Most have <a href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-236-5\/\" target=\"_blank\" rel=\"noopener\"><u>provisions tailored for each specific case<\/u><\/a>. The type also dictates who is eligible to apply (petition) for the order. A review of each\u00a0<span data-term-id=\"39332878\">court order<\/span>\u00a0will help determine which\u00a0<span data-term-id=\"39332864\">protective order<\/span>\u00a0is best suited\u00a0for your situation.<\/p>\n<h3><span data-term-id=\"39332867\">Domestic Violence<\/span> <span data-term-id=\"39332864\">Protective Orders<\/span><\/h3>\n<p><span data-term-id=\"39332867\">Domestic violence<\/span> offenses involve certain abusive acts committed between people sharing specific familial or <span data-term-id=\"39332883\">intimate relationships<\/span>. They focus on, but are not limited to, physical abuse and the threat of physical abuse. It&#8217;s a complex subject, but you can find a detailed primer in FindLaw&#8217;s <a href=\"https:\/\/www.findlaw.com\/state\/iowa-law\/iowa-domestic-violence-laws.html\"><u><span data-term-id=\"39332863\">Iowa<\/span> <span data-term-id=\"39332867\">Domestic Violence<\/span> Laws<\/u><\/a> article. It includes a detailed look at <span data-term-id=\"39332863\">Iowa<\/span>&#8216;s <span data-term-id=\"39332867\">domestic violence<\/span> <span data-term-id=\"39332864\">protective orders<\/span>.<\/p>\n<p>As with most civic court <span data-term-id=\"39332864\">protective orders<\/span>, the goal of a <span data-term-id=\"39332867\">domestic violence<\/span> <span data-term-id=\"39332864\">protection order<\/span> (DVPO) is to separate the victim (petitioner) from the abuser (defendant). DVPOs focus on provisions that tell the defendant what they can and can&#8217;t do. While not quite the same as a <span data-term-id=\"39332869\">no-contact order<\/span>, DVPOs can <a href=\"https:\/\/www.findlaw.com\/state\/iowa-law\/iowa-domestic-violence-laws.html\"><u>contain a condition that forbids the defendant from contacting the petitioner<\/u><\/a>.<\/p>\n<p>The court has the right to add any condition it considers necessary for a DVPO. Provisions for protecting the safety of the petitioner can include:<\/p>\n<ul>\n<li>Ceasing all abuse by the defendant<\/li>\n<li>Forbidding the defendant from possessing firearms, ammunition, or other deadly weapons<\/li>\n<li>Ordering the defendant to vacate a shared dwelling and not return<\/li>\n<li>Awarding of a <span data-term-id=\"39332882\">temporary <\/span><span data-term-id=\"39332907\">custody<\/span><span data-term-id=\"39332907\"> order<\/span> or support for a <span data-term-id=\"39332871\">minor child<\/span> to the petitioner<\/li>\n<li>Granting possession of shared family pets to the petitioner<\/li>\n<li>Forbidding the defendant from contacting the petitioner<\/li>\n<\/ul>\n<p>This is not an exhaustive list. An <span data-term-id=\"39332863\">Iowa<\/span> DVPO may contain some of these conditions or a completely different set. It will depend on the situation.<\/p>\n<h3>No-Contact <span data-term-id=\"39332864\">Protective Orders<\/span><\/h3>\n<p>Unlike other <span data-term-id=\"39332893\">Iowa<\/span> <span data-term-id=\"39332864\">protective orders<\/span>, no-contact <span data-term-id=\"39332864\">protective orders<\/span> are issued in criminal court. They often follow an arrest or <a href=\"https:\/\/codes.findlaw.com\/ia\/title-xvi-criminal-law-and-procedure-chs-687-916\/ia-code-sect-709-19\/\" target=\"_blank\" rel=\"noopener\"><u>precede an abuser&#8217;s release from incarceration<\/u><\/a>. They go into effect once the abuser leaves prison or jail. No-contact clauses are a regular inclusion in civil court <span data-term-id=\"39332864\">protection orders<\/span>.