Just like methamphetamine, fentanyl, and other illegal drugs, heroin can destroy families and increase crime. This is why the Iowa legislature has created strict laws governing the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/drug-possession-overview.html\">possession of a controlled substance<\/a>, drug trafficking, and other related offenses.<\/p>\r\n<p>The <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/controlled-substances-act-csa-overview.html\">federal laws<\/a> on drug possession, distribution, and trafficking are just as strict. With the recent <a href=\"https:\/\/www.shadac.org\/opioid-epidemic-united-states\" title=\"opioid epidemic\" target=\"_blank\" rel=\"noopener\">opioid epidemic<\/a>, lawmakers across the country are cracking down on heroin dealers. If law enforcement catches you with heroin or drug paraphernalia, you&#8217;ll face severe penalties.<\/p>\r\n<p>Here, we&#8217;ll explain Iowa&#8217;s heroin laws, including the penalties for these offenses. While heroin is one of the more problematic drugs today, that doesn&#8217;t mean it&#8217;s the only drug Iowa law criminalizes.<\/p>\r\n<p>Some of the other drugs Iowa lawmakers are cracking down on include:<\/p>\r\n<ul>\r\n<li>Methamphetamine<\/li>\r\n<li>Amphetamines<\/li>\r\n<li>Cannabis\/cannabinoids<\/li>\r\n<li>Illicit prescription drugs<\/li>\r\n<li>PCP<\/li>\r\n<li>LSD<\/li>\r\n<li>Depressants<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/state\/iowa-law\/iowa-cocaine-laws.html\">Cocaine\/crack<\/a><\/li>\r\n<li>Stimulants<\/li>\r\n<\/ul>\r\n<p>While some states have legalized marijuana, that is not the case in Iowa. <a href=\"https:\/\/www.findlaw.com\/state\/iowa-law\/iowa-marijuana-laws.html\">Marijuana<\/a> is a Schedule I drug and is still illegal in Iowa.<\/p>\r\n<p>In Iowa, the charges and penalties for <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/drug-possession-penalties-and-sentencing.html\">drug possession<\/a> are the same regardless of which drug you are carrying at the time of your arrest. The severity of the charge ranges from a simple misdemeanor to a Class D felony, depending on whether it&#8217;s your first, second, or third offense.<\/p>\r\n<h2><b>Heroin Laws in Iowa<\/b><\/h2>\r\n<p>Iowa law is strict when it comes to <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/what-is-a-controlled-substance.html\">controlled dangerous substances<\/a>. Whether it&#8217;s your first or second offense, you should expect the penalties to be severe.<\/p>\r\n<p>The penalties under Iowa state law for <a href=\"https:\/\/www.findlaw.com\/state\/criminal-laws\/details-on-state-heroin-laws.html#:~:text=Despite%20heroin%20references%20in%20movies%20and%20TV%20that,heroin%20laws%20in%20the%20United%20States%20are%20strict.\">heroin-related offenses<\/a> depend on the amount of drugs in your possession, where your arrest takes place, and whether you have prior convictions.<\/p>\r\n<p>The chart below lists the details of Iowa&#8217;s heroin statutes.<\/p>\r\n<p><b>Iowa heroin laws code sections<\/b> <a href=\"https:\/\/codes.findlaw.com\/ia\/title-iv-public-health-chs-123-158\/ia-code-sect-124-401\/\" target=\"_blank\" rel=\"noopener\">Iowa Code 124.401, et seq.