Compensation varies based on the extent to which your injury impacts your ability to work. In the event of your <a href=\"https:\/\/www.findlaw.com\/legalblogs\/injured\/2015\/04\/death-at-work-workers-comp-or-wrongful-death-claim.html\">death<\/a>, benefits may be paid to your survivors.<\/p>\r\n<p>Unlike many states, Louisiana does not cap the amount you can receive. How much you will receive depends on your level of disability.<\/p>\r\n<h2>Time Limits<\/h2>\r\n<p>In most cases, you must give your employer notice of your injury within <a href=\"http:\/\/www.laworks.net\/Downloads\/Posters\/Workers_Comp_ltr_color.pdf\" target=\"_blank\" rel=\"noopener\">30 days<\/a> or be barred from receiving <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/workers-compensation-questions-and-answers.html\">benefits<\/a>. Additionally, in most cases, claims for payments must be made within <a href=\"https:\/\/www.legis.la.gov\/legis\/Law.aspx?p=y&amp;d=83443\" target=\"_blank\" rel=\"noopener\">one year<\/a> of the accident that caused the injury. All claims absolutely must be made within <a href=\"https:\/\/www.legis.la.gov\/legis\/Law.aspx?p=y&amp;d=83443\" target=\"_blank\" rel=\"noopener\">three years<\/a> of the date of the accident that caused the disability.<\/p>\r\n<p>If your injury results in disability which lasts for less than <a href=\"https:\/\/www.legis.la.gov\/legis\/Law.aspx?d=83450\" target=\"_blank\" rel=\"noopener\">2 weeks<\/a>, you are entitled to <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/workers-comp-benefits-and-returning-to-work.html\">compensation<\/a> beginning during the second week. However, if your disability lasts for 2 weeks or more, you will receive compensation for the first week after two weeks.<\/p>\r\n<h2>Types of Injures Covered<\/h2>\r\n<p>Both <a href=\"https:\/\/www.legis.la.gov\/legis\/law.aspx?d=83328\" target=\"_blank\" rel=\"noopener\">mental and physical injuries<\/a> from either accidents or occupational diseases are covered. However, mental injuries must be the result of a physical injury or of a sudden, unexpected and extraordinary stress related to the employment.<\/p>\r\n<h2>How Workers&#8217; Compensation Benefits are Calculated<\/h2>\r\n<p>Your compensation rate (CR) is determined by your average weekly wage. For <a href=\"https:\/\/www.legis.la.gov\/legis\/Law.aspx?d=83447\" target=\"_blank\" rel=\"noopener\">permanent total disability<\/a>, <a href=\"https:\/\/www.legis.la.gov\/legis\/Law.aspx?d=83447\" target=\"_blank\" rel=\"noopener\">temporary partial disability<\/a>, <a href=\"https:\/\/www.legis.la.gov\/legis\/Law.aspx?d=83447\" target=\"_blank\" rel=\"noopener\">temporary total disability<\/a>, you will receive 66 2\/3 percent of your average wages. If an injury leaves you unable to earn wages equal to 90 percent of your wages at the time of injury, you are entitled to <a href=\"https:\/\/www.legis.la.gov\/legis\/Law.aspx?d=83447\" target=\"_blank\" rel=\"noopener\">supplemental earning benefits<\/a> equal to 66 2\/3 percent of the difference between you average monthly wages at the time of the injury and current average monthly wages. Benefits are limited to 520 weeks.<\/p>\r\n<p>If your injury leaves you permanently partially disabled, compensation is based on the type of loss. For example, for the loss of a thumb, <a href=\"https:\/\/www.legis.la.gov\/legis\/Law.aspx?d=83447\" target=\"_blank\" rel=\"noopener\">permanent partial disability<\/a> compensation is 66 2\/3 percent of wages for 50 weeks. If you suffered a catastrophic injury, you may be entitled to a one time <a href=\"https:\/\/www.legis.la.gov\/legis\/Law.aspx?d=83447\" target=\"_blank\" rel=\"noopener\">catastrophic injury payment<\/a> of $50,000. If you die, your surviving beneficiaries may recover a maximum of <a href=\"https:\/\/www.legis.la.gov\/legis\/Law.aspx?p=y&amp;d=83444\" target=\"_blank\" rel=\"noopener\">$8,500<\/a> in burial expenses in addition to other compensation.<\/p>\r\n<p>Unfortunately, Louisiana employers may not be required to keep your job available for you to return to when you are healthy enough to return to work. However, you cannot be fired simply because you file a workers&#8217; compensation claim.<\/p>\r\n<h2>What to Do If Your Claim Is Denied<\/h2>\r\n<p>If your claim for workers&#8217; compensation benefits is <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/workers-comp-denied-here-are-your-next-steps.html\">denied<\/a>, one option is to file a <a href=\"http:\/\/www.laworks.net\/Downloads\/OWC\/1008form.pdf\" target=\"_blank\" rel=\"noopener\">Disputed Claim for Compensation<\/a>.