<\/p>\n<h3><span data-term-id=\"39332891\">Sexual Abuse <\/span><span data-term-id=\"39332864\">Protection Orders<\/span><\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-236a-2\/\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39332891\">Sexual abuse <\/span><span data-term-id=\"39332864\">protective orders<\/span><\/u><\/a> offer a narrower criminal act focus than <span data-term-id=\"39332867\">domestic violence<\/span>. A victim of any kind of sexual abuse or sexual assault can petition for a <a href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-236a-3\/\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39332891\">sexual abuse <\/span><span data-term-id=\"39332864\">protective order<\/span><\/u><\/a>. Adults and guardians can petition for a <span data-term-id=\"39332871\">minor child<\/span> suffering sexual abuse.<\/p>\n<p><span data-term-id=\"39332891\">Sexual abuse <\/span><span data-term-id=\"39332864\">protective orders<\/span> have the same latitude for including provisions that DVPOs do. <a href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-236a-7\/\" target=\"_blank\" rel=\"noopener\"><u>Two conditions are somewhat standard<\/u><\/a> in sexual assault <span data-term-id=\"39332864\">protective orders<\/span>:<\/p>\n<ul>\n<li>The defendant must cease all sexual abuse of the victim<\/li>\n<li>The defendant must stay away from the victim&#8217;s residence, school, workplace, and any other place named in the order<\/li>\n<\/ul>\n<p>An abuser arrested for a sexual assault crime may have a <span data-term-id=\"39332869\">no-contact order<\/span> issued by the criminal court. If not, the <span data-term-id=\"39332891\">sexual abuse <\/span><span data-term-id=\"39332864\">protective order<\/span> can <a href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-236a-6\/\" target=\"_blank\" rel=\"noopener\"><u>include a no-contact provision<\/u><\/a>.<\/p>\n<h3>Elder Abuse <span data-term-id=\"39332864\">Protective Order<\/span><\/h3>\n<p>Those over the age of 60 years old who are unable to protect themselves from elder abuse are eligible for an elder abuse <span data-term-id=\"39332864\">protective order<\/span>. They can file for one themselves or <a href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-235f-1.html\" target=\"_blank\" rel=\"noopener\"><u>have a substitute petitioner<\/u><\/a> do it for them. A substitute petitioner is one of the following:<\/p>\n<ul>\n<li>Family members<\/li>\n<li><span data-term-id=\"39332874\">Household members<\/span><\/li>\n<li>Attorney in fact<\/li>\n<li>Conservators<\/li>\n<li>Guardians<\/li>\n<li>Guardians ad litem for a vulnerable elder<\/li>\n<li><span data-term-id=\"39332874\">Household members<\/span><\/li>\n<li>Other qualified interested persons<\/li>\n<\/ul>\n<p>If the abuser is under 17 years old, the case is moved to juvenile court. Otherwise, the petition is filed like any other <span data-term-id=\"39332868\">civil <\/span><span data-term-id=\"39332864\">protection order<\/span>. Vulnerable elders can file if <a href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-235f-1.html\" target=\"_blank\" rel=\"noopener\"><u>they&#8217;re suffering any of these abuses<\/u><\/a>:<\/p>\n<ul>\n<li>Financial abuse or exploitation<\/li>\n<li>Assault or unwanted <span data-term-id=\"39332903\">physical contact<\/span><\/li>\n<li>Any physical injuries<\/li>\n<li>Unreasonable confinement<\/li>\n<li>Unreasonable punishment<\/li>\n<li>Any sexual offense<\/li>\n<li>Neglect by deprivation of food, shelter, clothing, physical or mental health care, or supervision<\/li>\n<\/ul>\n<p><a href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-235f-6\/\" target=\"_blank\" rel=\"noopener\"><u>Relief is offered through many of the same provisions<\/u><\/a> as the other civil orders. The elder abuse <span data-term-id=\"39332864\">protective order<\/span> can stop the defendant from having control of the elder&#8217;s finances. It cannot give control to anyone but the elder.