If you\u2019re contemplating divorce, you should familiarize yourself with Maine divorce laws. You won\u2019t be able to file your complaint for divorce unless you meet the State of Maine\u2019s&nbsp;<a href=\"https:\/\/www.findlaw.com\/state\/family-laws\/details-on-state-requirements-for-divorce.html\">legal requirements<\/a>.<\/p>\r\n<p>Understanding how the&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/divorce\/how-to-divorce.html\">divorce process<\/a>&nbsp;in Maine works makes things easier for you. For example, how do the district courts handle such issues as alimony, child custody, and equitable distribution of marital property?<\/p>\r\n<p>The good news is that we will discuss these issues here. We also offer a chart that breaks down Maine divorce laws for you.<\/p>\r\n<h2>Legal Requirements for Maine Divorce<\/h2>\r\n<p>You must meet the state\u2019s residency requirements to file for divorce in Maine. There are several ways to meet the <a href=\"https:\/\/www.courts.maine.gov\/courts\/family\/divorce-separation\/divorce.html\" target=\"_blank\" rel=\"noopener\">residency requirement.<\/a><\/p>\r\n<p>According to Maine law, you must be a resident of Maine for at least six months before filing for divorce. You may also file if your spouse is a resident, or if you are a resident and you were married in Maine. If you are a resident and resided in Maine when the cause of divorce happened, you may also file in Maine.<\/p>\r\n<p>You can prove residency with your driver\u2019s license, mortgage statement, rental agreement, or other documents that include your address.<\/p>\r\n<p>You must also abide by the state\u2019s waiting period. The Maine courts cannot issue your final divorce decree for at least 60 days from the filing date. Once the court issues your final divorce decree, there is <a href=\"https:\/\/secure.ssa.gov\/poms.nsf\/lnx\/0200305165\" target=\"_blank\" rel=\"noopener\">no required waiting period<\/a> if you intend to remarry.<\/p>\r\n<h2>No-Fault Divorce Cases vs. Fault-Based Divorce in Maine<\/h2>\r\n<p>All states recognize no-fault divorce. This wasn\u2019t always the case. Today, if you file for divorce in Maine, you don\u2019t have to cite specific grounds for divorce. According to&nbsp;<a href=\"https:\/\/legislature.maine.gov\/statutes\/19-A\/title19-Asec902.html#:~:text=If%20one%20party%20alleges%20that%20there%20are%20irreconcilable,agreement%20of%20the%20parties%20or%20by%20the%20court.\" target=\"_blank\" rel=\"noopener\">Title 19-A Section 902<\/a>, you must only certify that you and your spouse are experiencing irreconcilable differences.<\/p>\r\n<p><a href=\"https:\/\/dictionary.findlaw.com\/definition\/irreconcilable-differences.html\" target=\"_blank\" rel=\"noopener\">Irreconcilable marital differences<\/a>&nbsp;mean you and your spouse don\u2019t get along as a married couple anymore. If the other party denies the allegation that there are irreconcilable differences, the court may continue the case and <a href=\"https:\/\/legislature.maine.gov\/statutes\/19-A\/title19-Asec902.html#:~:text=If%20one%20party%20alleges%20that%20there%20are%20irreconcilable,agreement%20of%20the%20parties%20or%20by%20the%20court.\" target=\"_blank\" rel=\"noopener\">direct the parties to undergo marital counseling<\/a> before finalizing the divorce.<\/p>\r\n<p>Just because Maine recognizes no-fault divorce doesn\u2019t mean you can\u2019t cite specific grounds for divorce in your divorce complaint.<\/p>\r\n<p>According to&nbsp;<a href=\"https:\/\/legislature.maine.gov\/statutes\/19-A\/title19-Asec902.html#:~:text=If%20one%20party%20alleges%20that%20there%20are%20irreconcilable,agreement%20of%20the%20parties%20or%20by%20the%20court.