Education is primarily governed by <span data-term-id=\"36028809\">state law<\/span>. In <span data-term-id=\"36028795\">Illinois<\/span>, the board of education appoints a <span data-term-id=\"36028833\">state <\/span><span data-term-id=\"36028802\">superintendent<\/span>. This official implements academic standards. They also oversee compliance with <a href=\"https:\/\/www.findlaw.com\/education.html\"><span data-term-id=\"36028807\">education laws<\/span><\/a>. From <span data-term-id=\"36028801\">Chicago<\/span> to <span data-term-id=\"36028805\">Springfield<\/span>, <span data-term-id=\"36028842\">regional offices of education<\/span> support these goals.<\/p>\n<p>The <a href=\"https:\/\/ilga.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"36028795\">Illinois<\/span> <span data-term-id=\"36028817\">General Assembly<\/span><\/a> frequently updates <span data-term-id=\"36028807\">education laws<\/span> to match evolving needs. In 2023, for example, it expanded <span data-term-id=\"36028835\">health education<\/span> mandates to include guidance for accessing <span data-term-id=\"36028804\">mental health<\/span> resources. Governor Pritzker signed <a href=\"https:\/\/www.ilga.gov\/legislation\/BillStatus?GAID=18&amp;DocNum=1560&amp;DocTypeID=SB&amp;LegId=0&amp;SessionID=114\" target=\"_blank\" rel=\"noopener\">the first bill of its kind<\/a> in 2025, requiring <span data-term-id=\"36028797\">public schools<\/span> to offer <span data-term-id=\"36028804\">mental health<\/span> screenings for students in grades three through 12. The law goes into effect in the 2027-2028 <span data-term-id=\"36028799\">school year<\/span>.<\/p>\n<p>Another <a href=\"https:\/\/www.ilga.gov\/Legislation\/publicacts\/view\/103-0581\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"36028831\">new law<\/span> steepened penalties <\/a>for drivers who break school zone rules, such as failing to stop for a <span data-term-id=\"36028823\">school bus<\/span>. Violators now face higher fines and mandatory <span data-term-id=\"36028841\">community service<\/span>.<\/p>\n<h2>Special Education Requirements<\/h2>\n<p><span data-term-id=\"36028795\">Illinois<\/span> <span data-term-id=\"36028797\">public schools<\/span> follow the federal <a href=\"https:\/\/www.findlaw.com\/education\/special-education-and-disabilities\/can-the-individuals-with-disabilities-education-act-idea-help.html\">Individuals with <span data-term-id=\"36028798\">Disabilities<\/span> Education Act (IDEA)<\/a>. This protects disabled students&#8217; access to public education.<\/p>\n<p>These protections apply to all levels, from preschool to <span data-term-id=\"36028830\">high school students<\/span>. During this time, schools are required to provide transition services. These could include:<\/p>\n<ul>\n<li><span data-term-id=\"36028828\">Vocational<\/span> training<\/li>\n<li>College readiness<\/li>\n<li>Independent living skills<\/li>\n<\/ul>\n<p>Schools must identify and evaluate students who may need <span data-term-id=\"36028819\">special education services<\/span>. Eligible students receive an <a href=\"https:\/\/www.findlaw.com\/education\/special-education-and-disabilities\/iep-requirments-for-disabled-students.html\">Individualized <span data-term-id=\"36028806\">Education Program<\/span> (IEP)<\/a>. An IEP outlines the student\u2019s goals, accommodations, and supports.<\/p>\n<p><span data-term-id=\"36028838\">Public <\/span><span data-term-id=\"36028796\">school<\/span><span data-term-id=\"36028838\"> districts<\/span> may place students in <span data-term-id=\"36028837\">special education facilities<\/span> if they can\u2019t provide the needed services. These facilities must be approved by the<a href=\"https:\/\/www.isbe.net\/\" target=\"_blank\" rel=\"noopener\"> <span data-term-id=\"36028808\">Illinois<\/span><span data-term-id=\"36028808\"> State Board of Education<\/span> (<span data-term-id=\"36028800\">ISBE<\/span>)<\/a>.