Maryland takes <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/credit-debit-card-fraud.html\">credit card and debit card fraud<\/a> seriously and devotes an entire subchapter in the Fraud Related Crimes portion of the state\u2019s criminal laws to credit card crimes. The following table outlines these laws.<\/p>\n<table cellspacing=\"0\" cellpadding=\"0\" border=\"1\">\n<tbody><tr><td style=\"width: 102px;\"><p><b>Code Sections<\/b><\/p>\n<\/td>\n<td style=\"width: 522px;\"><p>Maryland Criminal Law <a adhocenable=\"false\" href=\"https:\/\/codes.findlaw.com\/md\/criminal-law\/md-code-crim-law-sect-8-201.html\" target=\"_blank\" rel=\"noopener\">\u00a7 8-201, et seq.<\/a><\/p>\n<\/td>\n<\/tr><tr><td style=\"width: 102px;\"><p><b>What is Prohibited?<\/b><\/p>\n<\/td>\n<td style=\"width: 522px;\"><p>Credit card <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/fraud.html\" adhocenable=\"false\">fraud<\/a> crimes in Maryland include:<\/p>\n<ul>\n<li><u>Fraud in Procuring the Issuance of a Credit Card<\/u> \u2013 making false statements in writing about you or another\u2019s identity in order to have a <a href=\"https:\/\/codes.findlaw.com\/md\/criminal-law\/md-code-crim-law-sect-8-203.html\" adhocenable=\"false\" target=\"_blank\" rel=\"noopener\">credit card issued<\/a><\/li>\n<li><u>Credit Card Theft<\/u> \u2013 Any of the <a href=\"https:\/\/codes.findlaw.com\/md\/criminal-law\/md-code-crim-law-sect-8-204.html\" adhocenable=\"false\" target=\"_blank\" rel=\"noopener\">following<\/a>:<ul style=\"list-style-type: circle;\">\n<li>Taking another person\u2019s credit card without the cardholder\u2019s consent or receiving a stolen credit card with the intent to use it or sell to someone who isn\u2019t the cardholder<\/li>\n<li>Receiving a credit card that you know is lost or misdelivered due to a mistaken address or cardholder identity and holding onto the card to use or sell it<\/li>\n<li>Buying or selling a credit card (when not from\/to the issuer)<\/li>\n<li>Receiving a credit card you know was taken or retained due to credit card theft or other fraud<\/li>\n<\/ul>\n<\/li>\n<li><u>Credit Card Counterfeiting<\/u> \u2013 Any of the <a href=\"https:\/\/codes.findlaw.com\/md\/criminal-law\/md-code-crim-law-sect-8-205.html\" adhocenable=\"false\" target=\"_blank\" rel=\"noopener\">following<\/a>:<ul style=\"list-style-type: circle;\">\n<li>Falsely making or embossing a credit card, having a falsely made or embossed card, or having or transferring a card knowing it was falsely made or embossed<\/li>\n<li>Signing a credit card you aren\u2019t the authorized cardholder of with the intent to defraud others<\/li>\n<\/ul>\n<\/li>\n<li><u>Obtaining Property by Counterfeiting, Theft, or Misrepresentation<\/u> \u2013 Using a credit card obtained fraudulently or that you know is counterfeit to <a href=\"https:\/\/codes.findlaw.com\/md\/criminal-law\/md-code-crim-law-sect-8-206.html\" adhocenable=\"false\" target=\"_blank\" rel=\"noopener\">obtain<\/a> anything of value (money, goods, services) or obtaining those items without the consent of the cardholder or with a supposed credit card that hasn\u2019t been issued<ul style=\"list-style-type: circle;\">\n<li>Receiving anything of value if you know or believe it was obtained this way is <a href=\"https:\/\/codes.findlaw.com\/md\/criminal-law\/md-code-crim-law-sect-8-209.html\" adhocenable=\"false\" target=\"_blank\" rel=\"noopener\">also prohibited<\/a><\/li>\n<\/ul>\n<\/li>\n<li><u>Fraud by Honoring a Stolen or Counterfeit Credit Card or False Representation to Issuer<\/u> \u2013 When a person authorized by a credit card issuer gives away anything of value to a person knowing the credit card he or she used was stolen or counterfeit or <a href=\"https:\/\/codes.findlaw.com\/md\/criminal-law\/md-code-crim-law-sect-8-207-nr2.html\" adhocenable=\"false\" target=\"_blank\" rel=\"noopener\">fails to furnish<\/a> any money, goods, or services to a person, but represents to the issuer that if he or she had.