Because of this, you might have a strong claim under <span data-term-id=\"52844654\">Illinois<\/span><span data-term-id=\"52844654\"> law<\/span> in spite of not qualifying for a federal claim.<\/p>\n<p>To illustrate this, let&#8217;s take a look at key <span data-term-id=\"52844632\">Illinois<\/span> <span data-term-id=\"52844641\">civil rights<\/span><span data-term-id=\"52844641\"> laws<\/span> in this section.<\/p>\n<h3><span data-term-id=\"52844636\">Illinois<\/span><span data-term-id=\"52844636\"> Human Rights Act<\/span> (IHRA)<\/h3>\n<p>The <a href=\"https:\/\/codes.findlaw.com\/il\/chapter-775-human-rights\/\" target=\"_blank\" rel=\"noopener\"><strong><u>IHRA<\/u><\/strong><\/a>\u200b is the state&#8217;s main <span data-term-id=\"52844641\">civil rights<\/span><span data-term-id=\"52844641\"> law<\/span>. This pay transparency requirement helps ensure wage fairness by allowing applicants to understand compensation before applying or accepting positions.<\/p>\n<h3>Victims&#8217; Economic Security and Safety Act (VESSA)<\/h3>\n<p><a href=\"https:\/\/labor.illinois.gov\/laws-rules\/leave_rights_division\/vessa.html\" target=\"_blank\" rel=\"noopener\"><strong><u>VESSA<\/u><\/strong><\/a>\u00a0is a labor and employment leave statute that provides important protections, working alongside\u00a0<span data-term-id=\"52844641\">civil rights<\/span><span data-term-id=\"52844641\"> laws<\/span>. It gives certain rights to employees affected by domestic violence, sexual violence, or gender violence. These include the right to:<\/p>\n<ul>\n<li>Take unpaid, job\u2011protected leave to address issues related to the violence<\/li>\n<li>Use leave to seek, obtain, or enforce an<a href=\"https:\/\/www.findlaw.com\/state\/illinois-law\/illinois-protective-orders-laws.html\"><u> <span data-term-id=\"52844653\">order of protection<\/span><\/u><\/a>\u200b<\/li>\n<li>Request workplace accommodations or other safety-related modifications<\/li>\n<\/ul>\n<p>VESSA protects people experiencing violence from losing their jobs. This fills a gap not covered by federal <span data-term-id=\"52844633\">civil rights<\/span> statutes.<\/p>\n<h3><span data-term-id=\"52844632\">Illinois<\/span> Equal Wage Act (IWEA)<\/h3>\n<p>The IWEA supplements federal wage laws, such as the <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/fair-labor-standards-act.html\"><strong><u>Fair Labor Standards Act (FLSA)<\/u><\/strong><\/a>\u200b and the federal EPA. It covers all <span data-term-id=\"52844632\">Illinois<\/span> employers and bans sex\u2011based wage discrimination, including the smallest employers not covered by the <span data-term-id=\"52844632\">Illinois<\/span> and federal EPAs.<\/p>\n<h2>How To File an <span data-term-id=\"52844632\">Illinois<\/span> <span data-term-id=\"52844633\">Civil Rights<\/span> Complaint<\/h2>\n<p>State and federal <span data-term-id=\"52844633\">civil rights<\/span> protections generally have their own enforcement mechanisms. Your starting point for complaints depends on which law or laws were violated. Since this is not always obvious, let\u2019s examine the most common paths to follow.<\/p>\n<p>Most <span data-term-id=\"52844632\">Illinois<\/span> <span data-term-id=\"52844633\">civil rights<\/span> complaints start with the<a href=\"https:\/\/dhr.illinois.gov\/\" target=\"_blank\" rel=\"noopener\"><strong><u> <span data-term-id=\"52844646\">Illinois<\/span><span data-term-id=\"52844646\"> Department of Human Rights<\/span> (IDHR)<\/u><\/strong><\/a>, which often serves as a single intake point. It can evaluate the facts and determine which state and federal <span data-term-id=\"52844641\">civil rights<\/span><span data-term-id=\"52844641\"> laws<\/span> may apply.<\/p>\n<p>Filing with the IDHR can preserve your ability to pursue both state and federal remedies. The IDHR has a work-sharing agreement with the EEOC, which means filing with the IDHR may automatically initiate a federal claim with the EEOC as well.<\/p>\n<h3>Step-By-Step Process<\/h3>\n<p>Begin by accessing the <a href=\"https:\/\/dhr.illinois.gov\/filing-a-charge.html\" target=\"_blank\" rel=\"noopener\"><strong><u>IDHR&#8217;s online intake system<\/u><\/strong><\/a>\u200b. You can also start by calling or walking into the\u00a0<span data-term-id=\"52844642\">Chicago<\/span>\u00a0or\u00a0<span data-term-id=\"52844648\">Springfield<\/span>\u00a0offices.<\/p>\n<p>Provide details about what happened and why you suspect discrimination. The IDHR will investigate your claim. This involves interviewing witnesses, reviewing documents, and gathering evidence.<\/p>\n<p>The IDHR then decides whether there is &#8220;substantial evidence&#8221; of discrimination. If so, your case can move to the <a href=\"https:\/\/hrc.illinois.gov\/\" target=\"_blank\" rel=\"noopener\"><strong><u><span data-term-id=\"52844655\">Illinois<\/span><span data-term-id=\"52844655\"> Human Rights Commission<\/span> (IHRC)<\/u><\/strong><\/a>\u200b for a hearing.
