But sometimes, especially when alcohol is involved, celebrations lead to wardrobe malfunctions. Depending on where that malfunction happens, it could end up violating <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/indecent-exposure.html\" target=\"_blank\">indecent exposure<\/a> laws in Illinois, also referred to as <i>public indecency<\/i> laws.<\/p>\r\n<p>In Illinois, anyone 17 or older can be charged with public indecency by engaging in the following in a public place:<\/p>\r\n<ul>\r\n<li>An act of sexual penetration or sexual conduct; or<\/li>\r\n<li>A <a href=\"https:\/\/www.findlaw.com\/legalblogs\/blotter\/2014\/10\/what-counts-as-criminally-lewd-behavior.html\" target=\"_blank\">lewd exposure<\/a> of the body done with the intent to arouse or to satisfy the sexual desire of the person.<\/li>\r\n<\/ul>\r\n<p>Notably, and thankfully, the statute specifically excludes breast-feeding of infants from the definition of public indecency.<\/p>\r\n<h2>What is Public?<\/h2>\r\n<p>Illinois&#8217; law contains a fairly broad definition of &quot;public place&quot; to include &quot;any place where the conduct may reasonably be expected to be viewed by others.&quot; Granted, you have <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/invasion-of-privacy.html\" target=\"_blank\">privacy rights<\/a>, especially in your own home. However, under this definition the focus is less on where you are geographically and more on whether third parties could reasonably be expected to see your exposure, which could apply even in less-public places.