\" target=\"_blank\" rel=\"noopener\">Title 19-A Section 902<\/a>, the State of Maine recognizes the following fault-based grounds for divorce:<\/p>\r\n<ul>\r\n<li>Adultery<\/li>\r\n<li>Impotence<\/li>\r\n<li>Extreme cruelty<\/li>\r\n<li>Utter desertion for three consecutive years<\/li>\r\n<li>Gross and confirmed habit of intoxication (alcohol or drugs)<\/li>\r\n<li>Cruel and abusive treatment<\/li>\r\n<li>Failure or refusal to support the other spouse despite having the ability or means to do so<\/li>\r\n<li>Mental incapacity necessitating the need for a guardian to be appointed<\/li>\r\n<\/ul>\r\n<p>If you cite any of these grounds, your Maine divorce lawyer must submit proof that your spouse behaved in the manner you allege in your complaint.<\/p>\r\n<h2>Uncontested Divorce vs. Contested Divorce<\/h2>\r\n<p>Once you decide to file a fault-based or no-fault divorce, you must decide whether to file a contested or uncontested divorce case. Ideally, you and your spouse will agree to the terms of divorce. You can submit a copy of your divorce settlement agreement for the judge\u2019s approval if you do.<\/p>\r\n<p>Once the judge approves your agreement, they\u2019ll hold your final hearing. At this hearing, the judge will finalize your divorce action.<\/p>\r\n<p>You&#8217;ll file a contested divorce action if you and your spouse disagree on material divorce terms. These divorce cases take much longer to resolve. Your family law attorney will try to negotiate a property settlement agreement with your spouse\u2019s lawyer. If not, the judge will decide these issues for you.<\/p>\r\n<p>The issues you and your spouse may disagree on during divorce proceedings include:<\/p>\r\n<ul>\r\n<li>Alimony\/Spousal support<\/li>\r\n<li>Parental rights and responsibilities<\/li>\r\n<li>Child custody (for minor children)<\/li>\r\n<li>Child support<\/li>\r\n<li>Determining whether property is marital property vs. separate property<\/li>\r\n<li>Division of marital assets and debts<\/li>\r\n<\/ul>\r\n<p>Once your case goes to trial, these decisions will be in the hands of the judge. You won\u2019t have a say in their disposition.<\/p>\r\n<h2>Child Custody and Child Support for Minor Children<\/h2>\r\n<p>When determining child custody, the courts only care about the child&#8217;s best interests. Maine law presumes that both parties are <a href=\"https:\/\/codes.findlaw.com\/me\/title-19-a-domestic-relations\/me-rev-st-tit-19-a-sect-1651.html\" target=\"_blank\" rel=\"noopener\">joint natural guardians of their minor children<\/a>. The courts agree that both parents should have a say in their child\u2019s lives and welfare. If custody is contested both parents receive equal consideration. Neither has an advantage over the other.<\/p>\r\n<p>Regarding physical custody, the courts look to see which party was primarily responsible for the children\u2019s care during the marriage and assess the current living arrangements of the children. They\u2019ll also consider <a href=\"https:\/\/www.courts.maine.gov\/courts\/family\/divorce-separation\/decisions-children.html\" target=\"_blank\" rel=\"noopener\">other factors<\/a>, such as:<\/p>\r\n<ul>\r\n<li>The ability and willingness of each parent to encourage contact between the child and the other parent<\/li>\r\n<li>Stability of each party&#8217;s living arrangements<\/li>\r\n<li>The child&#8217;s adjustment to their current home, community, and school<\/li>\r\n<li>Relationships between the parents and children<\/li>\r\n<li>Age of the children<\/li>\r\n<li>Any history of domestic violence or child abuse<\/li>\r\n<li>The child&#8217;s wishes if they are old or mature enough to express a preference<\/li>\r\n<\/ul>\r\n<p>Whichever parent gets primary physical custody will also receive child support. The courts use the state\u2019s <a href=\"https:\/\/codes.findlaw.com\/me\/title-19-a-domestic-relations\/me-rev-st-tit-19-a-sect-2006\/\" target=\"_blank\" rel=\"noopener\">child support guidelines<\/a> when <a href=\"https:\/\/www.courts.maine.gov\/courts\/family\/divorce-separation\/child-support.html\" target=\"_blank\" rel=\"noopener\">calculating the amount of support<\/a>.<\/p>\r\n<h2>What Does Maine Law Say About Alimony?<\/h2>\r\n<p>You\u2019re never guaranteed alimony in a divorce. The courts will consider many factors when determining if either party deserves spousal support.