In non-<span data-term-id=\"40962882\">right-to-<\/span><span data-term-id=\"40962906\">work<\/span><span data-term-id=\"40962906\"> states<\/span>, Private-sector workers in other states can be required to pay fees to the union that represents them, even if they choose not to formally join it. <span data-term-id=\"40962886\">Federal law<\/span> bans requiring formal <span data-term-id=\"40962924\">union membership<\/span> as a hiring condition nationwide. Fees are a reduced amount that covers only the union&#8217;s core representational work, such as <span data-term-id=\"40962932\">employment policy<\/span> bargaining, contract administration, and grievance procedures.<\/p>\n<p><span data-term-id=\"40962903\">Public employers<\/span> can\u2019t require government workers to pay any union fees unless they opt in. In a <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/16-1466.html\" target=\"_blank\" rel=\"noopener\">2018 case<\/a>, the U.S. Supreme Court ruled that requiring public employees to pay union fees without their affirmative consent violated the First Amendment.<\/p>\n<p>Union supporters don\u2019t favor <span data-term-id=\"40962882\">right-to-work<\/span> status. This stems from their belief that all workers benefit from union activities and should contribute. In\u00a0<span data-term-id=\"40962882\">right-to-<\/span><span data-term-id=\"40962906\">work<\/span><span data-term-id=\"40962906\"> states<\/span>, employers can circumvent union-negotiated contract terms by hiring non-union members, minimizing the union\u2019s power.<\/p>\n<p>Employers can counter that they want the freedom to choose who they hire. <span data-term-id=\"40962882\">Right-to-work<\/span> supporters feel that joining a union and paying dues should be a worker\u2019s option.<\/p>\n<h2><span data-term-id=\"40962882\">Right-To-Work<\/span> in <span data-term-id=\"40962881\">Georgia<\/span><\/h2>\n<p>Under <a href=\"https:\/\/codes.findlaw.com\/ga\/title-34-labor-and-industrial-relations\/ga-code-sect-34-6-21\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40962881\">Georgia<\/span> law<\/a>, an individual can\u2019t be forced to become or remain a union member as a <span data-term-id=\"40962893\">condition of employment<\/span>, despite benefiting from the union\u2019s <span data-term-id=\"40962894\">collective bargaining<\/span> efforts. A <span data-term-id=\"40962881\">Georgia<\/span> employer or a <span data-term-id=\"40962889\">labor organization<\/span> that violates the <span data-term-id=\"40962882\">right-to-<\/span><span data-term-id=\"40962900\">work<\/span><span data-term-id=\"40962900\"> law<\/span> may face <a href=\"https:\/\/codes.findlaw.com\/ga\/title-34-labor-and-industrial-relations\/ga-code-sect-34-6-28\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40962926\">misdemeanor<\/span> criminal liability<\/a>, separate from any civil action the affected employee may bring. In a <a href=\"https:\/\/codes.findlaw.com\/ga\/title-34-labor-and-industrial-relations\/ga-code-sect-34-6-27\/\" target=\"_blank\" rel=\"noopener\">civil claim<\/a>, the worker may be entitled to receive injunctive relief and money for damages and attorneys\u2019 fees.<\/p>\n<h2><span data-term-id=\"40962918\">At-Will Employment<\/span> vs. <span data-term-id=\"40962882\">Right-to-Work<\/span><\/h2>\n<p>The terms \u201c<span data-term-id=\"40962918\">at-will employment<\/span>\u201d and \u201c<span data-term-id=\"40962882\">right-to-work<\/span>\u201d answer completely different questions. <span data-term-id=\"40962882\">Right-to-work<\/span> answers whether or not you can be required to join a union or to pay union fees as a <span data-term-id=\"40962893\">condition of employment<\/span>. <span data-term-id=\"40962918\">At-will employment<\/span> relates to job security.<\/p>\n<p>Under <span data-term-id=\"40962881\">Georgia<\/span> law, <a href=\"https:\/\/codes.findlaw.com\/ga\/title-34-labor-and-industrial-relations\/ga-code-sect-34-7-1\/\" target=\"_blank\" rel=\"noopener\">an indefinite hiring may be terminated at will by either party<\/a>. Without an <span data-term-id=\"40962923\">employment contract<\/span> term stating otherwise, the employment relationship can end at any time.