Some orders will also give temporary orders for child custody, <span data-term-id=\"42413774\">child support<\/span>, and spousal support.<\/p>\n<p>The type of <span data-term-id=\"42413762\">Indiana<\/span> <span data-term-id=\"42413765\">restraining order<\/span> used depends on the people involved and the particular crimes committed. While some are more common than others, the provisions in <span data-term-id=\"42413763\">protective orders<\/span> are tailored to fit each case. Let&#8217;s take a look at the <a href=\"https:\/\/www.in.gov\/courts\/admin\/tech\/protection-order\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"42413770\">orders of protection<\/span> available in <span data-term-id=\"42413762\">Indiana<\/span><\/a>.<\/p>\n<h3><span data-term-id=\"42413762\">Indiana<\/span> <span data-term-id=\"42413764\">Domestic Violence<\/span> <span data-term-id=\"42413770\">Orders of Protection<\/span><\/h3>\n<p><span data-term-id=\"42413762\">Indiana<\/span>&#8216;s definition of <span data-term-id=\"42413764\">domestic violence<\/span> is a bit broader than that of other states. <a href=\"https:\/\/www.findlaw.com\/state\/indiana-law\/indiana-domestic-violence-laws.html\"><span data-term-id=\"42413764\">Domestic violence<\/span> crimes<\/a> occur between <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-6-2-44-8\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"42413794\">family members<\/span> and <span data-term-id=\"42413769\">household members<\/span><\/a>. These participants include:<\/p>\n<ul>\n<li>Spouses<\/li>\n<li><span data-term-id=\"42413799\">Former spouses<\/span><\/li>\n<li>People with a child in common<\/li>\n<li>People who are intimate partners<\/li>\n<li>People who were in an intimate relationship with one another<\/li>\n<li>People who are dating<\/li>\n<li>People who have dated each other<\/li>\n<li>Related by marriage (in-laws)<\/li>\n<li>Related by consanguinity (blood relatives)<\/li>\n<li>Related by adoption<\/li>\n<li>A legal relationship as a ward, guardian, foster parent, or custodian<\/li>\n<li>A <span data-term-id=\"42413782\">minor child<\/span> of any of the people in one of the relationships listed<\/li>\n<\/ul>\n<p>To qualify as a <span data-term-id=\"42413764\">domestic violence<\/span> offense, the <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-6-2-34-5\/\" target=\"_blank\" rel=\"noopener\">crime committed must fall under one of the following categories<\/a>:<\/p>\n<ul>\n<li>Attempting to cause physical harm<\/li>\n<li>Causing physical harm<\/li>\n<li>Threatening to cause physical harm<\/li>\n<li>Causing someone to engage in a sexual act against their will via duress, threats, or force<\/li>\n<li>Causing a person to suffer <span data-term-id=\"42413780\">fear of physical harm<\/span><\/li>\n<li>Torturing, abusing, mutilating, or killing a vertebrate animal without justification to intimidate, terrorize, coerce, harass, or threaten<\/li>\n<\/ul>\n<p><span data-term-id=\"42413762\">Indiana<\/span> expands <span data-term-id=\"42413764\">domestic violence<\/span> classification, for purposes of <span data-term-id=\"42413763\">protective orders<\/span>, to include <a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-45-10-5\/\" target=\"_blank\" rel=\"noopener\">stalking<\/a> and <span data-term-id=\"42413798\">sex crimes<\/span> such as <span data-term-id=\"42413797\">sexual assault<\/span>, <a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-42-4-8\/\" target=\"_blank\" rel=\"noopener\">sexual battery<\/a>, <a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-42-4-1\/\" target=\"_blank\" rel=\"noopener\">and rape<\/a>. These offenses do not require the abuser and the victim to have a close personal or family relationship. For <span data-term-id=\"42413778\">civil <\/span><span data-term-id=\"42413763\">protection orders<\/span>, stalking and <span data-term-id=\"42413798\">sex crimes<\/span> are treated as <span data-term-id=\"42413764\">domestic violence<\/span>.<\/p>\n<p>A victim (petitioner) has a few different ways of filing for an <span data-term-id=\"42413762\">Indiana<\/span> <span data-term-id=\"42413764\">domestic violence<\/span> <span data-term-id=\"42413776\">order for protection<\/span>. Forms are <a href=\"https:\/\/www.in.gov\/courts\/iocs\/publications\/po-forms\/\" target=\"_blank\" rel=\"noopener\">available online<\/a>, which can be filled out and filed in the <span data-term-id=\"42413803\">clerk&#8217;s office<\/span> of <a href=\"https:\/\/www.in.gov\/courts\/directory\/\" target=\"_blank\" rel=\"noopener\">a <span data-term-id=\"42413792\">civil court<\/span> near you<\/a>. The <a href=\"https:\/\/public.courts.in.gov\/porefsp#\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"42413773\">Indiana<\/span> <span data-term-id=\"42413763\">Protection Order<\/span> E-filing Service Provider<\/a> allows online filing.