<\/p>\n<h2><span data-term-id=\"39332893\">Iowa<\/span> <span data-term-id=\"39332864\">Protective Orders<\/span> Law: How To Get an Order<\/h2>\n<p>The <span data-term-id=\"39332868\">civil <\/span><span data-term-id=\"39332864\">protection orders<\/span> &#8211; <span data-term-id=\"39332867\">domestic violence<\/span>, sexual abuse, and elder abuse &#8211; use similar rules for issuance. All three are eligible for an <strong>emergency ex parte <span data-term-id=\"39332864\">protective order<\/span><\/strong>. <a href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-236-6\/\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39332897\">Emergency orders<\/span><\/u><\/a> are used most often when the courts are closed, but can also result from <span data-term-id=\"39332876\">law enforcement<\/span> responding to an abuse call.<\/p>\n<p>A judge is reached and, if the threat of immediate abuse exists, will issue an <span data-term-id=\"39332897\">emergency order<\/span>. This order is very temporary, lasting only 72 hours. It&#8217;s issued ex parte, which means the court doesn&#8217;t speak with the defendant before issuance. Either before or soon after it expires, the <a href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-236-3\/\" target=\"_blank\" rel=\"noopener\"><u>petitioner needs to file for their <span data-term-id=\"39332864\">protective order<\/span><\/u><\/a> of choice with the <span data-term-id=\"39332885\">district court<\/span>.<\/p>\n<p>Unless you get permission to deliver it <span data-term-id=\"39332888\">in person<\/span> to a <span data-term-id=\"39332877\">county courthouse<\/span>, all <span data-term-id=\"39332864\">protective order<\/span> petitions are <a href=\"https:\/\/www.iowacourts.state.ia.us\/Efile\/\/\" target=\"_blank\" rel=\"noopener\"><u>filed through <span data-term-id=\"39332863\">Iowa<\/span>&#8216;s eFile system<\/u><\/a>. <span data-term-id=\"39332863\">Iowa<\/span> offers a step-by-step process, but don&#8217;t be afraid <a href=\"https:\/\/www.icadv.org\/iowa-victim-service-programs\" target=\"_blank\" rel=\"noopener\"><u>to ask for help<\/u><\/a> if you need it. Make sure to give as many details as possible when describing the abuse you&#8217;ve suffered.<\/p>\n<p>After you&#8217;ve filed, a <span data-term-id=\"39332870\">clerk of court<\/span> will take the petition to a judge. They may call you to ask for more information or clarification. If the court <a href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-236a-3\/\" target=\"_blank\" rel=\"noopener\"><u>agrees that abuse occurred or is a threat to occur<\/u><\/a> in the future, a <strong>temporary ex parte <span data-term-id=\"39332864\">protection order<\/span><\/strong> is issued. As with the <span data-term-id=\"39332897\">emergency order<\/span>, the defendant isn&#8217;t consulted before issuance.<\/p>\n<p><span data-term-id=\"39332876\">Law enforcement<\/span> serves the order to the defendant. A full <span data-term-id=\"39332900\">hearing date<\/span> is scheduled between five and 15 days after the service, unless the defendant chooses not to oppose the order. If that&#8217;s the case, your temporary order will likely become a <strong><span data-term-id=\"39332906\">final <\/span><span data-term-id=\"39332864\">protective order<\/span><\/strong>. Otherwise, <a href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-236-4\/\" target=\"_blank\" rel=\"noopener\"><u>you&#8217;ll have a full <span data-term-id=\"39332873\">court hearing<\/span><\/u><\/a>.<\/p>\n<p>At the hearing, the petitioner must prove that abuse has occurred or is in imminent danger of happening again. Both sides can make their arguments, call witnesses, and present evidence. If the court agrees with the petitioner, <a href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-236a-6\/\" target=\"_blank\" rel=\"noopener\"><u>the <span data-term-id=\"39332875\">temporary <\/span><span data-term-id=\"39332864\">protective order<\/span> becomes permanent<\/u><\/a>. Unlimited extensions are available if a hearing proves the threat still exists.