The standard sentence is 20 to 60 years in prison, with mandatory time added if a firearm is used. Certain <span data-term-id=\"40931803\">aggravating factors<\/span>, such as the victim&#8217;s age or a particularly brutal crime, can increase the penalty to a mandatory sentence of <span data-term-id=\"40931811\">natural life<\/span> in prison without parole.<\/p>\n\n    <\/div>\n\n\n\n<p><span data-term-id=\"40931776\">First-degree murder<\/span> is among the most serious of all <span data-term-id=\"40931798\">criminal offenses<\/span>. While <span data-term-id=\"40931777\">Illinois<\/span> no longer has the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/death-penalty.html\"><span data-term-id=\"40931788\">death penalty<\/span><\/a>, the penalties for murder are still quite severe. If the state convicts someone of <span data-term-id=\"40931776\">first-degree murder<\/span>, they\u2019ll face up to life imprisonment.<\/p>\n<p>Like most other states, <span data-term-id=\"40931777\">Illinois<\/span> recognizes several levels of <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/homicide.html\">homicide<\/a>, up to and including <span data-term-id=\"40931776\">first-degree murder<\/span>. Whether the prosecutor can prove guilt beyond a <span data-term-id=\"40931786\">reasonable doubt<\/span> depends on whether they can prove intent.<\/p>\n<p>This article examines and explains how <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/first-degree-murder-overview.html\"><span data-term-id=\"40931776\">first-degree murder<\/span><\/a> laws work in Illinois. To prove <a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/first-degree-murder-overview.html\"><span data-term-id=\"40931776\">first-degree murder<\/span><\/a>, the state must establish its case beyond a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/defending-yourself-against-a-criminal-charge.html\"><span data-term-id=\"40931786\">reasonable doubt<\/span><\/a>. This requires proving that the defendant killed another individual without <span data-term-id=\"40931797\">lawful justification<\/span>, and either:<\/p>\n<ul>\n<li>Intended to kill their victim or do <span data-term-id=\"40931778\">great bodily harm<\/span><\/li>\n<li>Knew that their actions had a strong probability of causing death or <span data-term-id=\"40931778\">great bodily harm<\/span><\/li>\n<\/ul>\n<p><span data-term-id=\"40931777\">Illinois<\/span> also recognizes the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/felony-murder.html\"><span data-term-id=\"40931801\">felony murder rule<\/span><\/a>. Under this rule, a person can be found guilty of <span data-term-id=\"40931776\">first-degree murder<\/span> if they kill another person during the commission of a <a href=\"https:\/\/codes.findlaw.com\/il\/chapter-720-criminal-offenses\/il-st-sect-720-5-2-8\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40931779\">forcible felony<\/span><\/a>, such as sexual assault, robbery, etc.<\/p>\n<h2><span data-term-id=\"40931776\">First-Degree Murder<\/span> vs. <span data-term-id=\"40931780\">Second-Degree Murder<\/span><\/h2>\n<p>Most states recognize both first-degree and <span data-term-id=\"40931780\">second-degree murder<\/span>. The difference between the two crimes lies in the defendant&#8217;s intent. However, <span data-term-id=\"40931777\">Illinois<\/span> approaches this distinction a bit differently.<\/p>\n<p>Under <span data-term-id=\"40931777\">Illinois<\/span>&#8216; <span data-term-id=\"40931822\">criminal laws<\/span>, a person is guilty of <span data-term-id=\"40931776\">first-degree murder<\/span> when they intentionally kill another human being. With <a href=\"https:\/\/www.findlaw.com\/state\/illinois-law\/illinois-second-degree-murder-laws.html\"><span data-term-id=\"40931780\">second-degree murder<\/span><\/a>, the defendant commits an act of <span data-term-id=\"40931776\">first-degree murder<\/span>, but the charge is reduced if the defendant can prove that one of two mitigating circumstances existed:<\/p>\n<ul>\n<li>They acted under a sudden and <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-is-heat-of-passion\/\"><span data-term-id=\"40931785\">intense passion<\/span><\/a> resulting from <span data-term-id=\"40931789\">serious provocation<\/span><\/li>\n<li>They unreasonably believed their actions were legally justified (known as \u201cimperfect <span data-term-id=\"40931790\">self-defense<\/span>\u201d)<\/li>\n<\/ul>\n<p>In <span data-term-id=\"40931777\">Illinois<\/span>, <span data-term-id=\"40931780\">second-degree murder<\/span> is a <a href=\"https:\/\/codes.findlaw.com\/il\/chapter-730-corrections\/il-st-sect-730-5-5-4-5-30\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40931794\">Class 1<\/span> felony<\/a>. It carries a penalty of four to 20 years in prison. A person convicted of this <span data-term-id=\"40931798\">criminal offense<\/span> may also be required to pay fines of up to $25,000 as well as court costs.<\/p>\n<h2>How <span data-term-id=\"40931795\">Involuntary Manslaughter<\/span> Is Different from Murder<\/h2>\n<p>In addition to breaking murder down into first- and <span data-term-id=\"40931818\">second-degree <\/span><span data-term-id=\"40931783\">murder<\/span><span data-term-id=\"40931818\"> charges<\/span>, <span data-term-id=\"40931781\">Illinois<\/span><span data-term-id=\"40931781\"> law<\/span> recognizes the lesser offense of <span data-term-id=\"40931795\">involuntary manslaughter<\/span>. The primary difference between murder and <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-is-manslaughter\/\">manslaughter<\/a> has to do with intent.