A married couple is treated as a single head of family for purposes of the exemption. This means that spouses filing jointly cannot add their exemptions to double the protection.<\/p>\n<p>The\u00a0<a href=\"https:\/\/codes.findlaw.com\/hi\/division-4-courts-and-judicial-proceedings\/hi-rev-st-sect-651-92\/\" target=\"_blank\" rel=\"noopener\">exemption<\/a>\u00a0only applies to one parcel of <span data-term-id=\"52743523\">real property<\/span>. Even if you own multiple properties, only one qualifies. The exemption does not apply if a <a href=\"https:\/\/codes.findlaw.com\/hi\/division-4-courts-and-judicial-proceedings\/hi-rev-st-sect-651-92\/\" target=\"_blank\" rel=\"noopener\">creditor&#8217;s lien occurred before you acquired an interest<\/a> in the property and started living there.<\/p>\n<p>Other than the traditional single-family homes, the following property types may also qualify:<\/p>\n<ul>\n<li>Condominium units<\/li>\n<li>Stock cooperative units<\/li>\n<li>Property held under a long-term lease of 20 years or more<\/li>\n<\/ul>\n<p>The property must be located in <span data-term-id=\"52743517\">Hawaii<\/span>.\u00a0<a href=\"https:\/\/codes.findlaw.com\/hi\/division-4-courts-and-judicial-proceedings\/hi-rev-st-sect-651-92\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52743533\">State\u00a0law<\/span> does<\/a>\u00a0not protect out-of-state <span data-term-id=\"52743541\">real estate<\/span>. Mobile homes may qualify if they are affixed to land in a way that makes them <span data-term-id=\"52743523\">real property<\/span> under <span data-term-id=\"52743517\">Hawaii<\/span> law. This depends on how the home is titled and whether it is classified as personal or <span data-term-id=\"52743523\">real property<\/span>.<\/p>\n<h2><strong>How Do You Claim the Exemption?<\/strong><\/h2>\n<p>How you claim the exemption depends on your situation. These include:<\/p>\n<ul>\n<li><strong>Outside of bankruptcy<\/strong>:\u00a0If a creditor attempts to attach or execute against your home, you can assert the exemption in the relevant court proceeding by filing a claim of exemption<\/li>\n<li><strong>In a bankruptcy case<\/strong>:\u00a0You must list the property on Schedule A\/B: Property, and then claim the exemption on Schedule C: The Property You Claim as Exempt (<span data-term-id=\"52743517\">Hawaii<\/span> allows you to choose between the state exemption system and the\u00a0<a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-522\/\" target=\"_blank\" rel=\"noopener\">federal bankruptcy exemptions<\/a>)<\/li>\n<\/ul>\n<p>The federal <span data-term-id=\"52743534\">homestead exemption<\/span> (as of April 2025) protects up to $31,575 in home equity. This figure doubles to $63,150 for married <span data-term-id=\"52743531\">homeowners<\/span> who jointly own the house. Whether <span data-term-id=\"52743517\">Hawaii&#8217;s<\/span> state exemption or the federal exemption works better for you depends on your specific assets and debts. To use <span data-term-id=\"52743517\">Hawaii&#8217;s<\/span> state exemption, you must <a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-522\/\" target=\"_blank\" rel=\"noopener\">have lived in\u00a0<span data-term-id=\"52743517\">Hawaii<\/span><\/a>\u00a0for at least 730 days (two years) before filing. If you fall short of that threshold, you will generally need to use the exemptions from the state where you previously lived.<\/p>\n<h2><strong>What Happens When You Sell Your Home?<\/strong><\/h2>\n<p>If you sell property that qualifies for the <span data-term-id=\"52743534\">homestead exemption<\/span>, <span data-term-id=\"52743517\">Hawaii<\/span> law temporarily extends the protection. The money received as the <span data-term-id=\"52743535\">Hawaiian <\/span><span data-term-id=\"52743534\">homestead<\/span><span data-term-id=\"52743534\"> exemption<\/span> from a forced sale <a href=\"https:\/\/codes.findlaw.com\/hi\/division-4-courts-and-judicial-proceedings\/hi-rev-st-sect-651-96\/\" target=\"_blank\" rel=\"noopener\">remains protected for six months<\/a>. It receives the <a href=\"https:\/\/codes.findlaw.com\/hi\/division-4-courts-and-judicial-proceedings\/hi-rev-st-sect-651-92\/\" target=\"_blank\" rel=\"noopener\">same protection against attachment and execution<\/a> that\u00a0extends to <span data-term-id=\"52743523\">real property<\/span>. This window gives you time to reinvest the proceeds in another protected asset without losing the exemption&#8217;s benefit.