A rating between 70% and 99% adds $4,500 in <span data-term-id=\"52744863\">assessed value<\/span>, or roughly $45,000 in <span data-term-id=\"52744877\">fair market value<\/span>. A 100% <span data-term-id=\"52744878\">disability rating<\/span> exempts the full remaining <span data-term-id=\"52744863\">assessed value<\/span> of the property. Veterans seeking these benefits should contact the Louisiana Department of Veterans Affairs for an updated form reflecting their current home address.<\/p>\n<h3>First responders<\/h3>\n<p>Law enforcement officers and first responders who live in the same <span data-term-id=\"52744858\">parish<\/span> where they work may qualify for an extra $2,500 in <span data-term-id=\"52744863\">assessed value<\/span> under\u00a0<a href=\"https:\/\/codes.findlaw.com\/la\/louisiana-constitution-of-1974\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52744871\">Louisiana&#8217;s Constitution<\/span><\/a>. This includes full-time law enforcement, fire protection, emergency medical services, and rapid-response personnel.<\/p>\n<h3><span data-term-id=\"52744859\">Homeowners<\/span> who are 65 or older or permanently disabled<\/h3>\n<p>If you are 65 <span data-term-id=\"52744876\">years of age<\/span> or older or permanently disabled, you may qualify for a\u00a0<a href=\"https:\/\/stcharlesassessor.com\/special-assessment-levels\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52744866\">Special Assessment<\/span> Level Freeze<\/a>. This keeps your <span data-term-id=\"52744863\">assessed value<\/span> from rising above the amount set in your first qualifying year, as long as your income stays below the Louisiana Tax Commission&#8217;s current limit, which is headquartered in <span data-term-id=\"52744893\">Baton Rouge<\/span>.<\/p>\n<h2>Qualifying Property Types<\/h2>\n<p>Under\u00a0<a href=\"https:\/\/codes.findlaw.com\/la\/revised-statutes\/la-rev-stat-tit-20-sect-1\/\" target=\"_blank\" rel=\"noopener\">Louisiana&#8217;s homestead seizure exemption<\/a>, a qualifying homestead is a residence you occupy as the owner. This includes the land it sits on, any buildings and improvements, and contiguous tracts within the applicable acreage limits.<\/p>\n<p>Some less obvious types of property may also\u00a0<a href=\"https:\/\/legis.la.gov\/Legis\/law.aspx?d=206550\" target=\"_blank\" rel=\"noopener\">qualify for homestead protection<\/a>. Let\u2019s take a look:<\/p>\n<ul>\n<li><strong><span data-term-id=\"52744882\">Mobile homes<\/span><\/strong>\u00a0used as a <span data-term-id=\"52744864\">primary residence<\/span> qualify for the <span data-term-id=\"52744862\">property tax<\/span> <span data-term-id=\"52744857\">homestead exemption<\/span>, even if you do not own the underlying land. The land itself would not be exempt, though.<\/li>\n<li><strong>Property held in a trust<\/strong>\u00a0may qualify if the main beneficiaries were also the immediate prior owners and still live in the home as their <span data-term-id=\"52744864\">primary residence<\/span>. Property subject to a <span data-term-id=\"52744894\">usufruct<\/span>, which is the right to use and enjoy property owned by someone else, may also qualify if the person with that right was an immediate prior owner and still lives there.<\/li>\n<li><strong><span data-term-id=\"52744861\">Surviving spouses<\/span> and minor children<\/strong>\u00a0of a deceased owner who still live in the home may qualify for the exemption. A former spouse who stays in the property after a divorce may also qualify.<\/li>\n<\/ul>\n<p>You can only claim one <span data-term-id=\"52744857\">homestead exemption<\/span> per person in Louisiana. The exemption does not apply to property owned by a partnership or corporation, property used for business, or bond-for-deed purchases.<\/p>\n<h2>How To Claim a <span data-term-id=\"52744857\">Homestead Exemption<\/span> in Louisiana<\/h2>\n<p>The <span data-term-id=\"52744862\">property tax<\/span> <span data-term-id=\"52744857\">homestead exemption<\/span> does not apply automatically. You need to apply to your local <span data-term-id=\"52744872\">parish<\/span> <span data-term-id=\"52744860\">assessor<\/span>. Once approved, the exemption remains as long as you own and live in the home as your main residence.<\/p>\n<p>To qualify, you must own and live in the home by December 31 of the <span data-term-id=\"52744898\">tax year<\/span>. You will usually need to provide:<\/p>\n<ul>\n<li>A valid Louisiana <span data-term-id=\"52744880\">driver&#8217;s license<\/span> or state-issued ID listing the property&#8217;s address<\/li>\n<li>A recorded copy of your Warranty Deed or Act of Sale<\/li>\n<li>A current unpaid utility bill in your name showing the property as both the service location and <span data-term-id=\"52744886\">mailing address<\/span><\/li>\n<\/ul>\n<p>Some <span data-term-id=\"52744858\">parishes<\/span> may require extra proof of residency or other documents. If you move but keep your old property, let your <span data-term-id=\"52744860\">assessor<\/span> know about the change.<\/p>\n<h2>Exceptions and Limitations<\/h2>\n<p>There are certain exemptions to the application of homestead laws. <span data-term-id=\"52744888\">Louisiana law<\/span> allows creditors to force a sale or seizure of your home in certain situations. These include:<\/p>\n<ul>\n<li>A lien that existed on the property before the homestead was established<\/li>\n<li>A mortgage on the property that you voluntarily granted as security for a loan<\/li>\n<li>A loan from a homestead or building and loan association secured by the property<\/li>\n<li>The unpaid purchase price of the home itself<\/li>\n<li>Past-due taxes owed to the state or its <span data-term-id=\"52744858\">parishes<\/span> and <span data-term-id=\"52744874\">municipalities<\/span><\/li>\n<li>Unpaid labor, money, or materials used to build, repair, or improve the home<\/li>\n<li>Liabilities incurred by a public officer, fiduciary, or attorney for money collected or received in that capacity<\/li>\n<\/ul>\n<p>In general, <span data-term-id=\"52744888\">Louisiana law<\/span> prevents a judgment creditor from forcing the sale of your home just to collect consumer credit card debt. However, the creditor can still record a judicial mortgage against your property.<\/p>\n<p>Federal debts can override Louisiana&#8217;s homestead protections. For example, a <span data-term-id=\"52744887\">federal income tax<\/span> lien takes priority over the state exemption. The IRS rarely forecloses on homes for tax debt, but the risk increases if your property is mortgaged or sold while a federal tax lien is in place.<\/p>\n<p>If you are considering bankruptcy, Louisiana does not allow you to use federal bankruptcy exemptions instead of state ones.
