For a <span data-term-id=\"38993557\">criminal charge<\/span> like <span data-term-id=\"38993545\">domestic battery<\/span>, the act must be committed by someone in a qualifying relationship, such as a spouse, relative, or person who shares a child in common. Victims of <span data-term-id=\"38993554\">family violence<\/span>, stalking, or sexual offenses may be able to seek a civil <span data-term-id=\"38993548\">protective order<\/span> from the court.<\/p>\n\n    <\/div>\n\n\n\n<p>Also referred to as <span data-term-id=\"38993554\">family violence<\/span>, acts of <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/domestic-violence.html\" aria-expanded=\"false\"><span data-term-id=\"38993544\">domestic violence<\/span><\/a> occur between family and <span data-term-id=\"38993547\">household members<\/span>. <span data-term-id=\"38993543\">Indiana<\/span> has laws and protections in place to help <span data-term-id=\"38993555\">victims of <\/span><span data-term-id=\"38993544\">domestic violence<\/span> find safety.<\/p>\n<p><span data-term-id=\"38993543\">Indiana<\/span>&#8216;s definition of <span data-term-id=\"38993544\">domestic violence<\/span> is a bit different than that of most other states, so it&#8217;s important to know what it covers. In this article, we&#8217;ll explain the exact definition of <span data-term-id=\"38993544\">domestic violence<\/span> in <span data-term-id=\"38993543\">Indiana<\/span>, <a href=\"https:\/\/www.in.gov\/courts\/help\/efiling\/protection-orders\/\" target=\"_blank\" rel=\"noopener\">examine available protections and programs<\/a>, and outline the process of getting a <span data-term-id=\"38993548\">protective order<\/span>.<\/p>\n<h2>Defining <span data-term-id=\"38993544\">Domestic Violence<\/span><\/h2>\n<p>For the most part, <span data-term-id=\"38993544\">domestic violence<\/span> occurs when people sharing certain personal relationships have a specified abusive act happen between them. Both elements are required for <span data-term-id=\"38993544\">domestic violence<\/span> classification.<\/p>\n<p>For example, a husband <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/battered-women-s-syndrome.html\" aria-expanded=\"false\">causing a physical injury to his wife<\/a> is <span data-term-id=\"38993544\">domestic violence<\/span>. A person punching someone they don&#8217;t know in the face is a crime, but not <span data-term-id=\"38993544\">domestic violence<\/span>.<\/p>\n<p>The best way to understand <span data-term-id=\"38993544\">domestic violence<\/span> offenses is to take a closer look at each aspect. Let&#8217;s dive in.<\/p>\n<h3>Criminal Acts<\/h3>\n<p><span data-term-id=\"38993544\">Domestic violence<\/span> is about <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/power-and-control\/\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">control and power<\/a>. Abusers use different <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/types-of-domestic-violence.html\" aria-expanded=\"false\">types of <span data-term-id=\"38993584\">domestic abuse<\/span><\/a> to keep victims living in fear and feeling helpless. The vicious cycle of threats, coercion, abuse, and violence can ruin lives and tear families apart.<\/p>\n<p>Not every abusive crime is eligible to be <span data-term-id=\"38993544\">domestic violence<\/span>. Under the <span data-term-id=\"38993549\">Indiana<\/span><span data-term-id=\"38993549\"> Code<\/span>, <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-6-2-34-5\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">offenses under certain categories<\/a> can qualify as <span data-term-id=\"38993544\">domestic violence<\/span> if committed between people in certain relationships. These categories are:<\/p>\n<ul>\n<li>Causing, threatening to cause, or attempting to cause <span data-term-id=\"38993570\">physical harm<\/span><\/li>\n<li>Placing a person in fear of <span data-term-id=\"38993570\">physical harm<\/span><\/li>\n<li>Causing someone to engage in a sexual act against their will via threats, duress, or force<\/li>\n<li>Abusing, torturing, mutilating, or killing a vertebrate animal without justification to coerce, harass, intimidate, terrorize, or threaten a <span data-term-id=\"38993567\">family member<\/span><\/li>\n<\/ul>\n<p>For example, <a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-42-2-9\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"38993552\">strangulation<\/span> is considered causing <span data-term-id=\"38993570\">physical harm<\/span><\/a>. Threatening to strangle a <span data-term-id=\"38993567\">family member<\/span> or <span data-term-id=\"38993547\">household member<\/span> is also <span data-term-id=\"38993544\">domestic violence<\/span>.