<\/p>\n<p>Permanent <span data-term-id=\"39332864\">protective orders<\/span> in <span data-term-id=\"39332863\">Iowa<\/span> last up to one year. A <span data-term-id=\"39332901\">protected party<\/span> may request an extension, and the court may extend it for another year if a hearing proves that the threat still exists. The law does not limit the number of one-year extensions. <a href=\"https:\/\/www.hud.gov\/vawa#openModal\" target=\"_blank\" rel=\"noopener\"><u>Under federal law<\/u><\/a>, any <span data-term-id=\"39332864\">protective order<\/span> issued in <span data-term-id=\"39332863\">Iowa<\/span> is good anywhere on American soil. <span data-term-id=\"39332863\">Iowa<\/span> also <a href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-236-19\/\" target=\"_blank\" rel=\"noopener\"><u>supports out-of-state orders<\/u><\/a> at the state level.<\/p>\n<p><span data-term-id=\"39332863\">Iowa<\/span> does not offer an extreme risk <span data-term-id=\"39332864\">protective order<\/span> (ERPO). This order would allow <span data-term-id=\"39332876\">law enforcement<\/span> and family members to temporarily separate someone deemed a threat to themselves and others from access to firearms.<\/p>\n<h2><span data-term-id=\"39332893\">Iowa<\/span> <span data-term-id=\"39332864\">Protective Orders<\/span> Laws: Violations and Penalties<\/h2>\n<p>For a <span data-term-id=\"39332864\">protective order<\/span> to be effective, the abuser needs to fear the penalties for violations. If your abuser violates or threatens to violate a <span data-term-id=\"39332864\">protective order<\/span>, call <span data-term-id=\"39332876\">law enforcement<\/span>. Police are <a href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-236-11\/\" target=\"_blank\" rel=\"noopener\"><u>trained to arrest abusers who violate <span data-term-id=\"39332864\">protective orders<\/span><\/u><\/a>. Even if they don&#8217;t catch them, they can get a bench warrant issued.<\/p>\n<p>Even a minor violation can mean jail time. A violation of a criminal <span data-term-id=\"39332869\">no-contact order<\/span> is a contempt of court charge that <a href=\"https:\/\/codes.findlaw.com\/ia\/title-xv-judicial-branch-and-judicial-procedures-chs-595-686\/ia-code-sect-664a-7\/\" target=\"_blank\" rel=\"noopener\"><u>carries a minimum of seven days in jail<\/u><\/a>. The court can also choose to extend the <span data-term-id=\"39332869\">no-contact order<\/span> by up to five years after a violation.<\/p>\n<p>Violating one of the <span data-term-id=\"39332868\">civil <\/span><span data-term-id=\"39332864\">protection orders<\/span> is either contempt of court or a <a href=\"https:\/\/codes.findlaw.com\/ia\/title-xvi-criminal-law-and-procedure-chs-687-916\/ia-code-sect-903-1\/\" target=\"_blank\" rel=\"noopener\"><u>simple misdemeanor<\/u><\/a>. The misdemeanor penalties are up to 30 days in jail and a fine of between $105 and $855. Other punishments include mandatory batterers&#8217; treatment programs, restitution for court and attorneys&#8217; fees, and enhancements for crimes committed during the violation.<\/p>\n<h2><span data-term-id=\"39332893\">Iowa<\/span> <span data-term-id=\"39332864\">Protective Orders<\/span> Laws: Review<\/h2>\n<p><span data-term-id=\"39332893\">Iowa<\/span> <span data-term-id=\"39332864\">protective orders<\/span> are useful tools for fighting abuse, but there&#8217;s a lot to know. Human Services<\/u><\/p>\n<p>Elder Abuse<\/p>\n<ul>\n<li><a title=\"Iowa Code Section 235.F1\" href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-235f-1.html\" target=\"_blank\" rel=\"noopener\">Iowa Code Section 235.F1<\/a> (<em>definitions<\/em>)<\/li>\n<li><a title=\"Iowa Code Section 235.F2\" href=\"https:\/\/codes.findlaw.com\/ia\/title-vi-human-services-chs-216-255a\/ia-code-sect-235f-2\/\" target=\"_blank\" rel=\"noopener\">Iowa Code Section 235.F2<\/a> (<em>commencement of action &#8211;
