Federal exemptions are sometimes more generous in certain categories, so this difference can affect how much property you can protect.<\/p>\n<p><span data-term-id=\"52743418\">Georgia<\/span> raised the bankruptcy <span data-term-id=\"52743417\">homestead exemption<\/span> amount in 2012. A\u00a0<a href=\"https:\/\/accg.org\/links\/Local%20Government%20HB%20581%20Opt-Out%20Period%20Ends%20March%201.pdf\" target=\"_blank\" rel=\"noopener\">2025 law<\/a> set a floating <span data-term-id=\"52743441\">base-year<\/span> <span data-term-id=\"52743417\">homestead exemption<\/span> for <span data-term-id=\"52743419\">property taxes<\/span>, limiting how much your home&#8217;s <span data-term-id=\"52743423\">assessed value<\/span> can increase each year.<\/p>\n<h2><strong><span data-term-id=\"52743417\">Homestead Exemption<\/span> Limits in <span data-term-id=\"52743418\">Georgia<\/span><\/strong><\/h2>\n<p>The <span data-term-id=\"52743417\">homestead exemption<\/span> amount you can claim in <span data-term-id=\"52743418\">Georgia<\/span> depends on whether you are protecting your home from creditors or lowering your <span data-term-id=\"52743419\">property taxes<\/span>. Each program has its own rules and code sections.<\/p>\n<h3><strong>Creditor Protection and Bankruptcy Exemptions<\/strong><\/h3>\n<p>Under the <a href=\"https:\/\/codes.findlaw.com\/ga\/title-44-property\/ga-code-sect-44-13-100\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52743418\">Georgia<\/span> Code<\/a>, a debtor may exempt up to $50,000 of equity in real or personal property used as a <span data-term-id=\"52743434\">primary residence<\/span>. When the property is titled in the name of the debtor&#8217;s spouse, the exemption doubles to $100,000.<\/p>\n<p>If a debtor does not use the full <span data-term-id=\"52743417\">homestead exemption<\/span>, up to $10,000 of the unused portion may be applied to protect other property. <span data-term-id=\"52743418\">Georgia<\/span> does not set acreage limits for the bankruptcy <span data-term-id=\"52743417\">homestead exemption<\/span>. The protection is based on the equity value, not the lot size.<\/p>\n<p><span data-term-id=\"52743418\">Georgia<\/span>\u2019s bankruptcy exemptions often require a residency requirement of at least 730 days. If you haven\u2019t been living in <span data-term-id=\"52743418\">Georgia<\/span> for the full two years before filing, you\u2019ll use exemptions from the state where you lived for most of the six months before that two-year period.<\/p>\n<h3><strong><span data-term-id=\"52743419\">Property <\/span><span data-term-id=\"52743435\">Tax<\/span><span data-term-id=\"52743435\"> Exemptions<\/span><\/strong><\/h3>\n<p><span data-term-id=\"52743418\">Georgia<\/span> <span data-term-id=\"52743420\">homeowners<\/span> can also reduce their <span data-term-id=\"52743419\">property tax<\/span> burden through a separate <span data-term-id=\"52743417\">homestead exemption<\/span> program. The standard <span data-term-id=\"52743419\">property tax<\/span> <span data-term-id=\"52743417\">homestead exemption<\/span>, under <a href=\"https:\/\/codes.findlaw.com\/ga\/title-48-revenue-and-taxation\/ga-code-sect-48-5-44\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52743466\">O.C.G.A<\/span><\/a>, provides a $2,000 reduction from the <span data-term-id=\"52743423\">assessed value<\/span> of the homestead for county and <span data-term-id=\"52743430\">school tax<\/span> purposes. This reduction does not apply to <span data-term-id=\"52743430\">school taxes<\/span> levied by municipalities or to taxes used to retire <span data-term-id=\"52743446\">bonded indebtedness<\/span>.