In this article, we&#8217;ll explain how it\u2019s different, who and what acts are involved, and the protections and penalties available.<\/p>\n<h2>What Is <span data-term-id=\"39071681\">Domestic Abuse<\/span>?<\/h2>\n<p>In most instances, <span data-term-id=\"39071640\">domestic violence<\/span> occurs when a particular abusive act happens between people in qualifying relationships. <span data-term-id=\"39071641\">Maine<\/span> expands its definition by allowing <a href=\"https:\/\/codes.findlaw.com\/me\/title-19-a-domestic-relations\/me-rev-st-tit-19-a-sect-4103\/\" target=\"_blank\" rel=\"noopener\">some crimes to be classified as <span data-term-id=\"39071681\">domestic abuse<\/span><\/a> regardless of those involved. Let&#8217;s take a closer look at the requirements.<\/p>\n<h3>What Acts Qualify as <span data-term-id=\"39071681\">Domestic Abuse<\/span>?<\/h3>\n<p>There&#8217;s a wide range of abusive crimes, but <span data-term-id=\"39071681\">domestic abuse<\/span> offenses focus on <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/power-and-control\/\" target=\"_blank\" rel=\"noopener\">power and control<\/a>. Abusers use different types of <span data-term-id=\"39071640\">domestic violence<\/span> to keep victims feeling hopeless and helpless. Someone <a href=\"https:\/\/www.findlaw.com\/state\/maine-law\/maine-stalking-laws.html\">stalking a victim<\/a> is <span data-term-id=\"39071640\">domestic violence<\/span> in <span data-term-id=\"39071641\">Maine<\/span>, whether or not they share a relationship.<\/p>\n<h3><span data-term-id=\"39071657\">Family Members<\/span> and <span data-term-id=\"39071643\">Household Members<\/span><\/h3>\n<p>For the majority of <span data-term-id=\"39071681\">domestic abuse<\/span> crimes, a close personal relationship is required for classification. <span data-term-id=\"39071641\">Maine<\/span> refers to these individuals as <a href=\"https:\/\/codes.findlaw.com\/me\/title-19-a-domestic-relations\/me-rev-st-tit-19-a-sect-4103\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39071657\">family members<\/span> and <span data-term-id=\"39071677\">adult <\/span><span data-term-id=\"39071643\">household members<\/span><\/a>. Not all relationships require sharing the same dwelling. Eligible people and relationships include:<\/p>\n<ul>\n<li>Spouses<\/li>\n<li>Former spouses<\/li>\n<li><span data-term-id=\"39071653\">Domestic partners<\/span><\/li>\n<li>Former <span data-term-id=\"39071653\">domestic partners<\/span><\/li>\n<li>People who are <span data-term-id=\"39071685\">sexual partners<\/span><\/li>\n<li>People who were <span data-term-id=\"39071685\">sexual partners<\/span><\/li>\n<li>People in a dating relationship together<\/li>\n<li>People who were <span data-term-id=\"39071662\">dating partners<\/span><\/li>\n<li>Individuals living together<\/li>\n<li>Individuals who have lived together<\/li>\n<li>Adults related by consanguinity (blood relatives)<\/li>\n<li>Adults related by affinity (in-laws)<\/li>\n<li>Parents with a child in common<\/li>\n<li>Children of a parent sharing one of these relationships<\/li>\n<\/ul>\n<p>If people sharing one of these relationships have a qualifying crime happen between them, it&#8217;s <span data-term-id=\"39071681\">domestic abuse<\/span> in <span data-term-id=\"39071641\">Maine<\/span>. This matters because the classification enables <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-orders-of-protection-and-restraining-orders.html\">special protections for the victim<\/a> and enhanced penalties for abusers.