This article offers answers to an array of questions about <span data-term-id=\"39187229\">domestic violence<\/span>. Advocates lean toward <span data-term-id=\"39187229\">domestic violence<\/span>, and the state&#8217;s <span data-term-id=\"39187247\">intervention program<\/span> does as well. Unless you&#8217;re drafting a legal document, either form will convey the meaning.<\/p>\n<h2>Okay, so what is <span data-term-id=\"39187229\">domestic violence<\/span>?<\/h2>\n<p>In most states, <span data-term-id=\"39187229\">domestic violence<\/span> follows a <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/stop-domestic-violence.html\">somewhat strict definition<\/a>. It occurs when one or more of a specific subset of abusive acts are committed between people in qualifying close personal relationships. Offenses that don&#8217;t fit the classification aren&#8217;t considered <span data-term-id=\"39187229\">domestic violence<\/span>.<\/p>\n<p><span data-term-id=\"39187233\">Maine<\/span><span data-term-id=\"39187233\"> law<\/span> uses a broader interpretation of <span data-term-id=\"39187229\">domestic violence<\/span>. It gives victims of certain abusive crimes access to <span data-term-id=\"39187235\">domestic abuse<\/span> protections without the relationship requirement. The exceptions are noted in the following list, which shows <a href=\"https:\/\/legislature.maine.gov\/statutes\/19-a\/title19-Asec4103.html\" target=\"_blank\" rel=\"noopener\">abusive acts and categories of crime considered eligible for <span data-term-id=\"39187229\">domestic violence<\/span> classification<\/a>:<\/p>\n<ul>\n<li>Attempting to cause <span data-term-id=\"39187232\">bodily injury<\/span> or <span data-term-id=\"39187257\">offensive physical contact<\/span><\/li>\n<li>Attempting to place another in fear of <span data-term-id=\"39187232\">bodily injury<\/span> through harassing, threatening, or tormenting behavior<\/li>\n<li>Causing <span data-term-id=\"39187232\">bodily injury<\/span> or <span data-term-id=\"39187257\">offensive physical contact<\/span><\/li>\n<li>False imprisonment through kidnapping, isolation, or restraint<\/li>\n<li>Making a person do something they don&#8217;t want to by intimidation, force, or threat of force<\/li>\n<li>Keeping someone from doing something they want to do by intimidation, force, or threat of force<\/li>\n<li>Placing another in fear of <span data-term-id=\"39187232\">bodily injury<\/span> through harassing, threatening, or tormenting behavior<\/li>\n<li>Tampering with a condom or nonconsensual removal of a condom (no relationship requirement)<\/li>\n<li>Threatening a crime of dangerous violence with risk to human life<\/li>\n<li>Attempted <span data-term-id=\"39187240\">sexual assault<\/span> (no relationship requirement)<\/li>\n<li>Dissemination of sexually explicit material to a minor (no relationship required)<\/li>\n<li>Engaging in sex trafficking or aggravated sex trafficking (no relationship requirement)<\/li>\n<li>Harassment of a minor by electronic means through pictures or footage of a sexual act (no relationship requirement)<\/li>\n<li><span data-term-id=\"39187240\">Sexual assault<\/span> (no relationship requirement)<\/li>\n<li>Sexual exploitation of a minor (no relationship requirement)<\/li>\n<li>Sharing of unauthorized private images (no relationship requirement)<\/li>\n<li>Stalking (no relationship requirement)<\/li>\n<\/ul>\n<p>Crimes that don&#8217;t have a relationship requirement are still <span data-term-id=\"39187229\">domestic violence<\/span> if committed between <span data-term-id=\"39187243\">family members<\/span>, <span data-term-id=\"39187266\">adult <\/span><span data-term-id=\"39187230\">household members<\/span>, or <span data-term-id=\"39187249\">dating partners<\/span>. <span data-term-id=\"39187228\">Maine<\/span> considers <a href=\"https:\/\/legislature.maine.gov\/statutes\/19-a\/title19-Asec4103.html\" target=\"_blank\" rel=\"noopener\">the people and relationships that qualify<\/a> as:<\/p>\n<ul>\n<li><span data-term-id=\"39187255\">Domestic partners<\/span><\/li>\n<li>Former <span data-term-id=\"39187255\">domestic partners<\/span><\/li>\n<li>Spouses<\/li>\n<li>Former spouses<\/li>\n<li>Individuals living together<\/li>\n<li>Individuals who have lived together<\/li>\n<li>People who are sexual partners<\/li>\n<li>People who were sexual partners<\/li>\n<li>People in a dating relationship together<\/li>\n<li>People who were in a dating relationship together<\/li>\n<li>Adults related by affinity (in-laws)<\/li>\n<li>Adults related by consanguinity (blood relatives)<\/li>\n<li>Parents with a child in common<\/li>\n<li>Children of a parent sharing one of these relationships<\/li>\n<\/ul>\n<p>Inclusion in one of these relationships doesn&#8217;t make every crime between the people involved an act of <span data-term-id=\"39187229\">domestic violence<\/span>.