<\/p>\n<p>Additional <span data-term-id=\"52743419\">property <\/span><span data-term-id=\"52743435\">tax<\/span><span data-term-id=\"52743435\"> exemptions<\/span> are available for qualifying residents and <span data-term-id=\"52743432\">property owners<\/span>:<\/p>\n<ul>\n<li><strong>Standard homestead<\/strong>:\u00a0A <a href=\"https:\/\/codes.findlaw.com\/ga\/title-48-revenue-and-taxation\/ga-code-sect-48-5-44\/\" target=\"_blank\" rel=\"noopener\">$2,000 reduction<\/a> from the <span data-term-id=\"52743423\">assessed value<\/span>, available to owner-occupants of a <span data-term-id=\"52743434\">primary residence<\/span><\/li>\n<li><strong>Age 65 and older<\/strong>:\u00a0A <a href=\"https:\/\/codes.findlaw.com\/ga\/title-48-revenue-and-taxation\/ga-code-sect-48-5-47\/\" target=\"_blank\" rel=\"noopener\">$4,000 reduction<\/a> from county <span data-term-id=\"52743427\">ad valorem taxes<\/span> is available to <span data-term-id=\"52743420\">homeowners<\/span> whose combined household income from the <span data-term-id=\"52743453\">prior year<\/span> does not exceed $10,000 (Retirement, pension, and disability income are excluded from that calculation up to the federal <span data-term-id=\"52743436\">Social Security<\/span> maximum)<\/li>\n<li><strong>Age 62 and older <span data-term-id=\"52743430\">school <\/span><span data-term-id=\"52743435\">tax<\/span><span data-term-id=\"52743435\"> exemption<\/span><\/strong>:\u00a0<a href=\"https:\/\/codes.findlaw.com\/ga\/title-48-revenue-and-taxation\/ga-code-sect-48-5-52\/\" target=\"_blank\" rel=\"noopener\">Up to $10,000 off the <span data-term-id=\"52743423\">assessed value<\/span><\/a> for <span data-term-id=\"52743430\">school taxes<\/span> is available for <span data-term-id=\"52743420\">homeowners<\/span> whose household income does not exceed $10,000 per year (excluding retirement, survivor, or disability benefits under <span data-term-id=\"52743436\">Social Security<\/span> or other qualifying retirement systems)<\/li>\n<li><strong><span data-term-id=\"52743429\">Disabled veteran<\/span> or <span data-term-id=\"52743422\">surviving spouse<\/span><\/strong>:\u00a0At least $32,500 off the <span data-term-id=\"52743423\">assessed value<\/span> for those disabled during an <span data-term-id=\"52743460\">armed conflict<\/span>, adjusted annually ($121,812 for 2025)<\/li>\n<\/ul>\n<p>Many <span data-term-id=\"52743418\">Georgia<\/span> counties offer additional <span data-term-id=\"52743456\">local exemptions<\/span> beyond the state minimums. Check with your <a href=\"https:\/\/dor.georgia.gov\/county-tag-offices\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52743461\">county <\/span><span data-term-id=\"52743455\">tax<\/span><span data-term-id=\"52743455\"> commissioner<\/span><span data-term-id=\"52743455\">&#8216;s office<\/span><\/a> or the <a href=\"https:\/\/dor.georgia.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52743418\">Georgia<\/span> Department of Revenue<\/a> for details about local programs.<\/p>\n<h3><strong>Qualifying Property Types<\/strong><\/h3>\n<p>Not every property qualifies for the <span data-term-id=\"52743417\">homestead exemption<\/span>. You may <a href=\"https:\/\/codes.findlaw.com\/ga\/title-44-property\/ga-code-sect-44-13-100\/\" target=\"_blank\" rel=\"noopener\">apply the bankruptcy <span data-term-id=\"52743417\">homestead exemption<\/span><\/a> to real property used as a <span data-term-id=\"52743434\">primary residence<\/span>, personal property used as a residence, a cooperative in which you or a dependent lives, or a burial plot if the <span data-term-id=\"52743417\">homestead exemption<\/span> is not otherwise used.<\/p>\n<p>Rental properties, vacant land, and commercial properties do not qualify. <span data-term-id=\"52743418\">Georgia<\/span> courts consider both the debtor&#8217;s intent and the property&#8217;s actual use when determining whether it qualifies as a residence. A property rented to a tenant, even if it sits next to your home, does not qualify.