<\/li>\n<li><u>Completing a Credit Card without Issuer Consent or Having Materials to Reproduce Credit Cards without Issuer Consent<\/u> \u2013 Possessing an <a href=\"https:\/\/codes.findlaw.com\/md\/criminal-law\/md-code-crim-law-sect-8-208.html\" adhocenable=\"false\" target=\"_blank\" rel=\"noopener\">incomplete credit card<\/a> with intent to complete it with a stamp, emboss, or imprint or having equipment to create a credit card without the issuer\u2019s consent<\/li>\n<li><u>Publishing a Telephone Card Number<\/u> \u2013 Informing one or more people of a <a href=\"https:\/\/codes.findlaw.com\/md\/criminal-law\/md-code-crim-law-sect-8-210.html\" adhocenable=\"false\" target=\"_blank\" rel=\"noopener\">phone card number<\/a> orally or in writing with the intent it be used fraudulently to avoid phone charges<\/li>\n<li><u>Unauthorized Use or Disclosure of Credit Cards<\/u> &#8211; Using or <a href=\"https:\/\/codes.findlaw.com\/md\/criminal-law\/md-code-crim-law-sect-8-214.html\" adhocenable=\"false\" target=\"_blank\" rel=\"noopener\">disclosing<\/a> a credit or debit card number without being the cardholder, the consent of the cardholder, or another necessary use or disclosure (such as required by law, is court ordered, to process payment or fraud prevention, or made to a credit report bureau).<\/li>\n<\/ul>\n<\/td>\n<\/tr><tr><td style=\"width: 102px;\"><p><b>Penalties<\/b><\/p>\n<\/td>\n<td style=\"width: 522px;\"><p>The penalties for each credit card fraud crime in Maryland are dictated by the statutes. The penalties are:<\/p>\n<ul>\n<li><u>Credit Card theft<\/u> and <u>fraud in issuance<\/u> are <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-distinguishes-a-misdemeanor-from-a-felony.html\" adhocenable=\"false\">misdemeanors<\/a> that can be penalized by up to 18 months in jail and a fine up to $500.<\/li>\n<li><u>Credit card counterfeiting<\/u> is a felony subject to up to 15 years in prison and a fine up to $1,000.<\/li>\n<li><u>Completing or reproducing credit cards without the issuer\u2019s consent<\/u> is a felony that can be punished by up to 15 years in prison and a $1,000 fine.<\/li>\n<li><u>Publishing phone card numbers<\/u> is a misdemeanor that can be punished by up to 12 months in jail and a $500 fine.<\/li>\n<li><u>The unlawful use or disclosure of card numbers<\/u> is a <a href=\"https:\/\/codes.findlaw.com\/md\/criminal-law\/md-code-crim-law-sect-8-216.html\" adhocenable=\"false\" target=\"_blank\" rel=\"noopener\">felony subject to up to 15 years in prison<\/a> and a fine up to $1,000.<\/li>\n<\/ul>\n<p>The penalty for obtaining or receiving anything of value by use of a counterfeit or stolen credit card or honoring a stolen or <a href=\"https:\/\/dictionary.findlaw.com\/definition\/counterfeit.html\" adhocenable=\"false\" target=\"_blank\" rel=\"noopener\">counterfeit<\/a> card depends on the value of the items involved.<\/p>\n<ul>\n<li>For less than $100 in goods, services, or other things of value, the crime is a misdemeanor punished by up to 90 days in jail and up to a $500 fine.<\/li>\n<li>For between $100 and $1,000, it\u2019s penalized by up to 18 months in custody and a $500 fine.<\/li>\n<li>For between $1,000 and $10,000, it\u2019s a felony subject to up to 10 years in prison and a fine of up to $10,000.<\/li>\n<li>For $10,000 to $100,000 obtained fraudulently, the punishment is up to 15 years in prison and up to a $15,000 fine.<\/li>\n<li>For $100,000 or more, the person can be sentenced to up to 25 years in prison and up to a $25,000 fine.<\/li>\n<\/ul>\n<p><u>Civil Penalties<\/u><\/p>\n<p>Finally, the unlawful use or disclosure of a card can also be <a href=\"https:\/\/codes.findlaw.com\/md\/criminal-law\/md-code-crim-law-sect-8-217.html\" adhocenable=\"false\" target=\"_blank\" rel=\"noopener\">penalized civilly<\/a>. Each prohibited use or disclosure of a credit card number or cardholder\u2019s signature is a separate violation subject to up to a $1,000 civil penalty.