<\/p>\n<h2>Why is my abuser doing this to me?<\/h2>\n<p>There&#8217;s no single answer to that question. <span data-term-id=\"39187229\">Domestic violence<\/span> is about <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/power-and-control\/\" target=\"_blank\" rel=\"noopener\">power and control<\/a>. The abuser feels entitled to dominate their victim&#8217;s life. The <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/types-of-domestic-violence.html\">tactics used<\/a> can vary, but most focus on keeping the victim feeling hopeless, helpless, and living in fear.<\/p>\n<p>Although isolation is a weapon for abusers, victims aren&#8217;t alone. <a href=\"https:\/\/www.mcedv.org\/get-help\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39187229\">Domestic violence<\/span> advocates<\/a> are experienced in helping people escape toxic relationships and can help.<\/p>\n<h2>Is <span data-term-id=\"39187229\">domestic violence<\/span> classification important? Isn&#8217;t a crime always a crime?<\/h2>\n<p>Abusive acts are always punished by the <span data-term-id=\"39187265\">state of <\/span><span data-term-id=\"39187228\">Maine<\/span>. Having a crime classified as <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/understand-relationship-abuse\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39187229\">domestic violence<\/span><\/a> offers specific protections and punishments that aren&#8217;t available in other situations. <span data-term-id=\"39187228\">Maine<\/span> <span data-term-id=\"39187238\">family law<\/span> is designed to deter repeat offenders. Any previous <span data-term-id=\"39187229\">domestic violence<\/span> conviction affects sentencing for another <span data-term-id=\"39187229\">domestic violence<\/span> crime.<\/p>\n<p>Let&#8217;s show an example. <a href=\"https:\/\/legislature.maine.gov\/statutes\/17-a\/title17-Asec207-A.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39187234\">Domestic violence<\/span><span data-term-id=\"39187234\"> assault<\/span><\/a> is a <span data-term-id=\"39187241\">Class D<\/span> penalty. However, a person with a <span data-term-id=\"39187260\">prior conviction<\/span> for <span data-term-id=\"39187234\">domestic violence<\/span><span data-term-id=\"39187234\"> assault<\/span> would face a Class C penalty for <a href=\"https:\/\/legislature.maine.gov\/statutes\/17-a\/title17-Asec209.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39187229\">domestic violence<\/span> <span data-term-id=\"39187250\">criminal threatening<\/span><\/a>.<\/p>\n<h2>I want to get away from my abuser. What&#8217;s the best way to do so?<\/h2>\n<p>First and foremost: if you&#8217;re suffering abuse or feel abuse and violence are imminent, call 911. <span data-term-id=\"39187233\">Maine<\/span> <a href=\"https:\/\/legislature.maine.gov\/statutes\/19-a\/title19-Ach103sec0.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39187233\">law<\/span> enforcement receives special training<\/a> for <span data-term-id=\"39187229\">domestic violence<\/span> calls, including alerting victims to services available.<\/p>\n<p>If possible, having a <a href=\"https:\/\/www.thehotline.org\/what-is-a-safety-plan\/\" target=\"_blank\" rel=\"noopener\">safety plan<\/a> in place is a great way to prepare for escape. Safety plans focus on having answers for all the &#8220;what if?&#8221; questions that may pop up during the process. <a href=\"https:\/\/www.mcedv.org\/get-help\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39187229\">Domestic violence<\/span> advocates<\/a> have the skill and experience for guidance. A <a href=\"https:\/\/lawyers.findlaw.com\/domestic-violence\/maine\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39187229\">domestic violence<\/span> attorney<\/a> is also an invaluable resource.