It\u2019s possible something in your lease is not legal and is therefore unenforceable. It\u2019s also possible to be evicted for doing something that isn\u2019t specifically listed in the lease, but is legal for other reasons, such as <a target=\"_blank\" href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/eviction.html\">evictions<\/a> for illegal activities, for example, manufacturing meth in a rented home. The laws below pertain to residential leases. If you have a mobile home that you own but lease a lot for it, a commercial business lease, or a farmland lease, different or additional laws apply. You can research those laws online or ask a <a target=\"_blank\" href=\"https:\/\/lawyers.findlaw.com\/landlord-tenant\/kansas\/\" rel=\"noopener\">landlord-tenant<\/a> or <a target=\"_blank\" href=\"https:\/\/lawyers.findlaw.com\/agriculture-law\/kansas\/\" rel=\"noopener\">agriculture lawyer<\/a> for help.<\/p>\r\n<table width=\"670\" cellspacing=\"0\" cellpadding=\"2\" border=\"1\">\r\n<tbody><tr><td width=\"200\" valign=\"top\"><b>Code Sections<\/b><\/td>\r\n<td width=\"468\" valign=\"top\">Kansas Statutes Chapter 58, Article 25: <a target=\"_blank\" href=\"http:\/\/kslegislature.org\/li\/b2015_16\/statute\/058_000_0000_chapter\/058_025_0000_article\/\" rel=\"noopener\">Landlords &amp; Tenants<\/a> and Chapter 44, Article 10: <a target=\"_blank\" href=\"http:\/\/kslegislature.org\/li\/b2015_16\/statute\/044_000_0000_chapter\/044_010_0000_article\/\" rel=\"noopener\">Kansas Acts Against Discrimination<\/a> (includes housing)<\/td>\r\n<\/tr><tr><td width=\"200\" valign=\"top\"><b>Terms of Leases<\/b><\/td>\r\n<td width=\"468\" valign=\"top\">Tenancies are generally considered to be for month-to-month, unless a boarder in a home is paying weekly, then it\u2019s a week-to-week tenancy.<br>\r\n<br>\r\nIf a tenant overstays a lease, he or she is considered a holdover tenant and the term converts to month-to-month.<\/td>\r\n<\/tr><tr><td width=\"200\" valign=\"top\"><b>Security Deposits<\/b><\/td>\r\n<td width=\"468\" valign=\"top\">Kansas law requires a <a target=\"_blank\" href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/rent-security-deposits.html\">security deposit<\/a> is not more than one month\u2019s rent if unfurnished. However, if furnished, then it can be up to one and a half month\u2019s rent. If you have pets, you can be required to pay an additional half-month\u2019s rent as pet deposit, at most. However, pet deposits aren\u2019t allowed for <a target=\"_blank\" href=\"https:\/\/www.kansaslegalservices.org\/node\/1934\/tenant-issues-and-rights-kansas-renters#PetDeposit\" rel=\"noopener\">service animals<\/a> for tenants with disabilities.<br>\r\n<br>\r\nAfter you move out, the security deposit must be <a target=\"_blank\" href=\"http:\/\/kslegislature.org\/li\/b2015_16\/statute\/058_000_0000_chapter\/058_025_0000_article\/058_025_0050_section\/058_025_0050_k\/\" rel=\"noopener\">returned within 30 days<\/a> along with an itemized list of any deductions taken from the deposit.<br>\r\n<br>\r\nIf the landlord fails to comply with the security deposit laws, the tenant can be awarded one and a half the amount wrongfully withheld. Tenants can\u2019t use their security deposit for last month\u2019s rent unless otherwise agreed to by the landlord.<\/td>\r\n<\/tr><tr><td width=\"200\" valign=\"top\"><b>Discrimination<\/b><\/td>\r\n<td width=\"468\" valign=\"top\">Landlords <a target=\"_blank\" href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/tenants-and-fair-housing.html\">can\u2019t discriminate<\/a> against renters on the basis of race, color, national origin, ancestry, religion, gender, disability, or family status (basically, having children or not). However, housing specifically for older persons are exempted from discriminating based on age or family status.<\/td>\r\n<\/tr><tr><td width=\"200\" valign=\"top\"><b>Uniform Residential Landlord &amp; Tenant Act<\/b><\/td>\r\n<td width=\"468\" valign=\"top\">Kansas adopted the <a target=\"_blank\" href=\"http:\/\/uniformlaws.org\/Act.aspx?title=Residential%20Landlord%20and%20Tenant%20Act\" rel=\"noopener\">Residential Landlord &amp; Tenant Act<\/a> in 1975. Leases can\u2019t claim to forgo the rights under this Act, if they do, that part is unenforceable.<\/td>\r\n<\/tr><tr><td width=\"200\" valign=\"top\"><b>Landlord Duties<\/b><\/td>\r\n<td width=\"468\" valign=\"top\">Landlords have many duties to tenants, including:<br>\r\n<ul>\r\n<li>Maintaining the rental in good and safe working order so it\u2019s livable, called the <a target=\"_blank\" href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/what-is-the-implied-warranty-of-habitability.html\">implied warranty of habitability<\/a>, with any electrical, plumbing, sanitation, heating, A\/C, ventilation, etc. supplied by landlord<\/li>\r\n<li>Hot running water and reasonable heat must be provided by the landlord<\/li>\r\n<li>Common areas, such as hallways or parking lots , must be reasonably maintain<\/li>\r\n<li>Complying with any applicable building or housing codes related to health and safety<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td width=\"200\" valign=\"top\"><b>Tenant Duties<\/b><\/td>\r\n<td width=\"468\" valign=\"top\">Generally, tenant duties are simple. You must pay your rent on time and avoid causing damage to the rental beyond the normal wear and tear of everyday living. You also must take out the trash to keep the place clean and ensure that you, a visitor, or a pet doesn\u2019t disturb other tenants.<br>\r\n<br>\r\nIn addition, you need to inform your landlord of any <a target=\"_blank\" href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/repairs-maintenance.html\">repairs<\/a> that need to be made.
