Let&#8217;s look at what each order does.<\/p>\n<h3><span data-term-id=\"39221164\">Protection From Abuse<\/span> (<span data-term-id=\"39221177\">PFA<\/span>)Orders &#8211;<span data-term-id=\"39221165\">Domestic Violence<\/span><\/h3>\n<p><span data-term-id=\"39221165\">Domestic violence<\/span> <span data-term-id=\"39221164\">protection from abuse<\/span> <span data-term-id=\"39221162\">protective orders<\/span> are filed for by the petitioner (victim) in any <a href=\"https:\/\/kscourts.gov\/About-the-Courts\/District-Courts\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39221163\">Kansas<\/span> <span data-term-id=\"39221166\">district court<\/span><\/a> or through a <a href=\"https:\/\/www.kcsdv.org\/find-help\/in-kansas\/dv-sa-services-map\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39221165\">domestic violence<\/span> advocate<\/a>. You can also file <a href=\"https:\/\/www.kansaslegalservices.org\/node\/2442\/kansas-protection-order-portal-file-protection-order-your-own\" target=\"_blank\" rel=\"noopener\">online through the <span data-term-id=\"39221183\">Kansas<\/span> <span data-term-id=\"39221183\">Protection Order<\/span><span data-term-id=\"39221183\"> Portal<\/span> (<span data-term-id=\"39221206\">KSPOP<\/span>)<\/a>, but your <span data-term-id=\"39221190\">order may<\/span> get delayed until a judge can speak with you.<\/p>\n<p>Forms are <a href=\"https:\/\/www.kjc.ks.gov\/legal-forms\/protection-from-abuse\" target=\"_blank\" rel=\"noopener\">available online<\/a> or in the <span data-term-id=\"39221189\">clerk&#8217;s office<\/span> at the courthouse. If you&#8217;re filing without legal aid, you need to submit a <a href=\"https:\/\/www.kansasjudicialcouncil.org\/legal-forms\/self-represented-litigant-srl-certification-form\" target=\"_blank\" rel=\"noopener\">Self-Represented Litigant Certification form<\/a> as well. You can keep your address hidden by submitting a <a href=\"https:\/\/www.kjc.ks.gov\/home\/showpublisheddocument\/2076\/638624777579000000\" target=\"_blank\" rel=\"noopener\">Confidential Address form<\/a>.<\/p>\n<p>If either you or a child is in immediate danger and your <span data-term-id=\"39221166\">district court<\/span> is closed, you can apply for an <strong>emergency <span data-term-id=\"39221171\">protection from abuse<\/span><span data-term-id=\"39221171\"> order<\/span><\/strong> at any <span data-term-id=\"39221166\">district court<\/span>. If the court agrees there&#8217;s a danger, <a href=\"https:\/\/codes.findlaw.com\/ks\/chapter-60-procedure-civil\/ks-st-sect-60-3105\/\" target=\"_blank\" rel=\"noopener\">the <span data-term-id=\"39221179\">emergency order<\/span> is issued <span data-term-id=\"39221195\">ex parte<\/span><\/a>, which means the defendant (the alleged abuser) does not have to be present at the hearing. The <span data-term-id=\"39221179\">emergency order<\/span> lasts until 5 p.m. on the next day the court is open.<\/p>\n<p>Whether or not an <span data-term-id=\"39221179\">emergency order<\/span> was issued, the next step is to file a petition for a <strong>temporary <span data-term-id=\"39221195\">ex parte<\/span> <span data-term-id=\"39221164\">protection from abuse<\/span> (<span data-term-id=\"39221177\">PFA<\/span>) order<\/strong>. The <span data-term-id=\"39221204\">district court<\/span><span data-term-id=\"39221204\"> clerk<\/span> will take it to a judge, who may ask you additional questions. If the judge finds that a threat of abuse exists, <a href=\"https:\/\/codes.findlaw.com\/ks\/chapter-60-procedure-civil\/ks-st-sect-60-3106\/\" target=\"_blank\" rel=\"noopener\">the order is issued <span data-term-id=\"39221195\">ex parte<\/span><\/a>. A temporary <span data-term-id=\"39221177\">PFA<\/span> order lasts up to 21 days or until the final court hearing.<\/p>\n<p>A temporary <span data-term-id=\"39221177\">PFA<\/span> order offers immediate protection by <a href=\"https:\/\/www.kjc.ks.gov\/about\/search?q=address#!