For example, while both simple battery and <span data-term-id=\"39095534\">domestic battery<\/span> are <span data-term-id=\"39095561\">Class B person misdemeanors<\/span> for a first offense, <span data-term-id=\"39095534\">domestic battery<\/span> carries enhanced penalties, including mandatory jail time, a mandatory fine between $200 and $1,000, and possible <span data-term-id=\"39095529\">domestic violence<\/span> offender assessment.<\/p>\n<h2><strong>What&#8217;s To Stop My Abuser From Coming After Me Once I Leave?<\/strong><\/h2>\n<p>If you&#8217;ve suffered <span data-term-id=\"39095543\">domestic abuse<\/span> or fear imminent <span data-term-id=\"39095529\">domestic violence<\/span>, help is available from a <span data-term-id=\"39095529\">domestic violence<\/span> protection from abuse (PFA) order. While not foolproof, a PFA is a court order that uses provisions to protect victims from their abusers through <span data-term-id=\"39095538\">no-<\/span><span data-term-id=\"39095573\">contact<\/span><span data-term-id=\"39095573\"> orders<\/span> and stay-away orders. They can&#8217;t be denied housing because of their protected person status. When Does It Start Working?<\/strong><\/h2>\n<p>A temporary PFA goes into effect once the defendant (abuser) is <a href=\"https:\/\/codes.findlaw.com\/ks\/chapter-60-procedure-civil\/ks-st-sect-60-3108\/\" target=\"_blank\" rel=\"noopener\"><u>served with the order<\/u><\/a>. This is done by the sheriff&#8217;s department or another <span data-term-id=\"39095567\">law enforcement officer<\/span>. As the petitioner, you should never serve the order yourself. The temporary order lasts 21 days or until the court date for the final hearing.<\/p>\n<h2><strong>My Abuser Likes Guns and Has a Bunch of Them. Should I Mention That When Filing for a PFA?<\/strong><\/h2>\n<p>Yes, you should make sure the court and law enforcement know about any deadly weapons possessed by your abuser. If you know what kinds of weapons they are and where they&#8217;re kept, supply that information.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/the-domestic-violence-offender-gun-ban.html\">Under federal law<\/a>, defendants convicted of a misdemeanor <span data-term-id=\"39095529\">domestic violence<\/span> offense face a lifetime ban on possessing firearms. <span data-term-id=\"39095536\">Kansas<\/span><span data-term-id=\"39095536\"> law<\/span> may impose additional restrictions.<\/p>\n<h2><strong>My Abuser&#8217;s Attorney Wants Me To Consider a Consent Order Instead of a PFA. For example, battery is a <span data-term-id=\"39095561\">Class B person misdemeanor<\/span>, while <span data-term-id=\"39095534\">domestic battery<\/span> is a <span data-term-id=\"39095561\">Class B person misdemeanor<\/span> for a first offense.<\/p>\n<p>However, <a href=\"https:\/\/codes.findlaw.com\/ks\/chapter-21-crimes-and-punishments\/ks-st-sect-21-5413\/\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39095534\">domestic battery<\/span><\/u><\/a> carries mandatory jail time and a mandatory minimum fine. The court can order an abuser to undergo a <span data-term-id=\"39095529\">domestic violence<\/span> offender assessment conducted by a certified batterer intervention program.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/ks\/chapter-21-crimes-and-punishments\/ks-st-sect-21-5924\/\" target=\"_blank\" rel=\"noopener\"><u>Violations of a <span data-term-id=\"39095530\">Kansas<\/span> <span data-term-id=\"39095539\">protection from abuse order<\/span><\/u><\/a> are a Class A misdemeanor for the first transgression. The abuser also faces contempt charges. The first violation carries potential jail time of up to one year and fines up to $2,500. In most instances, that means trying to keep both parents involved in the child&#8217;s life.
