Almost all states consider a crime as <span data-term-id=\"39053033\">domestic violence<\/span> when people in certain personal relationships have one of a set of specified abusive acts occur between them.<\/p>\n<p><span data-term-id=\"39053032\">Indiana<\/span> follows this classification but expands on it. Any offense involving either <a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-45-10-5\/\" target=\"_blank\" rel=\"noopener\">stalking<\/a> or a <a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-42-4-8\/\" target=\"_blank\" rel=\"noopener\">sex crime<\/a> is <span data-term-id=\"39053033\">domestic violence<\/span> in <span data-term-id=\"39053032\">Indiana<\/span>. The relationship between the participants doesn&#8217;t matter. This means that more victims have access to <span data-term-id=\"39053033\">domestic violence<\/span> protections and programs.<\/p>\n<h2>Who Can Be Involved in <span data-term-id=\"39053033\">Domestic Violence<\/span> and What Are the Crimes?<\/h2>\n<p>Let&#8217;s take the crimes first. The following <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-6-2-34-5\/\" target=\"_blank\" rel=\"noopener\">abusive acts are eligible for <span data-term-id=\"39053033\">domestic violence<\/span><\/a> classification if they occur between people in specified personal relationships:<\/p>\n<ul>\n<li>Causing <span data-term-id=\"39053067\">physical harm<\/span><\/li>\n<li>Attempting to cause <span data-term-id=\"39053067\">physical harm<\/span><\/li>\n<li>Threatening to cause <span data-term-id=\"39053067\">physical harm<\/span><\/li>\n<li>Using threats, force, or duress to cause someone to engage in any sexual acts against their will<\/li>\n<li>Abusing, torturing, mutilating, or killing a vertebrate animal without justification to coerce, threaten, harass, terrorize, or intimidate<\/li>\n<li>Causing fear of <span data-term-id=\"39053067\">physical harm<\/span><\/li>\n<\/ul>\n<p>As mentioned, the following two crimes do not require a personal relationship between victim and abuser. They are always <span data-term-id=\"39053060\">domestic violence<\/span><span data-term-id=\"39053060\"> crimes<\/span> in <span data-term-id=\"39053032\">Indiana<\/span>:<\/p>\n<ul>\n<li>Stalking<\/li>\n<li>Sexual offenses that include rape, sexual battery, and <span data-term-id=\"39053073\">sexual assault<\/span><\/li>\n<\/ul>\n<p>Aside from stalking and sex crimes, abusive acts require the participants to fall under the <span data-term-id=\"39053032\">Indiana<\/span> <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-6-2-44-8\/\" target=\"_blank\" rel=\"noopener\">definition of family members and <span data-term-id=\"39053035\">household members<\/span><\/a>. The required relationships are:<\/p>\n<ul>\n<li>Spouses<\/li>\n<li>Former spouses<\/li>\n<li>People in an intimate relationship<\/li>\n<li>People who had a sexual relationship with one another<\/li>\n<li>People with a child in common<\/li>\n<li>People who are dating<\/li>\n<li>People who dated each other<\/li>\n<li>Related by adoption<\/li>\n<li>Related by consanguinity (blood relatives)<\/li>\n<li>Related by marriage (in-laws)<\/li>\n<li>A legal relationship as a custodian, foster parent, guardian, or ward<\/li>\n<li>A minor child of any of the people in one of the relationships listed<\/li>\n<\/ul>\n<p>Under <span data-term-id=\"39053032\">Indiana<\/span> <span data-term-id=\"39053044\">family law<\/span>, a person threatening to assault a stranger is a crime, but not <span data-term-id=\"39053033\">domestic violence<\/span>. A lover threatening to assault their partner <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/understand-relationship-abuse\/\" target=\"_blank\" rel=\"noopener\">is <span data-term-id=\"39053033\">domestic violence<\/span><\/a>.<\/p>\n<h2>I Feel Like My Abuser Is Going To Assault Me Again Soon. What Can I Do?<\/h2>\n<p>Call 911. It sounds simple, but whenever you&#8217;re suffering abuse or are in imminent fear of it happening, you should call the police. <span data-term-id=\"39053040\">Law enforcement<\/span> in <span data-term-id=\"39053032\">Indiana<\/span> <a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-33-1-1-5\/\" target=\"_blank\" rel=\"noopener\">receives special training for <span data-term-id=\"39053046\">domestic violence<\/span><span data-term-id=\"39053046\"> cases<\/span><\/a>. They can arrest the abuser with good cause and confiscate all firearms.<\/p>\n<h2>Am I Better Off Running Away From My Abuser and Finding a Shelter?