<\/p>\n<h2>I think I might be an abuser. Is there a way I can get help so I&#8217;m not this way?<\/h2>\n<p><span data-term-id=\"39187228\">Maine<\/span> would much rather help you become a better person than incarcerate you. Assistance is available through <a href=\"https:\/\/www.maine.gov\/corrections\/victimservices\/cdvip\" target=\"_blank\" rel=\"noopener\">Certified <span data-term-id=\"39187229\">Domestic Violence<\/span> <span data-term-id=\"39187247\">Intervention Programs<\/span> (CDVIP)<\/a>. These courses run for 48 weeks. A court may make participation mandatory after a <span data-term-id=\"39187229\">domestic violence<\/span> conviction.<\/p>\n<p>Understand that this will <a href=\"https:\/\/www.mcedv.org\/get-help\/options-for-people-who-use-abusive-behaviors\/\" target=\"_blank\" rel=\"noopener\">not be a quick and easy remedy<\/a>. Learning a new belief system is hard work. Committing to change can benefit you and the important people in your life.<\/p>\n<h2>What&#8217;s going to stop my abuser from coming after me after I leave? Are there any protections?<\/h2>\n<p>There are resources available for <span data-term-id=\"39187259\">victims of <\/span><span data-term-id=\"39187229\">domestic violence<\/span>. <a href=\"https:\/\/www.maine.gov\/corrections\/victimservices\" target=\"_blank\" rel=\"noopener\">Some are through <span data-term-id=\"39187228\">Maine<\/span><\/a>, while others are from support organizations. Knowing what they are and how to access them is crucial. Let&#8217;s look at some important ones to be aware of.<\/p>\n<h3><span data-term-id=\"39187228\">Maine<\/span> Protective Orders<\/h3>\n<p>Also known as <span data-term-id=\"39187231\">protection from abuse<\/span> (PFA) orders, <a href=\"https:\/\/www.courts.maine.gov\/help\/abuse\/index.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39187229\">domestic violence<\/span> protection orders<\/a> are one of the strongest defenses a victim can get. These civil court orders are designed to keep an abuser away from the victim. They can also have temporary rulings on <span data-term-id=\"39187239\">child custody<\/span>, spousal support, and the surrendering of firearms.<\/p>\n<p>PFAs use provisions tailored to each case for specific protections and conditions. A <strong>temporary ex parte PFA <\/strong>is issued without the court speaking to the abuser and lasts for 21 days or until a full court hearing. A <strong>final PFA<\/strong> is issued if the victim convinces the court that the abuser remains a threat. <a href=\"https:\/\/legislature.maine.gov\/statutes\/19-a\/title19-Asec4110.html\" target=\"_blank\" rel=\"noopener\">Final PFAs last for two years and are renewable<\/a>.<\/p>\n<p>There&#8217;s a lot to know about <span data-term-id=\"39187228\">Maine<\/span> PFAs. FindLaw&#8217;s <a href=\"https:\/\/www.findlaw.com\/state\/maine-law\/maine-protective-orders-laws.html\"><span data-term-id=\"39187228\">Maine<\/span> Protective Orders Laws<\/a> article offers an in-depth look at PFAs and step-by-step instructions for obtaining one.<\/p>\n<h3>Renter Options<\/h3>\n<p>Fear of penalties for breaking a lease shouldn&#8217;t cause a victim grief. A <a href=\"https:\/\/www.mainelegislature.org\/legis\/statutes\/14\/title14sec6001.html\" target=\"_blank\" rel=\"noopener\">legal break of a lease<\/a> without penalty is available to victims under <span data-term-id=\"39187233\">Maine<\/span><span data-term-id=\"39187233\"> law<\/span>. Written notice is required, as is proof of <span data-term-id=\"39187235\">domestic abuse<\/span> or a <span data-term-id=\"39187245\">protection-from-abuse<\/span><span data-term-id=\"39187245\"> order<\/span>.<\/p>\n<p>If a victim wants to stay in their dwelling, they can <a href=\"https:\/\/www.mainelegislature.org\/legis\/statutes\/14\/title14sec6001.html\" target=\"_blank\" rel=\"noopener\">have the landlord remove the abuser<\/a> from the lease. Victims can change the locks if they <a href=\"https:\/\/www.mainelegislature.org\/legis\/statutes\/14\/title14sec6025.html\" target=\"_blank\" rel=\"noopener\">give the landlord a copy of the new key within 72 hours<\/a>.