This crime is commonly referred to as <a target=\"_blank\" href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/indecent-exposure.html\">indecent exposure<\/a>, but is referred to as both \u201cindecent exposure\u201d and \u201cpublic indecency&quot; in Indiana. Public nudity is also prohibited.<\/p>\n<p>The Indiana indecent exposure laws and their penalties are outlined in the table below.<\/p>\n<table cellspacing=\"0\" cellpadding=\"0\" border=\"1\">\n<tbody><tr><td><p><b>Code Sections<\/b><\/p>\n<\/td>\n<td><p>Indiana Code, Title 35: Criminal Law &amp; Procedure, Article 45: Offenses Against Public Health, Order, and Decency, <a adhocenable=\"false\" href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-45-4-1.html\" target=\"_blank\" rel=\"noopener\">Chapter 4: Indecent Acts and Prostitution<\/a><\/p>\n<\/td>\n<\/tr><tr><td><p><b>What is Prohibited?<\/b><\/p>\n<\/td>\n<td><p>Three types of indecent exposure are prohibited in Indiana:<\/p>\n<ul>\n<li><u>Public indecency<\/u> &#8211; Knowingly having sex or <a adhocenable=\"false\" href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-41-3-9.html\" target=\"_blank\" rel=\"noopener\">other sexual conduct<\/a>, appearing nude to sexually arouse another, or fondling your own or another&#8217;s genitals in a public place. It\u2019s also being nude (pubic area, butt, or female nipples exposed or a covered clearly erect penis) in public in order to be seen by a child under 16. It\u2019s a Class A misdemeanor. If a person was previously convicted of this or a similar charge in another state, it&#8217;s a Level 6 felony.<\/li>\n<li><u>Indecent exposure<\/u> &#8211; When a person engages in the activities described above for public indecency, but in a place that isn&#8217;t public, although with the intent to be seen by the public. This is a Class C misdemeanor.<\/li>\n<li><u>Public nudity<\/u> &#8211; Intentionally appearing in public nude, with pubic area, posterior, or female nipples exposed or a covered clearly erect penis. Usually, public nudity is a Class C misdemeanor. However, if done with the intent to be seen by a person, it&#8217;s a Class B misdemeanor. If done intentionally at a school, park, or on an Indiana <a adhocenable=\"false\" target=\"_blank\" href=\"http:\/\/www.in.gov\/dnr\/\" rel=\"noopener\">Department of Natural Resources<\/a> property with intent to sexually arouse anyone, it&#8217;s a Class A misdemeanor. If the defendant had a previous conviction, it&#8217;s increased to a Level 6 felony.<\/li>\n<\/ul>\n<\/td>\n<\/tr><tr><td><p><b>Penalties<\/b><\/p>\n<\/td>\n<td><p>The penalties, including possible jail time and fines, vary based on the misdemeanor class or felony level. The relevant penalties for public indecent exposure in Indiana are:<\/p>\n<ul>\n<li><u>Level 6 Felony<\/u> &#8211; 6 months to 2.5 years incarceration and a fine up to $10,000<\/li>\n<li><u>Class A Misdemeanor<\/u> &#8211; up to 1 year incarceration and a fine of up to $5,000<\/li>\n<li><u>Class B Misdemeanor<\/u> &#8211; up to 180 days incarceration and a fine of up to a $1,000<\/li>\n<li><u>Class C Misdemeanor<\/u> &#8211; up to 60 days incarceration and a fine of up to a $500<\/li>\n<\/ul>\n<p><b><i>Note:<\/i><\/b><i> On July 1, 2014 <\/i><a target=\"_blank\" href=\"http:\/\/indianacourts.us\/blogs\/legislative\/?cat=5\" rel=\"noopener\"><i>Indiana criminal law changed<\/i> <\/a><i>from classifying felonies as Classes A-D to Levels 1-6.