<\/p>\n<p>For a <span data-term-id=\"38993557\">criminal charge<\/span> like <span data-term-id=\"38993545\">domestic battery<\/span>, the act must occur between people in a qualifying relationship. However, <span data-term-id=\"38993543\">Indiana<\/span> law makes an exception for obtaining a <span data-term-id=\"38993548\">protective order<\/span>. Victims of stalking and certain <span data-term-id=\"38993571\">sex offenses<\/span> (like rape or <span data-term-id=\"38993575\">sexual assault<\/span>) can petition the court for a <span data-term-id=\"38993548\">protective order<\/span> against the offender, <em>regardless of their relationship<\/em>. This provides these victims with the same civil protections available to victims of <span data-term-id=\"38993554\">family violence<\/span>.<\/p>\n<h3><span data-term-id=\"38993567\">Family Members<\/span> and <span data-term-id=\"38993547\">Household Members<\/span><\/h3>\n<p>For <span data-term-id=\"38993544\">domestic violence<\/span> offenses that aren&#8217;t stalking or <span data-term-id=\"38993571\">sex offenses<\/span>, the participants must share a <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-6-2-44-8\/\" target=\"_blank\" rel=\"noopener\">qualifying personal relationship<\/a>. They can be any of the following:<\/p>\n<ul>\n<li>Current or former spouses<\/li>\n<li>People who are dating or have dated (<span data-term-id=\"38993583\">intimate partners<\/span>)<\/li>\n<li>People who have a child in common<\/li>\n<li>People related by blood, adoption, or marriage (such as in-laws)<\/li>\n<li>People with a legal relationship, like a guardian, ward, legal custodian, or foster parent<\/li>\n<li>A minor child of anyone in the relationships listed above<\/li>\n<\/ul>\n<p>If people in one of these relationships have a qualifying criminal act occur between them, it&#8217;s <span data-term-id=\"38993544\">domestic violence<\/span>.<\/p>\n<h2><span data-term-id=\"38993543\">Indiana<\/span> <span data-term-id=\"38993544\">Domestic Violence<\/span> <span data-term-id=\"38993548\">Protection Orders<\/span><\/h2>\n<p>If you&#8217;re suffering <span data-term-id=\"38993544\">domestic violence<\/span> or are in fear of future abuse, call 911 as soon as you can. <span data-term-id=\"38993543\">Indiana<\/span> <span data-term-id=\"38993566\">law enforcement<\/span> receives <a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-33-1-1-5\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">specialized training for handling domestic calls<\/a>. They&#8217;ll secure your safety and inform you of your options.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-orders-of-protection-and-restraining-orders.html\" aria-expanded=\"false\"><span data-term-id=\"38993543\">Indiana<\/span> <span data-term-id=\"38993548\">protection orders<\/span><\/a> are an option for <span data-term-id=\"38993555\">victims of <\/span><span data-term-id=\"38993544\">domestic violence<\/span>, as well as for victims of stalking and sexual violence, regardless of their relationship to the other person. These civil <span data-term-id=\"38993577\">court orders<\/span> are designed to keep abusers away from victims. They do this through provisions tailored to each case. While not a perfect form of defense, <span data-term-id=\"38993586\">orders of protection<\/span> offer an effective means of relief.<\/p>\n<h3>How To Get a <span data-term-id=\"38993548\">Protective Order<\/span><\/h3>\n<p>There are several ways to begin the process of getting an <span data-term-id=\"38993543\">Indiana<\/span> <span data-term-id=\"38993548\">protection order<\/span>. The state recommends seeking help from a <a href=\"https:\/\/www.thehotline.org\/get-help\/domestic-violence-local-resources\/\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><span data-term-id=\"38993544\">domestic violence<\/span> advocate<\/a> if possible. If not, you can file for a <span data-term-id=\"38993556\">restraining order<\/span> in <a href=\"https:\/\/www.in.gov\/courts\/directory\/\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">a civil court near you<\/a> or through the <a href=\"https:\/\/public.courts.in.gov\/porefsp#\/\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><span data-term-id=\"38993543\">Indiana<\/span> <span data-term-id=\"38993548\">Protection Order<\/span> E-filing Service Provider<\/a>. Forms are <a href=\"https:\/\/www.in.gov\/courts\/iocs\/publications\/po-forms\/\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">available online<\/a>.