A person is found guilty of\u00a0<span data-term-id=\"40796858\">second-degree murder<\/span>\u00a0only if, after the state proves all the\u00a0<span data-term-id=\"40796901\">elements of <\/span><span data-term-id=\"40796860\">first-degree murder<\/span>, the defense introduces <span data-term-id=\"40796870\">mitigating factors<\/span> that reduce the charge.<\/p>\n<h3><span data-term-id=\"40796860\">First-Degree Murder<\/span><\/h3>\n<p>The <span data-term-id=\"40796901\">elements of <\/span><span data-term-id=\"40796860\">first-degree murder<\/span> are detailed under <span data-term-id=\"40796864\">Illinois<\/span><span data-term-id=\"40796864\"> law<\/span>. The prosecution must prove the following elements beyond a\u00a0<span data-term-id=\"40796873\">reasonable doubt<\/span>\u00a0for a <span data-term-id=\"40796860\">first-degree <\/span><span data-term-id=\"40796880\">murder<\/span><span data-term-id=\"40796880\"> conviction<\/span>:<\/p>\n<ul>\n<li><strong>The defendant killed someone:<\/strong> They performed the act that caused the death of a <span data-term-id=\"40796900\">human being<\/span><\/li>\n<li><strong>The defendant had one of <\/strong><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/mens-rea-a-defendant-s-mental-state.html\"><strong>the required mental states<\/strong><\/a><strong>:<\/strong> Intent to kill or cause <span data-term-id=\"40796861\">great bodily harm<\/span> to another <span data-term-id=\"40796900\">human being<\/span>, or knowledge that their actions created a <span data-term-id=\"40796885\">strong probability of death<\/span> or <span data-term-id=\"40796861\">great bodily harm<\/span><\/li>\n<li><strong>The killing was without <span data-term-id=\"40796877\">lawful justification<\/span>: <\/strong>The defendant didn\u2019t act in true <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/self-defense-overview.html\"><span data-term-id=\"40796871\">self-defense<\/span><\/a> or defense of others, for example<\/li>\n<\/ul>\n<p>Only after the state proves these elements can the jury consider whether the killing should be reduced to <span data-term-id=\"40796858\">second-degree murder<\/span>. The reduction is a possibility with all\u00a0<span data-term-id=\"40796884\">first-degree murder<\/span><span data-term-id=\"40796884\"> charges<\/span>\u00a0except\u00a0<span data-term-id=\"40796866\">felony murder<\/span>. When a killing occurs during the commission of a <span data-term-id=\"40796862\">forcible felony<\/span>, <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-is-the-felony-murder-rule\/\">the <span data-term-id=\"40796887\">felony murder<\/span><span data-term-id=\"40796887\"> rule<\/span><\/a> treats the intent to commit the felony as a substitute for intent to kill.<\/p>\n<h3><span data-term-id=\"40796858\">Second-Degree Murder<\/span><\/h3>\n<p><span data-term-id=\"40796858\">Second-degree murder<\/span>\u00a0is <span data-term-id=\"40796860\">first-degree murder<\/span>\u00a0reduced by a\u00a0<span data-term-id=\"40796870\">mitigating factor<\/span>. <span data-term-id=\"40796859\">Illinois<\/span> used to call this <span data-term-id=\"40796881\">criminal offense<\/span> <span data-term-id=\"40796875\">voluntary manslaughter<\/span>, but the <a href=\"https:\/\/ilga.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40796859\">Illinois<\/span> <span data-term-id=\"40796897\">General Assembly<\/span><\/a> replaced it with <span data-term-id=\"40796858\">second-degree murder<\/span> in 1987.<\/p>\n<p><span data-term-id=\"40796858\">Second-degree murder<\/span> is still knowing or <span data-term-id=\"40796890\">intentional killing<\/span> without <span data-term-id=\"40796877\">lawful justification<\/span>. If the defendant can prove a <span data-term-id=\"40796870\">mitigating factor<\/span>, the crime becomes less serious in the eyes of the law.<\/p>\n<p><span data-term-id=\"40796859\">Illinois<\/span> recognizes two <span data-term-id=\"40796870\">mitigating factors<\/span>:<\/p>\n<ul>\n<li><span data-term-id=\"40796869\">Serious provocation<\/span> leading to <span data-term-id=\"40796865\">intense passion<\/span> at the <span data-term-id=\"40796872\">time of the killing<\/span><\/li>\n<li>An unreasonable belief in the need for <span data-term-id=\"40796888\">deadly force<\/span> in <span data-term-id=\"40796871\">self-defense<\/span><\/li>\n<\/ul>\n<p>Once the prosecution proves <span data-term-id=\"40796860\">first-degree murder<\/span>, the defendant must prove that one of these <span data-term-id=\"40796870\">mitigating factors<\/span> was present by a <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/standards-of-proof-in-civil-cases-preponderance-of-evidence-and-clear-and-convincing-evidence.html#:~:text=committed%20the%20offense.-,Preponderance%20of%20the%20Evidence,-As%20the%20most\"><span data-term-id=\"40796899\">preponderance<\/span> of the evidence<\/a>. This means showing it\u2019s more likely than not that the <span data-term-id=\"40796889\">mitigating circumstance<\/span> existed, a lower standard than <span data-term-id=\"40796873\">reasonable doubt<\/span>.<\/p>\n<h2>Penalties and Sentencing<\/h2>\n<p>Even though\u00a0<span data-term-id=\"40796858\">second-degree murder<\/span>\u00a0is less serious than\u00a0<span data-term-id=\"40796860\">first-degree murder<\/span>, it is still a\u00a0<span data-term-id=\"40796895\">serious crime<\/span>\u00a0with severe consequences. <a href=\"https:\/\/codes.findlaw.com\/il\/chapter-730-corrections\/il-st-sect-730-5-5-4-5-10\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40796859\">Illinois<\/span> uses a felony classification system<\/a>. It ranges from Class 4 (least serious) up to Class X. They must impose a sentence of either four to 20 years in prison, or probation for up to four years. If it&#8217;s a prison sentence, the person must also get two years of mandatory supervised release.<\/p>\n<p>One or more of the following penalties may also apply:<\/p>\n<ul>\n<li>Fines up to $25,000<\/li>\n<li>Court costs, fees, and assessments<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/restitution.html\">Restitution<\/a> to victims<\/li>\n<\/ul>\n<p>By comparison, a <span data-term-id=\"40796884\">first-degree murder<\/span><span data-term-id=\"40796884\"> charge<\/span> carries a standard sentencing range of 20 to 60 years, with possible extensions up to natural life. <span data-term-id=\"40796859\">Illinois<\/span> stopped using the <span data-term-id=\"40796886\">death penalty<\/span> in 2011.<\/p>\n<p>Judges consider many factors when deciding a sentence.
