long version<\/a>&nbsp;of the Florida Family Law Financial Affidavit. You can use the&nbsp;<a href=\"https:\/\/www.flcourts.gov\/content\/download\/685812\/file_pdf\/902b10-21.pdf\" target=\"_blank\" rel=\"noopener\">short form<\/a>&nbsp;of the affidavit if you earn less than $50,000.<\/p>\r\n<h3><b>Complete and File Other Child-Related Forms and Courses<\/b><\/h3>\r\n<p>If the judge schedules a child support hearing, complete and file the&nbsp;<a href=\"https:\/\/www.flcourts.gov\/content\/download\/685815\/file_pdf\/902%28e%29.pdf\" target=\"_blank\" rel=\"noopener\">Child Support Guidelines Worksheet<\/a>.<\/p>\r\n<p>You must also file a completed&nbsp;<a href=\"https:\/\/www.flcourts.gov\/Resources-Services\/Office-of-Family-Courts\/Family-Court-in-Florida\/Family-Law-Forms\/Additional-Supporting-Documents-12.902-Forms-B-J\/Uniform-Child-Custody-Jurisdiction-and-Enforcement-Affidavit\" target=\"_blank\" rel=\"noopener\">Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) Affidavit<\/a>. You must do this even if you and your spouse agree on custody.<\/p>\r\n<p>Both parents of minor children must attend a co-parenting class before the court will finalize your divorce.<\/p>\r\n<h3><b>Settlement or Contested Final Hearing<\/b><\/h3>\r\n<p>If you and your spouse agree on the divorce terms, you&#8217;ll sign a written agreement reflecting these terms. The law calls this agreement the &quot;<a href=\"https:\/\/www.flcourts.gov\/Resources-Services\/Office-of-Family-Courts\/Family-Court-in-Florida\/Family-Law-Forms\/Additional-Supporting-Documents-12.902-Forms-B-J\/Marital-Settlement-Agreement-for-Dissolution-of-Marriage-with-Dependent-or-Minor-Child-ren\" target=\"_blank\" rel=\"noopener\">Marital Settlement Agreement<\/a>.&quot; The agreement must include a parenting plan if you have children.<\/p>\r\n<p>Parties can also present their agreement orally to the judge in a final hearing. But, the judge may require a trial if you can&#8217;t agree to the terms in court. Some Florida counties require parties to attend&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/divorce\/divorce-mediation-faq.html\">mediation<\/a>&nbsp;before proceeding to trial.<\/p>\r\n<p>The judge will decide the remaining issues before issuing a final judgment.<\/p>\r\n<h2><b>How To File for Divorce in Florida Without an Attorney<\/b><\/h2>\r\n<p>Florida law can be confusing. The courts offer self-help resources for Florida residents who choose to represent themselves in their divorce.<\/p>\r\n<p>But divorce is a complex legal process that has long-lasting effects. Your final divorce decree will affect your finances, children, and property.
