These laws are extremely strict, and if the state convicts you of child pornography charges, you\u2019ll face severe penalties, including having to register as a sex offender.<\/p>\r\n<p>The Commonwealth of Kentucky takes the crime of child pornography quite seriously. Here, we\u2019ll explain the child porn laws in the state. We\u2019ll also explain the possible defenses your criminal defense lawyer can use if the state charges you with this criminal offense.<\/p>\r\n<p>Finally, we\u2019ll discuss the penalties you\u2019ll face if the court finds you guilty of distribution of child pornography or any other child porn offense.<\/p>\r\n<h2><b>How Does Kentucky Law Define Child Pornography?<\/b><\/h2>\r\n<p>Most states define child pornography the same way. The Kentucky Revised Statutes (KRS) may use different language than other states, but the elements of the crime are similar.<\/p>\r\n<p>Kentucky law criminalizes the creation, possession, distribution, and promotion of material that portrays minors in sexual performances. This includes any play, film, photograph, or dance that depicts a minor engaging in any of the following:<\/p>\r\n<ul>\r\n<li>Acts (actual or simulated) of masturbation, homosexuality, lesbianism, bestiality, sexual intercourse, or deviant sexual intercourse<\/li>\r\n<li>Physical contact with genitals or intentionally exhibiting their genitals<\/li>\r\n<li>Flagellation or excretion for sexual stimulation or gratification<\/li>\r\n<li>Exposing genitals, the pubic area, buttocks, or female breasts in an obscene manner<\/li>\r\n<\/ul>\r\n<p>The following tables highlight Kentucky&#8217;s primary child pornography laws.<\/p>\r\n<table cellpadding=\"0\">\r\n<tbody><tr><th scope=\"row\" style=\"text-align: left;\">Code section<\/th>\r\n<td><p><b>Producing child pornography<\/b><\/p>\r\n<p>Kentucky Revised Statutes <a href=\"https:\/\/apps.legislature.ky.gov\/SessionRecord\/21RS\/SB66\/SB66_7370.pdf\" target=\"_blank\" rel=\"noopener\">section 531.320<\/a><\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\">What&#8217;s prohibited?<\/th>\r\n<td>Producing, directing, or promoting any performance that includes sexual conduct by a minor while knowing the character and content of the material<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\">Penalties<\/th>\r\n<td><ul>\r\n<li>If the minor is younger Class D felony<\/li>\r\n<li>Subsequent offense: Class C felony<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<h2><b>Defenses to Child Pornography Charges<\/b><\/h2>\r\n<p>If the state finds evidence that you possess child porn, it will be difficult to contest any criminal charges that follow. As you can see, the laws in Kentucky are pretty clear on what constitutes possession, viewing, and distribution of child porn.<\/p>\r\n<p>It doesn\u2019t matter whether you engaged in sexual activity with a minor on film or in pictures. The fact that you have this material in your possession is enough for the state to convict you of a sex crime.<\/p>\r\n<p>Odds are, if the judge finds you guilty, you\u2019ll be facing a prison sentence along with fines and the requirement that you register as a sex offender. To avoid this from happening, you may need a skilled <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/kentucky\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">criminal defense lawyer in Kentucky<\/a>.