<\/p>\n<p><span data-term-id=\"40962918\">At-will employment<\/span> does not mean your employer can fire you for an illegal reason. Illegal reasons for firing an employee include:<\/p>\n<ul>\n<li><strong>Discrimination<\/strong>: Includes firings based on a protected characteristic such as race, color, religion, sex, <span data-term-id=\"40962910\">national origin<\/span>, age, disability, or <span data-term-id=\"40962915\">genetic information<\/span> that are illegal under <span data-term-id=\"40962886\">federal law<\/span><\/li>\n<li><strong>Retaliation for whistleblowing<\/strong>: <a href=\"https:\/\/codes.findlaw.com\/ga\/title-45-public-officers-and-employees\/ga-code-sect-45-1-4\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40962890\">State law<\/span><\/a> protects <span data-term-id=\"40962881\">Georgia<\/span> public employees against employer retaliation for certain whistleblowing activities, while private employees are covered by <a href=\"https:\/\/www.findlaw.com\/employment\/whistleblowers\/whistleblower-protections.html\">federal <span data-term-id=\"40962925\">whistleblower protections<\/span><\/a><\/li>\n<li><strong>Retaliation for exercising a federally protected right<\/strong>: Violations under the <span data-term-id=\"40962897\">Family and Medical Leave Act<\/span> (<span data-term-id=\"40962892\">FMLA<\/span>), <span data-term-id=\"40962904\">Occupational Safety<\/span> and Health Administration (<span data-term-id=\"40962898\">OSHA<\/span>), serving <span data-term-id=\"40962928\">jury duty<\/span>, or Uniformed Services Employment and Reemployment Rights Act (<span data-term-id=\"40962914\">USERRA<\/span>) rights tied to military service<\/li>\n<li><strong>Retaliation for exercising <span data-term-id=\"40962882\">right-to-work<\/span> protections<\/strong>: Firing someone for refusing to join a union or for asserting their <a href=\"https:\/\/codes.findlaw.com\/ga\/title-34-labor-and-industrial-relations\/ga-code-sect-34-6-27\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40962882\">right-to-work<\/span> protections<\/a><\/li>\n<\/ul>\n<p><span data-term-id=\"40962881\">Georgia<\/span> is both a <span data-term-id=\"40962882\">right-to-<\/span><span data-term-id=\"40962906\">work<\/span><span data-term-id=\"40962906\"> state<\/span> and an <span data-term-id=\"40962918\">at-will employment<\/span> state, but these two legal principles exist independently. Your <span data-term-id=\"40962882\">right-to-work<\/span> protections don&#8217;t affect how easily you or your employer can terminate your employment, and your at-will status doesn&#8217;t affect whether you can be forced into <span data-term-id=\"40962924\">union membership<\/span>.<\/p>\n<h2><span data-term-id=\"40962886\">Federal Law<\/span> for <span data-term-id=\"40962881\">Georgia<\/span> Employees<\/h2>\n<p>Because <span data-term-id=\"40962881\">Georgia<\/span> <span data-term-id=\"40962885\">employment laws<\/span> are minimal, most regulations are based on <span data-term-id=\"40962886\">federal laws<\/span>. In general, the federal statutes set a baseline, not a ceiling. For example, <span data-term-id=\"40962919\">Georgia<\/span><span data-term-id=\"40962919\">\u2019s <\/span><span data-term-id=\"40962883\">minimum wage<\/span> is below the baseline set by the federal <span data-term-id=\"40962888\">Fair Labor Standards Act<\/span> (<span data-term-id=\"40962891\">FLSA<\/span>), so the federal <span data-term-id=\"40962883\">minimum wage<\/span> applies to almost all covered workers in <span data-term-id=\"40962881\">Georgia<\/span>, with some <span data-term-id=\"40962902\">exemptions<\/span>.<\/p>\n<p><span data-term-id=\"40962881\">Georgia<\/span> has no <span data-term-id=\"40962916\">anti-discrimination laws<\/span> banning private-sector employment. No\u00a0<span data-term-id=\"40962890\">state laws<\/span>\u00a0cover <span data-term-id=\"40962901\">overtime pay<\/span>. Family leave law comes from the federal <span data-term-id=\"40962892\">FMLA<\/span>, which only applies to employers with 50 or more employees.