<\/p>\n<h2><strong>How Does the Exemption Work in Chapter 7 vs. Chapter 13?<\/strong><\/h2>\n<p>The chapter of bankruptcy you file under significantly affects how the <span data-term-id=\"52743534\">homestead exemption<\/span> protects your home. In a Chapter 7 case, the court appoints a trustee who reviews your assets and sells your nonexempt property to pay creditors. If your home equity is within the exemption limit, the trustee can\u2019t force a sale of your house. However, if you have equity above that threshold, the trustee may sell the property, pay off your mortgage and other secured liens, return the exempt amount to you, and distribute the remaining proceeds to unsecured creditors.<\/p>\n<p>Chapter 13 involves a three- to five-year <a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-1325\/\" target=\"_blank\" rel=\"noopener\">repayment plan instead of liquidating assets<\/a>. Unsecured creditors must receive no less through the repayment plan than they would have collected had the debtor filed under Chapter 7. This means that if you have nonexempt equity in your home, that amount must be reflected in your plan payments. However, the trustee will not sell your home to satisfy it. For <span data-term-id=\"52743531\">homeowners<\/span> with equity above the exemption limit, Chapter 13 is often the more practical way to keep the property while satisfying creditors through a repayment plan.<\/p>\n<p>Because\u00a0<span data-term-id=\"52743517\">Hawaii&#8217;s<\/span>\u00a0<span data-term-id=\"52743548\">exemption amounts<\/span>\u00a0are low\u00a0relative to typical home values, the chapter you choose can have real consequences. It is not a shield against obligations tied directly to the property itself, such as your mortgage or construction liens.<\/p>\n<p>Federal <span data-term-id=\"52743532\">income tax<\/span> liens can further complicate matters. Under the Supremacy Clause of the U.S. Constitution, <span data-term-id=\"52743551\">federal law<\/span> takes precedence over <span data-term-id=\"52743533\">state law<\/span> when the two conflict. The Internal Revenue Service (IRS) rarely forecloses on a home to collect a <span data-term-id=\"52743540\">real property<\/span><span data-term-id=\"52743540\"> tax<\/span> debt, but it may become involved if the property is mortgaged or sold before the federal tax lien expires.<\/p>\n<p>The exemption only counts equity you actually have above what you already owe. Due to <span data-term-id=\"52743517\">Hawaii&#8217;s<\/span> high property values, many <span data-term-id=\"52743531\">homeowners<\/span> carry mortgage balances that leave little or no equity within the $20,000 to $30,000 range. In those situations, the exemption may offer limited protection in a forced-sale scenario.<\/p>\n<h2><strong>What About <span data-term-id=\"52743534\">Homestead Exemptions<\/span> for <span data-term-id=\"52743518\">Native Hawaiians<\/span>?<\/strong><\/h2>\n<p>The\u00a0<a href=\"https:\/\/dhhl.hawaii.gov\/hhc\/laws-and-rules\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52743520\">Hawaiian Homes Commission Act<\/span>\u00a0(<span data-term-id=\"52743528\">HHCA<\/span>)<\/a>, signed into law in 1921, is a separate homestead program for\u00a0<span data-term-id=\"52743518\">Native Hawaiians<\/span>. <span data-term-id=\"52743528\">HHCA<\/span> established a system of <span data-term-id=\"52743527\">homestead leases<\/span> administered by the\u00a0<a href=\"https:\/\/dhhl.hawaii.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52743522\">Department of Hawaiian Home Lands<\/span><\/a>\u00a0(<span data-term-id=\"52743524\">DHHL<\/span>). Under this program, <span data-term-id=\"52743519\">beneficiaries<\/span> of Hawaiian ancestry may lease residential land on state-set-aside <span data-term-id=\"52743549\">public lands<\/span> on highly favorable terms.<\/p>\n<p><span data-term-id=\"52743528\">HHCA<\/span> leases operate under their own legal framework and differ from the standard homestead protections under the <span data-term-id=\"52743526\">Hawaii<\/span><span data-term-id=\"52743526\"> Revised Statutes<\/span>. <span data-term-id=\"52743552\">Eligibility<\/span> requires meeting a blood quantum requirement. This means applicants must demonstrate at least 50% Hawaiian ancestry to qualify for a new lease.