<\/p>\n<p>To qualify for the <span data-term-id=\"52743419\">property <\/span><span data-term-id=\"52743435\">tax<\/span><span data-term-id=\"52743435\"> exemption<\/span>, the property must be your <span data-term-id=\"52743425\">legal residence<\/span> as of January 1 of the <span data-term-id=\"52743421\">tax year<\/span>. It must be your primary home for all purposes, including vehicle registration, voter registration, and income tax filing. If you hold a life estate, which is a legal interest that gives you the right to live in the property for the rest of your life, you may also qualify.<\/p>\n<h2><strong>How the <span data-term-id=\"52743417\">Homestead Exemption<\/span> Works in Foreclosure and Bankruptcy<\/strong><\/h2>\n<p>Homestead claims are often part of foreclosure and bankruptcy cases. In foreclosure, a mortgage holder can take ownership of a property if the borrower defaults. If the lender sells the home, the former <span data-term-id=\"52743420\">homeowner<\/span> may lose all their equity. The <span data-term-id=\"52743417\">homestead exemption<\/span> helps prevent this by preserving a portion of your home equity.<\/p>\n<p>In <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7.html\">Chapter 7 bankruptcy<\/a>, a trustee can sell non-exempt assets to pay creditors. The <span data-term-id=\"52743417\">homestead exemption<\/span> determines how much of your home equity is protected. If your equity exceeds the exemption, the trustee may sell the home and pay you the exempt amount. In <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13.html\">Chapter 13 bankruptcy<\/a>, you keep your property but must pay creditors at least the value of any non-exempt equity through a repayment plan.<\/p>\n<p>The <span data-term-id=\"52743417\">homestead exemption<\/span> protects equity from unsecured creditors, such as credit card companies or medical debt collectors. It does not remove valid mortgage liens or other secured debts. A <span data-term-id=\"52743420\">homeowner<\/span> who stops paying their mortgage can still face foreclosure even if their equity falls within the exemption limit.<\/p>\n<h2><strong>How To Claim a <span data-term-id=\"52743417\">Homestead Exemption<\/span> in <span data-term-id=\"52743418\">Georgia<\/span><\/strong><\/h2>\n<p><span data-term-id=\"52743418\">Georgia<\/span> has two separate ways to claim a <span data-term-id=\"52743417\">homestead exemption<\/span>: one for the <span data-term-id=\"52743419\">property <\/span><span data-term-id=\"52743435\">tax<\/span><span data-term-id=\"52743435\"> exemption<\/span> and another, an automatic process for bankruptcy.<\/p>\n<h3><strong><span data-term-id=\"52743419\">Property <\/span><span data-term-id=\"52743435\">Tax<\/span><span data-term-id=\"52743435\"> Exemption<\/span><\/strong><\/h3>\n<p>To claim the <a href=\"https:\/\/dor.georgia.gov\/property-tax-homestead-exemptions\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52743419\">property tax<\/span> <span data-term-id=\"52743417\">homestead exemption<\/span><\/a>, you\u2019ll need to file an application with your <span data-term-id=\"52743461\">county <\/span><span data-term-id=\"52743426\">tax<\/span><span data-term-id=\"52743461\"> commissioner<\/span> or the local <span data-term-id=\"52743431\">board of assessors<\/span>. The exemption isn\u2019t automatic. If you don\u2019t apply, you lose the exemption for that <span data-term-id=\"52743421\">tax year<\/span>.