#tlPEMxaRIT\" target=\"_blank\" rel=\"noopener\">ordering the defendant to refrain from certain behavior<\/a>. It can also make temporary rulings on other issues, such as:<\/p>\n<ul>\n<li>The defendant (abuser) cannot abuse, harass, or interfere with the privacy or rights of the petitioner (victim)<\/li>\n<li>The defendant cannot enter the victim\u2019s home or be on their property<\/li>\n<li>The defendant must vacate a shared residence and not return<\/li>\n<li>Awarding <span data-term-id=\"39221188\">temporary custody<\/span> of any <span data-term-id=\"39221175\">minor children<\/span> with the best interests of the child in mind<\/li>\n<li>Setting parameters for parenting time and visitation that can include neutral sites and supervised visits<\/li>\n<\/ul>\n<p>The court can add any other <span data-term-id=\"39221181\">types of protection<\/span> it considers necessary. The temporary <span data-term-id=\"39221177\">PFA<\/span> is served to the defendant by <span data-term-id=\"39221168\">law enforcement<\/span>. The petitioner should never serve the defendant themselves.<\/p>\n<p>After being served, the defendant can do one of the following:<\/p>\n<ul>\n<li>Oppose the order<\/li>\n<li>File a <span data-term-id=\"39221199\">counter-petition<\/span> for a mutual order of <span data-term-id=\"39221164\">protection from abuse<\/span><\/li>\n<li>Offer a consent order<\/li>\n<\/ul>\n<p>A <a href=\"https:\/\/www.kjc.ks.gov\/about\/search?q=address#!#zbcbpl54wr\" target=\"_blank\" rel=\"noopener\">consent order<\/a> is an agreement between the two parties, often created by their attorneys. While the petitioner gets the <span data-term-id=\"39221177\">PFA<\/span>, the defendant agrees to abide by it without admitting to domestic abuse. If they oppose the order, the matter is settled at the final court hearing. Both sides argue their cases, <span data-term-id=\"39221201\">present evidence<\/span>, and call witnesses to testify.<\/p>\n<p>If the defendant does not oppose the order or doesn\u2019t show up at the court date, the court will finalize the order in their absence.<\/p>\n<p>If the plaintiff proves that further abuse is threatened, the court issues a <strong>final <span data-term-id=\"39221171\">protection from abuse<\/span><span data-term-id=\"39221171\"> order<\/span><\/strong>. This can amend the provisions from the <span data-term-id=\"39221170\">temporary order<\/span> and add new ones, such as:<\/p>\n<ul>\n<li>The defendant must pay for suitable alternate housing for the plaintiff and <span data-term-id=\"39221175\">minor child<\/span>(ren)<\/li>\n<li>Awarding custody of the <span data-term-id=\"39221175\">minor child<\/span>(ren) with a <a href=\"https:\/\/www.kjc.ks.gov\/about\/search?q=UCCJEA\" target=\"_blank\" rel=\"noopener\">UCCJEA form<\/a> included<\/li>\n<li>Establishing <span data-term-id=\"39221176\">child support<\/span><\/li>\n<li>Establishing spousal support<\/li>\n<li>Awarding possession of personal property, including pets, and the assistance of <span data-term-id=\"39221186\">law enforcement<\/span><span data-term-id=\"39221186\"> officers<\/span> in securing that property<\/li>\n<li><span data-term-id=\"39221187\">Attorney\u2019s fees<\/span> and costs<\/li>\n<li>Ordering <span data-term-id=\"39221165\">domestic violence<\/span> counseling for the defendant<\/li>\n<li>Transferring the rights to and billing responsibility for the wireless telephone number to the petitioner<\/li>\n<\/ul>\n<p>As with temporary <span data-term-id=\"39221177\">PFAs<\/span>, the court can include any provision needed. A final <span data-term-id=\"39221171\">protection from abuse<\/span><span data-term-id=\"39221171\"> order<\/span> in <span data-term-id=\"39221163\">Kansas<\/span> <a href=\"https:\/\/codes.findlaw.com\/ks\/chapter-60-procedure-civil\/ks-st-sect-60-3107\/\" target=\"_blank\" rel=\"noopener\">lasts for a fixed period of one to two years.<\/a> After that, it can be renewed for up to three years.