<\/a><\/p>\r\n<ul>\r\n<li>Iowa possession of heroin First-time offender \u2014 Serious misdemeanor, punishable by up to one year in jail and fines of $430 to $2,565<\/li>\r\n<li>Second offense \u2014 Aggravated misdemeanor, punishable by up to two years in jail and fines anywhere between $855 and $8,540<\/li>\r\n<li>Third and subsequent offenses \u2014 Class D felony, carrying a penalty of up to five years in prison and fines from $1,025 to $10,245 (Iowa Code \u00a7124.401)<\/li>\r\n<li>Possessing <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/is-possession-of-drug-paraphernalia-a-felony\/\">drug paraphernalia<\/a> is a simple misdemeanor punishable by up to 30 days in jail and fines between $105 and $850. (Iowa Code \u00a7124.414)<\/li>\r\n<li>Sale and distribution Less than 100 grams: <a href=\"https:\/\/codes.findlaw.com\/ia\/title-xvi-criminal-law-and-procedure-chs-687-916\/ia-code-sect-701-7\/\" target=\"_blank\" rel=\"noopener\">Class C felony<\/a>, punishable by fines anywhere from $1,000 to $50,000 and up to 10 years in prison.<\/li>\r\n<li>100 grams to 1 kg.: Class B felony, resulting in fines between $5,000 and $100,000 and up to 25 years in prison.<\/li>\r\n<li>Over 1 kg: Class B felony, punishable by up to 50 years in prison and fines of up to $1 million.Subsequent offense: Triple penalties (<a href=\"https:\/\/codes.findlaw.com\/ia\/title-iv-public-health-chs-123-158\/ia-code-sect-124-401\/\" style=\"background-color: rgb(255,255,255);\" target=\"_blank\" rel=\"noopener\">Iowa Code \u00a7124.401<\/a><span>)<\/span><\/li>\r\n<\/ul>\r\n<p>The penalties are more severe in the following situations:<\/p>\r\n<ul>\r\n<li>Sale or distribution to minors or someone three years younger than the defendant: Class B felony, with a mandatory minimum sentence of five years<\/li>\r\n<li>Within 1,000 feet of a public\/private school, recreation area, pool, or school bus: Mandatory minimum sentence of 10 years (<a href=\"https:\/\/codes.findlaw.com\/ia\/title-iv-public-health-chs-123-158\/ia-code-sect-124-401\/\" target=\"_blank\" rel=\"noopener\">Iowa Code \u00a7124.401(B)<\/a>)<\/li>\r\n<\/ul>\r\n<p><b>Defenses<\/b> As with any other crime, actual innocence is a defense to heroin-related charges. Your criminal defense attorney may raise other defenses, including the following:<\/p>\r\n<ul>\r\n<li>Illegal search and seizure<\/li>\r\n<li>Lack of knowledge or possession<\/li>\r\n<li>Good Samaritan exception (911 immunity defense)<\/li>\r\n<\/ul>\r\n<p>The good samaritan\/911 immunity defense includes people who are helping in a drug overdose. The state will not charge you with drug possession if you are merely aiding someone in a drug-related medical emergency. (<a href=\"https:\/\/codes.findlaw.com\/ia\/title-iv-public-health-chs-123-158\/ia-code-sect-124-418\/\" target=\"_blank\" rel=\"noopener\">Iowa Code \u00a7124.418<\/a>)<\/p>\r\n<p><b>Alternate punishment available<\/b> Like many states, Iowa maintains <a href=\"https:\/\/doc.iowa.gov\/districts-prisons-0\/8th-district#:~:text=Drug%20Court%20The%20District%20offers%20two%20drug%20court\" target=\"_blank\" rel=\"noopener\">drug courts<\/a> for some first- and second-time offenders. <a href=\"https:\/\/seventhdcs.com\/district-services\/drug-court\/\" target=\"_blank\" rel=\"noopener\">Drug court<\/a> offers defendants the opportunity to attend drug treatment programs instead of significant jail time.<\/p>\r\n<p>As shown above, selling heroin in Iowa could land you in prison for up to 50 years. You may also have to pay fines as high as $1 million. While these penalties can be extreme, some jurisdictions send drug crimes to specialized &quot;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/drug-possession-penalties-and-sentencing.html\">drug courts<\/a>.&quot; These programs allow first- and second-time offenders to attend treatment programs rather than face incarceration.<\/p>\r\n<p><i><b>Note:<\/b><\/i> <i>State laws are subject to change through new legislation, higher court rulings, and other means.
