They claim this<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/unions-basics.html\"> weakens unions&#8217; financial ability<\/a> to negotiate better wages and benefits for all workers.<\/p>\n<p>Thanks to the <span data-term-id=\"40768710\">Supreme Court <\/span><a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/16-1466.html\" target=\"_blank\" rel=\"noopener\"><em><span data-term-id=\"40768724\">Janus<\/span> v. AFSCME<\/em><\/a> (2018) ruling, the entire U.S. is effectively right-to-work for government employees. Regardless of whether a <span data-term-id=\"40768702\">public sector<\/span> employee works in an RTW or non-RTW state, they cannot be forced to pay <span data-term-id=\"40768688\">union dues<\/span>\/fees. This ensures that no future state <span data-term-id=\"40768718\">legislature<\/span> could pass a statewide RTW law without amending the state constitution.<\/p>\n<h3>Legislative History<\/h3>\n<p>Before 2019, some lawmakers in the state <span data-term-id=\"40768700\">House<\/span> and <span data-term-id=\"40768727\">Senate<\/span> introduced bills to create RTW laws or RTW zones, as did some municipalities. None of these efforts succeeded.<\/p>\n<p>The most famous <a href=\"https:\/\/caselaw.findlaw.com\/us-7th-circuit\/1900838.html\" target=\"_blank\" rel=\"noopener\">case concerned the village of Lincolnshire<\/a>. In 2015, Lincolnshire passed a local ordinance to become <span data-term-id=\"40768663\">Illinois<\/span>&#8216; first RTW zone. Federal courts struck it down. They said the <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/what-is-the-nlrb.html#:~:text=Roosevelt%20in%201934.-,National%20Labor%20Relations%20Act,-The%20NLRA%20protects\"><span data-term-id=\"40768686\">National Labor Relations Act<\/span><\/a> (<span data-term-id=\"40768736\">NLRA<\/span>) authorizes <span data-term-id=\"40768742\">only states<\/span> to prohibit union security clauses. This means that employers can terminate someone for almost any reason, or no reason at all, as long as the reason isn\u2019t illegal discrimination or <a href=\"https:\/\/www.findlaw.com\/employment\/losing-a-job\/retaliation-and-wrongful-termination.html\">retaliation<\/a>. At\u2011will employment also means workers are free to quit at any time.<\/p>\n<p>While this system has nothing to do with unions or RTW laws, a CBA may override an employment relationship&#8217;s at-will status. This often surfaces when a CBA prohibits employers from <a href=\"https:\/\/www.findlaw.com\/employment\/losing-a-job\/wrongful-termination.html\">terminating workers without just cause<\/a>. The employer\u2019s power to fire is restricted by the specific terms, procedures, and due process rules negotiated in the union contract.<\/p>\n<h2>How Does <span data-term-id=\"40768663\">Illinois<\/span>\u2019 RTW Position Compare to Neighboring States?<\/h2>\n<p><span data-term-id=\"40768663\">Illinois<\/span> sits in a region where <span data-term-id=\"40768678\">labor laws<\/span> vary. This makes its approach to union rights important for some people. Several <a href=\"https:\/\/www.findlaw.com\/state\/wisconsin-law\/wisconsin-right-to-work-laws.html\">nearby states, like <span data-term-id=\"40768694\">Wisconsin<\/span>,<\/a> Iowa, and <span data-term-id=\"40768696\">Indiana<\/span>, have adopted RTW laws. Workers there can\u2019t be required to pay union\u2011related fees even if they benefit from union representation.<\/p>\n<p><span data-term-id=\"40768698\">Michigan<\/span> was a right\u2011to\u2011work state for years as well. It passed legislation in 2023 to\u00a0<a href=\"https:\/\/www.findlaw.com\/state\/michigan-law\/michigan-right-to-work-laws.html\">repeal its RTW law<\/a>. It went into effect in 2024, restoring stronger union <span data-term-id=\"40768670\">protections<\/span>.<\/p>\n<p>This varying degree of union involvement and workplace <span data-term-id=\"40768670\">protection<\/span> can influence where workers near state borders choose to work. It can also affect where businesses choose to locate.<\/p>\n<h2>Key Rights of <span data-term-id=\"40768704\">Illinois<\/span><span data-term-id=\"40768704\"> Workers<\/span><\/h2>\n<p><span data-term-id=\"40768704\">Illinois<\/span><span data-term-id=\"40768704\"> workers<\/span> benefit from a wide range of legal <span data-term-id=\"40768670\">protections<\/span> that go beyond the RTW debate. These rights shape everyday workplace experiences and aim to ensure that <a href=\"https:\/\/www.findlaw.com\/state\/illinois-law\/illinois-employment-laws.html\">employees across <span data-term-id=\"40768663\">Illinois<\/span> have clear <span data-term-id=\"40768670\">protections<\/span><\/a>. Both <span data-term-id=\"40768746\">state law<\/span> and the <a href=\"https:\/\/beta.dol.gov\/policy-regulations\/unions-collective-bargaining\/what-union\/employee-rights-nlra\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40768736\">NLRA<\/span> protect workers from punishment<\/a> or termination for supporting a union.<\/p>\n<h3><span data-term-id=\"40768672\">Collective Bargaining<\/span> <span data-term-id=\"40768670\">Protections<\/span><\/h3>\n<p>Workers in <span data-term-id=\"40768663\">Illinois<\/span> have strong <span data-term-id=\"40768730\">collective bargaining<\/span><span data-term-id=\"40768730\"> rights<\/span>. This includes the ability to negotiate over wages, hours, and <a href=\"https:\/\/www.findlaw.com\/employment\/workplace-safety.html\"><span data-term-id=\"40768684\">working conditions<\/span><\/a>. Thanks to <span data-term-id=\"40768706\">the Workers\u2019 Rights Amendment<\/span>, these rights are now a <span data-term-id=\"40768739\">fundamental right<\/span> under the <span data-term-id=\"40768712\">Illinois<\/span><span data-term-id=\"40768712\"> Constitution<\/span>. This means the state can&#8217;t pass RTW laws or weaken <span data-term-id=\"40768672\">collective bargaining<\/span> through legislation.<\/p>\n<h3>Workplace Safety <span data-term-id=\"40768670\">Protections<\/span><\/h3>\n<p>State and federal safety rules protect <span data-term-id=\"40768704\">Illinois<\/span><span data-term-id=\"40768704\"> workers<\/span>.