<\/p>\n<p>The court clerk can help you with the forms, but can\u2019t offer legal advice. If you feel like you need guidance for your orders, speak with a <a href=\"https:\/\/lawyers.findlaw.com\/domestic-violence\/indiana\/?fli=dcta\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"38993544\">domestic violence<\/span> attorney<\/a>.<\/p>\n<p>Once you&#8217;ve filed, a judge will review your petition. If the court agrees that you (petitioner) have suffered <span data-term-id=\"38993584\">domestic abuse<\/span> or are in danger, an <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-26-5-6\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">ex parte order for protection<\/a> is issued. This is a temporary <span data-term-id=\"38993556\">restraining order<\/span> that lasts for 30 days or until the court hearing for a final <span data-term-id=\"38993586\">order of protection<\/span> takes place. Ex parte means that it&#8217;s issued without the court speaking with the abuser (respondent).<\/p>\n<p>The ex parte order is served to the respondent by <span data-term-id=\"38993566\">law enforcement<\/span>. Never serve an order to your respondent yourself. If you&#8217;re served with a <span data-term-id=\"38993548\">protective order<\/span>, you should speak to a <a href=\"https:\/\/lawyers.findlaw.com\/lawyer\/criminal-law\/indiana?fli=dcta\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"38993553\">criminal defense attorney<\/span><\/a> as soon as possible.<\/p>\n<p>A case hearing will take place <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-26-5-10\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">within 30 days of the ex parte order&#8217;s issuance<\/a>. If the respondent opposes the order, both sides present their cases at the court hearing. You can offer evidence and call witnesses. If the petitioner demonstrates that the threat persists, a final order for protection is issued.<\/p>\n<p>A final order for protection can amend conditions from the ex parte order and add new ones. Final <span data-term-id=\"38993548\">protection orders<\/span> <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-26-5-9\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">last for up to two years<\/a> and can be extended. Orders for victims of sexual crimes committed by someone either registered as a sex offender or who has to register as a sex offender after the conviction have no termination date.<\/p>\n<h3>What Does a <span data-term-id=\"38993548\">Protective Order<\/span> Do?<\/h3>\n<p>Ex parte orders for protection contain provisions to restrain the respondent and make temporary rulings on issues such as <span data-term-id=\"38993563\">child custody<\/span> and child support. While <span data-term-id=\"38993548\">protection orders<\/span> vary between cases, <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-26-5-6\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"38993543\">Indiana<\/span> law ensures certain provisions are available<\/a>:<\/p>\n<ul>\n<li>The respondent (abuser) cannot commit further acts of domestic or <span data-term-id=\"38993554\">family violence<\/span> against the petitioner (victim) or their family<\/li>\n<li>The respondent cannot threaten to commit further acts of domestic or <span data-term-id=\"38993554\">family violence<\/span> against the petitioner or their family<\/li>\n<li>The respondent must not have any contact with the petitioner<\/li>\n<li>The respondent cannot use a tracking device on the petitioner<\/li>\n<li>The respondent must vacate a shared dwelling and not return<\/li>\n<li>The respondent must stay away from the petitioner&#8217;s residence, workplace, school, or any other named location<\/li>\n<li>Awarding possession of any shared animals to the petitioner<\/li>\n<li>Ordering possession of property, such as a dwelling or an automobile, to the petitioner<\/li>\n<li>Make rulings on parenting time and necessary conditions<\/li>\n<li>Order a respondent to pay the petitioner&#8217;s legal fees, medical expenses, or other costs<\/li>\n<li>Prohibit the respondent from possessing any firearms or ammunition<\/li>\n<li>Set conditions if the petitioner and respondent must occupy the same location (i.e., a workplace)<\/li>\n<\/ul>\n<p>The court can add any condition it considers necessary for the petitioner&#8217;s safety. Conditions in the ex parte order often remain in the final order for protection.