A federal employee who works on a <span data-term-id=\"59369361\">federal holiday<\/span> is entitled to receive <span data-term-id=\"59369367\">premium pay<\/span> in addition to their <span data-term-id=\"59369358\">regular rate of pay<\/span>.<\/p>\n<h2>Georgia <span data-term-id=\"59369341\">State Holidays<\/span><\/h2>\n<p><span data-term-id=\"59369341\">State holidays<\/span> are paid non-workdays for most <span data-term-id=\"59369357\">state employees<\/span>. Georgia law determines the <a href=\"https:\/\/codes.findlaw.com\/ga\/title-1-general-provisions\/ga-code-sect-1-4-1\/\" target=\"_blank\" rel=\"noopener\">public and <span data-term-id=\"59369363\">legal holidays<\/span><\/a> the state observes. This requires Georgia to recognize all <span data-term-id=\"59369361\">federal holidays<\/span> designated as of January 1, 2022, plus any additional days proclaimed by the Governor. The statute further mandates 13 <span data-term-id=\"59369341\">state holidays<\/span>. Like many states, Georgia has its own public and <span data-term-id=\"59369363\">legal holidays<\/span>.<\/p>\n<p>In addition to the 11 <span data-term-id=\"59369361\">federal holidays<\/span>, the state recognizes two additional holidays. Each year, Georgia&#8217;s governor announces <a href=\"https:\/\/team.georgia.gov\/all-articles\/state-georgia-holiday-schedule\" target=\"_blank\" rel=\"noopener\">which holidays<\/a> the state government will observe. By statute, one of the two dates must be January 19 (Robert E. Lee\u2019s birthday) or April 26 (Confederate <span data-term-id=\"59369340\">Memorial Day<\/span>).<\/p>\n<p>Instead of <span data-term-id=\"59369367\">premium pay<\/span>, a Georgia state worker who works on a <span data-term-id=\"59369341\">state holiday<\/span> is entitled to compensatory time off (CTO). This is <span data-term-id=\"59369343\">paid time off<\/span> equal to the holiday hours you worked. Those unable to use the CTO within a certain timeframe will be paid for it instead.<\/p>\n<h2>Holidays for Private-Sector Employees<\/h2>\n<p>For those working in the private sector, paid holidays are a bit more complex. No law requires private-sector employers to provide holidays to their employees. They\u2019re under no obligation to close the business, give the day off, or provide\u00a0<span data-term-id=\"59369367\">premium pay<\/span>. Even the federal\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/fair-labor-standards-act.html\"><span data-term-id=\"59369338\">Fair Labor Standards Act<\/span><\/a> (<span data-term-id=\"59369346\">FLSA<\/span>), which sets\u00a0<span data-term-id=\"59369344\">minimum wage<\/span>\u00a0and overtime rules, has no\u00a0<span data-term-id=\"59369349\">holiday pay<\/span>\u00a0requirement.<\/p>\n<p>While not required, many private-sector employers do offer holidays to their employees. Providing a holiday schedule can boost employee morale, increase retention rates, and help the employer remain competitive in the job market. If a private-sector employer voluntarily offers holidays, the schedule is usually found in the employment offer letter or in the employee handbook. An employer is legally bound to provide holidays if this is a term in the <span data-term-id=\"59369351\">employment contract<\/span> or collective bargaining agreement.<\/p>\n<h2><span data-term-id=\"59369349\">Holiday Pay<\/span> and <span data-term-id=\"59369353\">Overtime Law<\/span><\/h2>\n<p>Under the <span data-term-id=\"59369346\">FLSA<\/span>, Georgia employers must provide <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/minimum-wage-and-overtime-basics.html\">overtime pay<\/a> to nonexempt employees who work more than 40 hours in a workweek. The overtime pay rate is one-and-a-half times the employee\u2019s <span data-term-id=\"59369358\">regular rate of pay<\/span> for each hour worked over 40. If an employee receives a paid day off for a holiday, those hours won&#8217;t count toward the overtime calculation.<\/p>\n<p>Here&#8217;s an example. If you work 40 hours in a week and receive eight hours of pay for a holiday, you\u2019re not entitled to overtime. The <span data-term-id=\"59369349\">holiday pay<\/span> hours don\u2019t qualify as actual work time.<\/p>\n<h2><span data-term-id=\"59369349\">Holiday Pay<\/span> Issues<\/h2>\n<p>Private employers have no legal obligation to offer holidays to their employees. If they do, they must do so lawfully. Key issues that can arise when a private employer promises <span data-term-id=\"59369349\">holiday pay<\/span> include wage issues and <span data-term-id=\"59369350\">discrimination<\/span> charges. Let\u2019s see what these entail.<\/p>\n<h3>Wage Issues<\/h3>\n<p>Most wage violations by private employers in the <span data-term-id=\"59369349\">holiday pay<\/span> context involve failing to honor something agreed to in writing, leading to a\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/small-business\/breach-of-employment-contract-what-remedies-may-be-possible\/\">breach-of-contract<\/a> dispute. This may be in the form of the employee handbook, your offer letter, your <span data-term-id=\"59369351\">employment contract<\/span>, or a collective bargaining agreement. Regardless of whether a <span data-term-id=\"59369349\">holiday pay<\/span> law covers it, the employer is liable for failing to meet an obligation it agreed to.<\/p>\n<p>Depending on the amount in dispute, your options for recovery include sending a demand letter, filing with small claims court, or filing in higher court for a breach-of-contract lawsuit. Union members disputing a violation of the collective bargaining agreement can follow union grievance procedures.<\/p>\n<h3><span data-term-id=\"59369350\">Discrimination<\/span><\/h3>\n<p>Under federal law, employers must apply their holiday policy in a non-discriminatory way. If your employer offers <span data-term-id=\"59369349\">holiday pay<\/span> to some employees but withholds it from others based on a <a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/civil-rights-basics.html\">legally protected characteristic<\/a> (such as race, gender, age, etc.), that&#8217;s <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/employment-discrimination.html\">employment <span data-term-id=\"59369350\">discrimination<\/span><\/a>. Pursuing a <span data-term-id=\"59369350\">discrimination<\/span> claim begins with filing a charge with the <a href=\"https:\/\/publicportal.eeoc.gov\/Portal\/Login.aspx\" target=\"_blank\" rel=\"noopener\">Equal Employment Opportunity Commission<\/a> (EEOC). The deadline to file is generally 180 days for Georgia workers.