<\/h2>\n<p>Every toxic relationship is different, so there&#8217;s no one-size-fits-all answer. Knowing where to go and what to do is often a better idea than just winging it. <a href=\"https:\/\/www.thehotline.org\/what-is-a-safety-plan\/\" target=\"_blank\" rel=\"noopener\">Developing a safety plan<\/a>, with important numbers, accounts, and locations, can make a big difference.<\/p>\n<p>There are organizations ready to help you on <a href=\"https:\/\/www.thehotline.org\/get-help\/domestic-violence-local-resources\/\" target=\"_blank\" rel=\"noopener\">both the national<\/a> and <a href=\"https:\/\/www.in.gov\/courts\/selfservice\/protection-orders\/#advocates\" target=\"_blank\" rel=\"noopener\">state level<\/a>. Keep in mind that your browser history is searchable. Be as careful as possible.<\/p>\n<h2>What Difference Does a Crime Being Classified as <span data-term-id=\"39053033\">Domestic Violence<\/span> Make?<\/h2>\n<p><span data-term-id=\"39053033\">Domestic violence<\/span> classification matters in a couple of ways. A <span data-term-id=\"39053066\">crime involving <\/span><span data-term-id=\"39053033\">domestic<\/span><span data-term-id=\"39053033\"> violence<\/span> has enhanced penalties. For example, <a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-42-2-1\/\" target=\"_blank\" rel=\"noopener\">simple battery<\/a> is a Class B <span data-term-id=\"39053039\">misdemeanor<\/span> in <span data-term-id=\"39053032\">Indiana<\/span>. <a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-42-2-1-3.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39053036\">Domestic battery<\/span><\/a> is a <span data-term-id=\"39053042\">Class A<\/span> <span data-term-id=\"39053039\">misdemeanor<\/span>. <span data-term-id=\"39053043\">Victims of <\/span><span data-term-id=\"39053033\">domestic violence<\/span> also gain access to a variety of programs, including orders for protection.<\/p>\n<h2>I Want My Abuser Out of My Life. Is There Any Way To Keep Them Away From Me?<\/h2>\n<p>One of the strongest tools an <span data-term-id=\"39053032\">Indiana<\/span> <span data-term-id=\"39053033\">domestic violence<\/span> victim has is an <a href=\"https:\/\/iga.in.gov\/laws\/2024\/ic\/titles\/34#34-26-5-9\" target=\"_blank\" rel=\"noopener\">order for protection<\/a>. These <span data-term-id=\"39053064\">civil <\/span><span data-term-id=\"39053034\">protection orders<\/span> consist of provisions designed to stop abuse and control of victims. Available in both emergency temporary and final versions, these <span data-term-id=\"39053047\">restraining orders<\/span> dictate what an abuser can and cannot do with regard to their victim.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/state\/indiana-law\/indiana-domestic-violence-laws.html\"><span data-term-id=\"39053034\">Protective orders<\/span><\/a> can contain no-contact provisions, housing decisions, temporary <span data-term-id=\"39053038\">child custody<\/span> directives, conditions banning the abuser from possessing firearms, and much more. <a href=\"https:\/\/www.in.gov\/courts\/iocs\/publications\/po-forms\/\" target=\"_blank\" rel=\"noopener\">Each order is tailored<\/a> to the needs of a case. Final orders last up to two years and are renewable.<\/p>\n<p>There are several different types of <span data-term-id=\"39053034\">protective orders<\/span> available in <span data-term-id=\"39053032\">Indiana<\/span>. FindLaw&#8217;s <a href=\"https:\/\/www.findlaw.com\/state\/indiana-law\/indiana-protective-orders-laws.html\"><span data-term-id=\"39053032\">Indiana<\/span> <span data-term-id=\"39053034\">Protective Orders<\/span> Laws<\/a> article will explain what each one does, which one is right for you, and how you get it.<\/p>\n<h2>I&#8217;m Taking the Kids To Visit My Mother, Who Lives in Another State. Is My Order for Protection Still Good?<\/h2>\n<p>Orders issued in <span data-term-id=\"39053032\">Indiana<\/span> stay in effect no matter what state you go to. They&#8217;re enforced under federal law through the <a href=\"https:\/\/www.hud.gov\/vawa#openModal\" target=\"_blank\" rel=\"noopener\">Violence Against Women Act (VAWA)<\/a>. You&#8217;re also covered on tribal reservations and all U.S. territories as well.<\/p>\n<p>Most states enforce out-of-state orders on their own. <span data-term-id=\"39053032\">Indiana<\/span> is no exception. Referred to as &#8220;foreign orders,&#8221; they receive full coverage.<\/p>\n<h2>I Think I Saw My Abuser in My Driveway. My Order for Protection States That They Have To Stay Away From My Residence and Have No Contact With Me. What Now?