<\/p>\n<p><a href=\"https:\/\/www.isbe.net\/documents\/226ark.pdf\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"36028810\">Illinois<\/span><span data-term-id=\"36028810\"> law<\/span><\/a> adds rules on evaluations and communication methods. Essentially, parents have the right to take part in decisions. They can also request independent evaluations and challenge placements.<\/p>\n<h2>Anti-Bullying Laws<\/h2>\n<p><span data-term-id=\"36028795\">Illinois<\/span> requires <span data-term-id=\"36028797\">public schools<\/span> to adopt and enforce written anti\u2011bullying policies. They must also investigate incidents and provide education on prevention. These mandates apply to public institutions from preschool to <span data-term-id=\"36028824\">secondary school<\/span> (high school).<\/p>\n<p>The definition of the laws on bullying includes <a href=\"https:\/\/www.findlaw.com\/consumer\/online-scams\/what-is-cyberbullying.html\">cyberbullying<\/a>. It also covers repeated verbal, physical, or electronic acts that harm a student\u2019s safety, health, or learning. Protected groups include race, national origin, religion, sex, <span data-term-id=\"36028798\">disability<\/span>, and more.<\/p>\n<p><span data-term-id=\"36028809\">State law<\/span> doesn\u2019t require staff training. Schools must report incidents internally and to the <span data-term-id=\"36028800\">ISBE<\/span>. They must also offer safeguards for victims.<\/p>\n<h2>Vaccination Requirements<\/h2>\n<p><span data-term-id=\"36028795\">Illinois<\/span> requires students in child care and all pre-K\u201312 schools to show proof of certain immunizations. These include:<\/p>\n<ul>\n<li>Measles<\/li>\n<li>Mumps<\/li>\n<li>Rubella<\/li>\n<li>Polio<\/li>\n<li>Diphtheria<\/li>\n<li>Tetanus<\/li>\n<li>Pertussis<\/li>\n<li>Hepatitis B<\/li>\n<li>Varicella<\/li>\n<li>Meningococcal disease<\/li>\n<\/ul>\n<p>These rules are designed to protect public health and <span data-term-id=\"36028814\">school safety<\/span>. Records must be submitted by October 15th each <span data-term-id=\"36028799\">school year<\/span>. Students may be excluded until compliant. <a href=\"https:\/\/www.findlaw.com\/healthcare\/patient-rights\/vaccine-exemption-laws-by-state.html\">Exemptions are allowed<\/a> for valid medical or religious reasons, but documentation is required.<\/p>\n<p><a href=\"https:\/\/www.dhs.state.il.us\/page.aspx\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"36028795\">Illinois<\/span> Department of <span data-term-id=\"36028827\">Human Services&#8217;<\/span><\/a> <span data-term-id=\"36028816\">grant programs<\/span> help connect families with vaccination services. These programs also provide education on the benefits of immunization.<\/p>\n<h2>Teacher Certification Standards<\/h2>\n<p><span data-term-id=\"36028795\">Illinois<\/span> <span data-term-id=\"36028797\">public school<\/span> teachers must hold a <a href=\"https:\/\/www.isbe.net\/Pages\/Professional-Educator-License.aspx\" target=\"_blank\" rel=\"noopener\">Professional Educator License (PEL)<\/a>. This requires a bachelor\u2019s degree. They must also complete a state-approved teacher preparation program and fulfill student-teaching requirements. Candidates then need to pass state exams covering content knowledge and teaching skills.<\/p>\n<p><span data-term-id=\"36028810\">Illinois<\/span><span data-term-id=\"36028810\"> law<\/span> sets professional teaching standards that guide preparation programs and licensure exams. This aims to ensure teachers can effectively manage classrooms and support all learners. In addition, teachers must renew their PELs every five years with 120 hours of <span data-term-id=\"36028839\">professional development<\/span>.