Perhaps most important is the Maryland\u00a0<span data-term-id=\"58906429\">homestead exemption<\/span>, which protects your <span data-term-id=\"58906442\">home equity<\/span> and can prevent it from being sold\u00a0to pay your debts.<\/p>\n<h2>Overview of Maryland <span data-term-id=\"58906429\">Homestead Exemption<\/span><\/h2>\n<p>Maryland is an \u201copt-out\u201d state, which means you can\u2019t claim the <span data-term-id=\"58906452\">federal exemptions<\/span> when <span data-term-id=\"58906439\">filing bankruptcy<\/span>. Otherwise, the court may reject your attempt to claim the exemption, and you\u2019ll risk losing your <span data-term-id=\"58906442\">home equity<\/span> to a forced sale by the trustee.<\/p>\n<h2>How To Claim the <span data-term-id=\"58906429\">Homestead Exemption<\/span> in Maryland<\/h2>\n<p>Claiming the <span data-term-id=\"58906429\">homestead exemption<\/span> in Maryland is straightforward. <span data-term-id=\"58906440\">Filers<\/span> of a <span data-term-id=\"58906431\">Chapter 13 <\/span><span data-term-id=\"58906456\">bankruptcy<\/span><span data-term-id=\"58906456\"> case<\/span> don\u2019t have to make a separate filing with the state. Include your <span data-term-id=\"58906461\">primary residence<\/span> in your list of assets on your Schedule A\/B. You must also indicate your intention to claim the exemption on Schedule C.<\/p>\n<p>Those filing a <span data-term-id=\"58906433\">Chapter 7 bankruptcy<\/span> have an additional step. You must include a \u201cStatement of Intention,\u201d alerting the bankruptcy trustee that you plan on keeping your home.<\/p>\n<h2>Exceptions and Limitations<\/h2>\n<p>The Maryland\u00a0<span data-term-id=\"58906429\">homestead exemption<\/span> has limitations. For example, if you don\u2019t meet the strict residency requirements, you won\u2019t be able to use the exemption. There\u2019s also an exception based on prior bankruptcy filings.