<\/p>\n<h3>Abusive Acts With No Required Relationship<\/h3>\n<p><span data-term-id=\"39071659\">Maine<\/span><span data-term-id=\"39071659\">&#8216;s <\/span><span data-term-id=\"39071668\">domestic violence<\/span><span data-term-id=\"39071668\"> law<\/span> is unique in that it identifies some acts as <span data-term-id=\"39071681\">domestic abuse<\/span> even when the people involved don\u2019t know each other or are not in a qualifying relationship. The following acts can lead to a <span data-term-id=\"39071681\">domestic abuse<\/span> charge regardless of the relationship between the parties:<\/p>\n<ul>\n<li>Stalking<\/li>\n<li><span data-term-id=\"39071658\">Sexual assault<\/span><\/li>\n<li>Attempted <span data-term-id=\"39071658\">sexual assault<\/span><\/li>\n<li>Sharing of unauthorized private images<\/li>\n<li>Engaging in sex trafficking or aggravated sex trafficking<\/li>\n<li>Nonconsensual removal of a condom or tampering with a condom<\/li>\n<li>Sexual exploitation of a minor<\/li>\n<li>Harassment of a minor by electronic means via pictures or footage of a sexual act<\/li>\n<li>Dissemination of sexually explicit material to a minor<\/li>\n<\/ul>\n<p>Despite not having the type of relationship usually required for <span data-term-id=\"39071640\">domestic violence<\/span> classification, these offenses are considered <span data-term-id=\"39071681\">domestic abuse<\/span> in <span data-term-id=\"39071641\">Maine<\/span>.<\/p>\n<h2>Help for Victims<\/h2>\n<p>When it comes to the violence and abuse associated with <span data-term-id=\"39071665\">domestic violence<\/span><span data-term-id=\"39071665\"> crimes<\/span>, gathering as much knowledge and protection as possible can save you from additional pain and suffering. Help is available through both the <span data-term-id=\"39071673\">state of <\/span><span data-term-id=\"39071641\">Maine<\/span> and <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-orders-of-protection-and-restraining-orders.html\"><span data-term-id=\"39071640\">domestic violence<\/span> advocates<\/a>.<\/p>\n<h3><span data-term-id=\"39071641\">Maine<\/span> <span data-term-id=\"39071647\">Protection From Abuse Orders<\/span> (PFA)<\/h3>\n<p><span data-term-id=\"39071647\">Protection from abuse orders<\/span> (PFA) are also known as <span data-term-id=\"39071675\">restraining orders<\/span> and orders of protection. They can offer an effective means of relief for <span data-term-id=\"39071654\">victims of <\/span><span data-term-id=\"39071640\">domestic violence<\/span>.<\/p>\n<p>PFAs use provisions to keep the abuser away from the victim, as well as ruling on <a href=\"https:\/\/codes.findlaw.com\/me\/title-19-a-domestic-relations\/me-rev-st-tit-19-a-sect-4108\/\" target=\"_blank\" rel=\"noopener\">other pertinent issues<\/a>. They&#8217;re designed to meet specific needs and differ from case to case. For example, a couple in a dating relationship who don&#8217;t have kids wouldn&#8217;t have a provision concerning child custody in a PFA.<\/p>\n<p>While the court can add any condition to a PFA, some provisions are more common than others. These include:<\/p>\n<ul>\n<li>Making temporary rulings on child custody, child support, and spousal support<\/li>\n<li>Ordering the abuser to turn in any firearms or other weapons used or threatened to be used during a <span data-term-id=\"39071687\">domestic violence<\/span><span data-term-id=\"39071687\"> offense<\/span><\/li>\n<li>Ordering the abuser to complete a certified <span data-term-id=\"39071640\">domestic violence<\/span> intervention program<\/li>\n<li>Forbidding the abuser from harassing, threatening, or having any contact with the victim<\/li>\n<\/ul>\n<p>This is not an exhaustive list. PFAs can contain all, some, or none of these provisions. Plaintiffs (victims) can apply for a temporary PFA at a <span data-term-id=\"39071641\">Maine<\/span> district court. Forms are <a href=\"https:\/\/www.courts.maine.gov\/forms\/index.html\" target=\"_blank\" rel=\"noopener\">available online<\/a> and <a href=\"https:\/\/www.courts.maine.gov\/courts\/find-by-town.html\" target=\"_blank\" rel=\"noopener\">at the courthouse<\/a>. You can also file with the help of a <a href=\"https:\/\/www.mcedv.org\/get-help\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39071640\">domestic violence<\/span> advocate<\/a>.