While the typical groups are exempt from coverage &#8212; including agricultural employees, some <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/domestic-workers-bill-of-rights.html\">domestic workers<\/a>, employees covered by <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/public-employees-and-workers-compensation.html\">federal acts<\/a>, and certain religious organizations &#8212; all employees may voluntarily accept coverage under the workers&#8217; comp program. However, the injuries and <a href=\"https:\/\/www.findlaw.com\/injury\/product-liability\/mesothelioma-and-asbestos.html\">occupational diseases<\/a> compensable are limited to physical injuries and mental injuries which directly result from those physical injuries. This means that if you suffered a heart attack during a performance review, that injury may be covered.<\/p>\r\n<p>In contrast, if &#8212; after your performance review &#8212; you suffer a debilitating panic attack every time you see your supervisor and you proceed to seek psychiatric treatment, it is highly unlikely that it would be covered.<\/p>\r\n<h2>Benefits<\/h2>\r\n<p>If you suffer from coal&nbsp; workers&#8217; <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/black-lung-benefits-program.html\">pneumoconiosis<\/a>, Kentucky offers <a href=\"http:\/\/www.lrc.ky.gov\/statutes\/statute.aspx?id=32546\" target=\"_blank\" rel=\"noopener\">special benefits<\/a> for income replacement and retraining. As far as other injuries are concerned, Kentucky offers <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/workers-comp-benefits-and-returning-to-work.html\">payment for medical care<\/a> and wage replacement. Wage replacement is equal to 66 2\/3 percent of your average weekly wages, subject to the state imposed maximums. If your employer does not use a managed care plan, you may choose your own physician by completing and returning the <a href=\"http:\/\/www.labor.ky.gov\/workersclaims\/Forms\/Form%20113.pdf\" target=\"_blank\" rel=\"noopener\">Notice of Designated Physician<\/a> form within ten days of your employer giving you the form. If you are entitled to permanent partial disability benefits, the <a href=\"http:\/\/www.labor.ky.gov\/workersclaims\/Pages\/PPD-Calculator.aspx\" target=\"_blank\" rel=\"noopener\">Permanent Partial Disability Benefit Calculator<\/a> is available to help you calculate the amount.<\/p>\r\n<h2>Dispute Resolution<\/h2>\r\n<p>If your claim is <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/workers-comp-denied-here-are-your-next-steps.html\">denied<\/a>, you may apply for a resolution of your injury claim by the <a href=\"http:\/\/www.labor.ky.gov\/workersclaims\/claims\/Pages\/Claims-Review.aspx\" target=\"_blank\" rel=\"noopener\">Department of Workers&#8217; Claims<\/a>.