<\/p>\n<p>Orders for protection issued in <span data-term-id=\"38993543\">Indiana<\/span> are good anywhere in the U.S. <a href=\"https:\/\/www.hud.gov\/vawa#openModal\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">under federal law<\/a>. <span data-term-id=\"38993543\">Indiana<\/span> also recognizes <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-26-5-17\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">out-of-state <span data-term-id=\"38993548\">protective orders<\/span><\/a>.<\/p>\n<p>An order is most effective when the victim is willing to call <span data-term-id=\"38993566\">law enforcement<\/span> for any violation or threatened violation. Punishments for domestic crimes receive enhancement. For example, a <a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-42-2-1\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">simple battery<\/a> under <span data-term-id=\"38993543\">Indiana<\/span> <span data-term-id=\"38993574\">Criminal law<\/span> is a Class B <span data-term-id=\"38993546\">misdemeanor<\/span>. <a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-42-2-1-3.html\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"38993588\">Misdemeanor<\/span> <span data-term-id=\"38993545\">domestic battery<\/span><\/a> is charged as a <span data-term-id=\"38993550\">Class A<\/span> <span data-term-id=\"38993546\">misdemeanor<\/span>.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-46-1-15-1\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">Violations of orders for protection<\/a> can also lead to <span data-term-id=\"38993576\">jail time<\/span>. In addition to penalties for conviction of any offenses committed during the violation, the following punishments apply:<\/p>\n<ul>\n<li><strong>First violation of an order for protection<\/strong> (<a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-50-3-2.html\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"38993550\">Class A<\/span> <span data-term-id=\"38993546\">misdemeanor<\/span><\/a>): A fine of up to $5,000 and up to one year in jail<\/li>\n<li><strong>Any violation of an order for protection after the first<\/strong> OR <strong>any violation with a previous conviction for stalking<\/strong> (<a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-50-2-7.html\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">Level 6 felony<\/a>): A fine of up to $10,000 and between six months and 2.5 years in prison<\/li>\n<\/ul>\n<p>Violating a <span data-term-id=\"38993548\">protective order<\/span> or no contact order can also be charged as <span data-term-id=\"38993558\">invasion of privacy<\/span>, a <span data-term-id=\"38993550\">Class A<\/span> <span data-term-id=\"38993546\">misdemeanor<\/span>. It is very important to report all <span data-term-id=\"38993548\">protective order<\/span> violations, including threats.<\/p>\n<h2>Other Resources for Survivors<\/h2>\n<p><span data-term-id=\"38993548\">Protective orders<\/span> are not the only way <span data-term-id=\"38993543\">Indiana<\/span> helps victims of domestic and <span data-term-id=\"38993554\">family violence<\/span>. An <a href=\"https:\/\/www.in.gov\/attorneygeneral\/about-the-office\/appeals\/victim-services\/hope-card-program\/\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><span data-term-id=\"38993543\">Indiana<\/span> Hope Card<\/a> allows victims to have important information about their <span data-term-id=\"38993548\">protective order<\/span> on a wallet-sized card. This enables\u00a0<span data-term-id=\"38993566\">law enforcement<\/span>\u00a0to quickly access the details of your order. It&#8217;s <a href=\"https:\/\/www.in.gov\/courts\/selfservice\/protection-orders\/#advocates\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">available for free through <span data-term-id=\"38993543\">Indiana<\/span> <span data-term-id=\"38993544\">domestic violence<\/span> advocates<\/a>.<\/p>\n<p>Leaving an abuser takes tremendous courage. Having a <a href=\"https:\/\/www.thehotline.org\/what-is-a-safety-plan\/\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">safety plan<\/a> in place can make the process easier and minimize the risk of danger. Knowing where to go, who to call, and how to access resources and protections can make a huge difference.<\/p>\n<p>Having your abuser find you again after you leave would be a nightmare. <span data-term-id=\"38993543\">Indiana<\/span>&#8216;s <a href=\"https:\/\/www.in.gov\/attorneygeneral\/about-the-office\/appeals\/victim-services\/address-confidentiality-program\/\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">Address Confidentiality Program<\/a> offers a solution. Participants receive a second legal mailing address for public records. First-class mail is forwarded to the victim&#8217;s true address.
