This is preferable, as the <span data-term-id=\"52745322\">homestead <\/span><span data-term-id=\"52745347\">exemption<\/span><span data-term-id=\"52745347\"> amount<\/span> in Maine is much higher than the federal exemption.<\/p>\n<h2><span data-term-id=\"52745337\">Maine <\/span><span data-term-id=\"52745322\">Homestead Exemption<\/span> Limits<\/h2>\n<p>According to <a href=\"https:\/\/codes.findlaw.com\/me\/title-14-court-procedure-civil\/me-rev-st-tit-14-sect-4422\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52745341\">M.R.S<\/span>. Title 14 Section 4422<\/a>, the <span data-term-id=\"52745322\">homestead exemption<\/span> for an individual who files bankruptcy in the <span data-term-id=\"52745329\">State of Maine<\/span> is $80,000. This amount increases to $160,000 for debtors with minor dependents and for filers with a disability. You won\u2019t be able to apply the exemption if you don\u2019t meet the eligibility requirements. This can leave your house vulnerable to sale.<\/p>\n<p>Some of the requirements for <span data-term-id=\"52745337\">Maine\u2019s <\/span><span data-term-id=\"52745322\">homestead exemption<\/span> include:<\/p>\n<ul>\n<li>You must be a <span data-term-id=\"52745355\">legal resident<\/span> of Maine<\/li>\n<li>The <span data-term-id=\"52745322\">homestead exemption<\/span> only applies to <span data-term-id=\"52745334\">residential property<\/span> and can\u2019t be used to protect <span data-term-id=\"52745345\">real property<\/span> you use solely for <span data-term-id=\"52745360\">commercial purposes<\/span><\/li>\n<li>The exemption only extends to your <span data-term-id=\"52745335\">primary residence<\/span>, not a <span data-term-id=\"52745348\">vacation home<\/span> or an investment property<\/li>\n<li>You must be the owner at the time of filing<\/li>\n<li>The property can\u2019t be part of a fraudulent conveyance<\/li>\n<\/ul>\n<p>Under <span data-term-id=\"52745356\">Maine law<\/span>, a homestead can be any type of <span data-term-id=\"52745334\">residential property<\/span> that\u2019s a <span data-term-id=\"52745324\">permanent residence<\/span>. This can include any of the following:<\/p>\n<ul>\n<li>Single-family home<\/li>\n<li>Condominium<\/li>\n<li><span data-term-id=\"52745334\">Residential property<\/span> held in a <span data-term-id=\"52745351\">revocable living trust<\/span><\/li>\n<li><span data-term-id=\"52745358\">Cooperative housing corporation<\/span><\/li>\n<li><span data-term-id=\"52745354\">Mobile home<\/span><\/li>\n<li>Burial plot for yourself or a dependent<\/li>\n<\/ul>\n<p>You can apply the <span data-term-id=\"52745337\">Maine <\/span><span data-term-id=\"52745322\">homestead exemption<\/span> to any proceeds from the sale of exempt <span data-term-id=\"52745336\">real estate<\/span> for up to 12 months, as long as you reinvest the proceeds into another <span data-term-id=\"52745334\">residential property<\/span>.<\/p>\n<h3><span data-term-id=\"52745322\">Homestead Exemption<\/span> Vs. <span data-term-id=\"52745333\">Homestead <\/span><span data-term-id=\"52745333\">Property Tax<\/span><span data-term-id=\"52745333\"> Exemption<\/span><\/h3>\n<p>Although they sound similar, the <span data-term-id=\"52745322\">homestead exemption<\/span> is different from the <span data-term-id=\"52745333\">homestead <\/span><span data-term-id=\"52745333\">property tax<\/span><span data-term-id=\"52745333\"> exemption<\/span>. The <span data-term-id=\"52745322\">homestead exemption<\/span> in bankruptcy helps protect the equity you have in your <span data-term-id=\"52745335\">primary residence<\/span>. For example, if you file Chapter 7 and have a good deal of equity in your home, there is a chance the trustee will sell your home to pay your creditors.<\/p>\n<p>By applying your state <span data-term-id=\"52745322\">homestead exemption<\/span>, you protect some or all of the equity in your home.