<\/p>\n<p>If you need a PFA but your local court is closed, you can file an emergency petition with another District Court judge or Superior Court judge. This is only permitted if there&#8217;s no shelter to take you in. Otherwise, your petition for a <strong>temporary ex parte order<\/strong> is filed with the court clerk, who takes it to a judge. The judge may ask you questions.<\/p>\n<p>If approved, the order is served to the defendant (abuser) by <span data-term-id=\"39071664\">law enforcement<\/span>. The temporary order lasts 21 days or until the full court hearing. At the court date, both sides plead their cases, present evidence, and call witnesses. If the court agrees that the threat of abuse exists, a <strong>final protection order<\/strong> is issued.<\/p>\n<p>A final PFA lasts for two years. It&#8217;s renewable, and the <a href=\"https:\/\/codes.findlaw.com\/me\/title-19-a-domestic-relations\/me-rev-st-tit-19-a-sect-4111\/\" target=\"_blank\" rel=\"noopener\">court can make the extension for any amount of time<\/a>. PFAs issued in <span data-term-id=\"39071641\">Maine<\/span> are enforced throughout the U.S. <a href=\"https:\/\/www.hud.gov\/vawa#openModal\" target=\"_blank\" rel=\"noopener\">under <span data-term-id=\"39071661\">federal law<\/span><\/a>. A basic violation is a <span data-term-id=\"39071682\">Class D<\/span><span data-term-id=\"39071682\"> crime<\/span>, which carries up to 364 days in jail and a $2,000 fine. Violations involving assault or <span data-term-id=\"39071651\">reckless conduct<\/span> that creates risk of death or serious <span data-term-id=\"39071649\">bodily injury<\/span> are Class C crimes, with up to five years imprisonment and a $5,000 fine. Repeat offenders with two or more prior PFA violations also face Class C penalties.<\/p>\n<h3>Address Confidentiality Program (ACP)<\/h3>\n<p>Getting away from an abuser is often just the beginning. The last thing a victim wants is for the abuser to find them again. <span data-term-id=\"39071641\">Maine<\/span>&#8216;s <a href=\"https:\/\/www.maine.gov\/sos\/acp\/index.html\" target=\"_blank\" rel=\"noopener\">Address Confidentiality Program (ACP)<\/a> provides relief by offering participants a second legal mailing address. This is used to keep public records hidden. The ACP also forwards first-class mail to the victim&#8217;s actual address.<\/p>\n<h3>Renter Protections<\/h3>\n<p>When exiting a toxic relationship, issues with your landlord are an additional hassle you don&#8217;t need. <span data-term-id=\"39071654\">Victims of <\/span><span data-term-id=\"39071640\">domestic violence<\/span> can <a href=\"https:\/\/codes.findlaw.com\/me\/title-14-court-procedure-civil\/me-rev-st-tit-14-sect-6001\/#:~:text=6.%20Domestic%20violence%2C%20sexual%20assault%20and%20stalking.\" target=\"_blank\" rel=\"noopener\">legally break their lease<\/a> without penalty under <span data-term-id=\"39071645\">Maine<\/span><span data-term-id=\"39071645\"> law<\/span>. Depending on the length of the lease, victims must give either seven or 30 days&#8217; written notice.<\/p>\n<p>If a victim is planning on staying and their PFA has forced the abuser to leave the residence, victims can have the landlord remove the abuser from the lease. They can also change the locks without penalty if they <a href=\"https:\/\/codes.findlaw.com\/me\/title-14-court-procedure-civil\/me-rev-st-tit-14-sect-6025\/\" target=\"_blank\" rel=\"noopener\">give the landlord a copy of the new key within 72 hours<\/a>.