For example, if a defendant drugged the victim with Rohypnol, GHB, or ketamine, they would face Class B felony charges.<\/p>\n<h3><span data-term-id=\"50796336\">Unlawful Sexual Contact<\/span><\/h3>\n<p>A <span data-term-id=\"50796332\">gross sexual assault<\/span> conviction requires that the defendant engage in or attempt to engage in a <span data-term-id=\"50796334\">sexual act<\/span> with the victim. With an <span data-term-id=\"50796336\">unlawful sexual contact<\/span> charge, the state must only prove that the defendant touched the victim&#8217;s <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/rape.html\">genital area or private parts<\/a>. They can do this directly or indirectly through the victim&#8217;s clothes. A person is also guilty of this offense if they force the victim to touch the defendant&#8217;s genitals or anus.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/me\/title-17-a-maine-criminal-code\/me-rev-st-tit-17-a-sect-255-a\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"50796336\">Unlawful sexual contact<\/span><\/a> charges range from a <span data-term-id=\"50796369\">Class E crime<\/span> to a Class B felony, depending on the victim&#8217;s age. This is the case with almost all of <span data-term-id=\"50796331\">Maine<\/span>&#8216;s <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/sex-crimes.html\"><span data-term-id=\"50796338\">sex crime<\/span><\/a> classifications.<\/p>\n<p><span data-term-id=\"50796331\">Maine<\/span>&#8216;s classifications for <span data-term-id=\"50796336\">unlawful sexual contact<\/span> are as follows:<\/p>\n<ul>\n<li><strong>Class B felony:<\/strong> The victim is under 14 <span data-term-id=\"50796341\">years of age<\/span>, and the defendant is at least three years older than the victim<\/li>\n<li><strong>Class C felony:<\/strong> The victim is unconscious or otherwise unable to physically resist the defendant, and the sexual contact includes penetration<\/li>\n<li><strong><span data-term-id=\"50796350\">Class D crime<\/span> (misdemeanor):<\/strong> The victim is unconscious or otherwise unable to physically resist the defendant, but the defendant&#8217;s contact does not include penetration<\/li>\n<li><strong><span data-term-id=\"50796369\">Class E crime<\/span> (misdemeanor):<\/strong> If the victim is under the age of twelve and the defendant is at least three years older than the victim, it constitutes a <span data-term-id=\"50796369\">Class E crime<\/span><\/li>\n<\/ul>\n<p>Each sexual assault case is different, so charges and penalties will vary due to the details.<\/p>\n<h3><span data-term-id=\"50796339\">Unlawful Sexual Touching<\/span><\/h3>\n<p>The lowest level sexual assault charge in <span data-term-id=\"50796331\">Maine<\/span> is <a href=\"https:\/\/codes.findlaw.com\/me\/title-17-a-maine-criminal-code\/me-rev-st-tit-17-a-sect-260\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"50796339\">unlawful sexual touching<\/span><\/a>. A person commits this crime if they subject another person to any sexual touching under the following circumstances:<\/p>\n<ul>\n<li><strong>The other person did not consent<\/strong>, and a reasonable person in the same situation would have understood that the victim did not consent<\/li>\n<li><strong>The other person was unconscious<\/strong> or otherwise physically incapable of resisting or providing consent<\/li>\n<\/ul>\n<p>The statute also lays out specific circumstances where any sexual contact is prohibited, such as:<\/p>\n<ul>\n<li><strong>The other person is under 14 years old,<\/strong> and the defendant is at least five years older<\/li>\n<li><strong>The other person has a <span data-term-id=\"50796361\">mental disability<\/span><\/strong> that is reasonably apparent and renders them incapable of understanding the nature of the touching involved, or that they can deny or withdraw consent<\/li>\n<li><strong>The defendant has supervisory or disciplinary authority<\/strong> over the victim in a prison, jail, or other incarceration environment (includes <span data-term-id=\"50796392\">probation<\/span> officers and parole supervisors)<\/li>\n<li>The victim is under 18, and the defendant is a <strong>parent, stepparent, foster parent, or other guardian<\/strong><\/li>\n<li><strong>The defendant is a teacher or other school official<\/strong>, and the other person is a student<\/li>\n<li><strong>The defendant is a mental health professional<\/strong>, and the other person is a current patient or client<\/li>\n<\/ul>\n<p>A person is also guilty of <span data-term-id=\"50796339\">unlawful sexual touching<\/span> if they force another person to touch them in this manner.<\/p>\n<p>Any of these acts constitutes a <a href=\"https:\/\/www.legislature.maine.gov\/lawlibrary\/what-is-maines-law-on-felonies-misdemeanors\/9465\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"50796350\">Class D crime<\/span><\/a> (misdemeanor) in the <span data-term-id=\"50796356\">state of <\/span><span data-term-id=\"50796331\">Maine<\/span>.<\/p>\n<h2><span data-term-id=\"50796344\">Statutory Rape<\/span> in the <span data-term-id=\"50796356\">State of <\/span><span data-term-id=\"50796331\">Maine<\/span><\/h2>\n<p><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/statutory-rape.html\"><span data-term-id=\"50796344\">Statutory rape<\/span><\/a> refers to cases where an individual engages in <span data-term-id=\"50796334\">sexual acts<\/span> or <span data-term-id=\"50796389\">sexual conduct<\/span> with someone <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/is-sex-between-minors-a-crime\/\">under the age of majority<\/a>. <span data-term-id=\"50796337\">Maine<\/span><span data-term-id=\"50796337\"> law<\/span> defines <span data-term-id=\"50796344\">statutory rape<\/span> as <a href=\"https:\/\/codes.findlaw.com\/me\/title-17-a-maine-criminal-code\/me-rev-st-tit-17-a-sect-254\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"50796342\">sexual abuse<\/span><span data-term-id=\"50796342\"> of a minor<\/span><\/a>.