<\/p>\n<p>You can also file through a <a href=\"https:\/\/www.thehotline.org\/get-help\/domestic-violence-local-resources\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"42413764\">domestic violence<\/span> advocate<\/a>, which the state recommends. If filing in person, the court clerk can help you fill out the forms. They can&#8217;t offer legal advice. The judge may ask you questions. An <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-26-5-6\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"42413779\">ex parte<\/span> <span data-term-id=\"42413776\">order<\/span><span data-term-id=\"42413776\"> for protection<\/span><\/a> is issued if the court agrees with your claims. <span data-term-id=\"42413768\">Ex parte<\/span> means <span data-term-id=\"42413804\">issuance<\/span> without the court contacting the abuser (<span data-term-id=\"42413767\">respondent<\/span>).<\/p>\n<p><span data-term-id=\"42413768\">Ex parte<\/span> <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-26-5-9\/\" target=\"_blank\" rel=\"noopener\">temporary <span data-term-id=\"42413765\">restraining orders<\/span> last for 30 days<\/a> or until the court hearing for a final <span data-term-id=\"42413776\">order for protection<\/span>. They contain provisions to protect the petitioner. Rulings on child custody and <span data-term-id=\"42413774\">child support<\/span> issues are also permitted. These are temporary.<\/p>\n<p>Conditions vary between <span data-term-id=\"42413776\">orders for protection<\/span>. <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-26-5-6\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"42413785\">Indiana<\/span><span data-term-id=\"42413785\"> law<\/span> ensures certain provisions are available<\/a> for inclusion:<\/p>\n<ul>\n<li><span data-term-id=\"42413767\">Respondent<\/span> must not have any contact with the petitioner<\/li>\n<li><span data-term-id=\"42413767\">Respondent<\/span> (abuser) cannot commit further acts of domestic or <span data-term-id=\"42413772\">family violence<\/span> against the petitioner (victim) or their family<\/li>\n<li><span data-term-id=\"42413767\">Respondent<\/span> cannot threaten to commit further acts of domestic or <span data-term-id=\"42413772\">family violence<\/span> against the petitioner or their family<\/li>\n<li><span data-term-id=\"42413767\">Respondent<\/span> must surrender all firearms and ammunition<\/li>\n<li><span data-term-id=\"42413767\">Respondent<\/span> must stay away from the petitioner&#8217;s residence, workplace, school, or any other named location<\/li>\n<li>Rule on parenting time and necessary conditions<\/li>\n<li>Award possession of shared animals to the petitioner<\/li>\n<li>Order possession of a dwelling, an automobile, or other personal property to the petitioner<\/li>\n<li><span data-term-id=\"42413767\">Respondent<\/span> must leave a shared residence and not return<\/li>\n<li><span data-term-id=\"42413767\">Respondent<\/span> cannot use a tracking device on the petitioner<\/li>\n<li><span data-term-id=\"42413767\">Respondent<\/span> must pay the petitioner&#8217;s medical expenses, <span data-term-id=\"42413789\">attorney fees<\/span>, or other costs<\/li>\n<li>Set conditions if the petitioner and <span data-term-id=\"42413767\">respondent<\/span> must occupy the same location (i.e. a workplace)<\/li>\n<\/ul>\n<p>A victim should never try to serve an order to the <span data-term-id=\"42413767\">respondent<\/span>. <span data-term-id=\"42413783\">Law enforcement<\/span><span data-term-id=\"42413783\"> officers<\/span> serve the <span data-term-id=\"42413779\">ex parte<\/span><span data-term-id=\"42413779\"> order<\/span> to the <span data-term-id=\"42413767\">respondent<\/span>. The order is sent to <span data-term-id=\"42413791\">law enforcement<\/span><span data-term-id=\"42413791\"> agencies<\/span> and entered into the <a href=\"https:\/\/www.in.gov\/courts\/admin\/tech\/protection-order\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"42413809\">Indiana<\/span> <span data-term-id=\"42413763\">Protective Order<\/span><span data-term-id=\"42413809\"> Registry<\/span> (POR)<\/a>. This will enter it into the\u00a0<a href=\"https:\/\/www.in.gov\/idacs\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"42413762\">Indiana<\/span> Data and Communication System<\/a>\u00a0(<span data-term-id=\"42413802\">IDACS<\/span>) as well.<\/p>\n<p>If you&#8217;re served with a <span data-term-id=\"42413763\">protective order<\/span>, it&#8217;s not something you can ignore. Speak to a <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/indiana?fli=dcta\" target=\"_blank\" rel=\"noopener\">criminal defense attorney<\/a> as soon as possible. They can explain your options.