<\/h2>\n<p>Call <span data-term-id=\"39053040\">law enforcement<\/span> and report the violation. Threatening to violate an <span data-term-id=\"39053032\">Indiana<\/span> <span data-term-id=\"39053034\">protection order<\/span> is also a violation and can lead to arrest. Violation of an order for protection is considered <a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-46-1-15-1\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39053048\">invasion of privacy<\/span><\/a> in <span data-term-id=\"39053032\">Indiana<\/span>. Even a single violation can invoke jail time.<\/p>\n<p>Violation penalties are in addition to any sentences for crimes committed during the transgression. If the abuser chooses to ignore a <span data-term-id=\"39053034\">protection order<\/span>, they face the following:<\/p>\n<ul>\n<li><strong>First violation of an order for protection<\/strong> (<a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-50-3-2.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39053042\">Class A<\/span> <span data-term-id=\"39053039\">misdemeanor<\/span><\/a>): Up to one year in jail and a fine of up to $5,000<\/li>\n<li><strong>Any violation of an order for protection after the first<\/strong> OR <strong>any violation with a previous conviction for stalking<\/strong> (<a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-50-2-7.html\" target=\"_blank\" rel=\"noopener\">Level 6 felony<\/a>): Between six months and two and a half years in prison or a fine of up to $10,000<\/li>\n<\/ul>\n<p>While <span data-term-id=\"39053040\">law enforcement<\/span> has access to your order through a <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-26-5-3\/\" target=\"_blank\" rel=\"noopener\">central registry<\/a>, it&#8217;s a good idea to make sure they have a copy on file at your local police station. Keep a copy in your possession as well, or get a <a href=\"https:\/\/www.in.gov\/attorneygeneral\/about-the-office\/appeals\/victim-services\/hope-card-program\/\" target=\"_blank\" rel=\"noopener\">Hope Card<\/a>.<\/p>\n<h2>I&#8217;m Worried My Spouse Is Going To Get Violent During the Divorce Process. What Options Do I Have?<\/h2>\n<p>If the threat of <span data-term-id=\"39053033\">domestic violence<\/span> exists during your divorce or separation, you can take steps to protect yourself. You can request an <a href=\"https:\/\/codes.findlaw.com\/in\/title-31-family-law-and-juvenile-law\/in-code-sect-31-15-5-1.html\" target=\"_blank\" rel=\"noopener\">ex parte <span data-term-id=\"39053034\">protective order<\/span><\/a> from the court. Ex parte means the court won&#8217;t speak to your spouse before issuing the order. A provision limiting contact through your spouse&#8217;s attorney is common for this type of order.<\/p>\n<h2>Will a Family Violence Charge Affect a Custody Hearing?<\/h2>\n<p>There&#8217;s little doubt that it would. When it comes to custody, courts are guided by the concept of <a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/focusing-on-the-best-interests-of-the-child.html\">acting in the best interests of the child<\/a>. Being with an abusive parent or having to view acts of <span data-term-id=\"39053033\">domestic violence<\/span> isn&#8217;t optimal. If a pattern of <span data-term-id=\"39053033\">domestic violence<\/span> is established, the court will act to protect the child.<\/p>\n<p>The court has the right to set conditions for <span data-term-id=\"39053045\">parenting time<\/span>. If the abuser is the <span data-term-id=\"39053063\">noncustodial parent<\/span>, the court can <a href=\"https:\/\/codes.findlaw.com\/in\/title-31-family-law-and-juvenile-law\/in-code-sect-31-17-2-8-3.html\" target=\"_blank\" rel=\"noopener\">dictate supervised visitation for between one and two years<\/a>. In extreme cases, the court can deny visitation.<\/p>\n<h2>Legal Fees, Medical Bills, Missed Work &#8211; Dealing With My Abuser Is Costing Me a Fortune. Can I Make Them Pay?<\/h2>\n<p>There&#8217;s more than one way to recover expenses caused by an abuser. The court can put provisions in an <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-26-5-9\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39053055\">order of protection<\/span> that require the abuser pay<\/a> for things such as attorney&#8217;s fees, spousal support, rent or mortgage, and temporary child support.<\/p>\n<p>You can also <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/filing-a-domestic-violence-lawsuit.html\">sue your abuser in civil court<\/a> to recover damages for pain and suffering, lost wages, and medical expenses. Amounts under $10,000 are handled in the <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/indiana-small-claims-courts.html\"><span data-term-id=\"39053032\">Indiana<\/span> Small Claims division of the Superior Court<\/a>. More than $10,000 is handled in civil court.