<\/p>\n<h2>Understanding Your Rights and Options<\/h2>\n<p>In <span data-term-id=\"36028795\">Illinois<\/span>, parents and <a href=\"https:\/\/www.findlaw.com\/education\/student-rights.html\">students have important educational rights<\/a>. This could include <span data-term-id=\"36028813\">enrollment<\/span> in:<\/p>\n<ul>\n<li><span data-term-id=\"36028797\">Public school<\/span><\/li>\n<li><span data-term-id=\"36028811\">Nonpublic<\/span>\/<span data-term-id=\"36028822\">private school<\/span><\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/education\/education-options\/education-and-homeschooling-state-laws.html\">Homeschool<\/a><\/li>\n<\/ul>\n<p><span data-term-id=\"36028834\">Homeless children<\/span> are also subject to <a href=\"https:\/\/www.findlaw.com\/state\/illinois-law\/illinois-compulsory-education-laws.html\"><span data-term-id=\"36028795\">Illinois<\/span>\u2019 compulsory <span data-term-id=\"36028807\">education laws<\/span><\/a>.<\/p>\n<p>Parents\/guardians are legally responsible for ensuring attendance during the full school term. <a href=\"https:\/\/www.ilga.gov\/Legislation\/ILCS\/Articles?ActID=1005&amp;ChapterID=17&amp;Chapter=SCHOOLS&amp;MajorTopic=EDUCATION\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"36028795\">Illinois<\/span> <span data-term-id=\"36028803\">School Code<\/span><\/a> allows <span data-term-id=\"36028820\">excused absences<\/span> with an approved and valid cause, which are handled by the individual <span data-term-id=\"36028796\">school districts<\/span>.<\/p>\n<p>Leaves of absence may be granted for longer periods. These apply when a student is unable to attend school for significant reasons. The district must formally authorize leaves. In <a href=\"https:\/\/www.findlaw.com\/education\/education-options\/public-school.html\"><span data-term-id=\"36028797\">public schools<\/span><\/a>, the <span data-term-id=\"36028802\">superintendent<\/span> or <span data-term-id=\"36028821\">school board members<\/span> usually carry this authority.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/education\/student-conduct-and-discipline\/truancy-overview.html\">Truancy<\/a> can lead to consequences, such as mandatory parent meetings or student interventions. In some cases, fines or even referral to juvenile court could result.<\/p>\n<\/p>\n                                    <\/li>\n                            <li>\n                    <h3>                                                    <a title=\"Illinois&#x20;School&#x20;Record&#x20;Privacy&#x20;Laws\" href=\"https:\/\/www.findlaw.com\/state\/illinois-law\/illinois-privacy-of-school-records-laws.html\">\n                                Illinois&#x20;School&#x20;Record&#x20;Privacy&#x20;Laws\n                            <\/a>\n                                            <\/h3>\n                    <p><p><span data-term-id=\"36028795\">Illinois<\/span> rules about <span data-term-id=\"36028812\">student records<\/span> largely derive from two laws. These are:<\/p>\n<ul>\n<li><a href=\"https:\/\/iarss.org\/wp-content\/uploads\/2019\/12\/Section-1-Resource-Student-Permanent-Records.pdf\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"36028795\">Illinois<\/span>\u2019 School <span data-term-id=\"36028812\">Student Records<\/span> Act<\/a> (Act)<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/education\/higher-education\/what-is-ferpa.html\">Federal Family Educational Rights and Privacy Act of 1974 (FERPA)<\/a><\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.findlaw.com\/state\/illinois-law\/illinois-privacy-of-school-records-laws.html\"><span data-term-id=\"36028795\">Illinois<\/span> school record privacy laws<\/a> give parents and eligible students rights over education records. <span data-term-id=\"36028815\">Eligibility<\/span> generally depends on age. Parents of <span data-term-id=\"36028840\">minors<\/span> can review records, request corrections, and challenge inaccurate information. Once a student turns 18 or attends a <span data-term-id=\"36028794\">postsecondary<\/span> institution, these rights transfer to the student.<\/p>\n<p>Records are divided into categories.<\/p>\n<ul>\n<li><strong>Permanent files<\/strong>: Academic transcripts, attendance records, immunization\/physical exam health records<\/li>\n<li><strong>Temporary files<\/strong>: Disciplinary records, other health records, special education files<\/li>\n<\/ul>\n<p>Schools must keep records confidential. School officials may access <span data-term-id=\"36028812\">student records<\/span> only when necessary for their duties. <span data-term-id=\"36028812\">Student records<\/span> cannot be shared with third parties unless they have the parent\u2019s\/student\u2019s written consent. Narrow exceptions include health emergencies or court orders.