<\/p>\n<p>To be guilty of <a href=\"https:\/\/www.findlaw.com\/state\/illinois-law\/illinois-involuntary-manslaughter-laws.html\"><span data-term-id=\"40931795\">involuntary manslaughter<\/span><\/a>, the offender does not need to intend to kill their victim. Instead, it&#8217;s their reckless or negligent act that causes the death of another person. For example, if a person causes a death during a <a href=\"https:\/\/www.findlaw.com\/dui\/charges\/drunk-driving-accidents.html\">drunk driving<\/a> <span data-term-id=\"40931819\">motor vehicle<\/span> accident, they may be guilty of <span data-term-id=\"40931795\">involuntary manslaughter<\/span>. This is considered a <span data-term-id=\"40931810\">reckless homicide<\/span>.<\/p>\n<p>Under <span data-term-id=\"40931781\">Illinois<\/span><span data-term-id=\"40931781\"> law<\/span>, <a href=\"https:\/\/codes.findlaw.com\/il\/chapter-720-criminal-offenses\/il-st-sect-720-5-9-3.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40931795\">involuntary manslaughter<\/span><\/a> is a <span data-term-id=\"40931823\">Class 3<\/span> felony, which will result in a <span data-term-id=\"40931812\">prison sentence<\/span> of two to five years. If the victim is a <span data-term-id=\"40931791\">police officer<\/span>, firefighter, or EMT, the defendant will face <span data-term-id=\"40931816\">Class 2<\/span> felony charges instead and a potential <span data-term-id=\"40931812\">prison sentence<\/span> of three to seven years.<\/p>\n<h2>Penalties and Sentencing<\/h2>\n<p><span data-term-id=\"40931776\">First-degree murder<\/span> is the most serious felony in <span data-term-id=\"40931777\">Illinois<\/span>, <a href=\"https:\/\/codes.findlaw.com\/il\/chapter-730-corrections\/il-st-sect-730-5-5-4-5-20\/\" target=\"_blank\" rel=\"noopener\">with its own specific sentencing structure<\/a>. The standard sentence for a <span data-term-id=\"40931776\">first-degree <\/span><span data-term-id=\"40931796\">murder<\/span><span data-term-id=\"40931796\"> conviction<\/span> is 20 to 60 years in prison.<\/p>\n<p>When handing down a defendant&#8217;s sentence, the judge will consider both <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/factors-considered-in-determining-sentences.html\"><span data-term-id=\"40931803\">aggravating factors<\/span><\/a> and <span data-term-id=\"40931787\">mitigating factors<\/span>. These can increase or reduce the sentence given. Some of these factors include:<\/p>\n<ul>\n<li>Defendant\u2019s age at the <span data-term-id=\"40931804\">time of the killing<\/span><\/li>\n<li>Defendant&#8217;s history of committing <a href=\"https:\/\/archive.findlaw.com\/blog\/types-of-violent-crime\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40931793\">violent crimes<\/span><\/a><\/li>\n<li>The nature of the homicidal act<\/li>\n<li>The victim\u2019s age<\/li>\n<li>Defendant&#8217;s state of mind during the <span data-term-id=\"40931817\">commission of the offense<\/span><\/li>\n<\/ul>\n<p>If the judge or jury determines that certain <span data-term-id=\"40931803\">aggravating factors<\/span> exist, the sentence can be extended to a <a href=\"https:\/\/codes.findlaw.com\/il\/chapter-730-corrections\/il-st-sect-730-5-5-8-1\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40931811\">natural life<\/span> imprisonment<\/a>. For example, murders carried out through exceptionally brutal or heinous behavior indicative of wanton cruelty may have heavier sanctions. Other <span data-term-id=\"40931803\">aggravating factors<\/span> include the murder of a <span data-term-id=\"40931791\">police officer<\/span>, murdering more than one person, or a contract killing. <span data-term-id=\"40931777\">Illinois<\/span> does not use the <span data-term-id=\"40931788\">death penalty<\/span> as punishment.<\/p>\n<h3>Mandatory Firearm Enhancements<\/h3>\n<p><span data-term-id=\"40931777\">Illinois<\/span> also has a separate sentencing structure that adds significant mandatory time if a firearm was involved in the killing. The following sentences are added on top of the 20- to 60-year base sentence:<\/p>\n<ul>\n<li>+15 years if the person was armed with a firearm<\/li>\n<li>+20 years if the person discharged the firearm<\/li>\n<li>+25 years if use of the firearm caused <span data-term-id=\"40931778\">great bodily harm<\/span>, permanent disability\/disfigurement, or death to another person, which can be extended to <span data-term-id=\"40931811\">natural life<\/span> imprisonment at the court\u2019s discretion<\/li>\n<\/ul>\n<p>If a judge sentences a person to the minimum of 20 years for murder and the person discharged a firearm that killed the victim, the total mandatory sentence becomes 45 years to <span data-term-id=\"40931811\">natural life<\/span> (20 years + 25 years).<\/p>\n<h3>Parole for Young Offenders<\/h3>\n<p>Some convicted of <span data-term-id=\"40931776\">first-degree murder<\/span> in <span data-term-id=\"40931777\">Illinois<\/span> may receive a sentence of life without the possibility of parole. This is not the case for offenders who were under 21 years of age at the time of the crime. Effective January 1, 2024, young offenders who receive a life sentence <a href=\"https:\/\/codes.findlaw.com\/il\/chapter-730-corrections\/il-st-sect-730-5-5-4-5-115\/\" target=\"_blank\" rel=\"noopener\">are eligible for parole after serving 40 years<\/a>.<\/p>\n<h2>Possible Defenses Against <span data-term-id=\"40931808\">First-Degree <\/span><span data-term-id=\"40931783\">Murder<\/span><span data-term-id=\"40931808\"> Charges<\/span> in <span data-term-id=\"40931777\">Illinois<\/span><\/h2>\n<p>Like any other criminal charge, someone facing <span data-term-id=\"40931783\">murder charges<\/span> is innocent until proven guilty.