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/ga\/title-48-revenue-and-taxation\/ga-code-sect-48-5-40\/\" target=\"_blank\" rel=\"noopener\">Key requirements<\/a> include:<\/p>\n<ul>\n<li>You must have owned and occupied the property as your <span data-term-id=\"52743425\">legal residence<\/span> as of January 1 of the <span data-term-id=\"52743421\">tax year<\/span><\/li>\n<li>Applications are generally due by April 1 of the <span data-term-id=\"52743421\">tax year<\/span>, though <span data-term-id=\"52743418\">Georgia<\/span> permits late filers to apply within a 45-day window to appeal their notice of assessment<\/li>\n<li>Once granted, the exemption is renewed annually, provided you continue to reside in the <span data-term-id=\"52743438\">homestead property<\/span><\/li>\n<li>You may only claim a <span data-term-id=\"52743417\">homestead exemption<\/span> on one property, including properties in other <span data-term-id=\"52743418\">Georgia<\/span> counties or other states<\/li>\n<\/ul>\n<p>Required documents typically include a valid <span data-term-id=\"52743433\">Georgia<\/span><span data-term-id=\"52743433\"> driver&#8217;s license<\/span> or state ID showing the property address, vehicle registration reflecting the property address, and proof of ownership, such as a deed. Additional documentation may be required for age-based or disability-based exemptions, such as proof of age, income <span data-term-id=\"52743440\">tax returns<\/span>, or a physician&#8217;s certificate.<\/p>\n<p>You can usually submit your <span data-term-id=\"52743443\">homestead exemption<\/span><span data-term-id=\"52743443\"> application<\/span> online, by mail, or in person. Each county has its own process. Contact your local <span data-term-id=\"52743455\">tax commissioner<\/span><span data-term-id=\"52743455\">&#8216;s office<\/span> or visit the <a href=\"https:\/\/dor.georgia.gov\/property-tax-homestead-exemptions\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52743418\">Georgia<\/span> Department of Revenue&#8217;s <span data-term-id=\"52743417\">homestead exemption<\/span> page<\/a> for instructions specific to your county.<\/p>\n<h3><strong>Bankruptcy Exemption<\/strong><\/h3>\n<p>The <a href=\"https:\/\/codes.findlaw.com\/ga\/title-44-property\/ga-code-sect-44-13-100\/\" target=\"_blank\" rel=\"noopener\">bankruptcy <span data-term-id=\"52743417\">homestead exemption<\/span><\/a> doesn\u2019t require a separate filing with your county. Claim it on your bankruptcy schedules filed with the court by listing the property, its value, any outstanding liens, and the exemption code section. Helpful documents include a recent appraisal to determine <span data-term-id=\"52743462\">fair market value<\/span>, mortgage statements, <span data-term-id=\"52743419\">property tax<\/span> records, and proof that the property is your <span data-term-id=\"52743434\">primary residence<\/span>.<\/p>\n<h3><strong>Exceptions and Limitations<\/strong><\/h3>\n<p>The <span data-term-id=\"52743449\">state of <\/span><span data-term-id=\"52743418\">Georgia<\/span>&#8216;s <span data-term-id=\"52743417\">homestead exemption<\/span> doesn\u2019t protect you from every type of debt. It doesn\u2019t cover mortgage liens and deeds of trust, <span data-term-id=\"52743419\">property tax<\/span> liens, mechanic&#8217;s and materialman&#8217;s liens for unpaid work, or <a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-522\/\" target=\"_blank\" rel=\"noopener\">child support and alimony<\/a> obligations. <a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-522\/\" target=\"_blank\" rel=\"noopener\">Judgment liens<\/a> recorded against your property may or may not be affected by the <span data-term-id=\"52743417\">homestead exemption<\/span> depending on the circumstances, including whether you file for bankruptcy.<\/p>\n<p>There are other limits to keep in mind. <span data-term-id=\"52743418\">Georgia<\/span> does not offer unlimited homestead protection. Any equity above $50,000, or $100,000 for married couples filing jointly, is still available to creditors and bankruptcy trustees.<\/p>\n<p>If you haven\u2019t lived in <span data-term-id=\"52743418\">Georgia<\/span> for at least 730 days before filing for bankruptcy, you may not qualify for <span data-term-id=\"52743418\">Georgia<\/span>&#8216;s exemptions. Receiving your home through a transfer meant to avoid creditors could expose you to fraudulent conveyance rules.
