But in larger industries, the employee-employer relationship can get contentious. And in some cases, it helps to have unions act on labor\u2019s behalf when negotiating contract terms with management. This association, between employee, union, and employer, has always been governed by a strict, but evolving set of labor regulations. Here is an overview of \u201cright-to-work\u201d laws in Kansas.<\/p>\n<h2>Right to Work Laws<\/h2>\n<p>In the simplest sense, state <a href=\"https:\/\/www.findlaw.com\/state\/employment-laws\/details-on-state-right-to-work-laws.html\">&quot;right-to-work&quot; laws<\/a> prohibit unions and employers from requiring employees to be union members (or to pay membership dues) in order for to obtain or stay on a job. Kansas passed a right-to-work amendment to the state constitution in 1958, and added statutory provisions in 1975 that allow for a civil lawsuit in case of a constitutional violation.<\/p>\n<h2>Right to Work Statutes in Kansas<\/h2>\n<p>The details of Kansas\u2019s right to work statutes are listed below.<\/p>\n<table cellspacing=\"0\" cellpadding=\"0\" border=\"0\">\n<tbody><tr><td style=\"width: 147px;\"><p>Code Section<\/p>\n<\/td>\n<td style=\"width: 429px;\"><p><a href=\"http:\/\/kslib.info\/841\/Article-Fifteen-Miscellaneous\" target=\"_blank\" rel=\"noopener\">Kansas Constitution Article XV \u00a712<\/a>: Membership or Nonmembership in Labor Organizations;<\/p>\n<p><a href=\"http:\/\/kslegislature.org\/li_2014\/b2013_14\/statute\/044_000_0000_chapter\/044_008_0000_article\/044_008_0031_section\/044_008_0031_k\/\" target=\"_blank\" rel=\"noopener\">Kansas Statutes 44-831<\/a>: Violations of Right to Work Amendment<\/p>\n<\/td>\n<\/tr><tr><td style=\"width: 147px;\"><p>Policy on Union Membership, Organization, etc.<\/p>\n<\/td>\n<td style=\"width: 429px;\"><p>There is a cause of action if there is a constitutional violation. These laws manage the relationship between employees, employers, and <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/unions.html\">unions<\/a> by preventing both employers and unions from excluding non-union workers or requiring existing employees to join a union or pay union dues.<\/p>\n<p> Politically, unions have almost universally opposed right-to-work laws, while most business interests and Chambers of Commerce have lobbied heavily in favor of these measures. With a few states passing new statutes somewhat recently, right-to-work laws have been more prevalent in the news lately, and their overall impact on union membership, <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/state-minimum-wage-laws.html\">wages<\/a>, and <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/what-is-collective-bargaining-.html\">collective bargaining agreements<\/a> has yet to be fully determined.<\/p>\n<h2>More Resources for Kansas Right to Work Laws<\/h2>\n<p>State employment laws can be confusing.