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/state\/illinois-law\/illinois-privacy-of-school-records-laws.html\">Violations of the Act<\/a> can result in civil liability and state sanctions. FERPA violations may trigger corrective action by the <a href=\"https:\/\/www.ed.gov\/\" target=\"_blank\" rel=\"noopener\">U.S. Department of Education<\/a>.<\/p>\n<\/p>\n                                    <\/li>\n                    <\/ul>\n    <\/div>\n            <div class=\"g-col-12 g-col-md-6\">\n        <ul class=\"nav-links fl-list-style-none fl-no-margin-horizontal\">\n                            <li>\n                    <h3>                                                    <a title=\"Illinois&#x20;Expression&#x20;and&#x20;School&#x20;Prayer&#x20;Laws\" href=\"https:\/\/www.findlaw.com\/state\/illinois-law\/illinois-prayer-in-public-schools-laws.html\">\n                                Illinois&#x20;Expression&#x20;and&#x20;School&#x20;Prayer&#x20;Laws\n                            <\/a>\n                                            <\/h3>\n                    <p><p><span data-term-id=\"36028795\">Illinois<\/span> <span data-term-id=\"36028797\">public school<\/span> teachers are required to begin each school day with a <a href=\"https:\/\/www.ilga.gov\/Legislation\/ILCS\/Articles?ActID=1008&amp;ChapterID=17\" target=\"_blank\" rel=\"noopener\">brief moment of silence<\/a>. Students may use this time for quiet reflection or take part in student-led prayer. Schools cannot organize, promote, or sponsor religious activity.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/state\/illinois-law\/illinois-prayer-in-public-schools-laws.html\"><span data-term-id=\"36028795\">Illinois<\/span> School Prayer Laws<\/a> allow students to express their religious beliefs, but it must be:<\/p>\n<ul>\n<li>Voluntary<\/li>\n<li>Non-disruptive<\/li>\n<li>Not endorsed by the school<\/li>\n<\/ul>\n<p><a href=\"https:\/\/codes.findlaw.com\/us\/title-20-education\/20-usc-sect-7904.html\" target=\"_blank\" rel=\"noopener\">Federal law<\/a> also requires districts to certify that they don\u2019t restrict constitutionally protected prayer. The goal is to respect <a href=\"https:\/\/www.findlaw.com\/education\/student-rights\/school-prayer-and-pledge-of-allegiance-types-of-prayer-banned.html#:~:text=Prayer%2C%20Public%20Schools%2C%20and%20the%20First%20Amendment\">students\u2019 First Amendment rights<\/a>.<\/p>\n<\/p>\n                                    <\/li>\n                            <li>\n                    <h3>                                                    <a title=\"Illinois&#x20;Discipline&#x20;Corporal&#x20;Punishment&#x20;Laws\" href=\"https:\/\/www.findlaw.com\/state\/illinois-law\/illinois-corporal-punishment-in-public-schools-laws.html\">\n                                Illinois&#x20;Discipline&#x20;Corporal&#x20;Punishment&#x20;Laws\n                            <\/a>\n                                            <\/h3>\n                    <p><p><span data-term-id=\"36028795\">Illinois<\/span> strictly bans the use of physical force to discipline school students. Before 2025, this ban applied only to <span data-term-id=\"36028797\">public schools<\/span>. As of 2025, however, it applies to all schools statewide.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/state\/illinois-law\/illinois-corporal-punishment-in-public-schools-laws.html\"><span data-term-id=\"36028795\">Illinois<\/span> Corporal Punishment laws<\/a> allow reasonable physical restraint only in specific situations. These include:<\/p>\n<ul>\n<li>To protect students or staff from harm<\/li>\n<li>To stop a fight<\/li>\n<li>To prevent serious disruption<\/li>\n<\/ul>\n<p>Corporal punishment is never permitted as a disciplinary method. Instead, schools must rely on non-violent strategies.