<\/p>\n<h3>Address Confidentiality Program (ACP)<\/h3>\n<p>Victims don&#8217;t want their abusers to find them after they leave. The <a href=\"https:\/\/www.maine.gov\/sos\/acp\/index.html\" target=\"_blank\" rel=\"noopener\">Address Confidentiality Program (ACP)<\/a> gives participants a second legal mailing address. This is used for public records while also forwarding first-class mail to the victim&#8217;s actual address. There&#8217;s no charge for the program, and victims can <a href=\"https:\/\/www.maine.gov\/sos\/about-us\/address-confidentiality-program\" target=\"_blank\" rel=\"noopener\">apply online<\/a>.<\/p>\n<h3><span data-term-id=\"39187229\">Domestic Violence<\/span> Advocates<\/h3>\n<p>When caught up in the chaos and horror of <span data-term-id=\"39187235\">domestic abuse<\/span>, an experienced <a href=\"https:\/\/www.mcedv.org\/get-help\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39187229\">domestic violence<\/span> advocate<\/a> is a powerful ally. They&#8217;ll help you craft an escape plan, guide you to shelters, and work with you on applying for protection.<\/p>\n<h2>The final court hearing for the <span data-term-id=\"39187245\">protection-from-abuse<\/span><span data-term-id=\"39187245\"> order<\/span> is coming up. Do I need to prepare?<\/h2>\n<p>Whether you&#8217;re the victim or the person who was served with a temporary protection order, it&#8217;s important to <a href=\"https:\/\/legislature.maine.gov\/statutes\/19-a\/title19-Asec4109.html\" target=\"_blank\" rel=\"noopener\">prepare for the court hearing<\/a>. As the plaintiff (victim), you need to make sure the provisions you requested are part of the order. If you have any witnesses to the abuse, confirm that they are available to testify. Bring evidence that supports your claim. You need to prove the threat exists.<\/p>\n<p>If you&#8217;re the defendant (abuser), your task is to defend yourself against the claims the alleged victim is making. The court won&#8217;t give you special treatment if you represent yourself. Given the penalties you&#8217;re facing, consider speaking with a <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/maine?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39187276\">criminal defense<\/span><span data-term-id=\"39187276\"> attorney<\/span><\/a>. <span data-term-id=\"39187244\">Maine<\/span> <span data-term-id=\"39187252\">domestic violence<\/span><span data-term-id=\"39187252\"> charges<\/span> are serious.<\/p>\n<h2>I got a temporary ex parte <span data-term-id=\"39187231\">protection from abuse<\/span> (PFA) order from the district court. Can I go shove it in my abuser&#8217;s face?<\/h2>\n<p>While your relief is understandable, that&#8217;s not a good idea. Under no circumstances should a <span data-term-id=\"39187259\">victim of <\/span><span data-term-id=\"39187229\">domestic violence<\/span> ever serve a protection order themselves. A <a href=\"https:\/\/legislature.maine.gov\/statutes\/19-a\/title19-Asec4107.html\" target=\"_blank\" rel=\"noopener\">law enforcement agency will serve the defendant<\/a> with a copy of the order and a summons for the final court hearing. If the defendant is present, they&#8217;ll receive the order at the court.<\/p>\n<h2>My abuser has guns. A lot of guns. Can a protective order do something about them?<\/h2>\n<p>Protective orders can address possession of firearms and other deadly weapons by an abuser. Under <span data-term-id=\"39187233\">Maine<\/span><span data-term-id=\"39187233\"> law<\/span>, a defendant cannot <a href=\"https:\/\/mainelegislature.org\/legis\/statutes\/15\/title15sec393.html\" target=\"_blank\" rel=\"noopener\">possess a firearm or deadly weapon if it was used or threatened to be used during a <span data-term-id=\"39187229\">domestic violence<\/span> offense<\/a>. A ban is also possible if the court believes the defendant is a threat to use a firearm against those under a PFA.<\/p>\n<p>Give as many details as possible. Identify the gun, explain how it was used, and let the court know where it&#8217;s kept. If included in the PFA, a firearms provision forbids the defendant from possessing any firearms or ammunition for the duration. They may also face a <a href=\"https:\/\/www.atf.gov\/resource-center\/docs\/guide\/misdemeanor-crimes-domestic-violence-and-federal-firearms-prohibitions\/download\" target=\"_blank\" rel=\"noopener\">ban under <span data-term-id=\"39187258\">federal law<\/span><\/a>.<\/p>\n<h2>I have a protection order, but my abuser said they&#8217;re coming over anyway. What do I do?<\/h2>\n<p>If you&#8217;re in immediate danger, call 911.