<\/p>\r\n<p>The courts consider the following factors when&nbsp;<a href=\"https:\/\/legislature.maine.gov\/statutes\/19-A\/title19-Asec951-A.html\" target=\"_blank\" rel=\"noopener\">determining alimony<\/a>:<\/p>\r\n<ul>\r\n<li>Length of the marriage<\/li>\r\n<li>Age and health of both parties<\/li>\r\n<li>Tax consequences as it pertains to both spousal support and division of property<\/li>\r\n<li>Standard of living during the marriage<\/li>\r\n<li>Training and education of each party<\/li>\r\n<li>Income and employment history of the parties<\/li>\r\n<\/ul>\r\n<p>If you receive alimony, your spouse can move to terminate support upon the event of your death, cohabitation, or remarriage.<\/p>\r\n<h2>Maine Courts and Equitable Distribution of Marital Property<\/h2>\r\n<p>Maine is not a community property state. The courts apply principles of <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/equitable-distribution.html\">equitable distribution<\/a> when dividing marital debts and assets. The judge will divide marital property in a way they see as fair and equitable.<\/p>\r\n<p>Some of the types of property that are subject to distribution include:<\/p>\r\n<ul>\r\n<li>Real estate<\/li>\r\n<li>Personal property (cars, artwork, jewelry, etc.)<\/li>\r\n<li>Retirement accounts<\/li>\r\n<li>Bank accounts<\/li>\r\n<li>Pensions<\/li>\r\n<li>Family pets<\/li>\r\n<\/ul>\r\n<p>Most couples\u2019 divorce attorneys work together to divide these assets. This way, you have some control over who gets what.<\/p>\r\n<h2><b>Maine Divorce Laws: The Basics<\/b><\/h2>\r\n<p>No matter where you divorce, you must meet the state&#8217;s legal requirements to file for divorce.<\/p>\r\n<p>The table below outlines the basics of Maine&#8217;s divorce laws.<\/p>\r\n<table>\r\n<tbody><tr><th scope=\"row\" style=\"text-align: left;\"><p>Maine Divorce Code Sections<\/p>\r\n<\/th>\r\n<td><p>Maine Code Revised Title 19-A, Chapter 29:&nbsp;<a href=\"https:\/\/mainelegislature.org\/legis\/statutes\/19-A\/title19-Ach29sec0.html\" target=\"_blank\" rel=\"noopener\">Divorce<\/a><\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p>Residency Requirements<\/p>\r\n<\/th>\r\n<td><p>The residency requirement is considered met if any of the following apply:<\/p>\r\n<ul>\r\n<li>The plaintiff has resided in Maine for six months<\/li>\r\n<li>The defendant is a resident<\/li>\r\n<li>The plaintiff is a resident and the parties were married in Maine<\/li>\r\n<li>The plaintiff is a resident and the parties resided in Maine when the cause of the divorce action arose<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p>Waiting Period<\/p>\r\n<\/th>\r\n<td><p>60-day waiting period between divorce filing and entry of final decree of divorce<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p>No-Fault Grounds for Divorce<\/p>\r\n<\/th>\r\n<td><p>Irreconcilable differences<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p>Other Grounds for Divorce<\/p>\r\n<\/th>\r\n<td><p>The fault-based grounds for divorce in Maine are:<\/p>\r\n<ul>\r\n<li>Adultery<\/li>\r\n<li>Extreme cruelty or cruel and abusive treatment (domestic violence)<\/li>\r\n<li>Desertion or abandonment for three consecutive years<\/li>\r\n<li>Drug and\/or alcohol addiction<\/li>\r\n<li>Impotence<\/li>\r\n<li>Failure or refusal to support despite their ability to do so<\/li>\r\n<li>Mental incapacity (necessitating need for a guardian to be appointed)<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p>Defenses to a Divorce Filing<\/p>\r\n<\/th>\r\n<td><p>Recrimination is a comparative but not an <a href=\"https:\/\/legislature.maine.gov\/statutes\/19-A\/title19-Asec902.html\" target=\"_blank\" rel=\"noopener\">absolute&nbsp;defense<\/a>. At the court&#8217;s discretion,&nbsp;condonation or forgiveness may serve as a defense.<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p>Out-of-State Divorces<\/p>\r\n<\/th>\r\n<td><p>Maine recognizes <a href=\"https:\/\/legislature.maine.gov\/statutes\/19-A\/title19-Asec907.html\" target=\"_blank\" rel=\"noopener\">out-of-state divorces<\/a> if the state had proper jurisdiction over the parties.