<\/p>\n<p>In certain serious circumstances, such as when the defendant has violated the <span data-term-id=\"39221162\">protection order<\/span>, previously violated a <span data-term-id=\"39221162\">protection order<\/span>, or been convicted of a <span data-term-id=\"39221198\">person felony<\/span> against the plaintiff or <span data-term-id=\"39221184\">household member<\/span>, the court may extend the <span data-term-id=\"39221162\">protective order<\/span> for the lifetime of the defendant. This means the defendant must comply with the order&#8217;s restrictions for the rest of their life.<\/p>\n<h3><span data-term-id=\"39221169\">Protection From Stalking<\/span>, <span data-term-id=\"39221172\">Sexual Assault<\/span>, and <span data-term-id=\"39221167\">Human Trafficking<\/span> Order<\/h3>\n<p>If you&#8217;ve suffered abuse but don&#8217;t have a close personal relationship with your abuser, a <span data-term-id=\"39221163\">Kansas<\/span> <span data-term-id=\"39221162\">protection order<\/span> is another option. The <a href=\"https:\/\/codes.findlaw.com\/ks\/chapter-60-procedure-civil\/ks-st-sect-60-31a01\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39221163\">Kansas<\/span> <span data-term-id=\"39221169\">Protection From Stalking<\/span>, <span data-term-id=\"39221172\">Sexual Assault<\/span>, and <span data-term-id=\"39221167\">Human Trafficking<\/span> Act<\/a> covers the following offenses regardless of the association between the victim and the abuser:<\/p>\n<ul>\n<li>Stalking (intentional harassment that causes a person to fear for their safety)<\/li>\n<li><span data-term-id=\"39221172\">Sexual assault<\/span> (nonconsensual sexual acts or an attempted sexual act against another by force, threat of force, duress, or when the person is incapable of giving consent)<\/li>\n<li><span data-term-id=\"39221167\">Human trafficking<\/span>\/commercial sexual exploitation of a child<\/li>\n<\/ul>\n<p>Getting a <span data-term-id=\"39221162\">protection order<\/span> begins with the petitioner (victim) filing the <span data-term-id=\"39221193\">necessary forms<\/span> for an <strong><span data-term-id=\"39221195\">ex parte<\/span> temporary <span data-term-id=\"39221162\">protection order<\/span><\/strong> in any <a href=\"https:\/\/kscourts.gov\/About-the-Courts\/District-Courts\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39221163\">Kansas<\/span> <span data-term-id=\"39221166\">district court<\/span><\/a> or through a <a href=\"https:\/\/www.kcsdv.org\/find-help\/in-kansas\/dv-sa-services-map\/\" target=\"_blank\" rel=\"noopener\">sexual violence advocate<\/a>. If the judge agrees the threat of abuse is present, <a href=\"https:\/\/codes.findlaw.com\/ks\/chapter-60-procedure-civil\/ks-st-sect-60-3106\/\" target=\"_blank\" rel=\"noopener\">the order is issued <span data-term-id=\"39221195\">ex parte<\/span><\/a>, which means the defendant (abuser) isn&#8217;t spoken to before the order is issued. The sheriff&#8217;s department will serve the order to the defendant. A temporary <span data-term-id=\"39221177\">PFA<\/span> order lasts up to 21 days or until the final court hearing.<\/p>\n<p>The temporary <span data-term-id=\"39221162\">protection order<\/span> contains provisions designed to stop the abuser from continuing to stalk, sexually assault, or traffic the victim. Some <a href=\"https:\/\/codes.findlaw.com\/ks\/chapter-60-procedure-civil\/ks-st-sect-60-31a06\/\" target=\"_blank\" rel=\"noopener\">common conditions available include<\/a>:<\/p>\n<ul>\n<li>Issuing a no-contact order<\/li>\n<li>Forbidding the defendant (abuser) from abusing or harassing the petitioner (victim)<\/li>\n<li>Issuing a stay-away order<\/li>\n<li>Forbidding the defendant from committing or attempting to commit any form of <span data-term-id=\"39221172\">sexual assault<\/span> on the petitioner<\/li>\n<li>Forbidding the defendant from stalking the petitioner<\/li>\n<li>Forbidding the defendant from trafficking the petitioner<\/li>\n<\/ul>\n<p>The court can add other conditions. At the court hearing, the petitioner must convince the court that the defendant remains a threat. If successful, <strong>a <span data-term-id=\"39221174\">final order<\/span><\/strong> lasts up to a year. It&#8217;s renewable for an <span data-term-id=\"39221194\">additional year<\/span>.