<\/p>\n<h3><span data-term-id=\"39071640\">Domestic Violence<\/span> Advocates<\/h3>\n<p>There&#8217;s no substitute for experience. When caught up in the chaos and horror of <span data-term-id=\"39071681\">domestic abuse<\/span>, <a href=\"https:\/\/www.mcedv.org\/get-help\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39071640\">domestic violence<\/span> advocates<\/a> who have helped others through the same before make powerful allies. They&#8217;ll work with you to create a <a href=\"https:\/\/www.thehotline.org\/what-is-a-safety-plan\/\" target=\"_blank\" rel=\"noopener\">safety plan<\/a>, make sure you have somewhere safe to go, and show you available protections.<\/p>\n<h2>Penalties for <span data-term-id=\"39071650\">Domestic Violence<\/span><span data-term-id=\"39071650\"> Charges<\/span> in <span data-term-id=\"39071641\">Maine<\/span><\/h2>\n<p><span data-term-id=\"39071640\">Domestic violence<\/span> classification matters for more than the protections it makes available. Crimes involving <span data-term-id=\"39071640\">domestic violence<\/span> often carry enhanced penalties.<\/p>\n<p>Many <span data-term-id=\"39071665\">domestic violence<\/span><span data-term-id=\"39071665\"> crimes<\/span> in <span data-term-id=\"39071641\">Maine<\/span> are classified as <span data-term-id=\"39071644\">Class D<\/span> offenses, though specific penalties depend on the underlying crime and circumstances. The penalties for a <span data-term-id=\"39071644\">Class D<\/span> are up to 364 days in county jail and a fine of up to $2,000. For repeat offenders of any <span data-term-id=\"39071665\">domestic violence<\/span><span data-term-id=\"39071665\"> crime<\/span>, or if the offense is aggravated, the penalty is Class C instead. <a href=\"https:\/\/codes.findlaw.com\/me\/title-17-a-maine-criminal-code\/me-rev-st-tit-17-a-sect-1604\/\" target=\"_blank\" rel=\"noopener\">Class C penalties<\/a> are up to five years in prison and a fine of up to $5,000.<\/p>\n<p>It&#8217;s important to note that <span data-term-id=\"39071687\">domestic violence<\/span><span data-term-id=\"39071687\"> offenses<\/span> don&#8217;t have to be for the same type of crime to receive enhancement for another conviction. For example, an abuser who was convicted of <a href=\"https:\/\/codes.findlaw.com\/me\/title-17-a-maine-criminal-code\/me-rev-st-tit-17-a-sect-207-a\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39071642\">domestic violence<\/span><span data-term-id=\"39071642\"> assault<\/span><\/a> would face a Class C penalty for <a href=\"https:\/\/www.mainelegislature.org\/legis\/statutes\/17-a\/title17-Asec209-A.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39071679\">domestic violence<\/span><span data-term-id=\"39071679\"> criminal threatening<\/span><\/a> if they promised to assault the victim again.<\/p>\n<p>Most violations of a <span data-term-id=\"39071641\">Maine<\/span> PFA order are a <span data-term-id=\"39071644\">Class D<\/span> offense. Exceptions include:<\/p>\n<ul>\n<li>Civil violations such as support non-payment or refusal to pay court-ordered expenses are contempt charges that the plaintiff must pursue in court<\/li>\n<li>Violations involving <span data-term-id=\"39071651\">reckless conduct<\/span> or assault that creates the risk of serious <span data-term-id=\"39071649\">bodily injury<\/span> or death are Class C offenses<\/li>\n<li>Any subsequent violation after a second violation is a Class C offense<\/li>\n<\/ul>\n<p>Abusers may also receive mandatory court-ordered <span data-term-id=\"39071640\">domestic violence<\/span> intervention program requirements.