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-26-5-10\/\" target=\"_blank\" rel=\"noopener\">Within 30 days of the <span data-term-id=\"42413779\">ex parte<\/span><span data-term-id=\"42413779\"> order<\/span>&#8216;s <span data-term-id=\"42413804\">issuance<\/span><\/a>, the case hearing takes place. If the <span data-term-id=\"42413767\">respondent<\/span> doesn&#8217;t oppose the order or fails to appear, your order will likely become a final <span data-term-id=\"42413776\">order for protection<\/span>.<\/p>\n<p>If the <span data-term-id=\"42413767\">respondent<\/span> opposes the order, both sides argue their cases at the <span data-term-id=\"42413800\">protective order<\/span><span data-term-id=\"42413800\"> hearing<\/span>. They can <span data-term-id=\"42413811\">present evidence<\/span> and call witnesses. The onus is on the petitioner to show abuse occurred and that the threat remains. If successful, <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-26-5-9\/\" target=\"_blank\" rel=\"noopener\">a final <span data-term-id=\"42413776\">order for protection<\/span><\/a> is issued.<\/p>\n<p>Final orders <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-26-5-9\/\" target=\"_blank\" rel=\"noopener\">last for up to two years<\/a> and are extendable. The conditions from the <span data-term-id=\"42413779\">ex parte<\/span><span data-term-id=\"42413779\"> order<\/span> remain in effect, and new provisions are permitted. If the <span data-term-id=\"42413767\">respondent<\/span> committed a sexual crime and either was already a registered sex offender or has to register as a sex offender, the order may be effective indefinitely unless later modified or terminated.<\/p>\n<p>Victims who get a <span data-term-id=\"42413764\">domestic violence<\/span> <span data-term-id=\"42413776\">order for protection<\/span> can apply for a <a href=\"https:\/\/www.in.gov\/attorneygeneral\/about-the-office\/appeals\/victim-services\/hope-card-program\/\" target=\"_blank\" rel=\"noopener\">Hope Card<\/a>. Hope Cards fit in a wallet and contain the important details of your order. This allows <span data-term-id=\"42413767\">responding<\/span> <span data-term-id=\"42413783\">law enforcement<\/span><span data-term-id=\"42413783\"> officers<\/span> to be aware of all the provisions included.<\/p>\n<h3><span data-term-id=\"42413762\">Indiana<\/span> <span data-term-id=\"42413781\">Workplace Violence <\/span><span data-term-id=\"42413765\">Restraining Orders<\/span> (WVRO)<\/h3>\n<p>Much like your home, your workplace shouldn&#8217;t carry the <span data-term-id=\"42413807\">threat of violence<\/span>. Employers can file for an <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-26-6-6\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"42413762\">Indiana<\/span> <span data-term-id=\"42413781\">workplace violence <\/span><span data-term-id=\"42413765\">restraining order<\/span> (WRVO)<\/a> for an employee who has suffered violence or the credible threat of unlawful violence at work. Unlawful violence <a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-42-2-1\/\" target=\"_blank\" rel=\"noopener\">includes battery<\/a> <a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-45-10-5\/\" target=\"_blank\" rel=\"noopener\">and stalking<\/a>.<\/p>\n<p>The employer <a href=\"https:\/\/www.in.gov\/courts\/iocs\/files\/center-bb-po-form-wv-0100.pdf\" target=\"_blank\" rel=\"noopener\">files for a temporary WRVO<\/a>, typically in the civil division of Superior Court. A hearing is held within 15 days. The <span data-term-id=\"42413767\">respondent<\/span> can file a counterclaim to fight the order. If the court agrees that the <span data-term-id=\"42413767\">respondent<\/span> has displayed a <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-26-6-1\/\" target=\"_blank\" rel=\"noopener\">course of conduct<\/a> that is threatening, a final WRVO is issued. This is also known as an injunction.<\/p>\n<p>The injunction lasts <a href=\"https:\/\/codes.findlaw.com\/in\/title-34-civil-law-and-procedure\/in-code-sect-34-26-6-9\/\" target=\"_blank\" rel=\"noopener\">for three years<\/a> and is extendable. It forbids the <span data-term-id=\"42413767\">respondent<\/span> from continuing to inflict unlawful violence or threatening to inflict unlawful violence.<\/p>\n<h3><span data-term-id=\"42413762\">Indiana<\/span> <span data-term-id=\"42413777\">No-Contact Orders<\/span><\/h3>\n<p><span data-term-id=\"42413762\">Indiana<\/span> <a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-33-8-3-6\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"42413777\">no-contact orders<\/span> are issued by judges in criminal court<\/a> as part of bail agreements. These are used when the offender is accused of committing a violent crime that inflicted bodily injury on the victim. They forbid any contact by the <span data-term-id=\"42413767\">respondent<\/span> with the victim for either 10 days or until the initial hearing.
